The Guide for Montenegrin researcher who wants to spend one part of their career at one of the institutions in Europe is a set of practical information: regulation at national and institutional level, possibilities within the EURAXESS initiative, Scientific Visa Package, as well as the list of funds for scientific research financing. The Guide is prepared and published within the EURAXESS Montenegro project by the University of Montenegro as the bridgehead organization for development of EURAXESS network for mobility of researchers, which is financially supported by the European Commission within the 7th Framework Programme.

National regulationOn the basis of Articles 38 and 76 of the Labour Law (Official Gazette.

49/2008 and 26/2009) regulates the field of education, training and education of employees in Montenegro. On the basis of these articles is on, the internal Regulations within the institutions, shall ensure the obligations of the employer and employee

Article 38 of the Labour Law stipulates the following:

Obligations of employer and employee

(1) An employer shall permit the employee education, training and education when the demand of the work process, introducing a new way of organizing work, especially when it comes to adopting and implementing new methods of organization and technology work.

(2) An employee shall, in accordance with their abilities and needs work processes, professional training and perfecting the work.

(3) The costs of education, professional training and development funds provided from the employer and other sources in accordance with the law and collective agreements.

In this regard, employees have the right and obligation to work during the educated, professional training and improving the operation, when required by the needs of the work process or the introduction of new methods of work organization, in accordance with the established curriculum development of the employer, at the expense covered by employer.

In cases that are employed in improving the work independently, and that this improvement is not related to the work process within the working arrangement at an appropriate work from the activities of the employer, the employer has no obligation to finance this kind of professional training of the employee.

The suspension of employment rights

Article 76 of the Labour Law stipulates es the following:

(1) An employee her rights and responsibilities from work and from work, if absent from work due to:

1) the work abroad in the framework of international technical and cultural and educational cooperation, diplomatic, consular and other missions, as well as professional training or education, with the consent of the employer

(2) The right to suspension of employment has the spouse of the employee who was sent to work abroad in terms of paragraph 1, item 1 above

(3) The employee and spouse of the employee are entitled to, within 30 days from the date of termination of the reasons that were pending rights and responsibilities from work, return to her job with the same or another position that suits their level of education, or level of education and occupation.

Institutional regulations

University of Montenegro

Regulations on education and training regulates the rights of employees at the University of Montenegro to the use of leave for education and training.

Excerpts from the Regulation:

University, or organizational unit of the University provides training and education of employees in accordance with the needs of the scientific-teaching, research and artistic work, the need for the updated work processes and technical and technological improvement, and other specific needs of the workplace, and to this end provide material, organizational and other conditions. Education and training includes in particular the right to:

• in scientific meetings that are organized at home and abroad (such as conferences, symposia, seminars, conferences, professional meetings, etc.);

• go to specialization and study visits abroad;

• additional education or vocational training; training at work through special programs courses in areas of importance to the University, or organizational unit of the University.

Funding for education and training of employees to predict the annual financial plan and are provided from:

- State Budget ;

- special fund of the University, or organizational unit of the University to promote scientific research;

- other funds that the university or organizational unit of the University allocated for this purpose;

- other sources.

Special funds for professional development at the University, or organizational unit of the University, are used and deployed in accordance with the regulation to which these funds are established and decisions of governing them.

University Senate, on the proposal of organizational units, made for each academic year program of professional development and education of employees, which contain the details of its implementation, location and time of implementation, the financial resources necessary to implement professional development and education and the dynamic of their ensuring.

In order to implement the program of ongoing professional development and monitoring of scientific achievements, a person with academic or scientific title, teaching or research assistant may to attend yearly two scientific and professional meetings in the country (congresses, symposia, seminars, conferences, professional meetings, etc.).

Exceptionally, by limitations in the previous paragraph, it may attend to more meetings if they submit the report, co-report or announcement

who has accepted scientific article or co-report, has right for paid leave. If the meeting organizer does not reimburse the participation expenses, the costs may be provided in accordance with a special decision of the University.

A person with an academic or scientific title, teaching or research assistant could point to a period of time up to 90 days at another university, research institute or similar institution abroad for training, learning-research certain issues, share experiences, etc., if this is useful for teaching and scientific work at the university, or organizational unit of the University.

The teacher has the right to be absent during the specialization and study abroad, if it has guaranteed the financing of living or scholarship.

