EXECUTIVE: At board of alderman meeting Mayor Dalton played Trump. Most of

the elected officials followed along like loyal White House staffers.

It was on the Town and Country Board of Aldermen agenda as a “discussion” item only.

Of course Missouri is in the Federal “Red Zone” of extensive COVID-19 cases. In this

area only St. Louis Mayor Lyda Krewson and St. Louis County Executive Dr. Sam Page

have issued Health Emergency Orders requiring masks be worn in public, limiting crowd

sizes, limiting seating in restaurants and bars and limiting hours of operation. These

leaders are not trying to hurt businesses, they are trying to keep people safe and

avoiding a deadly virus until vaccinations are available. National health experts have

said as recently as this week that changing or reducing these regulations is a very

dangerous thing to do.

But now Town and Country Alderperson Jeff Wittmaier thinks these orders are

unnecessary and the pandemic is greatly overstated. He discussed this with Mayor

Dalton before writing it. Here it is:

WHEREAS, the St. Louis County Executive, Sam Page (County Executive), has declared a

state of emergency regarding the pandemic of Coronavirus-19 (Covid-19); and

WHEREAS, the County Executive has issued Executive Orders and ‘Safe Operating Guidelines’

(Orders and Guidelines) that materially restrict activity and require specific behavior of our

citizens; and

WHEREAS, while efforts are underway to create a vaccine, the likelihood of an effective

vaccine in the quantities required to vaccinate our population within the near future is uncertain;

and

WHEREAS, treatment protocols for Covid-19 have matured, reducing the threat of extreme

symptoms and reducing the impact on healthcare systems; and

WHEREAS, the likelihood of chronic conditions caused by the virus appear to be low; and

WHEREAS, we have learned that the fatality rate from this disease is far lower than originally

thought; and

WHEREAS, ~91% of fatalities from this disease in Missouri have been people aged sixty or

older and ~76% of fatalities from this disease in Missouri have been people aged seventy or

older;and

WHEREAS, ~50% of all fatalities nationwide show a co-morbidity factor due to a pre-existing

condition; and

WHEREAS, the mental health of our population is as important as their physical well-being; and

WHEREAS, the spiritual health of our population is as important as their physical well-being;

and

WHEREAS, the economic health of our population is as important as their physical well-being;

and

WHEREAS, the ability of our citizens to govern themselves is as important as their physical

well-being; and

WHEREAS, many of the County Executive Orders and Guidelines generally treat all populations

in the same manner regardless of age, race, pre-existing condition, or living situation, focusing

primarily on their physical well-being; and

WHEREAS, the mental health of our population is declining, resulting in depression, negative

behavioral change, and suicide; and

WHEREAS, our citizens are struggling to attend religious services and freely participate

according to their religious beliefs and traditions;

WHEREAS, the businesses that buttress our community are suffering from the impact of the

County Executive’s Orders and Guidelines; and

WHEREAS, the employees of these businesses are suffering financially from the impact of the

County Executive’s Orders and Guidelines; and

WHEREAS, we are struggling to govern our city under the current Orders and Guidelines.

WE HEREBY RESOLVE that the City of Town and Country asks the County Executive, Sam

Page, to restore the personal liberties of our citizens by removing the restrictions and behavioral

requirements imposed on our citizens, our government, and our businesses through the County

Executive’s Orders and Guidelines; and that the County Executive establish Orders and

Guidelines that protect our most vulnerable without impacting our least vulnerable.

Adopted this XX day of XX, 2020, Town and Country Board of Aldermen.

Keep in mind that Missouri is ranked the 6th most dangerous State for COVID-10 infections and

deaths. (per capita)

South Dakota and North Dakota have the highest per capita rate of infection thanks to

the lack of emergency health orders and the Sturgis Motorcycle rally of over 250,000

people gathering in a small town.

Mayor Donald Tru…er I mean Jon Dalton started the

discussion. “I was please to meet with Ald. Wittmaier several times over this.”

He then had Wittmaier take over.

Wittmaier: There are so many people who hold the same theory. (Co. Executive

Pages’ Health Orders are unnecessary) Thess (Heath orders) are affecting mental

health, spiritual health and our ability to govern ourselves.

Dalton: It (The Health restrictions) is a significant situation.

