Sacramento Streamlines Permit Process

Aspart ofSacramentoStreamline,theCityofSacramentoannouncedapilotprogramaimedtofurtherim-prove theefficiencyof thebuildingpermitprocessandhelpensurethatall work performed is done safe-ly. Dubbed the Accelerated MinorPermit Program, this new service– which will go live mid-February–will allow licensed contractors topurchasepermitsforspecificminorinstallations and repairs. The costsavings of purchasing permits inbulkcouldbeupto75percent.Thefirstavailablepermitwould includewater heaters for residential andcommercial customers, with otherwork including re-roofsandelectri-cal circuits to follow shortly there-after.

The program will allow licensedcontractors to immediately pur-chase permits, in groups of five,for specific minor installations andrepairs, at a reduced cost.As partof the program, City staff will ran-domly inspect one installation pergrouping,tomakecertainworkper-formed is done correctly. The Cityhopes the program encouragescontractorsandresidents toobtainabuildingpermitforavarietyofmi-norprojects.

$2.5 Billion Spent, $2 Billion More Needed

Inspectorstakingthefirst-everin-ventory of flood control systemsoverseen by the federal govern-ment have found hundreds ofstructures at risk of failing andendangeringpeopleandpropertyin 37 states, including inCalifor-nia.Leveesdeemedinunaccept-ableconditionspanthebreadthofAmerica.Theyareineveryregion,incitiesandtownsbigandsmall:Washington,D.C.,ClevelandandDallas,Augusta, Ga. and Brook-port,Ill.,aswellasCalifornia.

After Hurricane Katrina in 2005,Californiavotersapprovednearly$5billioninbondstoshoreupthestate’sagingfloodprotectionsys-tem.Withmorethanhalfthemon-ey spent, officials say they needupto$12billionmoretofinish.

In Sacramento, a 42-mile-longlevee along the Sacramento andAmerican rivers protects theNatomasarea, a flood-proneba-sin transformed from croplandintoacommunityof100,000withan airport, nearly three dozenschoolsandtwointerstates.Thatlevee received an unacceptableratingby theU.S.ArmyCorpsofEngineers.But,at this time,onlyabouthalf the$810millionneed-ed forupgradeshasbeen raisedfromstateandlocalsources.Thecityisseekingfederalfinancingoftherest.

Wereittofail,“itwouldbebeyondcatastrophic,” said AngeliqueAshby,thecity’svicemayor.

Thepoorratingledfederalemer-gency officials to impose strictbuilding limits that have prevent-ed homeowners frommaking re-pairsanddelayedconstructionofschoolsandapolicestation,shesaid.

“This is going to be a nationalproblemand it justhasn’tdawnedonpeoplehowbig it’s going tobe,”saidJeffreyMount,aleveemanage-ment specialist and founder of theCenterforWatershedSciencesatUCDavis.“We’reinanever-endingcycleoffloodandrebuild.”

As of Jan. 10, the Corps had pub-lishedratingsfor1,451,or58percent,ofthelevees.Ofthose,326wereun-acceptable,1,004wereminimallyac-ceptablewith deficiencies that needcorrecting,and121wereacceptable.

Local governments and districts areresponsible for upgrading unaccept-ablelevees.InYoloCounty,mostle-veemaintenanceistheresponsibilityoflocalreclamationdistricts,saidPa-nosKokkas, thecounty’sdirectorofpublicworks.

Reclamationdistrictsarefundedandgovernedbypropertyownerswhoselandstheleveesprotect.Kokkassaidthereareseveralsuchdistrictsalongthe Sacramento River and CacheCreek,andthattheyareoverseenbythe state Department of Water Re-sources’CentralValleyFloodProtec-tionBoard.

December Surge In Home Building

U.S.buildersstartedworkonhomesinDecemberatthefastestpacein4½ years and finished 2012 as theirbestyearforresidentialconstructionsincetheearlystagesofthehousingcrisis.

TheCommerceDepartmentreportedthatbuildersbrokegroundonhous-es and apartments last month at aseasonally adjusted annual rate of954,000.That’s 12.1 percent higherthan November’s annual rate. And

it isnearlydouble therecession lowreachedinApril2009.

Constructionincreasedlastmonthforbothsingle-familyhomesandapart-ments.And thepace inwhichbuild-ers requested permits to startmorehomestickeduptoa4½yearhigh.

