27 EXTRAORDINARY DELEGATES CONFERENCE GENERAL SECRETARY'S REPORT (2012-2014) -------------------------------------------------------------------------- We are happy to report that it has been a challenging and fruitful term in office. NUJM now faces a strong wave of pressure from our various company managements and that is the hiring of new staff as executives with a slightly higher salary. Basically, it is a form of union busting. However, with the scoping test of NST complete. other unions too are heading towards that direction. UKSB, though has done the scoping test, it is still going through some challenges with their management. Sin Chew will possibly embark on a scoping test soon with the present of an in-house union overlapping the job scope of union members. Most notable is that we are no longer in deficit but have a surplus of RM41,235. This however must be improved with more fund raisings and less court cases. We have changed our lawyers. Sad to say, even if our previous lawyer was doing his job, he was overcharging us with advance payments, star rated hotels and expensive flights to Penang. Our new lawyer however is thrifty but will get the job done. To speak of collective agreement success, The Star signed its agreement before the expiry date, Sin Chew will now have five working days, and The Sun achieved a 13% increment. The exco has put a proposal that in the coming CAs, only union members should get their backdated salaries and this ought to be written in the CA. Non union members will still enjoy the benefits of the effective CA. As many may know that our struggle for online journalist to join us remains futile as it was rejected the second time by the RTU in disallowing us to amend our constitutions. If the RTU still rejects our proposal to this ammendmend, we will therefore take it for judicial review. However, we have not stopped our fight for press freedom in our voicing out of injustices done to journos locally and internationally. It is our duty as members of the press and as affiliate to IFJ to do so. We have made leaps and bounds on our international frontier. As a Reserve Adviser for Asia, we have raised the issues of press freedom in Malaysia and made known of it in the IFJ circuit. Within Asean, our active participation in Confederation of ASEAN Journalists has seen the gradual strengthening of CAJ with new members from Vietnam and Laos actively participating in it. In the near future, we hope to have short term courses for members to participate with speakers from our Asean region. Our construction of a learning centre is being built in Palembang, Indonesia. Over on the IFJ, we will be hosting the South East Asia Journalists Union (SEAJU) end of October, 2014. Under SEAJU, we aim to promote Malaysia as the headquarters for this union. The meeting will be held in Malacca. This will be the foundation meeting after the setup in Cambodia last year. As for workshops, we held the Gender Equity workshop last year. This month, IFJ will hold a Union Leaders Trainers Workshop for branch union leaders.

For our members here, we had the passing of a few members and donation was given to their families as well as to families who lost their homes in floods up north. We also held a Bowling tournament between the Union and the various management human resource department. We also invited our foreign delegates to our Anniversary Dinner. To note, this anniversary dinner was supposed to be held in 2012 as part of NUJ's Golden Jubilee Celebration. However, due to lack of concerted efforts, it was shelved. We have finally managed to organise and hold the dinner for past and present office bearers, for our branches' human resource departments as well as for our affiliate members of the public. The last time NUJ organised a press night was in 1991, almost 25 years ago. The Dinner was also held to recognise and offer our gratitude to past office bearers for their contribution towards the betterment of NUJ. We have also invited our colleagues from ASEAN who took part in our Press Freedom Forum, Anniversary Dinner and a trip to Penang to visit our Chief Minister Lim Guan Eng. Our trip to Penang was well organised by our Penang members. These are just the highlights of the one year and ten months the exco has been serving and we look forward to continue fighting for NUJM. In the next term, as part of a membership drive, we would be coming up with a booklet on membership and benefits of joining the union. It will be distributed to all NUJ branches. This would give non-members a clear understanding on what is a Union's role and benefits of becoming a member. We are also looking for some foreign journalists Unions to have exchange programmes like we used to do with the All China Journalists Organisation (ACJA) in the past. Our exchange programme with ACJA ended during the 2010-2012 period. The exchange programme would encourage more participation of branch members to go abroad to visit these organisations as part of union building and to exchanging ideas on Unionism and press freedom. 1. BRANCH BGMs All Branches held their 2014-2016 Biennial General Meetings on the following dates: a) NUJ-Sun Branch - April 15, 2014 b) NUJ-Utusan Karya Branch - April 18, 2014 c) NUJ-Star Branch - May 29, 2014 d) NUJ-Nanyang Branch - June 4, 2014 e) NUJ-NST Branch - June 16, 2014 f) NUJ-Utusan Branch - June 16, 2014 g) NUJ-Kwong Wah Branch - June 18, 2014 h) NUJ-Sin Chew Branch - June 20, 2014 10. COLLECTIVE AGREEMENTS Various Collective Agreements were signed with newspaper Managements during the period 2012-2014. 1. NST: 2014-2016 Collective Agreement was signed on June 13 2014.

2. STAR: NUJ-Star signed its 2013-2015 Collective agreement on December 12, 2012 but would take effect on February 1, 2013. Amendment to the CA date was done on 31 January, 2013 at ID Court Kuala Lumpur.

3. SUN: NUJ-SUN Collective Agreement 2013-2015 was signed on February 17 2014. Signing of Sun CA for amendment at Court was held on 4th June 2014.

4. KWONG WAH: On July 4, 2013 in Industrial Court of Malaysia pursuant to Section 26(2) of the IR Act 1967 resolved the matter between the two parties and awarded NUJ on the terms of the Collective Agreement 2010-2013. The terms of the CA are contained in the annexure which forms part of the award. (Award No. 1400 /2013. Award was handed down on 2 August 2013. New Collective Agreement for 2013-2016: : The Human Resources Minister through a decision made on August 4, 2014 referred the NUJ-Kwong Wah CA deadlock to the Industrial Court under Section 26(2)of the IR Act 1967. It will be mentioned in Court on 10th October 2014. 5. UTUSAN KARYA: The NUJ-Utusan Karya 2011-2013 Collective Agreement was signed on November 14, 2012. The CA was delayed. NUJ withdrew its complain with the IRD against the management on July 2012 after the management agreed to NUJ's terms. The 2014-2016 CA deadlock has been passed on to the IRD on 10 February 2014. The HR Minister on September 3, 2014 referred the case to the ID Court. Mentioned will be held on October 16, 2014. 6. NANYANG: The NUJ-Nanyang Collective Agreement of 2013-2015 was signed on 23rd July 2013. 7. SIN CHEW: The Branch and management met a deadlock over Clause 4 and 39 of the new CA 2011-2013.The Award under the ID Court was handed down in favour of the Union on May 8, 2014. However Union Lawyer has informed to put the two

clauses in abeyance and was agreed by the Company lawyer to sign the CA and leave the two Clauses for Judicial review. The CA of 2014-2016 was signed on September 15, 2014 attaching a MOU to keep the above clauses in abeyance until the decision given by the High Court. 8. UTUSAN MELAYU: NUJ-Utusan Melayu (M) Berhad Collective Agreement of 2011-2014 expired on July 31, 2014. Negotiations for renewal of new CA 2014-2017 met a deadlock. Under IRD arbitration which both parties met on August 26,2014, the Union resubmitted a revised CA draft on September 4, 2014 upon both parties' agreement during the IRD tripartite meeting. Another meeting was held on 10 September 2014 upon the resubmission of the CA.

11. TRADE UNION EDUCATION/MEETINGS/SEMINARS/EVENTS A. CENTRAL WORKING COMMITTEE MEETING WITH BRANCH HR MANAGERS: A cordial visits to HRs was held; 28 November, 2012 with HR Nanyang; 29 November to HR Star and 30 November to HR Utusan. B. CORDIAL VISITS TO IRD KL AND RTU SHAH ALAM: President, Vice President Mohd Taufek, General Secretary, Deputy General Secretaries and General Treasurer had a cordial meeting with IR officer Puan Salma at KL office on 3 December, 2012 in the morning and met RTU Director Puan Anita and En Syahrin in Shah Alam in the evening. Meeting also served to introduce NUJ’s new office bearers. C. CONFERENCE ORGANISED BY ATTORNEY GENERAL'S CHAMBERS: President, Vice-President Mr. Taufek Razak and Mr. Nor Azmi attended as participants in the Conference on Transformation Security Relating to Legal and Human Rights, held at the Royale Chulan Hotel Kuala Lumpur from 14 to 16 January, 2013 This conference was a collaboration between AGC, the Razak School of Government and the Malaysian Institute of Translation and Books. D. THE NISSAN LIGHTFOOT QUEST 2013: Edaran Tan Chong Motor Sdn Bhd once again organized the Nissan Lightfoot Quest 2013 and invited two NUJ officials to sit in as scrutineers. Sdr Taufek and Sdr Schave participated in the event on 16 and 17 March. Nissan has contributed RM4,000 to NUJ for our assistance. E. NUJ-IGP MEETING: NUJ CWC President, Vice Presidents, GS Dep Secretary Hidhir and Sdr Baha attended a meeting with the IGP on 15 April. The meeting was to discuss on the safety of journalists covering news during the 13th General Election. F. SUHAKAM INVITE: President attended a half day session SUHAKAM meeting on the International Covenant on Civil and Political Rights (ICCPR) on April 18 2013. It viewed the ICCPR's objectives as well as its suggestions and the government could implement. G. WORLD PRESS FREEDOM DAY FORUM: Asian Institute for Development Corporation (AIDCOM) invites President and GS to a Forum to commemorate World Press Freedom Day. at 10.00 am on May 3, 2013 at Kumpulan Media Karangkraf. Theme: “Safe to Speak: Securing Freedom of Expression in All Media” Keynote Speaker Professor Andi Faisal Bakti, Ph.D. Dean, Faculty of Communication, Universitas Pancasila, Jakarta, Indonesia. The forum is jointly organised by AIDCOM and UNISEL in collaboration with Sinar Harian. H. TETAMU JEMPUTAN PROGRAM "BERSAMA WARTAWAN" DI BERNAMA RADIO 24: Sdr Taufek attended the above on May 26. he spoke on press freedom in Malaysia. I. NUJ-PRESS BOWLING TOURNAMENT: It was held at Sunway Pyramid on August 25. Collaboration from Kelab Sukan SportsUnite chairman Dato' Dina. 32 teams (3 players per team (96 members) ) took part in the event. J. COURSE ON PEACEFUL ASSEMBLY ACT 2012- President attended the discussion on as session panelist for Panel Discussion - “Peaceful assembly: Is it still a challenge?” on August 28, 2013. It was organised by Judicial and Legal Training Institute (ILKAP), JPM K. 2012 WORLD PRESS FREEDOM DAY FORUM (3 MAY 2012): NUJ-Utusan organised the forum with UNISEL (Universiti Selangor) College in collaboration with AIDCOM at UNISEL Shah Alam. The theme for this year as declared by UNESCO was “New Voices: Media Freedom Helping to Transform Societies”. GS was one of the panel members. L. MAJLIS APRESIASI BERSAMA MEDIA: Vice President Sdr Taufek attended the event on November 21 at Sime Darby Convention Centre Bukit Kiara KL. This event was for media hosted by Ketua Setiausaha Negara YBhg. Tan Sri Dr. Ali bin Hamsa.