Leave may be paid or unpaid, depending on his character.

One-time leave can last up to one year, provided that the new leave on this basis can be used until the expiration of three years from the close of the previous absence.

Teaching or research assistant may use paid leave for a period of 30 days in a year, to meet its obligations provided for educational or research program of postgraduate or doctoral studies.

Exceptionally, an associate-doctoral student with the agreement of three years can use the leave for up to one year if it is of special interest to the University, or organizational unit of the University, and of importance for the completion of his training.

Associates who attend graduate or doctoral studies at the University released the tuition for these studies.

University, or organizational unit of the University, may participate in the cost of teaching or research assistants who attend graduate or doctoral studies at another university in the country and abroad, in accordance with the contract.

Absence for up to thirty days, approve the dean or director of the organizational unit of the University. Total absence per employee, which may be granted on this basis, within one study year, cannot be longer than 30 days. Absence for a period of thirty days to six months approved by the Rector of the University.

Total absence per employee, which may be granted on this basis, within one study year cannot be longer than six months. Absence lasting more than six months approved by the Executive Board of the University, at the proposal of the Rector.

Sabbatical

Free study year is approved for the purpose of research training to the associate professor and full professor, as a one-year or one semester leave.

The right to a free study year has academic staff who continuously worked at the University at least seven years.

A person may be entitled to a free year up to two times in its total engagement at the University.

Free study year is used as a paid leave.

Request for a free study year shall be submitted not later than six

months before the start of leave, along with the activities program

The Board of the University approved a free study year, on the with opinion of the University Senate and Faculty Council.

The Board of the University cannot approve yearly more than 2% of requests in relation to the total number of persons with academic degrees at the University.

With a view to rational and balanced use of this Regulation, the Board can plan the number of places, the sequence of use and priorities for each organizational unit of the University.

After the expiration of the free study year beneficiary should submit report to Organizational unit Council as well as to the University Senate and the University Board.

Ministry of Science- Policy and Support to the mobility of researchers

Within its competencies, the Ministry of Science has created a set of instruments, which supports research and development in Montenegro.

The most important document is the Law on Scientific Research Activity, which entered into force on the 8th of January 2011.

As one of the main priorities of research policy is mobility of researchers and human capacities development in area of research, the Government of Montenegro has adopted the “Action Plan on Mobility of Researchers (2011-2012)” in March 2011. The Action Plan foresees measures that the Ministry of Science will take in order to remove barriers to mobility, as well as strengthening financial instruments for mobility support. The main changes are in relation to national research projects that are now available to foreign researchers, and planning of a national programme for young researchers’ mobility for the period after 2012. The Ministry is also focused at the improvement of bilateral scientific cooperation that sets legal framework for free realization of mobility.

Bilateral interstate cooperation

Bilateral interstate scientific-technological cooperation is a very efficient mechanism for mobility support according to the principle of reciprocity, for research teams from partner countries working on similar topics of research that are financed from state budget of two countries. Since the Declaration of Independence of Montenegro, eight agreements have been signed (Austria, Albania, Bosnia and Herzegovina, Slovenia, Croatia, Serbia, Bulgaria and China), through which three calls for mobility of researchers have been realized within bilateral agreements for a two year period (Slovenia, Croatia and Austria). Mobility is considered to be a short-term stay (up to 3 months) depending on the dynamics of visits.

Mobility through national scientific research projects

The Ministry supports research, which is realized through national scientific research projects that represents the most important instrument of national policy. Participation of research teams in this programme is also available to foreign researchers who could be part of the team realizing activities foreseen by the project. Making national programmes available to foreign researchers with whom domicile research team cooperates is a good practice presented within the strategic document “European Partnership for Researchers”. Mobility financing through national project has already been practiced but at smaller scale, and with the new Action Plan on Mobility of Researchers (2011-2012) this mechanism will be improved, as main transitional instrument until bilateral cooperation is established with larger number of states. Through participation in national projects, foreign researchers have the possibility to come to Montenegro to perform research, mentorship in preparation of dissertations, knowledge transfer etc.

Montenegrin researchers could use financial resources for realization of project also to perform research in large research centres and laboratories abroad, participation in scientific congresses etc.