Applications for new building per-mits,whichareseenasanindicatorofbuilders’confidenceinthemarket,werelittlechangedfromNovember’srate.But theannual rateof903,000reportedinDecemberisup28.8per-centfromlastyear’slevel.

Thisisonemorepositivesignthatthehousingmarket ispickingupsteam,as record-low mortgage rates havespurreddemandforhomes.

Arecoveringjobmarketandataper-ingoffofforeclosureshavealsogiv-enthemarketaboost.Asdistressedhomesleavethemarket,thatmeansthattherearemorebuyersinterestedinpurchasingfeweravailablehomes.Homeprices,inturn,havecontinuedto rise, posting the biggest percent-agegaininmorethantwoyearslastmonth.

Apartment construction, which ismorevolatile,surged23percentlastmonth. It is now back to pre-reces-sionlevels.

Applications for building permits, asign of future construction, incheduptoarateof903,000,whichisthehighestlevelsinceJuly2008.

Ripon High Work Funded

RiponUnifiedSchoolDistrictTrusteeshaveallocatedmoneyfromFund35togotowardstechnologyupgradesatRiponHighandall-weathersurfacingontheDs–that’sthetwocornerpor-tionsinsidethetrackovalusedforthe

jumpingevents–andAmericanDis-abilityActrequirementsnecessaryforthe ongoing Stouffer Field modern-izationproject.

Theboardapproved$100,000tohelpreplacebothstudentcomputerlabsatRHS,with$75,000of thatgoing im-mediatelyandtheremaining$25,000to be used asmatching funds for aproposed RHS technology boostersclub, according toTrusteeErnieTy-hurst.

Stouffer Field will receive $250,000fromFund35.Ofthat,$100,000willgotowardsreplacingtherestroomsattheRHSstadium.Fundingnottoex-ceed$50,000willbeusedforupgrad-ing classroom locksets district-wide,theDBuildingroofincludingasbestosabatement at RHS, and resurfacingoftenniscourts.

Summer School Construction Projects

TheCupertinoUnionSchoolDistrictissettobeginamajorseriesofcon-struction projects this summer. LastJune,votersinthedistrictattendanceboundaries passed Measure H, a$220millionschoolfacilityandrepairbondmeasure.Thebondwillbeusedto modernize classrooms and bath-rooms,upgradeearthquakeandfiresafety systems, replace infrastruc-ture, update science labs and tech-nology systems and build additionalclassrooms.

The twenty elementary school cam-puses in thedistrictwill see thead-dition of robust wireless Internetnetworks. Other summer projectsincludeaddingexteriorlightingtosixcampuses, roof replacement at an-otherthreecampuses,paintingatan-othertwocampusesandthereplace-mentofsewer,waterandstormdrainundergroundutilitiesat12sites.

PerhapsthemostambitiousprojectswillbeatLawsonandCupertinomid-dleschools.Thetwoschoolswereamajor focal point when voters wereaskedtoapprovethebond.Lastyear,thedistrict said itwasanticipatingasurge inenrollmentatHyde,Cuper-tinoandLawsonmiddleschools.

PhaseIoftheLawsonMiddleSchoolprojectwillseetheconstructionofanew 20-classroom, two-story build-ing. Four of those will be scienceclassrooms,sixwillbe formathandscience, and 10 will be standardclassrooms.Therearealsoplansfora new band building, including twomusicroomsandanareaforstorage.

TomakeroomatLawson,theneigh-boring district office on Vista DrivewillvacatethepremisesbytheendofApril.ThedistrictisleasingtwoofficesuitesinSunnyvaleat1309S.MaryAve. forat least thenextfiveyears.The district office’s move will alsomakeway for anew trackandfieldat Lawson. The Lawson project willbegin with site preparation betweenJuneandearlySeptember.Construc-tion of the new buildings will startsoonafterandrunintoAugust2014.The new track and field will breakgroundinmid-June2014andlastun-tilapproximatelytheendofOctober.

PhaseIofCupertinoMiddleSchool’sprojectisequallyambitiousinscope.It, too,willsee theconstructionofanew 20-classroom, two-story build-ing with the same number of sci-ence,mathand regularclassrooms.Theschoolwillalsogetanewgym-nasiuminadditiontoitscurrentone.Thelockerroomswillberebuilt,andbuildings100,200,300and500willbemodernized.

Site improvements and classroomconstruction follow thesamesched-uleasLawson’sidenticalproject.ThenewgymwillbreakgroundinlateAu-gustand takeaboutayear tocom-plete.