M. SUHAKAM MEETING: SESI DIALOG BERSAMA MEDIA was held on 23 January 2014 at SUHAKAM office Menara TH Perdana. President attended. N. NUJ- UITM PRESS FREEDOM FORUM 2014: It was held at UiTM Shah Alam on 3rd May 2014 from 9:00-1:00pm. Theme: NUJ-UiTM Press Freedom Forum: Press Freedom in ASEAN; Ahead or in Reverse?. Panelists were Ms Rowena Carranza Paraan (NUJ Philippines), Mr Oon Ee Seng (Former GS NUJ), Tan Sri Ramon Navaratnam (ASLI), Prof Zaharom Nain (University of Nottingham), Prof Murad Merican (University Technology Petronas) and Mr Roger Cheng (Bar Council co Chairman Human Rights). Moderator was NUJ former president Sdri Norila Daud. The forum was officiated by Dean, Faculty of Communication & Media Studies UiTM Prof. Dr. Azizul Halim Yahya, O. NUJ-CAJ PENANG VISIT: It was attended by NUJ CWC, excos from Kwong Wah, Utusan and Sun while CAJ/ASEAN delegates comprised of Mr Arulnathan John (SNUJ President), Ms Mindy Kwok (SNUJ GS), Mr Teguh Santosa and Mr Bapak Wina Armada Sukardi (PWI), Ms. Adena Mahavong (LJA), Mrs. Marta Dianta Silahi (CAJ Secretariat), Mr. Phann Ana (Cambodia) and Ms. Rowena Carranza Paraan (NUJP). Penang Programme were Courtesy Visit to Chief Minister of Penang, Tours arranged by Penang Global Tourism & George Town World Heritage Inc and Dinner hosted by Penang Chinese Newspaper Reporters & Photographers Association. P. MTUC WORKSHOPS AND SEMINARS:

Being an affiliate to MTUC, NUJ sends its members to the workshops and seminars organised by MTUC in co-operation with the International Labour Organisation. MTUC is pursuing its efforts to establish the following: a) minimum wage law; b) 5-day work; c) increase in rates of EPF contribution and SOCSO benefits; d) amendments to the present labour laws – Employment Act, Trade Union Act and Industrial Relations Act; e) lifting of restrictions for the formation of bigger unions by workers from related trades; f) organising the large number of workers yet to be organised including workers in the Free Trade Zone Area; g) influx of guest workers; h) retraining for retrenched workers, re-employment of retrenched workers.

i. 4-6 December 2012 - MTUC/SOCSO National Conference “ overcoming Stress at

Workplace” : General Secretary attended the conference held at Genting View Resort.

ii. 3 March, 2013 - MTUC Council Meeting: General Secretary Schave attended a special MTUC

council meeting. MTUC General Secretary En Abdul Halim bin Mansur was asked to step down with a

vote of no-confidence by council members. He was replaced by N. Gopal Krishnan of NUTEAIW

(National Union of Transport Equipment and Allied Industries Workers). However, there have been

protest letters from several unions rejecting the appointment. iii. 31 March, 2013 - MTUC Council Meeting: Sdr Taufek attended the meeting at Subang Jaya.

iv. 2-6 September, 2013 - CA & IR COURSE: President Chin attended the CA and Industrial Course

at MTUC Subang Jaya.

v. 27 October, 2013 - MTUC Youth Convention: - Sdr Hidhir attended the Convention.

vi. 8-10 October, 0213 - Kursus OSH: Setiausaha NUJ-Utusan Sdr Muhamamd Basir telah

menghadiri satu Konferen Occupational Safety and Health (OSH) yang dianjurkan oleh MTUC di

Genting Highlands.

vii. October 30, 2013 - CA & IR Course: Workshop on Industrial Court - Preparation of Statement

of Case: "Skills in Preparation of Statement of Case" for Industrial Court Practitioners. President,

Vice President Sdr Taufek and GS Sdr Schave attended the course on at MTUC Subang Jaya.

viii. 18 November, 2013 - NUJ-MTUC Collective Agreement Workshop: The workshop was held

by NUJ and MTUC. 10 NUJ members attended the workshop. MTUC President and Vice President

were the trainers and speakers for the day. From UKB Firhat Yasir Omar Sudi & Azman Taha; from

Sun - Karen Arukesamy & Kogulan Ayappan; from Utusan - Muhammmad Basir Abu Bakar, Abdul

12. PRESS STATEMENTS A. NOVEMBER 6, 2012: CONSENT AWARD - CONTRACT WORKERS ISSUE SETTLED OUT OF COURT: The National Union of Journalists issued a press statement announcing that it has arrived at a consensus with Kwong Wah Yit Poh’s employer to settle the contract system issue that was referred to the Industrial Court earlier in the year. This follows an out of Court settlement reached between both parties whereby the Company agrees that all Fixed Term Contract employees fall within the scope of the Union representation and scope of the Collective Agreement between the company and the Union. B. FEBRUARY 20, 2013 The National Union of Journalists Utusan Branch issued a press statement inviting members of the press on Judicial review of NUJ-Utusan Bonus Case C. MARCH 18, 2013 The National Union Of Journalists Penisular Malaysia (NUJM) in its press statement condemning the PDRM for threatening a journalist from The Star , for her refusal to divulge her sources in connection with her news report. D. MARCH 19 2013 - NUJ URGES COPS TO STOP INTIMIDATION OF JOURNALIST OVER STORY SOURCE PETALING JAYA: The National Union of Journalists (NUJ) has issued another statement calling on the police to stop intimidating a journalist into revealing her source. NUJ president said it was improper for the police to ask a journalist to reveal a source. E. APRIL 4, 2013- FAIR REPORTING: The National Union of Journalists Peninsular Malaysia (NUJM) called all members and media practitioners to continue reporting fairly and truthfully in accordance to the Journalists’ Code of Professional Conduct while carrying their duty during the May 8 2013, 13th General Election. about the meeting the Union had with the IGP of Police who promised journalists' safety during the event. H. MAY 3, 2013 - NUJ PRESS STATEMENT IN CONJUNCTION WITH WORLD PRESS FREEDOM DAY MAY 3: In conjunction with May 3, 2013 World Press Freedom Day, the NUJ urged the incoming government to repeal the 1984 Printing, Presses and Publishing Act (PPPA) and other relevant laws and regulations that curb the freedom of the press in the country in liaise with its democratic process. The NUJ made a statement that during the 13th General Elections on May 5, journalists must uphold their professional conducts, to advocate impartial neutral news coverage of the ruling and opposition parties alike in order to meet the public's right to know. I.MAY 9, 2014 - National Union of Journalists Malaysia (NUJ) reproached Utusan Malaysia newspaper for highlighting a racial tainted issue with the heading "Apa Lagi Cina Mahu?" and two photographs of locals in a peaceful gathering in Taiwan and Mid Valley Megamall on the paper's front page. J. MAY 23, 2013 - The National Union of Journalists (NUJ) condemned the attack on reporters by an unruly group, believed to be sent to distrupt a candlelight vigil attended by more than 100 non-governmental organisation (NGO) members, students, social activists and several state Pakatan Rakyat leaders held in Esplanade Penang on May 22, 2013 to show solidarity for student activist Adam Adli Abdul Halim who was arrested on Saturday (May 18) for alleged offences under the Sedition Act. Oriental Daily's reporter Ooi Chun Nam and Sin Chew Daily reporter Cheah Chin Liang were assaulted by the group when they tried to help vigil organiser Sean Ho from being run over by an attacker on a motorcycle. In the same statement NUJ also condemned and strongly urged the police to investigate the attack by an unruly group in a similar gathering on Monday at the University Sains Malaysia's Sungai Dua where two more journalists from Malaysikini and Nanyang Siang Pau's were also attacked and hit on their arms by while they were taking photographs. K. FEBRUARY 13, 2014 - The NUJ urged the government to repeal the 1984 Printing, Presses and Publishing Act (PPPA) and other relevant laws and regulations that curb the freedom of the press in the country in liaise with its democratic process. The NUJ stated that during the thirteenth General Elections which took place on May 5, 2013, the new BN government was supposed to seriously look at the various draconian laws that constrict press freedom and threaten journalists, to make the desired changes in restructuring and reforms possible to advocate impartial neutral news coverage in order to meet the public's right to know. The statement was in view of the Reporters San Frontieres (Reporters Without Borders) press freedom index 2013 which indicated that Malaysia's press freedom was ranked 147th out of 179 countries compared to 123 in 2011/2012. This sharp fall should sound an alarm. Malaysia has fallen to its lowest-ever position because access to information is becoming more and more limited. In the statement NUJ also strongly opposed media manipulation by political parties or government monopoly, especially when the press freedom ranking we have seen is closely related to the government of a country that is not epitomizing democratic openness. L. MEI 30, 2014 - UTUSAN AKHBAR PERJUANGAN NEGARA: Majlis Eksekutif Kesatuan Kebangsaan Wartawan Semenanjung Malaysia di dalam satu kenyataan akhbar secara kolektif melahirkan rasa kecewa dengan kenyataan Setiausaha Agong DAP, Lim Guan Eng yang menuduh akhbar aspirasi kebangsaan negara Utusan Malaysia sebagai rasis dan ekstrimis. M. SEPTEMBER 2, 2014 - ATTACK ON PHOTOGRAPHER: NUJ Malaysia statement strongly condemning the attack against NUJ member Saudara Aizuddin, a photographer from NST branch while doing his work who suffered a bleeding nose

and damaged camera after being beaten by a MH 17 victim's family. NUJ said it would not tolerate any kind of uncivilized violence especially when it pertains to carrying out work as journalist and urged the law enforcers to look into this matter and conduct the proper investigation as soon as possible.. N. SEPTEMBER 5, 2014 - The NUJ strongly condemned the inquiry by the police to investigate Malaysiakini reporter Susan Loone under Section 4 (1)(C) of the Sedition Act 1948. Susan was merely doing her job as a reporter when she was arrested after being questioned over her phone interview with an exco of the Penang State Government, in which he was quoted as saying that he had been “treated like a criminal” while in detention. Her article was published on the news portal on September 1, allegedly defaming the police. O. SEPTEMBER 8, 2014: The NUJ issued a letter to the KDN Minister YB Dato' Seri Dr. Ahmad Zahid Hamidi expressing its regret and concern over Malaysiakini journalists Susan Loone who was arrested under the Sedition Act 1948. NUJ expressed that Susan Loone's detention under the Sedition Act was outrageous and very contrary to what has been mooted by by YAB Prime Minister in the past concerning press freedom that reporters must be free and not be afraid to report the truth.

13. INTERNATIONAL RELATIONS The Union's international relations activities are concentrated within the sphere of the International Federation of Journalists (IFJ), the Asia Journalists Association (AJA) and the Confederation of ASEAN Journalists (CAJ). Through the international network of the IFJ, the Union maintains close ties with more than 161 member unions and journalistic organisations worldwide. The IFJ works closely with the United Nations, particularly UNESCO, the United Nations Human Rights Commission, WIPO and the ILO, the International Committee of the Red Cross, the European Union, the Council of Europe and other similar bodies. Today the Federation represents around 600,000 members in more than 100 countries. Through the regional and international network of the CAJ, NUJM has maintained close rapport with its partners in the ASEAN as well as the Asia-Pacific region. i. INTERNATIONAL FEDERATION OF JOURNALISTS (IFJ) A) IFJ CONGRESS 2013: General Secretary attended the International Federation of Journalists (IFJ) World Congress which was held in Dublin, Ireland from 2 to 8 June, 2013. He was elected reserved IFJ adviser for Asia Region. Earlier Sdr. Schave was also appointed as steering committee for IFJ Asia Pacific replacing former GS Anba. B) IFJ TRAINERS WORKSHOP AND IFEX MEETING: President attended the IFJ workshop which was held in Phnom Penh, Cambodia from 15 to 18 June, 2013. He presented a country report during the workshop. Vice President Sdr Taufek and GS Sdr Schave attended the IFJ workshop on 16 -17 June and continued for the IFEX meeting from 19 - 21 June, 2013. C) Subsequently in June 24, 2013 A Media Release was issued to the Asia Pacific Region by the IFJ concerning the Media Unions in Southeast Asia forming an alliance to advance journalists' welfare, freedom of the press and expression. Journalist unions from five Southeast Asian countries made history on June 17 2013 in Phnom Penh, Cambodia by forming a regional alliance to defend press freedom and safeguard the safety and welfare of journalists. meeting and workshop was with the International Federation of Journalists (IFJ) and South East Asia affiliates in Phnom Penh, Cambodia between 16 and 18 June 2013 to create solidarity and a stronger regional network. The Phnom Penh Declaration announced the formation of the Southeast Asian Journalist Unions or SEAJU, which counts National Union of Journalists of the Philippines(NUJP), The Indonesian Alliance of Journalists( AJI) , Cambodian Association for the Protection of Journalists(CAPJ), The National Union of Journalists Malaysia(NUJM), and Myanmar Journalists Association(MJA) are all affiliates of the IFJ. D) IFJ - GENDER EQUITY WORKSHOP : 16 participants attended the one-day International Federation of Journalists (IFJ) Gender Equity Workshop that was held at Hotel Maya on 28 October 2013. Its Facilitator was IFJ Deputy Director Ms Jane Worthington. E) NOVEMBER 1, 2013 - NUJ CONDEMNS THE DETENTION OF ASIA-PACIFIC DIRECTORS ON 30 OCTOBER 2013: Letter to President Mahinda Rajapaksa Democratic Socialist Republic of Sri Lanka C/o High Commission of the Democratic Socialist Republic of Sri Lanka in Kuala Lumpur. The International Federation of Journalists condemns the detention of Asia-Pacific Director Jacqui Park and Asia-Pacific Deputy Director Jane Worthington in Sri Lanka. The two have recently been allowed to leave after being detained without charge since Wednesday October 30. Ms Park and Ms Worthington were detained at a press freedom meeting in Colombo and were held in their hotel and subjected to lengthy interrogation by defence and immigration officials and the Criminal Investigation Department. F) IFJ EXECUTIVE COMMITTEE MEETING: GS who is the reserved adviser for IFJ Asia Pacific attended a meeting in Brussels from 8 -11 November, 2013. This meeting was held also in conjunction with the unlawful detainment of IFJ Director Jacqueline Park and Deputy Director Jane Worthington in Sri Lanka on 29 -31 October by its government. The meeting also discussed about ending journalist impunity around the world.

