Tho Ha-waiian Coinmorcinl nnd SugarCompany is formed and incorpor-ated under tho laws of this Stuto.Tho other plaintiffs, Russoll J.Wilson, Mountford S. Wilson.Charles S. Whcolor, lludolphSprcckols and 13. J. Hoffacker,aro citizens of this Stalo, and thodefendant, Olaus Spreckols, is acitizon of this State. Tho defen-dant, under theso circumstances,has a right to havo a case againsthim tried in tho State of whichall partios uro citizons, nnd Mr.Sprockets has invoked tho aid ofone of tho principles of equitywhich guarantoos this right. This was doneby royal patent aud by a specialact of tho Hawaiian Legislaturein August, 1882. Spreckols thenturned oor to tho compmy, miSoptember 25, 1882, all pioportyho hold in trust for its benefit.Thocompiny had by that timoboen organized under tho nameof tho Hawaiian Commercial andSugar Company. On February27, 1885, Mr. Spreckols sold to thecompany 18,000 acres of tho Ahu- -
puaa of Wailuku, included in thotract being tho 10,000 acres thocompany had originally secuiedby leaso from tho crown beforothe land itself enmo into Mr.Sprockols' possession. Tho deedto tho 18,000 acros was made byMr. Spreckols individually undertho direction of tho company'snttornoys, and wnB accepted by itas wholly satisfaotoiy. Tho re-

Tho prayer of Olaus Sprookols'complaint asked that said de-
fendant, tho Hawaiian Commer-cial and Sugir Compauy, boon-joine- d
from furthor prosecutingits aforesaid action in tho courtsof the republic of Hawaii, andthat the defendants, lludolphSpreckols, Kussoll J. Wilson,Mountford S. Wilson, Charles SWhoolor and B. J. Uoflackor, thedirectors of said Hawaiian Com-
mercial nnd Sugar Company, boenjoined from pussing any isolat-ion, or doing any not or thing infurtherance of B.iid action; andfor such other and furthor roliofns to oquity may soom meet; andcosts of suit. Tho injunction wasgranted by Judge Bahis and itnow rests with tho defendants mthe injunction suit to obey thocourt's order or move for its dis-missal. In our last advertisement inthis column we called atten-tion of the public to theStearns wheels which are nowbeing sold in this city. Westated without fear of contra-diction that they were backnumbers, manufactured in 1894and shipped to the PacificCoast as up to date wheelswhen they are not. We rei-
terate that assertion more for-
cibly in this ad. It has notbeen denied and cannot be,and we again caution buyersnot to be deceived with anti-quated machines which arerepresented as containing allthe latest improvements.
An ad of the Stearns agencyin an afternoon paper, praisingthe Tribune wheel and givingit a good send-of- f, refers to aletter written by H. F. Terrill,the well-kno- wn scorcher, con-
cerning the Tribune wheel.In spite of their assertion tothe contrary, we deny that theagents of the Stearns wheelhave seen or read the privateletter of Harry F. Terrill to theTribune rider here (meaningTommy King) but as there isnothing secret about it weprint the whole of it relatingto bicycles below. If theStearns agents can get anysatisfaction out of it they aremore than welcome. Mr. Ter-rill says: "I am riding aStearn, 16 lbs. Say, Tom, theTribune wheel has an awfulgood reputation through theEast. I did not think muchof it before I came East.It is considered one of the bestmechanically constructedwheels in the world."
The balance of the letterrefers to private matters butthe Stearns agents may perusethe whole of it at any time.The explanation of Ten-ill'- s
riding a Stearns wheel lies inthe fact that he is under con-
tract with the manufacturersto do so, consequently he can-
not ride a Tribune although itis evident he would if he hadthe choice.
In our last advertisement weasked any intending pur-chaser to take one of theStearns wheels to any first-cla-ss
mechanic and have liim take itapart and compare it with thecorresponding features of theTribune wheel. We knew thatan honest opinion would bethat the Tribune is by far thebetter, wheel and hence madethe challenge. We renew thatchallenge and intend to keep itbefore the public. It has notbeen accepted and it will notbe.