Pier 70 Development Plan Unveiled

ForestCityhasunveiledaproposalforamixed-useinnovationcenteratPier 70 that could includeasmanyas 1,000 housing units, 2.2 millionsquare feet of office space, and adiverse collection of spaces to ac-commodate 275,000 square feet ofartisans, retailers, designers, andboutiquemanufacturers.

ForestCityestimates that the infra-structureaspectoftheworkwillcost$152millionandthehistoricrestora-tionpartoftheprojectwillcomeinat$90million.

Whilemuchof theproposal carriesout ideascultivatedatForestCity’s5MprojectatFifthandMission,theinclusionofhousingissurprisingbe-causethePortofSanFranciscohadpreviously said that residential de-velopmentat thesitewouldconflictwiththenoisyshiprepairbusinessesthat flourishon thepier.ButForestCityhascircumventedtheconflictbyplacing thehousingas far from theshipoperationsaspossibleandhasbeenworkingcloselywithBAESys-tems,whichoperatesthefacility,thelargestfloatingdrydockontheU.S.WestCoast.

The Forest City concept envisionsanewwaterfrontneighborhoodwitheightacresofgreenspacethatbothstretches along the waterfront andjutsintotheheartofthecampus.Theparkland would create both accessto theBayaswell a towncommonofsorts—alivelyinteriorurbanparkthatcouldbecomparedtoWashing-tonSquareinSanFrancisco’sNorthBeach.

Phase one, which would start con-struction in2016,would includethereuseoftwohistoricshipyardbuild-ings.The100,000-square-footBuild-ing2wouldbecomeabout100unitsofhousing.The160,000-square-foot

Building 12 would be reimaginedas a loft-style creative office build-ingwithagroundfloormarketplacethat spills out into the public plaza.Thescaleofthecentralareawoulddraw inspiration from the networkof alleysandnarrowpathways thatcharacterized Pier 70 duringWorldWarII,whenitwasthebusyhometo18,500workers.

San Jose Pushing Development Hard

When Chuck Reed took over asSan Jose’s Mayor, he wanted tochange the city’s construction fo-cusfromhousingtobusiness.He’ssomesuccess.

Mike Crimaldi knows track carriers. He was working with crawler-mounted drills before he had a driver’s license, starting out as a driller’s helper at age 15. As his company’s drilling fleet grew, so did its service and repair capabil-ity. Eight years ago he transitioned out of direct drilling services to found Rig Source Inc. in Elburn, Ill. Since then, more and more customers have wanted to put crawlers under a variety of equip-ment that spanned the construction in-dustry. By now Crimaldi has just about seen it all. Speaking from his 35 years of experience, he sums it up: “If you can mount it to a truck, you can put it on tracks.”

Tracks provide a stable, versatile plat-form that can turn about in place to maneuver equipment precisely where it needs to be, and they do this with sig-nificantly less threat of damage to the worksite’s surface. Additionally, tracks allow owners to keep equipment in the field when soil and weather conditions would park truck-mounted equipment, thus improving productivity.

Tracking the Industry

Though the most common mounts still tend to be flatbeds and dumpers, Crimal-di says, “One customer might have a flat-bed to mount on a tracked undercarriage, the next a scissor lift. That’s the exciting thing for us—the new uses we keep see-ing for it.” He has seen customers use the unit for mulch blowers, mat carriers, mobile epoxy coating machines, hydro-

Improve Productivity With Crawler Carriers

Tracked carriers were originally de-signed for off-road use. Using rubber tracks eliminated the need to lay down lumber or matting to protect paved sur-faces the rig might have to cross or work from. Advances in rubber track technol-ogy have made them highly durable and long lived. “Manufacturers don’t bother much with steel anymore,” Crimaldi says, “since so many customers have gone to rubber.”

Choosing a Carrier

For customers deciding whether to mount certain equipment or which man-ufacturer to purchase from, Crimaldi defers to Rig Source’s director of sales, Matt Slater. Are there cases where he’d advise against upgrading to tracked

Crimaldi says the roots of the tracked carrier market can probably be traced to tracked dumpers. Contractors noted how they could be used on soft, wet ground when trucks would either cause too much damage or get stuck. As trucks wore out, owners found they could ex-tend the life and utility of their equip-ment by remounting it to similar tracked carriers.