G) NOVEMBER 21, 2013 -LETTERS TO HIGH COMMISSIONER OF PAKISTAN AND AMBASSADOR OF THE PHILIPPINES : International Day to End Impunity. The NUJ wrote letters to the High Commissioner as the representative of the government of Pakistan and the Ambassador of the Philippines as part of the IFJ worldwide campaign to protest against the lethal violence targeting journalists going about their jobs and the failure to bring the perpetrators of that violence to justice and because Pakistan and the Philippines (Ampatuan Massacre) have troubling records of violence against journalists and subsequent impunity for those responsible. H) FEBRUARY 25, 2014 - AL-JAZEERA JOURNALISTS ARRESTS: NUJ-IFJ Letter to Ambassador of Egypt in Kuala Lumpur demanding an end to the intimidation of journalists and media suppression in Egypt and to call for the immediate release of all detained journalists of the Al Jazeera news. The letter was part of a worldwide pressure on the Egyptian government to release the journalists who were facing charges that could see the foreign journalists up to seven years in jail while Egyptian journalists up to 15 years. NUJ strongly urged the Egyptian government to release the detained journalists. ii. CONFEDERATION OF ASEAN JOURNALISTS (CAJ) The Union maintains a close relationship with media organisations in ASEAN through the CAJ network. A) HARI PERS 2013 - PWI INVITATION 7-10 February 2013: It was held in the city of Manado, North Sulawesi Province. President, Vice President Noor Azmi and General Secretary attended the meeting.

B) CAJ 17 GENERAL ASSEMBLY: President and GS attended the Assembly in Manila from 21 to 24 November, 2013. The Presidency and Secretary post which NUJM was holding since 2009 was transferred to NPC now until the next General Assembly. C) HARI PERS PWI 2014: Indonesia Press Day Commemoration will be held in Palembang, Sumatra Indonesia from 7 - 12 February, 2014. President, GS, Sdri KY and Sdri Wern Jun will be attending. Flight from Jakarta to Palembang will be sponsored and handled by the PWI counterpart. D) CAJ BOARD OF DIRECTORS' MEETING: It was held September 11-14, 2014 in Hanoi, Vietnam. President Chin and GS Schave attended. iii. NIHON SHINBUN KYOKAI-CAJ FELLOWSHIP PROGRAMME (NSK) A) 34TH NSK FELLOWHIP PROGRAMME: Sdri K.Y Leong of Kwong Wah attended the NSK-CAJ fellowship in Tokyo from 26 September 2014 to 6 October 2014. B) Due to financial constraint, under the new NSK policy the Union will only attend the programme on alternate years. iv. OTHERS

A) MEETING IN BANGKOK: President attended a meeting on Establishment of ASEAN Press Council which was held in Bangkok from 23-25 May 2013. It was organised by the Nation Press Council of Thailand (NPCT). A joint statement for the establishment of an ASEAN Press Council was signed. B) IFEX MEETING: Sdr Taufek and Sdr Schave attended the IFEX (International Freedom of Expression Exchange) workshop on 19 - 21 June, 2013. It was attended by all involved in media industry regardless of union members or otherwise. C) MEETING WITH THAI DELEGATES: 8 Thai journalists headed by Mr Chavarong of the Confederation of Thai Journalists (CTJ) met the NUJ CWC on May 17, 2013 to discuss on ASEAN and also about Malaysian press issues. The group also visited NSTP earlier. Later NUJ sponsored dinner for them. D) INVITATION: Taipei Economic And Cultural Office invited CWC to the 102 Anniversary of PRC National Day on Wed. 9th Oct 2013 at 7:30-9:30pm at Mayang Sari Grand Ballroom JW Marriot KL. 14. NUJ 52ND ANNIVERSARY DINNER Held at Hotel Armada on 3rd May, 2014. 81 guests including CAJ/ASEAN officials, former office bearers. NUJ excos and branch members attended. VIP was Tan Sri Ramon Navaratnam. Awards were bestowed upon Presidents Datuk Yazid, Abdullah Tahir, Norila Daud and Chin; GS awards Oon Ee Seng and Schave (Bob Teoh, Hong Boon How and V. Anbalagan were absent) while General Treasurer's award bestowed to Hayat Sueet, Norila, Martin Vengadesan, Saiful Hizam Mansor and Baharudin (Habsah Dinin was absent) Special awards for Vice President Sdr Taufek (unfortunately he couldn't attend the dinner due to an emergency situation); for former vice president Sdr Rupa Damodaran for her contribution towards the Union; Posthumous award for former vice president Cheah Kee Ling whom his widow Angie Ng received. Former President Norila received the CAJ award while two NUJ employees Richard and Esther were also awarded for their long term service to the Union. The Last time NUJ held the Anniversary dinner was 24 years ago in 1990. The event was supposed to be held in 2012 during NUJ's Golden Jubilee year but was shelved.

15. JOURNALISTS’ WELFARE FUND NUJ initiated the NUJ Welfare Fund based upon the module given by the Registrar of Trade Unions. The 17th Delegates Conference tabled the motion for consent on September 16, 2010. The RTU gave its approval in February 2011 and the fund was officially established on April 1 2011. From 01.04 2012 to 31.03.2014 number of retirement recipients is 11 (RM5,500.00), Hospitalisation 2 RM140.00 and Condolences 2(RM1,000.00). 16. BRANCH REPORTS I. NEW STRAITS TIMES BRANCH REPORT Oleh Setiausaha NUJ Cawangan NSTP: Sdri Mona Ahmad 1. Pada 15 Mei 2013, NUJ NST diwakili Sdr Anbalagan, Sdri Suriani dan Sdri Habsah menghadiri Mesyuarat Pemeriksaan Penguatkuasaan Perhubungan Seksyen 57 dan 64 (2)(a) Akta Kesatuan Sekerja 1959) di Jabatan Hal Ehwal Kesatuan Sekerja Selangor dan Wilayah Persekutuan di Shah Alam, Selangor. 2. Isu skoping: Ujian skoping yang diadakan pada 9 Januari dan 18 Januari 2013 di pejabat NSTP. Pada 16 Mei 2013, NUJ NST diwakili Pengerusi, Sdri V Anbalagan, Timbalan Pengerusi, Sdri Zalifah Mohd Yatim dan Bendahari, Sdri Habsah Dinin menghadirkan diri dalam rundingan bersama isu skoping bertempat di Jabatan Perhubungan Industri, Putrajaya. Pada 24 Disember 2013, pertikaian NUJ dengan NSTP berhubung Isu skop keahlian kesaatuan bagi jawatan eksekutif selesai. Eksekutif dan sulit atau keselamatan, Pihak pengurusan NSTP berjanji akan melihat perkara ini terutama yang membabitkan kira-kira 60 Graphic Artist yang sepatutnya termasuk dalam kakitangan BARGAINABLE. 3. Pada 27 Jun 2013 Pengerusi NUJ NSTP, V Anbalagan mengumumkan perletakan jawatan sebagai Pengerusi NUJ NSTP berkuatkuasa serta merta kerana beliau berhenti daripada berkhidmat dengan NST. Beliau meletakkan jawatan dalam syarikat untuk beralih kepada syarikat lain iaitu Malaysian Insider. Bagi menggantikan tempat Sdr Anbalagan, Sdr Sritharan mencadangkan Sdri Zalifah Mohd Yatim menggantikannya dan disokong Sdri Suriani Mohd Hanif. 4. Pada 23 Julai 2013, Pengerusi, Timbalan Pengerusi, Bendahari dan Setiausaha dijemput mengadakan pertemuan dengan JCC yang terdiri GM HR Media Prima, Puan Norazlin, Hj Wahab, Sharmini dan Valeria dan exco NUNW. Pertemuan itu berkaitan dengan umur persaraan,. Syarikat mendapat kebenaran daripada Kementerian Sumber Manusia untuk menangguhkan pelaksaanan umur pesaraan sehingga 60 tahun mulai 1 Januari 2014. NUJ NST turut mengemukakan isu seorang ahli, Meenachi yang tarikh lahirnya jatuh pada 28 Disember. Dia sepatut bersara tahun ini tetapi beliau merayu untuk melanjutkan sehingga 60 tahun.

Syarikat berkata beliau mesti bersara dan boleh memohon untuk kontrak tetapi bergantung kepada kekosongan. 5. Pada 16 dan 17 Disember 2013, dua wakil dari NUJ iaitu Sdri Zalifah dan Sdr Muhammad Asraf menghadiri latihan dengan pihak pengurusan di NSTP. Menerusi latihan dua hari itu banyak perkara yang dibangkitkan dan ditimbulkan. Antaranya, pekerja tidak boleh sewenang tidak hadir ke pejabat dengan hanya memaklumkan kepada rakan atau kerani. Ketidakhadiran perlu dimaklumkan kepada penyelia.. Ketua berhak memotong gaji jika curiga dengan alasan yang dikemukakan. Banyak isu termasuk hal ahli yang kebanyakan tidak diketahui ketua turut dibangkitkan termasuk perpindahan dengan notis kurang dua minggu. Dari segi KPI, sebagai pekerja kita ada hak untuk membuat salinan laporan KPI. 6. Pada 6 Januari 2014 satu taklimat Townhall diadakan dengan Group Editor BH, En Mahfar Ali dan GE NSTP Datuk Jalil. Wakil NUJ, Sdr Osman Lisut dan Sdri Mona membangkitkan mengapa gred Special tidak lagi ditawarkan sedangkan ia termaktub dalam CA. En Mahfar memberi alasan itu untuk ketua wartawan. Tetapi syarikat akan menilai semula untuk menwujudkan barisan perkembangan kerjaya wartawan yang enggan memasuki bahagian pentadbiran tetapi lebih gemar untuk menulis. Sdi Sri Intan adalah contoh daripada pengurusan M3 yang kini tdak melakukan kerja pentadbiran dan pengurusan tetapi lebih menumpukan kepada penghasilan rencana berkualiti.

7. Draf perjanjian bersama siap sepenuhnya dan sudah dihantar kepada pihak pengurusan pada NSTP . Bagaimanapun ada beberapa pindaan yang dibuat pada Artikel 5,6 dan & berhubung kenaikan tahunan. Syarikat menetapkan empat kali perjumpaan untuk membincangkan mengenai Perjanjian Bersama (CA) iaitu pada: 1) 3 April 2014; 2) 8 April 2014; 3) 24 April 2014; 4) 6 Mei 2014 Pada 13 Jun 2014, Perjanjian Bersama 2014-2016 ditandatangani antara NUJ dan NSTP. 8. Isu berbangkit Jurugambar

- Pada 5 November 2013, wakil NUJ mengadakan perjumpaan dengan kira-kira 20 jurugambar. Wakil NUJ, Sdri Sti Nuibaiyah, Sdri Suriani dan Sdr Dwan Lin Lee. Antara isu yang dibangkitkan pihak jurugambar adalah ketidakpuashati mengenai KPI, mengisi buku log, arahan merakam gambar video yang menggangu tumpuan kerja merakam gambar tetap, kelemahan sistem arkib, arahan bekerja tujuh hari tanpa cuti, tiada perkembangan kerjaya, ketua sering mengungut jurugambar dan permit kerja di Sabah tidak diuruskan syarikat.

- Rentetan daripada itu, pada 30 Januari 2014, wakil NUj yang terdiri dari Sdri Siti Nurbaiyah, Sdri Mona dan Sdri Suriani mengadakan pertemuan dengan Datuk Abdul Jalil Abdul Hamid (managing Group Editor) untuk membincangan perkara yang sama.