Sue Allen: Have you talked to our Councilman Tim Fitch or anyone at the County

Council?

Wittmaier: No

Dalton: This topic always comes up, social impact of the County regulations. There is

not a single conclusion on it.

Ryan Mortland: There are a lot of our citizens looking for change (Lift of the Health

Order/restrictions)

Town and Country.

Wittmaier: I’d suggest we red line this and get inpute from Councilman Fitch.

This was the end of the discussion. Neither Ward-2 Alderperson, Tiffany Frautschi or

Fritz Wiesehan said a word. It was odd from Wiesehan since he is part of the Mari de

Villa Senior Living and nursing home management team. Marie de Vila is one of the few

assisted living facilities not on the County Health department list of facilities with

COVID-19 cases.

I found it odd that no health professional familiar with the Virus is on the Board of

Aldermen and the no one would comment how County Exec. Page is not trying to

destroy businesses but keep people healthy and alive. There are many countries that

have taken much stronger measures than Sam Page. The United States leads the

world in COVID-19 deaths, but the Town and Country Board of Aldermen are blind to

the facts and the necessary restrictions to keep the public safe.

SMALL PROPERTY TAX VOTED DOWN. BUDGET RESERVE EXPECTS TO

START DWINDLING: At the August 31 meeting of the Ways and Means Commission

members were still pissed that the Board of Aldermen ignored their recommendation for

a small property tax. The Board of Aldermen can only vote in Property Tax increases in

EVEN number years. In ODD number years the increase has to be put on a ballot.

This means two years with a continued drop in sales tax revenue as business go out of

business and shoppers stay home until COVID vaccines have caused a drop in illness

and deaths.

The drop in sales tax revenues means the city will have to use the budget reserve or cut

services and employees.

The Commission voted unanimously for again submit a 10-cent per $100 valuation tax.

Commission Co-Chair Sue Allen agreed to introduce it as an amendment to the zero-tax

bill already before the aldermen..

When the matter came up, first on the legislative agenda, City Clerk Ashley McNamara

announced that she has received 26 emails from citizens who are all opposed to a tax

increase. (We have obtained those and will feature some in our next newsletter.

The No-Increase (ZERO Tax) bill was introduced for a vote.

Sue Allen then moved to introduce a replacement bill. There was total silence meaning

the motion would die for a lack of a second. Finally someone seconded the motion.

(This was a video virtual meeting so I could not tell who seconded the motion.) There

were then some comments:

Ald. Jon Benigas: This is the second time the Ways and Means

Commission has brought this before the board. All of the community is 100% against a

tax increase. It seems to me that the public is misinformed on a tax increase.

Ald. Tiffany Frautschi: We had a citizen meeting this morning and no one

understands the budget issue and the possible need for a tax increase. I believe whole

hardily with Ald. Benigas. We need to have some education where the tax money goes.

Jeff Wittmaier: I’m opposed to this substitution. Our citizens have

said they want us to use our reserves and further cut services.

Ryan Mortland: I echo what aldermen Frautschi and Benigas have

said. I think we are in a good position and not in a crisis.

Pam Holman: I’m not in support of the substitute bill.

The vote to approve a 10-cent property tax failed, 1-for and 7-no. Sue Allen was the

only person to vote for the tax.

The Board then returned to the original matter of voting for NO Property Tax. This

passed on an 8-0 vote.

At the end of meeting there is a vote on the “warrant list” which is a list of bills.

Tiffany Frautschi asked why there are such huge Missouri American Water and

Metropolitan Sewer District bill. (The last water bill was $3,487 and last MSD bill was

$1,446.)

Parks Director Anne Nixon stated the ponds have to be kept at a minimum

level. (They also have to be drained to keep the water from getting stagnant.) She

added they are trying to lower the water levels to the lowest acceptable level to save

money.

TOWN SQUARE 2020 COSTS: Here is the current list of Town Square expenses for

2020. This Dalton boondoggle cost $9.98-milion and continues to eat into the city’s

cash reserve.

OOPS! While I was downloading this bill, my computer downloaded a section twice,

which I did not catch. I did catch that the city was being double billed, which was

completely false. To make matters worse at 4:15AM I sent a smart ass email pointing

out the double billing that never occrred. I have a feeling this will not be helpful for

future editions of the newsletter. I did donate $224 (that I thought was double billed) to

the American Red Cross for Forest fire/Wildfire relief in the name of the city’s law firm.