“They would get maybe another five to ten years of use out of their equipment,” Crimaldi says, “but they were also find-ing that tracks gave them more flexibility for all ground and weather conditions.”

equipment? Slater couldn’t think of any offhand. Rubber track carriers exert as little as 3 psi of pressure on the surface, and their terrain-traversing capabili-ties surpass those of trucks and trailers. Though they can’t be driven to and from a worksite, transportation isn’t a prob-lem. Slater explains, “Most contractors already have a trailer to haul their equip-ment to the site, so they’re set.”

One potential limitation is size. Track carriers come in almost any size class imaginable, he says, but the greatest customer demand has been for what Crimaldi describes as “the largest car-rier possible without requiring special permitting to transport it.” Trailers with loads 8-feet and 6-inches wide or more require oversize permits.

Slater explains that, as far as manufac-

turers are concerned, most North Ameri-can customers prefer to buy from North American vendors. The issue is not one of nationalism or even of technical su-periority, however, and Slater notes that many of the overseas models are well made. Instead, it’s a matter of mainte-nance. With many foreign models, he says, “The parts are proprietary to that manufacturer.” He explains that the ad-vantage of a wholly North American-made carrier is that parts and service can be found locally throughout the U.S. and Canada.

The degree of modification that an un-dercarriage needs in order to accept a given mount can also be an issue, as not all manufacturers can be accommodat-ed easily. “We’ve had customers in the past who wanted to use a certain kind of winch on the front or rear of their rub-

ber track carrier. The problem with some models was they had to literally cut off the carrier’s bumper to be able to mount the winch.”

Tracked carriers directly contribute to increased productivity, since they ex-tend the company’s onsite calendar. They provide a stable, highly versatile platform that can turn about in place to maneuver equipment precisely where it needs to be, and they do this with sig-nificantly less threat of damage to the worksite’s surface.

When you think about it that way, put-ting a rubber track carrier under your equipment does exactly what you expect any equipment upgrade to do: reduce the pressure and get you from one job to the next quicker.

Should You Run Your Business As A Corporation Or LLC?

Whether you are a full-time or part-time business owner, everyone in the field of construction can benefit from forming a corporation or an LLC. There are two reasons why: one has to do with lower-ing your personal taxes and the other one with growing your busi-ness.

First, no matter what type of way you make your living, you are going to make income and pay taxes. If you are a business owner, your goal is to have the money you make taxed at the low-est rate allowed by law. If you are doing your business as a sole proprietor, you are going to pay more taxes than if you operated your business as a corporation or an LLC. Period.

Second, you are in business. Part-time or full-time, every business owner wants their business to grow and become more successful. However, if you are a sole proprietor, your business cannot grow to its full financial potential because it is limited by you. Look at the facts:

Sole Proprietorship vs. Corporation or LLC TAXES

If you are doing business as a sole pro-prietor, you will make money through-out the New Year and report that income at the end of the year. You will claim all expenses and deductions that you are eli-gible for, and the remainder will be your taxable net income. All of this income is now subject to self-employment tax. This is because there are only four ways in which income can come to the own-er of a sole proprietorship: cash, fringe

benefits, rent, and royalties. Therefore, almost every dollar of income is going to be taxed at the highest possible tax rate.

If you operated your business as a cor-poration or an LLC, even though you would make the same amount of in-come, the end result would be very dif-ferent. The tax code provides additional income reduction tools to the owners of corporations and LLC’s. It allows you to take income out of the business in six different ways: wages, fringe ben-efits, dividends and distributions, loans, rent, and royalties. As a result, you can change the character of the money that comes to you, and reduce your personal taxes!

Let’s look at the four most important ways your corporation or LLC can help reduce your personal taxes.

1. Wages

Wages consist of the income you take out of your business that pays you for your efforts. Wages are taxed at the same rates as a sole proprietor example. So at first there appears to be no difference between a sole proprietor and our entity. However, the owner of a corporation or LLC can regulate this income. So our owner here can have some of their life-style money taxed as wages, but can also take it out in a variety of other ways.

For instance, he could take some income out as wages, or he could flow the in-come into one of the other six categories mentioned above, so it can be taxed at a lower rate (if it is taxed at all). This

is called regulating income. The owner basically has the ability to change the character of money—an option the sole proprietor does not have because he or she has to declare their income as cash subject to self-employment tax.