- Datuk Abdul Jalil berjanji akan melihat perkara itu dan mahu berjumpa empat mata dengan jurugambar. 11 Februari ditetapkan sebagai tarikh pertemuan antara Datuk Jalil dan jurugambar di Bilik Latihan NSTP jam 8 malam.

- Pada 11 Februari 2014, seramai 32 jurugambar menghadiri pertemuan empat mata dengan Datuk Abdul Jalil di Bilik Latihan NSTP jam 8 malam. Perkara yang sama dibangkitkan. Datuk Abdul Jalil berjanji akan bertemu dengan Ketua Unit Foto untuk menyelesaikan perkara ini.

- Pada 20 Februari 2014, wakil NUJ, Sdri Mona, Sdri Habsah dan Sdri Siti Nurbaiyah berjumpa dengan Ketua Unit Foto, En Khairudin untuk

mendapatkan penyelesaian terhadap isu jurugambar. Hadir sama, En Khairul Ghazali.

- Antara jawapan dari En Khairudin mengenai jadual adalah ada jurugambar yang memohon untuk mengambil off day panjang untuk menjenguk keluarga dan sanggup bekerja dalam tempoh panjang. Beliau memberi tahu setiap hari ada 150 tugasan yang memerlukan sekurang-kurang 12 jurugambar siang dan empat jurugambar malam.

- Mengenai rakaman video masuk dalam KPI, Beliau mendakwa ada sesetangah jurugambar tidak menghantar rakaman video langsung. Syarikat mempunyai rancangan jangka panjang melengkapkan jurugambar dengan kemahiran merakam video dan menjadi serba boleh.

- Beliau mendakwa sikap tidak mahu berubah dan belajar menyebabkan jurugambar merasa terbeban.

- Isu kenaikan pangkat. En Khairudin mendakwa pihak pengurusan syarikat menyatakan tiada Special Gred.

- Isu datang lewat dan disiplin jurugambar turut dibangkitkan pihak pengurusan,

- Isu claim buku yang tidak ditandatangani supervisor kerana buku kanak-kanak.

- Syarikat memberikan laptop dan broadband tetapi tidak digunakan sewajarnya.

- Pihak pengurusan akan menjalankan latihan bagi meningkatkan kemahiran jurugambar.

- Pada Majlis Minum Petang dengan CEO dengan wakil NUJ dan NUNW pada 21 Februari 2014. Puan Arzlin dari HR dan Cik Sharmini, Pegawai IR berkata pihak pengurusan akan mengadakan latihan hak pekerja dan majikan kepada jurugambar bagi membolehkan isu yang dibangkitkan diselesaikan.

9. Pihak NUJ sudah mewujudkan akaun Facebook dengan alamat [email protected]. Ahli boleh mendapatkan maklumat terkini mengenai aktiviti atau pengumuman menerusi FB ini. 10. Pada 28 Jun 2014, NSTP dengan kerjasama NUJ dan NUNW mengadakan majlis Hari Pekerja. NUj menaja cendol, kuih muih dan pulut kuning. II. LAPORAN CAWANGAN UTUSAN Berikut adalah antara penglibatan kesatuan dalam menangani pelbagai isu dan aktiviti yang dijalankan kesatuan sepanjang penggal 2012-2014. Mesyuarat Pertama: Pada 24 Mei 2012 barisan Ahli Jawatan Kuasa NUJ-UM sesi 2012-2014 telah mengadakan mesyuarat pertama AJK NUJ-UM atau exco di Pejabat NUJ Malaysia, di alamat: 30B, Jalan Padang Belia, Kuala Lumpur. 2. Baju dan stiker NUJUM: NUJUM pada tahun 2011 telah membuat kira-kira 200 helai baju NUJUM untuk ahli. Rupa bentuk baju seperti baju biru pekat dan kelabu dengan kain lembut. Bajet harga baju adalah RM56. Ahli diperlukan untuk membayar RM10 dan lebihan kos akan ditanggung oleh NUJ-UM. 3. Mesyuarat Jawatankuasa Bersama (JCC) Perjanjian Kolektif (CA) 2011-2014: Pada 21 Jun 2012 exco NUJ-UM hadir kesinambungan JCC CA 2011-2014 yang telah dimeterai dan dalam proses kiraan tunggakan gaji. Selain itu turut dibincangkan beberapa perkara berbangkit.

4. Tabung Kebajikan: Gerak kerja mendapatkan dana untuk Tabung Kebajkan NUJ-UM sesi 2012-2014: Gerak kerja mencari dana untuk Tabung Kebajikan sesi kali ini digerakan oleh Setiausaha NUJ-UM, Muhammad Basir Abu Bakar. Gerak kerja mencari dana itu telah bermula pada bulan Julai 2012 dan akan berjalan sepanjang sesi 2012-2014 bagi mengisi tabung. 5. Pemeriksaan RTU: Lawatan ke Jabatan Hal Ehwal Kesatuan Sekerja (RTU): Kesatuan meminta perjumpaan RTU dengan NUJ-UM ditangguhkan dari tarikh yang ditetapkan pada 21 Jun 2012 ke tarikh baharu. Pegawai RTU yang terlibat bersetuju. Penangguhan itu disebabkan beberapa perkara yang tidak dapat dielakkan. 6. Penetapan garis panduan tuntutan Tabung Kebajikan dan elaun petugas kesatuan: Pada 18 Julai 2012 Bendahari NUJ-UM, Nurul Anuar Kari, yang baru, pada sesi kali ini menetapkan satu garis panduan tuntutan Tabung Kebajikan dan elaun petugas kesatuan dan diluluskan oleh mesyuarat exco. Garis panduan bertujuan bagi mengawal kewangan kesatuan dengan lebih baik bagi dua akaun iaitu Antara akaun aktiviti dan akaun tabung kebajikan. 7. Tuntutan bonus 2012: Pada bulan Ogos 2012 barisan exco NUJ-UM telah mengadakan kunjungan hormat ke pejabat Pengerusi Eksekutif Kumpulan Utusan, Tan Sri Mohamed Hashim Ahmad Makaruddin bagi memperkenalkan barisan exco baharu dan memohon tuntutan bonus sebanyak dua bulan diberikan kepada kakitangan pada hujung tahun 2012 dan tidak memberi pinjaman hujung tahun. 8. Pemberhentian Exco, Hafiz Idzla dan pelantikan exco baharu: Pada 20 September 2012 Exco NUJ-UM, Mohd. Hafiz Idzla telah meletakkan jawatan sebagai kakitangan Utusan Melayu (M) Bhd dan digantikan oleh seorang jurufoto, Abdul Nazir Mohamed. 9. Perbicaraan kes pemecatan bekas Pengerusi NUJ-UM, Amran Ahmad: Pada 10 Disember 2012 perbicaraan bekas Pengerusi NUJ-UM, Amran Ahmad yang pertama bermula di Mahkamah Perusahaan Kuala Lumpur. 10. Memorandum bangunan baharu: Pada pada 24 Januari 2013 mesyuarat exco telah meluluskan satu memorandum untuk dicadangkan kepada syarikat untuk dipertimbangkan demi kebajikan pekerja. 11. Bangunan baharu Utusan Melayu (M) Bhd. siap di bina pada penghujung 2012: Pada awal bulan Februari 2013. Barisan exco NUJ-UM memohon syarikat membenarkan kesatuan melakukan lawatan ke atas bangunan baharu bagi melihat dekorasi dan rupa sebenar bangunan yang dijangka akan menjadi ikon di Jalan Chan Sow Lin. 12. Peraturan pemberian Tabung Kebajikan: Pada 3 Februari 2013, Bendahari Agung NUJ-UM, Nurul Anuar Bin Kari menetapkan garis panduan khusus untuk pemberian token kebajikan kepada ahli NUJ-UM. Penetapan garis panduan ini lebih meluas dari sebelum ini dan memberi lebih nilai kepada token yang diberi. 13. Hari terbuka NUJ-UM: Pada 18 Februari 2013, barisan exco NUJ-UM telah mengadakan program Hari Terbuka NUJUM. Program ini diadakan di kantin utusan bertujuan untuk mencari keahlian baharu, pembaharuan kad PRESS, aduan ahli dan lain-lain. Program mendapat sambutan menggalakkan daripada ahli. Jumlah kutipan borang keseluruhan serbanyak 200 helai. 14. Perbicaraan semakan kehakiman kes bonus di Mahkamah: Pada 26 Februari 2013 exco NUJUM hadir ke mahkamah persekutuan untuk perbicaraan semakan kehakiman Kes BONUS 2009 oleh majikan yang tidak berpuas hati dengan award Mahkamah Perusahaan yang menang dan memihak NUJUM.

15. Pengambilan pekerja kontrak Pilihan Raya Umum ke 13: bermula pada bulan Mac 2013 syarikat telah mengambil seramai 40 orang kakitangan kontrak untuk kerja-kerja pilihan raya ke 13. 16. Kebenaran mengutip dana untuk tabung kebajikan NUJ Cawangan Utusan: Pada bulan Mac 2013 juga kesatuan cawangan meminta NUJ pusat memberikan kebenaran untuk mengutip dan menerima sumbangan dari orang awam, menteri, ahli politik dan syarikat. Kutipan dana ini dijangka bermula pada bulan enam 2013 sehingga disember 2013. 17. Syarikat tangguh pelaksanaan umur persaraan 60 tahun: Syarikat Utusan Melayu (M) Bhd. bersama Persatuan Majikan Malaysia membuat rayuan kepada kerajaan untuk menangguhkan pelaksanaan tarih umur persaraan 60 tahun untuk setahun lagi dari tarikh kuatkuasa yang ditetapkan kerajaan. Rayuan menangguh tarikh efektif umur persaraan pada 1 Januari 2014. 18. Lawatan ke biro-biro negeri untuk maklum balas NUJUM: Pada 10 Jun 2013, NUJUM melakukan lawatan ke biro-biro negeri dengan bermula dengan Pantai Timur seperti berikut; Biro Terengganu, Biro Kelantan, Biro Pahang dan Temerloh. Tarikh lawatan dari 10 hingga 13 Jun 2013. Lawatan Utara seperti berikut: Biro Perlis, Kedah, Pulau Pinang dan Ipoh. Tarikh lawatan dari 24 hingga 27 Jun 2013. Seterusnya lawatan ke biro selatan seperti Biro Johor Bahru, Batu Pahat, Melaka dan Negeri Sembilan. 19. Mesyuarat audit bersama Jabatan Hal Ehwal Kesatuan Sekerja (JHEKS): Pada 1 Ogos 2013, satu mesyuarat audit dalam NUJUM bersama JHEKS telah diadakan di pejabat JHEKS di Shah Alam dan pegawai JHEKS bertugas berpuas hati dengan akaun dan minit mesyuarat NUJUM. Beliau berharap keadaan ini dapat diteruskan pada masa akan datang. 20. Majlis Ulang Tahun dan Penghargaan Ahli NUJUM: Barisan NUJUM mengadakan majlis penghargaan wartawan utusan/kosmo 2013 pada 18 Oktober 2013. Majlis tersebut berjalan lancar. Seramai 200 ahli terlibat hadir manakala 500 kakitangan bukan kategori NUJUM turut hadir bagi memeriahkan majlis. 21. Surat mohon naikkan elaun minyak: Pada 3 September 2013, ekoran kenaikan harga minyak dipasaran selepas pilihan raya ke 13 dan kenaikan harga barangan yang mendadak exco NUJUM memutuskan untuk meminta syarikat menaikan elaun minyak untuk kakitangan yang layak dan telah menikmatinya. 22. Mesyuarat JCC bersama majikan: Pada 23 Oktober 2013, NUJUM telah mengadakan mesyuarat di antara pegawai pengurusan kanan syarikat Utusan Melayu (M) Bhd. bersama kesatuan KKPA bagi mendapat penjelasan mengenai kedudukan pendapatan syarikat. 23. Lawatan ke biro Borneo: Pada bulan November 2013, NUJUM telah mengadakan lawatan ke biro Sabah dan Sarawak. 24. Bonus 2013 lewat: Pada 24 Disember 2013, NUJUM telah mengadakan perjumpaan dengan Pengerusi Eksekutif Kumpulan, Tan Sir Ahmad Hashim bagi mendapatkan pencerahan mengenai kelewatan pengumuman BONUS 2013. 25. Suntikan Modal dari UMNO: Pada 24 Disember 2013 syarikat menjelaskan UMNO akan melakukan suntikan modal sebanyak RM40 juta tapi UMNO baru bagi RM10 juta. Ia tak cukup masih ada RM30 juta lain. Baki suntikan masih sepi dan tiada khabar bunyi. 26. Lawatan ke Biro Selatan: Pada 12 Februari 2014,exco NUJUM membuat lawatan kerja ke biro-biro cawangan di selatan. Lawatan exco NUJUM berjalan lancar dan mendapat respon yang menggalakkan. Tarikh lawatan ke biro selatan dilakukan pada 2014 selepas ia ditangguhkan kerana sebab teknikal dan kesibukan gerak kerja NUJUM yang lain.

