CONTRACTING OBJECTIVES
Have the Design-Builder take ownership in the project development early by including the initial engineering within the Design-Build scope of work
To establish a fair structure for the allocation of risk between the Design-Build Contractor and the Authority
To establish overall terms and conditions, including a fair system of incentives and disincentives, that will result in the Design-Build Contractor having a financial stake in completing the work
To establish a maximum price early with a bonus for delivery ahead of schedule

Include initial engineering activities as part of the Design-Build Contractor’s scope of work
Mitigate cost risk by establishing provisional sums for certain elements of the construction work such as;
• Utility Relocations/Rearrangements• Contaminated Soils/Hazardous Materials Remediation
Incentives/Disincentives• Cost Effective Design• Successful and Timely Completion of the Work• Sharing of under runs/over runs of the Provisional Sums• Liquidated damages