Other instruments for mobility support

The Ministry has developed several instruments that act as mobility support. They enable short-term mobility and give an opportunity to our researchers to promote their work and establish contacts for future cooperation. These instruments are:

• Participation in scientific events; Ministry co-finances participation o f M o n t e n e g r i n

researchers with scientific, academic and research title in scientific congresses held in Montenegro or abroad.

• Co-financing of organization of scientific congresses in Montenegro: Ministry co-finances part of the expenses for organization of scientific congresses in Montenegro, organized by scientific research institution or research association from Montenegro.

• Scientific development abroad; Ministry co-finances scientific development abroad if scientific development of a researcher is foreseen within the institutional programme; is approved by foreign institution; if financial means and conditions are provided.

• Cooperation with scientific diaspora; Ministry co-finances travel and accommodation costs for diaspora researchers in order to establish cooperation with scientific research institutions from Montenegro. Cooperation should include: promotion of science programme, mentorship in PhD thesis, participation in preparations and realization of scientific research projects, as well as transfer of knowledge, experiences and trends in modern science.

Besides national instruments for mobility support, mobility is also realized through participation in international programmes, as well as through cooperation of Montenegrin institutions with partner institutions abroad.

Social security

Through bilateral international agreements, on the basis of reciprocity, the rights in area of social security are secured for citizens of two countries-signatories in accordance with residence and work in one of these two countries.

Montenegro signed or applies principles of agreements on social security system on the basis of succession with following countries: Serbia, Macedonia, Croatia, Bosnia and Herzegovina, Slovenia, Luxemburg, Hungary, Austria, Belgium, Czech Republic, Slovakia, France, Italia, Holland, Norway, Germany, Poland, Sweden, Switzerland, Great Britain, Denmark, Libyan Jamahiriya, Romania, Panama and Turkey.

According to the agreements with abovementioned countries, Montenegrin citizens abroad have the right on a certain scope of health services, which mainly includes urgent and necessary health services, after submission of certificate on the right to health protection during temporary stay abroad issued by the Institute for Health Insurance in Montenegro.

Larger number of these agreements foresees providing urgent and necessary health services, while in some countries, according to bilateral agreement, there are possibilities for wider scope of health services (Serbia, Germany, Italy).

Also, if persons are sent abroad to work by home employer, in countries with which Montenegro has signed an agreement, working period spent abroad is covered by the home employer regarding pension and health insurance.

providing access to complete and up-to-date information and services to researchers from Europe and wider, who are interested to live in a foreign country and work at one of European research institutions. EURAXESS is a pan-European initiative supported by 37 countries. It is a single point of access to information from all these countries, including data on services centres and contact points who should be addressed and receive personalized service regarding administrative and other issues during regarding mobility. EURAXESS provides support to mobile researchers, but also to research organizations, in their search for unique research competencies. This is a key initiative in supporting the European Union’s commitment to removing the barriers to free movement of knowledge within Europe.

EURAXESS initiative is composed of four main sections which support mobility of researchers in Europe:

EUraXESS jobs As a researcher, you wil l f ind a wealth

of constantly updated information on job vacancies, funding opportunities and fellowships

throughout Europe. Posting your CV will allow recruiters to find you. As company or research institute you can post vacancies free of charge and search for CVs of international top-notch researchers.

Finding a job

There are two ways to get the latest information on open job vacancies:

• Through the national EURAXESS portal www.euraxess.me, or• Through the European EURAXESS portal http://ec.europa.eu/

euraxess/ National www.euraxess.me portal gives you the option to search for vacancies through the following steps:

• From the left menu choose outgoing researchers option, and then job vacancies

• A window will show up with options to search job vacancies by country of interest and area of research

• According to the parameters, you will see a list of active job vacancies

• Choosing one of the job vacancies from the list you will receive further details on application dates and terms.

At the very first page of the section EURAXESS Jobs you will get a list of recently published job vacancies and several options to search for the most adequate one. As a researcher, if you want to post your CV and search the jobs database you have to go through a simple process of registration by choosing the option researchers sign-up. Registration gives you two options to find a job: to go through the database and find job opportunity that suits you and your qualifications the best, or you could post your CV which will be stored in the EURAXESS database and wait until one or more of the European institutions needs a researcher that has qualification and experience as you do, and receive their offer through an e-mail.

Apart from job vacancies, at the national portal you have an option to search for fellowships and grants awarded for researcher’s career development.