27. Perbincangan CA 2014-2017: Pada 4 April 2014, Setiausaha NUJUM, Muhammad Basir Abu Bakar telah mengadakan perbincangan CA 2014-2017 di Genting Highland. Program lampias minda CA itu berlangsung selama empat hari. 28. Hantar proposal CA 2014-2017: NUJUM telah menghantar proposal CA 2014-2017 pada 9 Mei 2014 iaitu tiga bulan lebih awal dari tarikh CA tamat pada bulan Julai 2014. 29. Tawaran VSS kepada kakitangan Utusan Publication and Distributor (UP&D): Pada bulan April 2014 syarikat telah tawarkan VSS kepada sebahagian besar kaitangan Utusan Publication and Distributor (UP&D) untuk mengecilkan kos operasi syarikat. III. NANYANG BRANCH REPORT By NUJ-Nanyang Secretary: Ms Choy Siew Mei 1. 2013-2015 Collective Agreement: CA proposal had handed over to the Human Resource management of Nanyang Siang Pau by 17th October 2012. NUJ HQ sent first reminder letter to Human Resource Manager on December 2012. HR gave us counter proposal on salary increment less than 5% after HQ sent the 2nd reminder. NUJ-NYSP exco rejected the proposal and held 2nd meeting with HR and urge them to redo proposal and submit back within two weeks, if not will bring case to court. After HQ sent 3rd reminder, HR gave us counter proposal on March 12, 2013. CA Branch met HR on May 30 to discuss about CA. Branch rejected company's proposal and decided to bring the case to IR. HR called deputy president and secretary to meet next day and offered new proposal which salary conversion about 8%. NUJ-NYSP exco then reviewed the company's CA proposal and decided to accept it (7% salary increment across board; Overtime:- RM22, RM46, RM65 and RM85; Mileage – RM 0.45/km) and not bring to IR. Letter from HQ to IRD dated 7 June was retracted. New CA signed on 23 July 2013, HQ president and general secretary attended the signing ceremony. 2. Company Ex-gratia: Nanyang company gave Chinese New Year ex-gratia 0.25 month in 2014 and the extra incentive based on performance. Most of NUJ-NYSP members were satisfied. 3. RTU Inspection: Registrar of Trade Unions Selangor and Federal Territory officer meet with NUJ-NYSP Chairman, Secretary and Treasurer for inspection purpose on 25 July 2013. No big issues arose. Department of Trade Union Affairs Selangor and Federal Territory’s desk officer meet with NUJ-NYSP Chairman, Secretary and treasurer on 4 0f August 2014, to complete the routine inspection tasks. 4. Branch Activities: i. After the signing of NUJ-NYSP 2013-2015 CA, NUJ-Nanyang Chairman Yau Choon Hiam,Vice-Chairman Kuan Tai Huat (Now has resigned),Secretary Chiew Boon Leng (Now has resigned) and Treasurer Goh Yen Foo went to Penang and Perak visited NYSP office and NUJ members during 18-20 of July 2013. The purpose of the visit including distribution of CA, explain the importance of trade unions, recruit new members, etc. ii. NUJ-NYSP office bearers went to Johor Bahru to visit NYSP office and members from 27-29 February 2014.

iii. NUJ-NYSP had completed the Newsletter of 2014 and is expected to distribute to members in September. 5. Branch Elections: NUJ-NYSP held the 2014/2016 Branch General Meeting and Branch Election on 4 of June 2014, 7pm at Nanyang Siang Pau hall. Year of 2014/2016 NUJ-NYSP committee members are as follow: Chairman: Yau Choon Hiam; Vice-Chairman: Nui Sook Mun; Secretary: Choy Siew Mei; Assistant Secretary: Tan Siew Ling; Treasurer: Goh Yen Foo; Committee Members: Lee Hong Chun, Ngui Mee Ki, Wong Lee Haw, Chua Kim See, Chien Wee Yoon and Loh Siew Hung. 6. Welfare: NUJ-NYSP had design some T-shirts with NUJ logo and distributed to all of its members for free in May 2014. IV. KWONG WAH BRANCH REPORT Disediakan oleh Setiausaha Cawangan NUJ-Kwong Wah Sdri K.Y.Leong (A) PROSIDING KES

A1. Sistem Kontrak Wajib Ke Atas Pekerja Baru(Rujukan kes:1/3-591/12): Mulai tahun 2009, majikan mula melaksanakan sistem kontrak wajib selama setahun ke atas semua pekerja baru. Selepas setahun, sebahagian permohonan tukar menjadi pekerja tetap daripada pekerja kontrak ini diluluskan, tetapi ada di kalangannya diminta untuk menandatangani kontrak baru, ada juga yang dilanjutkan kontrak kepada dua tahun. Mulai tahun 2011, kebanyakan pekerja baru diwajibkan untuk menandatangani kontrak selama dua tahun. Majikan menggunakan alasan bahawa kandungan perjanjian kolektif telah menyatakan hanya “full time or permanent”boleh menjadi ahli. Dengan ini, majikan menafikan hak pekerja kontrak untuk memasuki kesatuan, dan ini akan memberi impak negatif kepada jumlah keahlian cawangan.

Pada 22 September 2010, Pengerusi Chua Cheong Wee, Naib Pengerusi Teh Im Im dan Setiausaha Leong Kit Yeng melawat ke Pejabat Registrar Kesatuan Sekerja, dan berjumpa dengan Pegawai Norainizi. Menurut beliau, Akta Kesatuan Sekerja menjamin hak-hak setiap pekerja untuk memasuki kesatuan sekerja, tak kira sama ada pekerja itu adalah pekerja sepenuh masa, kerja sambilan atau kontrak.

Maka, cawangan membawa isu ini kepada majikan dan pada mesyuarat NUJM. 8 September 2011, Pengerusi Chua Cheong Wee dan AJK Yap Siaw Song berjumpa dengan Penolong Pengarah Jabatan Hubungan Industri Pulau Pinang, En Mohd Shariffudin untuk membincangkan isu ini.

Jabatan Hubungan Industri terus mengatur perjumpaan antara wakil majikan dan kesatuan pada 19 Oktober 2011. Wakil kesatuan termasuk Presiden Chin Sung Chew, Pengerusi Chua Cheong Wee, Naib Pengerusi Teh Im Im, Setiausaha Leong Kit Yeng, Penolong Setiausaha Yeoh Siew Ying dan AJK Hoo Lei Lin.

Perjumpaan kedua diadakan pada 10 Januari 2012. Wakil kesatuan: Presiden Chin Sung Chew, Pengerusi Chua Cheong Wee, Naib Pengerusi Teh Im Im, Setiausaha Leong Kit Yeng, Penolong Setiausaha Yeoh Siew Ying dan AJK Hoo Lei Lin menghadiri pada hari itu.

Oleh kerana majikan dan kesatuan gagal mendapat konsesi dalam isu ini, kes ini dirujuk kepada mahkamah hubungan industri. Kes Mention pada 18 Jun, 27 Ogos dan 18 September 2012.

Kes ini mendapat kejayaan pada perbicaraan 5 November dan 6 November. Setiausaha Leong Kit Yeng sepatutnya dipanggil sebagai saksi pada hari pertama, tetapi suami peguam majikan memasuki hospital, kes ditundakan kepada hari keesokannya. Pada 6 November, majikan tiba-tiba minta untuk selesaikan di luar mahkamah.

Akhirnya, wakil majikan dan kesatuan bersetuju untuk menandatangani satu perjanjian berkaitan isu ini. Wakil kesatuan yang menandatangani perjanjian ini termasuk Peguam kesatuan En.Muhendaran, Presiden Chin Sung Chew dan Pengerusi Chua Cheong Wee.

Dengan penguatkuasaan perjanjian ini, wartawan, sub-editor, proof reader dan translator kontrak boleh memasuki NUJ sebagai ahli, dan hak-hak mereka dilindungi seperti mana pekerja tetap menikmati dalam perjanjian kolektif.

Hak-hak mereka termasuk:

** Pay back selepas kesatuan dan majikan menandatangani perjanjian kolektif (adjustment of basic dan petrol allowance).

** Sekiranya majikan enggan meneruskan kontrak selepas kontrak tamat tempoh, maka majikan perlu memberi pampasan mengikut tempoh perkhidmatan di syarikat(pekerja mempunyai masalah disiplin dan pernah mendapat amaran surat dikecualikan).

** Yang melindungi pekerja kontrak, bukan sekadar sekeping kertas seperti dulu, tetapi perjanjian kolektif yang lebih menyeluruh.

** Keahlian kesatuan tidak lagi menurun, perwakilan keahlian lebih significant semasa rundingan.

A2. Perjanjian Kolektif 2010-2013(Rujukan kes:9/2-1017/12): Perjanjian kolektif ini tamat tempoh pada 31 Oktober 2010. Kesatuan mengemukakan cadangan pertama pada 14 Januari 2011, tetapi majikan hantar cadangan counter proposal mereka pada 12 April 2011 (iaitu selepas tiga bulan cadangan pertama dihantar). Kesatuan menghantar cadangan kedua pada 3 Mei 2011, tetapi tidak terima apa-apa balasan dari majikan setakat 28 June 2011. Setiausaha Leong Kit Yeng mengeluarkan sepucuk surat kepada majikan, akhirnya mereka balas pada 18 Julai.

Memandangkan majikan telah membuang banyak masa dan cuba melambat-lambatkan proses, AJK bersetuju untuk membawa isu ini kepada Jabatan Perhubungan Perusahaan. Isu ini akhirnya mendapat surat dari Menteri Sumber Manusia pada 4 Julai 2012, dan dirujukkan kepada mahkamah perusahaan.

26 June 2013, AJK mengadakan sesi dialog dengan ahli, untuk memberi taklimat terkini tentang perkembangan kes ini. Selepas kian lama menunggu, kesatuan menerima judgement pada 2 Ogos 2013 daripada Pengerusi Mahkamah Hubungan Industri, Dato' Haji Sulaiman bin Ismail. No. kes keputusan NO.1400/2013.

Keputusan ini termasuk basic adjustment of 8% (paling tinggi dalam perjanjian lepas), petrol allowance tambah 15%, cuti awam tambah dua hari menjadi jumlahnya 15 hari, menambahkan SPECIAL GRADE (maximum RM2634), gaji maximum dinaikkan 8%, usia persaraan dilanjutkan kepada 60 tahun (sekiranya hendak bersara pada usia 55 tahun, perlu memberi notis kepada majikan tiga bulan sebelum tarikh persaraan), penambahan cuti tahunan selama sehari dan lain-lain.

A3. Perjanjian Kolektif 2013-2016: AJK terus merangka cadangan perjanjian kolektif baru, sejurus mendapat keputusan dari Pengerusi Mahkamah Hubungan Industri Pulau Pinang. Cadangan kesatuan dihantar pada 20 September 2013, dan sesi rundingan kali pertama diadakan pada 25 Oktober 2013. Setiausaha Leong Kit Yeng menghantar kertas cadangan kedua pada 31 Oktober, tetapi majikan verbally berkata, cadangan mereka pada sesi rundingan kali pertama adalah muktamad dan enggan untuk berbincang lagi.

NUJM mengeluarkan surat pada 4 Disember 2013, minta majikan untuk berunding lagi, tetapi majikan masih enggan. Maka, kesatuan terpaksa merujuk isu ini kepada Jabatan Hubungan Industri. Sesi dialog kali pertama di pejabat IR yang asalnya diadakan pada 23 Januari 2014, terpaksa ditundakan kepada 20 Februari atas permintaan majikan.