2. Fringe Benefits

Fringe benefits are legislative tax rules that benefit business. They allow busi-nesses to write off non-traditional busi-ness expenses, such as health insurance and retirement plans. Corporations and LLC owners can claim and take these fringe benefits for themselves. Handled this way, the cost becomes a business expense. If you are a sole proprietor and you claimed the same fringe benefit, it would almost always be considered tax-able income to the owner for the exact same benefit!

3. Dividends and Distributions

A dividend or distribution is considered profit. This profit can be given to an owner throughout the year, or at the end of the year. The key with this type of in-come is the classification. Since it is not classified as wages, it is not subject to employment tax. Therefore, every dol-lar paid out as dividend saves the owner 15.3 percent—the going U.S. employ-ment tax rate.

4. Loans

A corporation or LLC is considered a separate legal person. Even though you are the owner, you can still interact with it like a separate person. Therefore, you can borrow money from your corpora-

tion or LLC. The obvious benefit is that any money you borrow is not considered taxable income. Sole proprietors cannot enjoy this benefit because they are not considered separate from their business.

Summary of Tax Benefits

The reality of business taxation is that there are just more opportunities to low-er your taxes for corporations and LLCs than there are for sole proprietorships. So it’s simply good business to learn the rules and take advantage of them. As a sole proprietor, you will always pay more in personal taxes. Period. Sole Proprietorship vs. Corporation

We all want our businesses to grow and become more successful. However, suc-cess and growth can be two different things. As we learned above, we can make the exact same amount of money as we made last year, but end up paying less in taxes if our business is structured

differently. Therefore, we could be more successful simply by keeping more of the money we make.

But growth is not simply expansion of the business. We can have our business grow independent of our efforts in our trade. Let me explain. Because your corporation or LLC is considered a separate legal person in the eyes of the law, it has the ability to grow independent of you. It can develop and expand its own financial identity. For example, it can establish credit for it-self, which is independent of the owner. That means your business has unlimited growth potential. The sole proprietor and their business are one and the same person. Therefore, a sole proprietor can-not create their own independence and grow financially without the owner.

Another interesting aspect of this sepa-ration concept is that any credit you have, as an individual, is considered a debt. Any credit the business establishes

for itself is an asset. If the business was ever sold, the credit it established would be added to the value of the business. This again is not available to the sole proprietor. This is one more of the many ways you can grow your business with-out making any more money!

Sole Proprietorship vs. Corporation or LLC Summary

If you want to make extra money and be-come more successful, you are better off operating your business as a corporation or LLC. Remember, part-time or full-time, this is a business. No matter how much time you spend in it, you always want to make sound business decisions.

Applying Title 24 Building Energy Efficiency Standards

As a PCCA member and architect spe-cializing in building performance, my primary role is helping contractors un-derstand and apply the Title 24 Build-ing Energy Efficiency Standards, in this case to a specific project.

A contractor recently asked for help in preparing a bid proposal for a new resi-dence based on drawings from the late 1990s. Drawings were limited to plans, elevations and sections for a 2,300 SF single story with a slab-on-grade foun-dation. Notes and specifications were minimal with no HVAC information other than a condenser pad for a stan-dard split system. He wanted to know the changes that would be needed to meet the 2008 Standards with the mini-mum number of HERS tests.

Despite three code cycles, we modeled the house based on the original draw-ings, suggested some design changes

and achieved compliance with only two HERS tests, refrigerant charge and duct leakage. In this case, the major change was a reduction in total glazed area to the maximum allowed without pen-alty (20% total and 5% west elevation of total conditioned floor area, Package D, Climate Zone 12). For example, we reduced window height from six feet to five feet (3060 to 3050) and an ex-ternal French door (modeled as a win-dow) from eight feet to seven feet (2680 to 2670). An alternative would be to maintain the original window areas with high performance Low-E, and more ex-pensive, glazing (a U-factor/SHGC from .38/.37 to say .34/.19).

In addition to the T-24 Report (CF-1R) meeting his requirements, we provided a summary of results, recommendations, alternatives, and tools that allowed him to modify the design and window sched-ule consistent with T-24 compliance.

This approach allowed the contractor flexibility in resolving the final design

and cost with the owner without the cost and time of referring back to us for a compliance check until the design is fi-nalized. Once we receive the final docu-ments, we can revise the model and is-sue the final T-24 Report. In the absence of any major design change we expect minimal revision. We will also be able to check compliance for any construc-tion changes, manage rebate applica-tions, and minimize the potential risk of cost and delay of HERS testing.