EUraXESS Montenegro Servis centar

EURAXESS Servis centar pruža besplatnu i personalizovanu pomoć u izazovima sa kojima se susreću istraživači i njihove porodice prilikom boravka u stranoj zemlji. U Crnoj Gori osnovan je jedan Servis centar, u naležnosti krovne organizacije-Univerziteta Crne Gore, ovlašćenog od strane Ministarstva prosvjete i sporta.

Up to now, there are more than 200 services centres in 37 European countries. EURAXESS Services Centres are established in order to assist foreign researchers wanting to spend one segment of their career in one of the European countries. Their main objective is to provide necessary information, i.e. all information that a researcher has to know before, during and after moving to a foreign country, and make mobility process easier. In addition, it gives an opportunity to researchers to spend more time on their research instead of administrative procedures.

Service centres provide information on rights and obligations in regarding visas, work permits, health and pension insurance, accommodation, education system for children and many other practical information that one researcher should know for living in a foreign country.

Researchers that wishes to stay and work in Montenegro will find practical information in the Service Centre within the EURAXESS Montenegro network and at the Montenegrin portal, and Montenegrin researchers who wishes to stay and work in one of the European countries will find practical information at the national portal of that specific country and through contact with the closest service centre to desired location for research.

Scientific Visa Package

Large number of measures for hosting a foreign researcher implemented at national level was a basis for European legal initiatives. In cooperation of SG-HRM and EU Committee for Migration and Asylum Policy representatives, prepositions of directive and two recommendations were created on hosting third country researchers (non-EU countries), which were adopted by the Commission in March 2004. These three documents are called the “Scientific Visa package”.

The main concept of the directive is creation of a specific residence permit for third country researchers, which is requested from immigration

services by accredited research private or public institutions on behalf of a research, according to the “hosting agreement” (signed by researcher and institution). Institutions guarantee participation of researcher in a valid research project, as well as relevance of his/her competencies. This permit, which has to be approved by immigration service no later than 30 days after the submission of a request, gives an opportunity to third country researchers to work in any EU country within a scientific project and does not require working permit. No quota rules should apply in employment of researchers under these conditions. In order to extend residence permit, researchers do not have to go back to home country and could extend their stay from the host country. The Directive also supports researcher’s family reunification and is against any kind of discrimination.

The first recommendation refers to long-term hosting of third country researchers and does not apply for United Kingdom, Denmark and Ireland (which already have developed mechanisms for hosting third country researchers). The second recommendation refers to improvement of issuing short-term visas (up to three months), for participation in conferences, seminars, etc in EU countries. Recommendation does not apply for United Kingdom, Denmark and Ireland which are not Schengen Agreement signatories, as well as for countries that do not belong to this zone (new members).

FP7 - Seventh research Framework Programme

The Seventh Framework Programme for research and technological development (FP7) is the

European Union’s main instrument for funding research in Europe.

Programmes support organization of cooperation between universities, research centres and industry (including small and medium enterprises), provide financial support for their joint projects. The first cycle of the framework programmes started in 1984. Unlike previous framework programmes that lasted three to five years, Seventh framework programme lasts seven years, 2007-2013. FP7 is developed with a purpose to increase successfulness in relation to previous programmes that had as an objective to establish European Research Area and economy growth of Europe based on knowledge.

Total fund for seven years is 50,5 million euro and additional 2,7 million euro for five-year EURATOM programme for nuclear research..

Marie Curie Actions, The People Programme

A specific programme “Marie Curie” within the EU FP7 has as a goal to strengthen human potential in science and technology in Europe, in quantitative and

qualitative aspect. „Marie Curie“scholarships are developed to stimulate young people to consider and choose career in research, motivate

European researchers to stay in Europe and attract researchers from all over the world to Europe.

It is foreseen that 35 000 researchers will use “Marie Curie” fellowships, and about 35 000 will take part in various short-term activities during the FP7.

Who are users of “Marie Curie” programms?

Two parties establish cooperation:RES EARCHER – fellowship user, andRESEARCH CENTRE (university, company, research institution) -organizer of a training, professional improvement.“Marie Curie” establishes an attractive funding structure both for fellowship users and for center that hosts a research. Benefit for research centre is that they get researchers paid through the FP7. Benefit for research is the experience necessary in a certain career stage. For Montenegrin researchers benefit is a significantly larger income.