Pada sesi dialog pertama, majikan memberi alasan bahawa Senior HR Manager Branda Chew baru masuk kerja, perlukan masa untuk menangani isu ini dan majikan bersedia untuk berunding lagi. Naib Presiden Taufek berpendapat, majikan cuba menggunakan taktik melambat-lambatkan masa, dengan menunjukkan surat “muktamad”yang dikeluarkan oleh majikan sebelum ini.

Akhirnya, Penolong Pengarah bersetuju untuk memberi masa sebulan bagi perundingan semula. Tapi, majikan tidak menunjukkan keikhlasan mereka, malahan memansuhkan kandungan-kandungan yang asalnya melindungi ahli NUJ, contohnya adjustment tetap satu point setiap tahun dan bonus sebulan dalam setiap tahun.

Kes ini juga dirujukkan kepada Mahkamah Hubungan Industri dan masih menunggu tarikh untuk mention.

A4. Cuti Kesatuan Setiausaha Cawangan(Rujukan kes:9/3-116/14): Setiausaha cawangan Leong Kit Yeng dipilih sebagai wakil NUJM ke 34th NIHON SHINBUN KYOKAI (NSK) – CONFEDERATION OF ASEAN JOURNALISTS (CAJ) FELLOWSHIP PROGRAMME, pada 24 September 2013 ke 5 Oktober 2013. NUJM hantar surat permohonan cuti kesatuan kepada majikan sebanyak tiga kali, iaitu pada 21 June, 24 Ogos dan 17 September 2013. Tetapi majikan enggan meluluskan cuti kesatuannya, dan berkata program ini sepatutnya memohon cuti belajar (klausa 12 CA). Majikan juga meminta saudari Leong untuk menandatangani perjanjian perkhidmatan setahun (bermula dari Mei 2013 dan berakhir pada Mei 2014) dan sekiranya saudari meletak jawatan dalam tempoh setahun ini, saudari perlu membayar balik elaun sebulan (termasuk elaun petrol, telefon bimbit, parkir dan lain-lain).

Maka, saudari Leong terpaksa menghadiri program tersebut menggunakan sebelas hari cuti tahunan beliau (dua hari lagi adalah hari rehat).

Menurut wakil-wakil lain yang menyertai program ini, hanya bekas Setiausaha Cawangan Cheong Yin Fan diminta untuk menandatangani perjanjian perkhidmatan tersebut. Tempoh saudari Cheong pergi ke Jepun selama 28 hari. Manakala menurut perjanjian kolektif, sekiranya seorang pekerja tidak berkerja selama 14hari berturut-turut, majikan berhak untuk memotong elaunnya. Maka, saudari Cheong menandatangani perjanjian perkhidmatan itu tanpa pengetahuan NUJM.

Oleh sebab cawangan lain menyertai program ini dengan cuti kesatuan, dan tempoh program bagi tahun 2013 hanya 13 hari, maka NUJM HQ merujukkan isu ini kepada Jabatan Hubungan Industri Pulau Pinang.

Sebutan kes ini telah berlangsung beberapa kali. Masih dalam proses. (B) AKTIVITI-AKTIVITI CAWANGAN

Cawangan mengaturkan aturcara bagi tiga hari tersebut, dengan kerjasama George Town World Heritage Incorporated dan Penang Global Tourism. Wakil cawangan termasuk Pengerusi Chua Cheong Wee, Timbalan Pengerusi Chan Kok Hong, Setiausaha Leong Kit Yeng, Penolong Setiausaha Yeoh Siew Ying dan Bendahari Teh Im Im.

18 June 2014, BGM cawangan diadakan di Restoran Super 8, Lebuh Tye Sin, Pulau Pinang.

Mei 2013, Cawangan mengeluarkan surat gabungan dengan cawangan NUNW berkaitan dengan cuti umum pada 5 Mei 2013 (Kedah) dan 6 Mei 2013 (Pulau Pinang dan Selangor). Majikan setuju memberi cuti gantian sehari kepada pekerja-pekerja yang bekerja di tiga negeri tersebut.

V. STAR BRANCH REPORT Submitted by NUJ-Star Secretary, Mr. Qishin Tariq 1. Collective Agreement. i. The Branch completed its negotiations with the Management for CA 2013-2015. A draft was prepared and was presented to NUJ Exco during the HQ meeting on Dec 10, 2012. ii. The CA was signed after a meeting at the courts on Jan 31, 2013. The Collective Agreement 2013 was printed and distributed to members. iii. Key points of the CA included a 13% salary increase for members, RM10 increase for extra shifts across the board, and an increase in maternity leave from 60 days to 90. 2. Branch Activities i. The Branch launched a new website at http://nujstar.blogspot.com/ ii. On Jan 29, 2014, then Secretary Shaun Ho, made a poster with Chinese New Year greetings and pictures of committee members to remind members who is part of the branch exco. Cheesecake was also served as a treat for members that same day. iii. BGM held on May 29, 2014 to elect the 2014-2016 office bearers. Only the position of chairman was contested. Candidates were Christina Low Hooi May and Brian Moh Boon Leng. Christina Low gained the majority (60 votes) over Brian Moh (6 votes). iv. Met HR on July 23, 2014 to discuss MiCare - the new health coverage plan for Star employees, state of the Sarawak bureau and future of Star’s magazines, Kuntum, Shanghai and Flavours. v. Recruitment drive held on August 22, 2014. 3. Trade Union Education i. Branch (then secretary Shaun Ho, committee members Qishin Tariq and Liz Lee) took part in MTUC’s CA negotiation workshop ii. Branch did not organise any of its own workshops 4. BGM - New Office Bearers 2014-2016 i. New committee was elected on May 29, 2014. ii. 5. Newspaper - Closing Down Sections i. Star’s main paper was reduced to only one edition. One edition will effect overtime. ii. VSS (Voluntary Separation Scheme) was offered to all employees on Sept 25. iii. Galaxy was closed down. It was operating since the seventies. iv. Kuntum, Shanghai and Flavours were placed under a subsidiary of Star Publications, Magnet Biz. HR states they may be shut down in the near future. 6. Membership: Number of members as of June 2014 is 166. VI. THE SUN BRANCH REPORT By NUJ-Sun Secretary: Ms Anansa Jacob

A. Collective Agreement: TheSun’s previous Collective Agreement expired on December 31, 2012. On February 17, 2014 after many months of hard negotiations, theSun Collective Agreement was signed covering the period from January 1, 2013 to December 31, 2015. Members who were still with the company received their backdated salaries and bonuses. B. Membership: There are currently 28 members in theSun-NUJ, almost half of whom are new members who joined the company between 2013 to 2014. C. Branch BGM and Meeting: On April 15, 2014 a Biennial General Meeting was held to elect a new committee to replace many of those who had since left the company. The new committee branch members are – Bernard Cheah as Chairman; Karen Arukesamy as Vice-Chairman; Anansa Jacob as General Secretary; Arion Yeow as Assistant Secretary; Kogulanath Ayappan as Treasurer; Kishen Alex Raj, Yee Jie Min, Norman Hiu as Committee Members; Magenan Mohanan, Ong Yeevon as Branch Internal Auditors; Ee Ann Nee, Kishen Alex Raj, Tamarai Chelvi as Branch Scrutineers. The first branch meeting was held on July 22, 2014. D. Branch Bank Account: On August 4, 2014 the new Chairman, Secretary and Treasurer were able to gain access to the branch bank account which had been dormant for the last few years, due to the previous signatories to the account having left the company. E. RTU Inspection: On August 6,2014 the Chairman, Vice-Chairman, Secretary and Treasurer were called for an inspection at the RTU with a new case officer, Pn Nor Hafizah giving guidance on record- and book-keeping procedures for the future. F. Branch Dinner: On August 22, 2014 a dinner was organised for the members. Because many members were new, it was an opportunity for them to mingle and to get to know their new committee members. Future gatherings and team-building events were also suggested in order to foster relationships among members. G. MTUC: Two members – Bernard Cheah and Lee Choon Fai – attended an MTUC Course titled KURSUS PENGENDALIAN RUNGUTAN DAN SIASATAN DALAMAN from September 17 to 19 2014. The course taught some leadership and conflict resolution skills, as well as some basic education on labour laws.

VII. SIN CHEW BRANCH REPORT Laporan Cawangan Sin Chew Media Corp. 2 November 2012 hingga 20 September 2014 dikemukakan oleh Setiausaha Cawangan Sdr Chan Woei Loon 1. Collective Agreement 2011-2013 Klausa 4 di dalam CA tersebut pada tahun 2012 hingga 2013 masih dalam perundingan mahkamah. 9 Okt 2013, Peguam pihak syarikat dan NUJ telah membuat "submission" di mahkamah. 8 Mei 2014, Mahkamah menbuat keputusan, bahawa mahkamah menerima cadangan NUJ, ini bermaksud pekerja yang letak jawatan pada masa kesahihan CA ini ( 1 Jan 2011 sehingga CA baru ditandatangani), mereka layak menerima faedah yang berada di dalam CA. Cawangan kami telah mengumumkan keputusan baik ini kepada semua ahli Sin Chew, tetapi pihak syarikat masih belum melaksanakannya mengikut keputusan mahkamah atas sebab pihak syarikat ingin meminta rayuan di mahkamah Tinggi (semakan kehakiman). Sehingga September 2014, kes rayuan tersebut masih di dalam perundingan mahkamah. 2. Collective Agreement 2014-2016 Walaupun masalah CA 2011-2013 belum selesai, AJK cawangan telah bermula kerja-kerja menyedia CA baru pada 2013 untuk dihantar kepada pihak majikan jika kes CA 2011-2013 diselesaikan di mahkamah. 25 Mac 2014, pegerusi cawangan dan setiausaha cawangan telah kemukakan CA 2014-2016 kepada pihak majikan. Pada 4 Jun 2014 sehingga ke 9 Sept 2014, pihak NUJ Sin Chew telah mengadakan 7 kali perundingan CA dengan pihak majikan. Dalam perundingan CA kali ke-4 pada 22 Julai 2014, pihak majikan telah minta pihak NUJ-Sin Chew menerima Klausa 4 supaya pelaksanaan CA dapat dijalankan, tetapi akhirnya pihak NUJ-Sin Chew telah menolak permintaan tersebut dan mengumumkan satu kebuntuan (deadlock). Pada 25 Julai 2014, pihak majikan telah menulis surat kepada cawangan NUJ-Sin Chew meminta pihak kesatuan kembali ke meja perundingan tetapi kami berpendapat bahawa kami tidak dapat berkompromi dengan syarat yang tetapkan oleh pihak syarikat. Pihak syarikat kemudian membalas surat kepada kami pada 1 Ogos 2014 bersetuju untuk mengetepikan Klausa 4 pada masa sekarang di mana kes pertikaian atas Klausa tersebut telah dirujuk ke mahkamah tinggi untuk semakan kehakiman. Manakala pada 1 Ogos 2014, pihak majikan mengeluarkan surat rasmi kepada pegerusi cawangan dengan hasrat ingin kembali ke meja perundingan dengan pihak NUJ Sin Chew. Selepas perbincangan di kalangan AJK cawangan NUJ Sin chew, kami membuat keputusan untuk memberi peluang kepada pihak majikan dan menjalankan perundingan sekali lagi. Sehingga 12 Ogos 2014, pihak NUJ Sin Chew telah mengadakan perudingan sebanyak 5 kali dengan pihak majikan dan mereka telah setuju beberapa Klausa dalam CA yang kami cadangkan:

CLAUSE 33 (ADDITIONAL WORK ALLOWANCE): naik RM2 sejam, iaitu dari RM18

naik ke RM20 sejam. CLAUSE 40 (SALARY STRUCTURE):INCREMENT tambah RM5 bagi setiap kategori.