With each code cycle, the complexity of energy efficiency standards will increas-ingly affect building design, construction cost and project delivery. For example, according to the CEC (CA Energy Com-mission) the new 2013 Standards due out in 2014 will require 25% less energy for new residential (30% less for new non-residential). Since the CEC relies primar-ily on the construction industry to achieve their energy efficiency goals, contractors should select their project teams carefully to minimize the risks of non-compliance throughout the project cycle.

A Word To The Wise About Construction Defect

Possibly no two words strike more fear in the hearts of architects, engineers and contractors than “construction defect.” A claim for construction defect can cost astronomical amounts to correct and de-fend.

And then there’s the damage to your reputation and its impact on your future opportunities for work. It’s enough to break a business.

Construction Defect Risks

New technology, materials and applica-tions have changed the way commercial buildings, homes and condominiums are constructed.

Advances are enabling the design and construction of buildings that are more attractive and less costly. Yet, many of these advances have yet to be tested in real application over time, where prob-lems may be uncovered that were neveranticipated in the lab.

At the same time, new applications re-quire new skills from contractors, whomay overlook important requirements for installation or take shortcuts that cause devastating consequences.

When problems occur, it’s hard to know the cause without investigation, and everyone on the project is forced to be-come involved.

What new building materials are you using in your projects? Have you done your research? How confident are you in the manufacturer and the testing? Are you comfortable with the risk?

Types of Construction Defects

Generally, courts categorize construc-tion defects in one of four categories:

1. Design deficiencies typically relate tobuilding designs that do not meet code or perform to standard.

2. Material deficiencies occur when use of inferior materials causes significantproblems, such as when windows leak or fail to perform even when properly installed.

3. Construction deficiencies are prob-lems created by poor quality workman-ship.

4. Subsurface deficiencies usually in-volve cracked foundations or other structural damage caused when soil is not properly compacted and prepared for adequate drainage.

The goal of the court is to determine fault and damages, and require the party responsible for the defect to remedy the situation.

InsuranceUnder the standard commercial general liability (CGL) policy, your insurance company has a duty to defend you for

construction defect claims if any dam-ages are potentially covered under the policy. Coverage for construction defect only exists if there is an “occurrence” under the policy.

If the court finds against you and you are a subcontractor, the policy will fre-quently pay for property damage caused by the occurrence.

It does not, however, cover the costs to remedy your work – the faulty work-manship or material that led to the dam-age. In many cases, the cost to correct the construction defect will be greater than the actual property damages in-curred. Keep in mind that if you are a general contractor, the whole project is your work.

What You Can Do to Manage Your Risk

Many risks you face are not typically covered by insurance. In addition to insurance, you can reduce your risk through:

Risk ControlThe best way to avoid a construction de-fect claim is through quality construction. Work only with architects, engineers and contractors who have good reputations and a track record of performance. Don’t cut corners. Plan and perform work in the correct sequence and with proper super-vision. Be sure to document any and all plan changes. Organized records are criti-cal to your defense.

ADVERTISEMENT TO PREQUALIFIED PROPOSERS

Subject to conditions prescribed by the University of California, Davis, sealed proposals for a design build contract are invited from prequalified proposers for the following work: UC Davis Smart Lighting Initiative Phase 2, Project Number: 9521700.

Description of Work: The Work shall include all engineering, labor, material, tools, equipment, testing, inspection, commissioning and all necessary general conditions that may be reasonably inferred from the Contract Documents to provide all Design Work and Construction Work. The Work is to modify the lighting in approximately 40 buildings representing 2.5 million square feet to result in the highest lighting energy savings. The University’s initial studies indicate an overall 10-15 year payback period while maintaining good light quality and acceptable light levels is the best value. Proposers are expected to target these goals.

Maximum Acceptance Cost: $5,900,000.00.

The successful proposer and its subcontractors will be required to follow the nondiscrimination requirements set forth in the proposal documents and to pay prevailing wage rates at the location of the work. Contractor and every Subcontractor is required to submit certified payrolls and labor compliance documentation and shall use the FM International Labor Compliance Program software “LCPtrackerTM” provided by the University.

The successful proposer will be required to have the following California contractor’s license at the time of the proposal opening: “B” General Building or “C10” Electrical.

Every effort will be made to ensure that all persons have equal access to contracts and other business opportunities with the University within the limits imposed by law or University policy. Each Bidder may be required to show evidence of its equal employment opportunity policy.