Initial Training Networks – ITN

Target group: PhD and postdoctoral students, i.e. early-stage researchers with less than 4 years of experience (full-time equivalent) in their research career, including research training period.

How to apply: researchers apply individually with the research institution that organizes training and announces fellowship at www.euraxess.eu

Fellowship duration: 3 – 36 months

Deadlines: continuous (according to dynamics of suitable projects)

Intra European fellowships – IEF

Target group: experienced researchers with at least 4 years of experience or PhD.

The key content of individual fellowships is advanced training through research, better research career and life-long learning. Purpose of fellowship is to expand skills at the interdisciplinary level or to gain experience in other sectors. In addition, objective is to train researcher to achieve level of a leader in research or other higher positions in organization or company. For that reason, project has to prove that it is part of researcher’s career plan.

What is financed?

Grant covers up to 100% of estimated budget: subsistence costs of researcher, mobility costs (for family also), research costs at host institution, project management etc.

Project proposal is submitted by individual researcher who has to have agreement with the host institution on his/her research training within the proposed project. Engagement could last 12–24 months of full engagement.

How to apply: Institution submits project proposal for a candidate.

Deadlines: call for applications in March with deadline in August

International outgoing fellowships – IoF

Target group: experienced researchers with at least 4 years of experience or PhD.

Objective is to strengthen international dimension in a career of experienced European researcher providing an opportunity for training and new knowledge in renown research organization, in non EU/AC country. With return to EU/AC country in the second phase of the project, it is expected that gained knowledge and experience, as well as established contacts, will contribute to European economy and society.

Fellowship covers two phases of mobility:

How to apply: Fellowship beneficiary prepares project in cooperation with host institution i.e. supervisor. EU/AC institution in which fellowship user returns, submits project proposal for fellowship user.

Deadlines: call for applications in March with deadline in August

International incoming fellowships - IIF

Target group: experienced researcher with at least 4 years of experience in research or obtained PhD.

These fellowships are to attract experienced researchers that are active in “third” countries,to EU/AC countries, so that they could be engaged in research projects. So, these fellowships are not eligible for Montenegrin researchers, except if they are researchers from diaspora.

How to apply: Applicant prepares project proposal in cooperation with host institution i.e. supervisor. Institution submits the proposal.

Deadlines: call for applications in March with deadline in August

Career integration grants – CIg

Target group: experienced researcher with at least 4 years of experience in research or obtained PhD.

Objective of this scheme is to strengthen the European Research Area through encouraging experienced researchers to have a permanent job position in research organization in EU/AC for the first time – if such position is offered by host institution, after mobility period. The intention is to reverse direction of “brain drain” in improvement of working conditions through allocation of their own budget for research.

Grant is based on the principle of fixed amount that should cover part of engagement of researcher, from € 25.000 per year, for period 2 - 4 years.

How to apply: Applicant prepares project proposal in cooperation with host institution. Institution submits the proposal for fellowship user.

Deadlines: Call for applications is open throughout the year, with two terms for submission.

Industry-academia partnerships and pathways - IAPP

Target group: young and experienced researchers.

In order to realize this funding possibility, at least two organizations from two different sectors and two different countries have to be approved for project on mobility funding for their employees, as a mean of realization of long-term cooperation programme. Mobility could last 2 – 24 months.

How to apply: Partner institutions, out of which one is a coordinator, submits project proposal that foresees scholarships for mobility of employees.

Deadlines: call for applications in June/July with deadline in December/January

International research staff exchange scheme - IRSES

Target group: all generation researchers, as well as administrative and technical staff.Objective of this scheme is to fund a programme for short-term staff exchange between partner institutions in EU/AC and “third” countries (Russia, Japan, USA, Australia etc.). In order to realize mobility, institutions-partners should have approved project for funding. Mobility is financed in fixed amount of 1900 € per month.

How to apply: Partner institutions, out of which one is a coordinator, submit project proposal that foresees financing of short-term staff mobility.

Central European Exchange Program for University Studies

CEEPUS is an academic exchange program for students and professors from Central and Eastern Europe which started in 1993. Student exchange is organized within university networks. Each of the networks has a certain number of target subjects. It contributes to development of European Research Area through strengthening of research activities, and providing a platform to European scientists for cooperation at specific projects and exchange of expertises.