Pada 26 Ogos 2014, pihak majikan setuju dengan cadangan pihak NUJ Sin Chew iaitu pelaksanaan "5 working days" tetapi dengan syarat-syarat tertentu (tambah sejam masa kerja setiap hari). Dalam perudingan selama 5 jam, pihak NUJ Sin Chew telah bersetuju dengan syarat-syarat tertentu. Selain itu, pihak majikan juga setuju supaya membuat satu Memorandum Persefahaman (MOU) mengetepikan Klausa itu sehingga keputusan terakhir mahkamah tinggi dibuat. Pada 15 Sept 2014, pihak NUJ Sin Chew telah mengadakan Majlis menandatangani CA dan MOU dengan pihak majikan. 3. Aktiviti Cawangan / Jawatankuasa Lawatan: Wakil exco cawangan Sin Chew mengadakan satu perjumpaan dengan ahli di Seremban dan Melaka pada 14-15 Dec 2012. Program Tahun Baru Cina 2013: NUJ Sin Chew telah menganjurkan Makan Mesra Tahun Baru Cina 2013 di Restoran SS2 Mall pada 1 Feb 2013. Sebanyak 60 ahli hadir. Pemeriksaan RTU: i. Jabatan Hal Ehwal Kesatuan Sekerja (RTU) telah menjalankan pemeriksaan ke atas rekod-rekod NUJ Sin Chew pada 20 Mei 2013 jam 10 pagi. ii. Pada 6 Ogos 2014 jam 10 pagi, Jabatan Hal Ehwal Kesatuan Sekerja (RTU) telan menjalankan pemeriksaan ke atas rekod-rekod NUJ cawangan Sin Chew Daily. Pesta Tang Long 2013: NUJ Sin Chew telah menganjurkan "Mid Autumn Festival Celebration" pada 13 Sept 2013 di bilik aktiviti Sin Chew HQ. Seramai 60 ahli hadir. Program Tahun Baru Cina 2014: Cawangan kami telah berjaya menganjurkan makam malam bersama ahli sambil menyambut Tahun Baru Cina di Guinness Anchor pada 11 Feb 2014. Seramai 70 orang ahli hadir ke jamuan. 4. Pelantikan dan Peletakan AJK Cawangan Penolong setiausaha NUJ Cawangan Sin Chew Tay Siew Hui telah meletakkan jawatan pada 15 Mac 2013 atas sebab masalah peribadi. Pengerusi telah menerima surat perletakan jawatan tersebut. Jawatan Penolong Setiausaha diganti oleh AJK Chong Shin Wai. Chong Ching Yen mencadangkan pelantikan atas disahkan dan Kun Lai Leng menyokong. Seorang ahli iaitu Chan Woei Loon dijemput mengisi jawatan AJK. Dalam mesyuarat cawangan, Tan Chee Kwan mencadangkan pelantikan atas disahkan dan Tan Ming Min menyokong. Pada bulan Sept 2013, 2 orang AJK meletakkan jawatan mereka, iaitu naib pengerusi Kun Lai Leng (atas sebab dinaikkan pangkat) dan AJK Tan Chee Kwan yang telah berhenti kerja. Oleh sebab di atas, jawatan naib pengerusi diganti oleh AJK Lim Yah Whee, jawatankuasa juga menjemput 2 orang ahli, iaitu Low Kok Tong dan Kuek Ser Kwang Zhe untuk mengisi jawatan AJK.

Pelantikan tersebut telah dicadang dan disahkan pada mesyuarat cawangan pada 8 Okt 2013. Sehingga bulan Julai 2014, Bendahari Chong Ching Yen, Ahli AJK Kuek Ser Kwang Zhe dan Low Kok Tong telah meletakan jawatan. 5. BGM Cawangan Sin Chew BGM Cawangan Sin Chew ke19 diadakan pada 20 Jun 2014 di bilik aktiviti Sin Chew HQ, seramai 67 ahli hadir (Jumlah Ahli 250 orang) . Dalam BGM tersebut, Chin Sung Chew kekal sebagai pegerusi, Chan Woei Loon dilantik sebagai Setiausaha dan Tan Min Ming dilantik sebagai bendahari. Tambah 4 orang ahli AJK baru. 6. Jumlah Ahli Sehingga September 2014, jumlah ahli cawangan Sin Chew seramai 243. 7. Seminar atau Bengkel dihadiri oleh Exco Cawangan 2 orang wakil exco cawangan kami hadir ke kursus MTUC pada 18 Oct 2013 dengan memohon "union leave", tetapi akhirnya menimbulkan masalah "union leave". HR tidak memberi kelulusan ke atas pemohonan kerana kursus tersebut tidak kena-mengena dengan syarikat. Oleh itu, kami telah menbuat aduan kepada IR, dan berjumpa dengan pegawai IR pada 19 Dec 2013. Peraturan/akta yang digunakan untuk membuat aduan tidak tepat, pegawai IR mencadangkan Kesatuan guna Akta 18, bukan Akta 6. Mengikut akta yang digunakan, memang syarikat tidak memberi Union leave tetapi "unpaid leave" kepada wakil kami menghadiri kursus yang tidak kena-mengena dengan syarikat. Mengikut akta, NUJ boleh memberi sejumlah wang kepada wakil yang hadir ke kursus sebagai satu ganti balik atau "claim". Oleh kerana sebab-sebab di atas, aduan yang kami bangkitkan dikira selesai dan file ditutup. Jika kami ingin membuat aduan lagi, haruslah membuatnya di bawah Akta 18. Selepas melaporkan dan berbincang dengan Exco cawangan, kami akan memberi RM50 seorang kepada yang hadir ke kursus, jika wakil tersebut membuat permohonan. 8. Hal-Hal Lain Bonus 2013: Sin Chew Media Cooperation telah mengumumkan pemberian bonus sebanyak 2 bulan kepada pekerja. VII. UTUSAN KARYA BRANCH Laporan Cawangan Utusan Karya For 2012 -2014 A. ISU CUTI TAHUNAN : Pada 20 Disember 2012, NUJ cawangan Utusan Karya diminta menghadiri satu mesyuarat bersama dengan pihak Jabatan Perhubungan Perusahaan di Shah Alam. Ia berkenaan isu pertikaian di antara pihak Kesatuan Kebangsaan Wartawan Semenanjung Malaysia (NUJM) dengan Utusan Karya Sdn. Bhd. mengenai isu cuti tahunan di mana pihak majikan menghantar memo untuk mewajibkan pekerja mengambil cuti kesatuan 2 hari sebulan.

Pada 3 Mei 2013, NUJ cawangan Utusan Karya diminta sekali menghadiri satu mesyuarat bersama dengan pihak Jabatan Perhubungan Perusahaan di Shah Alam, Selangor. Ia berkenaan isu pertikaian di antara pihak Kesatuan Kebangsaan Wartawan Semenanjung Malaysia (NUJM) dengan Utusan Karya Sdn. Bhd. mengenai cuti tahunan. Menteri telah membuat keputusan untuk dirujuk ke Mahkamah. Pihak kesatuan telah mendapat surat dari Putrajaya pada 23 Ogos. Sebutan pada September 23 8.30 pagi di Mahkamah Perusahaan KL Court 24. Kes ini yang difailkan di bawah Seksyen 26(2) Akta Perhubungan Perusahaan telah diselesaikan di mana pihak majikan menarik balik memo tersebut B. PERJANJIAN BERSAMA : CA UKSB 2011-2013 telah tamat pada 31 Disember 2013. Pihak Cawangan telah menyiapkan cadangan CA. Oleh kerana pihak majikan tidak menjawab surat cadangan kesatuan untuk memulakan rundingan, ia dirujuk ke IR Shah Alam. Pihak majikan dan Kesatuan bertemu pada 12 Disember 2013. Keputusan pertemuan fail CA di tutup sementara sebab pihak majikan mahu berunding pada 23 dan 24 Disember 2013. Pihak IR berkata jika sekira rundingan buntu boleh di fail semula kes CA. Rundingan CA NUJ UKSB 2014-2016 dengan pihak Syarikat telah berlangsung pada 23 & 24 Disember 2013. Perkara yang dicadangkan oleh pihak Kesatuan sebanyak 50 Perkara dan pihak Syarikat 45 Perkara. Pada rundingan 23 & 24 Disember pihak Kesatuan dan Syarikat telah mempersetujui 29 perkara dan tinggal 16 perkara belum di persetujui. Cadangan pihak Syarikat mereka telah keluarkan perkara mengenai elaun kenderaan, pihak Kesatuan tidak mempersetujuinya. Pada 24 Disember 2013 rundingan CA pihak Syarikat ada mencadangkan rundingan akan disambung pada 15 & 16 Januari 2014. Kemudian pihak Syarikat mencadangkan 16 Januari 2014 sahaja, tetapi pada 10 Januari 2014 pihak Syarikat memberitahu pihak kesatuan 16 Januari 2014 pun tak jadi kerana ketiadaan pegawai tertentu dalam rundingan tersebut. Jadi ditukar ke tarikh lain akan diberitahu kemudian. Pada Mac 11, 2014, satu perjumpaan diadakan di JPP Shah Alam Pengurusan dan Kesatuan tidak dapat bersetuju dengan pelarasan gaji. Kesatuan meminta 15% dalam pelarasan gaji, Pengurusan hanya menawarkan 3%. Kesatuan kemudian dikurangkan kepada 12% tetapi Pengurusan memberi pelarasan hanya 5%.Ia di rujuk kepada Kementerian untuk sebutan Mahkamah yang akan berlangsung pada 16 Oktober, 2014 di Mahkamah Perusahaan Kuala Lumpur. C. PERTIKAIAN PERUSAHAAN: ISU UNION BUSTING: PEKERJA BARU DITAWARKAN JAWATAN EKSEKUTIF DAN PELANTIKAN KE JAWATAN EKSEKUTIF AHLI-AHLI NUJ WALAUPUN BIDANG TUGAS MASIH SAMA : Pada 29 Mac 2013, pihak majikan telah menawarkan jawatan eksekutif kepada lapan orang wartawan dan seorang pelukis kreatif. Daripada sembilan tawaran tersebut, tujuh orang wartawan telah memilih untuk menerima tawaran tersebut. Pada 16 April 2013, NUJ cawangan Utusan karya telah mengadakan perjumpaan bersama exco serta ahli-ahli yang telah menerima tawaran jawatan eksekutif daripada pihak majikan. Satu penyerahan kuasa telah dilakukan. Malangnya, pihak majikan masih enggan bekerjasama. NUJ cawangan Utusan Karya meminta NUJ Pusat membantu dalam kes ini. JPP cawangan Shah Alam mencadangkan agar isu tersebut terus di bawa ke JPP Putrajaya. Kesatuan pada mulanya menulis kepada IRD mengenai perkara ini pada 17 Mei 2012 dan susulan pada 22 Jun 2012 meminta JPP untuk melakukan ujian kapasiti untuk menentukan skop keahlian. Pada 25 Januari 2013, Kesatuan menarik balik permintaan ujian kapasiti dan memfailkan aduan sebagai Union Busting walaupun ujian kapasiti telah dijalankan oleh IRD. Menteri kemudian merujuk kes itu ke Mahkamah Perusahaan pada 8 Oktober, 2013 Sebutan telah diadakan di Mahkamah Perusahaan pada 25 November 2013 (No. 24/3 Kes -1361/13) dan satu lagi pada 25 Jun, 2014.