THE BERRA MATTER AND THE JOHN DIEHL FENCE: We estimated the lawyers

spent 7.2 hours dealing with “The Berra Matter” at an estimated cost of $1008. The

Berras were battling with neighbors over horse manure on the grounds of their riding

track outside of the riding stable. Neighbors complained of the strong smell. The city

was going to order them to remove manure from the property once a week. The Berras

threatened to sue and it was agreed they would treat the horse poop to eliminate the

odor. Now it is a fight over the current Condituing Use Permit. We could not find out

much more or if it involved their horses of the horse poop.

The “Fence Issue” resulted in an estimated 9.6 hours totalling $1,344. I inquired with

the city the issues were. I got the following reply from City Administrator:

The Berra issue is in response to a neighbor’s complaint about a

potential violation of the CUP.

The Fence issue involving John Diehl is in response to a complaint

regarding a legal non-conforming use.

Tim worked 14 years as an engineer with the Illinois Department of Transportation and

14 years as the City Engineer in Belleville, Illinois.

Since August Gregowicz has been a senior engineer for the Lochmueller Group, an

engineering firm with 10 offices in Missouri, Illinois and Indiana.

TOWN AND CRIME SUNDAY CRIME: Strong Arm Robbery at Schnucks. Below is

a posting made by Town and Country Police on Sunday after the crime.

At approximately noon today, a purse snatching occurred in the parking lot of Schnucks

in Woods Mill Plaza causing injury to the victim. The suspect is a white male.

Sandi McMillin of Ballwin was the victim of an apparent gang of armed males using

stolen vehicles to commit crimes in West County. The theft was featured on KMOV

Newscasts on Wednesday September 16. The frightening thing is that the suspect

grabbed McMillin’s arm that had her purse while he was driving a moving vehicle. That

forced her to the pavement causing injuries. Other gang members were later seen on

video using her credit cards in North County.

20-3226 - Larceny Report SEU officers handled a delayed shoplifting call from Walmart.

20-3228 - Larceny Report SEU officers handled another delayed shoplifting call from Walmart. 20-3230 - Assault Report A 46 year old female reported she was struck in the face several times by her 48 year old aunt, for refusing to help her steal from Ross Dress for Less. Officers located the aunt inside the store and questioned her about the incident. The aunt and another friend who was with them gave conflicting statements and there were no injuries or signs of being struck on the victim. Due to lack of evidence a summons was not issued but the case will be forwarded to the Prosecuting Attorney for review and any possible charges.

20-3232 - CIT Report A 12 year old female with mental health issues made threats to hurt herself. She was voluntarily conveyed to Mercy Hospital for evaluation and officers completed a CIT report.

20-3233 - Larceny Report A hostess from Vito’s restaurant in the valley reported her purse was stolen and then her credit cards were used to make fraudulent purchases. Officers will be making follow up investigation to possibly identify a suspect from the restaurant or where the cards were used, investigation on-going.

Gun thefts from cars has been a problem for decades. I’m amazed at the number of people who had their guns stolen last week. When I was in the Police Academy in 1974 there were a number of police officers who left guns in their car and had them stolen. CHIEF WANTS TO ADD ANOTHER NEGATIVE THING FOR THIEVES TO STAY AWAY FROM CHESTERFIELD STORES: At the last Public Health and Safety meeting Chesterfield Police Ray Johnson apparently did something that the city prosecutor and judge refuse to do, as they drop criminal charges against people who come to Chesterfield and are arrested for stealing from retail store as long as the thief has a lawyer. This does not cause much negative reinforcement not to return. Chief Johnson announced that a policy is in the works to tow the thieves’ cars when they are arrested, even if they are not being driven. The theory is that they are trespassing since the car was driven to the shopping/strip center to steal. Some thieves after being released on bond, go back to get their car and are caught stealing at a different store in the shopping center.

I emailed Chief Johnson and asked if the policy is in effect yet. Here is his reply. That is our plan going forward. But we haven’t had the occasion as of yet.

The house was built in 1965 and is 19,891 square feet. A drawback is that it is on 3

acres which will increase your lawn service fees if you don’t have someone full time for