Peguam Kesatuan meminta Mahkamah untuk penangguhan kes tersebut dan Mahkamah telah memberikan kelulusan. Beliau menasihatkan Kesatuan bahawa keputusan ujian kemampuan akan memberi peluang lebih baik untuk memenangi kes Union Busting tersebut. Sepucuk surat telah dihantar kepada JPP pada 14 Ogos 2014 meminta hasil keputusan ujian kapasiti yang jabatan tersebut lakukan pada 2012 tetapi telah ditolak. Kesatuan menulis kepada IRD pada September 12, 2014 meminta untuk melakukan ujian kapasiti yang baru. Satu mesyuarat mengenai perkara kapasiti telah dibincangkan di pejabat JPP pada 9 September, 2014 di antara Kesatuan, Pengurusan dan JPP. D. MESYUARAT DWI TAHUNAN : Mesyuarat pada 18 April, 2014 dan pememilihan jawatankuasa yang baru sesi 2014-2016 telah diadakan. Pengerusi Latip Bin Mat Radzi; Naib Pengerusi - Firhat Yasir Bin Omar Sudi; Setiausaha - Mohd Nazirul Afiq Bin Ismail; Penolong Setiausaha -Nor Asmah Binti Hitam; Bendahari - Ruhaya Binti Abdul Hamid; AJK - Azman Bin Taha, Haswadi Bin Abu Hassan, Noorzilla Binti Ahmad, Mohd Rosli Bin Husin, Mohd Hasrul Nizam Bin Sabani. E. BILANGAN AHLI : Bilangan ahli NUJ cawangan Utusan Karya berkurangan apabila tujuh orang ahli telah meletak jawatan dengan memilih tawaran eksekutif. Kini jumlah ahli penuh dan bersekutu semasa adalah 26 orang. F. PEMERIKSAAN KE ATAS DOKUMEN / AKAUN KESATUAN CAWANGAN UKSB : i. Pihak kesatuan NUJ-UKSB telah pergi ke Shah Alam untuk pemeriksaan kesatuan pada 1 Ogos, 2013. ii. Pihak kesatuan NUJ-UKSB telah meminta penangguhan untuk pemeriksaan kesatuan. Pihak NUJ-UKSB ada masalah tentang akaun yang tidak balance dan kita sedang membetulkan akaun yang terlebih RM150. 17. INDUSTRIAL MATTERS i) NUJ-KWONG WAH CA COURT AWARD- Case No 1/3-591/12 : On July 4, 2013 in Industrial Court of Malaysia pursuant to Section 26(2) of the IR Act 1967 resolved the matter between the two parties and awarded NUJ on the terms of the Collective Agreement 2010-2013. The terms of the CA are contained in the annexure which forms part of the award. (Award No. 1400 /2013. Award was handed down on 2 August 2013. ii) NUJ-KWONG WAH CA of 2013-2016 - Case No. 3/2-630/14: It is in the Industrial Court. Mention will be held on October 9, 2014. Deadlock arose after Kwong Wah Management refused to negotiate. Vice President Sdr Taufek and NUJ-Utusan Secretary Sdr Muhammad Basir attended the IRD arbitration meetings in Penang on February 20 and April 14, 2014. On August 4, 2014 the Minister had referred the case to the ID court for mention. It will be mentioned at Penang Industrial Courr on October 10, 2014. iii) UNION LEAVE ISSUE - Case No. 9/3-116/14: Branch Secretary Sdri K.Y Leong was refused union leave to attend the NSK Fellowship Programme in September 2013. The management wanted her to sign a one year contract to remain in the company if her leave was to be approved. The case, after several arbitrations under IRD, it was referred to the Court by Minister on January 22, 2014. So far seven mentions had been held and awaiting date to be heard. iv) NST JOB SCOPE - The IRD has sent its reply of its finding on the job capacity issue at NST on 24 December 2013. The IRD has given its decision on workers capacity as being under management while the Minister has given his decision on workers capacity as being Union members and another list for job scope as non union entitlement. (Please see NSTP Branch Report) v) NUJ- UTUSAN MELAYU BONUS ISSUE - Case No. 1/1-238/10 : On May 24, 2011, the Industrial Court made an award in favour of NUJ It held that the newspaper publisher Kumpulan Utusan Melayu (M) Bhd to pay NUJ bargainable employees the balance of two month’s bonus for 2009 since the company recorded a profit. However, the Award handed down in favour of NUJ mentioned the Utusan as Group of companies instead as an individual company who was the party in the collective agreement. The company then filed a judicial review in the High Court to quash the award. It obtained leave for the review application and the matter was heard and award was handed down in February 26, 2013 (No: R1-25-166-2011). In March 2013, union lawyer filed to the Appeals Court. Appeals Court hearing in Putrajaya was held on August 7, 2014 and the Court asked the Union to revert to the Industrial Court that handed down the award in the first place with no cost incurred at the Appeals Court. vi) AMRAN AHMAD’S DISMISSAL- Case No: 9/4-1143/10: The former Utusan branch chairman was dismissed from employment for giving press statements against his company in 2009. The Human Resources Minister has referred the

matter to the Industrial Court. There were a number of postponements (from 18-02-2011 to 12-08-2014) at the request of both the company and union lawyer. Lawyer A. Sivanesan, who is entrusted with the case, has informed the union that the company lawyer had requested a proposal to settle the matter out of court. Meaning there is a likelihood of the company paying Amran backdated wages and compensation in lieu of reinstatement. However for the next hearing on November 10, 2014, the Branch suggested to Sdr Amran to request for a postponement as he might still be in overseas for his further studies. vii) HATA WAHARI’S DISMISSAL Case No. 2/4-1284/11: The former NUJ president and NUJ-Utusan branch treasurer was sacked for allegedly tarnishing the image of the company through a series of interviews in the The Sun newspaper and newsportals in late 2010 and early 2011. NUJ Counsel filed the case in 2011, Last mention was held on 19-08-2014. Statement of case was filed by NUJ on 15-06-2012. Witness statement was submitted by Company on 22.11.2013 Case was postponed many times and the next date of hearing is 12-01-2015. viii) INDUSTRIAL COURT AWARD TO UNION: CLAUSE 4 AND CLAUSE 39 OF NUJ-SIN CHEW CA: The Industrial Court on May 8, 2014 unanimously accepted the Union's proposal and argument for Clause 4 and Clause 39. In handing down the award the Court bore in mind S.30(4) and S.30(5) of the Industrial Relations Act 1967. On. May 29, 2014 company has filed for judicial review at the High Court. A memorandum of Understanding was signed by both parties in keeping the above Clauses in abeyance pending the decision by the High Court on concluding the 2013-2016 Collective Agreement which was signed on September 15, 2014. ix) INDUSTRIAL MATTER BETWEEN NUJ AND UTUSAN KARYA SDN BHD - UNION BUSTING ISSUES - 1) PEKERJA BARU DITAWARKAN JAWATAN EKSEKUTIF DAN 2) PELANTIKAN KE JAWATAN EKSEKUTIF AHLI-AHLI NUJ WALAUPUN BIDANG TUGAS MASIH SAMA - The Union first wrote to the IRD concerning these matter on May 17, 2012 and a follow up letter on June 22, 2012 requesting the IRD to do a capacity test to ascertain the membership scope. On January 25, 2013, The Union retracted the capacity test request and filed complaint as Union Busting even though the capacity test has been conducted by the IRD. The minister then referred the case to Industrial Court on October 8, 2013. Mention was held at the Industrial Court on November 25, 2013 (Case No. 24/3 -1361/13) and another on June 25, 2014. Union Lawyer requested the Court for a stay and was granted. He advised the Union that the result of the capacity test would ensue better chance for winning the case. A letter was sent to IRD on August 14, 2014 requesting the office for the 2012 capacity result but was declined. Union wrote to IRD on September 12, 2014 requesting to do another capacity test. This ensued after a meeting concerning the capacity matter was discussed on 9 September, 2014 between the Union, Management and IRD. x) NUJ-UKSB ANNUAL LEAVE CASE: The case filed under Section 26(2) of the IR Act was amicably resolved at the Industrial Court on September 23, 2013. This issue arose because UKSB management sent out a circular forcing workers to take their annual leave every month of not more than 2 days. xi) NUJ-UKSB COLLECTIVE AGREEMENT REFERRED TO COURT: The Minister had referred the NUJ-UKSB 2014-2016 CA deadlock to the Industrial Court on August 28, 2014. Mention will be held on Thursday 16th October. 2014 at 8:30 am at KL Industrial Court. xii) UTUSAN MELAYU COLLECTIVE AGREEMENT 2014-2017: Negotiations for renewal of new CA 2014-2017 met a deadlock. Union sent a letter to IRD on July 27, 2014 to intervene. After IRD arbitration on August 26,2014, which both parties met, the Union resubmitted a revised CA draft on September 4, 2014. Another meeting was held on 10 September 2014 upon the resubmission of the CA. xiii) UTUSAN MELAYU - NON COMPLIANCE CA 1 August 2011 - 31 July 2014 (COG NO: 016/2012). The Union sent a letter to the IRD August 15, 2014 for intervention on non compliance of the CA under section 17.(2) of the IR Act 1967 and under Clause 2(a) (Perkara 2(a) of the above CA. Below are the non-compliance issues forwarded to IRD:

i. Pengurusan Utusan Melayu (M) Bhd mengambil wang potongan pinjaman kakitangan ke Bank Rakyat tanpa pengetahuan. Pengurusan Utusan Melayu (M) Bhd. turut disyaki menggunakan wang potongan gaji kakitangan untuk simpanan dan pelaburan di bank Ketidakpatuhan CA, Layanan Faedah Perubatan oleh Pengurusan Utusan Melayu (M) Bhd. Pengurusan Utusan Melayu (M) Bhd. melantik kakitangan baharu ke jawatan eksekutif dan menjadi mangsa kezaliman syarikat yang menafikan faedah yang lebih baik dari CA. Pengurusan Utusan Melayu (M) Bhd. gagal membayar tuntutan perbatuan (millage), elaun luar daerah, bayaran lebih masa kakitangan dan tuntutan tol/parking kakitangan yang termaktub di dalam CA.

18. NUJ EXCO NEW OFFICIAL SHIRT The Union made Official Shirts for NUJ Exco. Short Sleeves and Long Sleeves. 19. CAR STICKERS New NUJ car stickers are available. The Union has come up with a new design. It is priced at RM15 (RM8 for NUJ HQ and RM7 for Branch) 20. NUJ PRESS CARD Members can apply for the new Accredited Press Card (APC) which costs RM20 and valid for two years. 21. ASSOCIATE MEMBERSHIP DRIVE This campaign was initiated to increase the number of associates. Currently NUJ has a very small number of associate members. NUJ decided to collect two years’ subscription plus entrance fee while offering complementary press card and car sticker (RM154) for associate members to encourage them to join NUJ. 22. NUJ WEBSITE The Union's website is www.nujm.org. Members can view/download the Union Constitution in any three languages,and also other relevant Acts such as the IRD Act 1967, Trade Union Act 1959, Official Secrets Act 1972 and others. There is also a link to the IFJ website for international journalistic affiliation. The NUJ Safety handbook and the Benevolent fund booklet are also included and search for newspapers around the world - regionally indexed in the link section (Index Newspapers and News Media Guide) that was included in 2011. Also recent events and happenings plus press statements. We also have a section where non-members/members can download membership forms and press application forms. The Organisation Chart of the NUJ office bearers is listed as well. There is a page of NUJ history in the archives which we are continuously trying to update and to obtain more photos of NUJ's past form the public and newspaper companies. 23. TENANCY AGREEMENT i. Renewal of agreement was made on February 1 2014 with the 1st floor tenant Blind Touch Massage Service with a monthly rental of RM1,400 for a term of two years ending January 31, 2016. ii. Renewal of Agreement was made on August 19, 2013 with the 3rd floor tenant Mr Arasu Balakrishnan with monthly rental of RM1100 from RM1000 for a term of two years from July 31, 2013 ending August 1, 2015. iii. Renewal of agreement was made on August 1, 2013 with ground floor tenant Mr Kamarudeen bin Abdul Razak (Yusuf Ali Restoran/ Din Bistro) with an increase of five per cent in rentals which now stands at RM3,468 from previous RM3,333 for a period of one year ending December 31, 2014. 24. REFURBISHMENT OF UNION BUILDING The Exco met on March 5, 2013 to do an office cleanup and take into account what needed to be discarded, replaced or upgraded. The Union managed to collect funds for maintenance of NUJ building from 2013-2014 from the Anniversary celebration contributions in from Sept 2013 to May 3, 2014. From the funds received, conference room was refurbished with glass panels removing wooden plywood walls. Two new air-condition units were sponsored by bukit Bintang MP upon request by Union. Extensive roof repairs were made including gutter replacement and zinc under-sheet fixtures. Plumbing was done to fix new

Polyethylene-pipes from ground floor mains to office as the old metal pipes within the walls were rusted and low on pressure. Bathroom repairs were also made recently as the severage pipes broke and damaged the ceiling as well. For the past 30 years the roof has not been changed. Third floor repairs on plumb lines were made. Ground floor plumbing was also done. Ground floor rusted front and back metal sliding shutters were replaced with Aluminum pull-down shutters. The NUJ is thinking of renting the 3rd Floor to the South East Asia Journalists Union (SEAJU) as its office headquarters and receive much higher rentals from this office if it is agreed upon. The Union is also supposed to make a curtain screen at the lounge area as prayer room. However, it has been suggested verbally by the office bearers to break out the air-way area to enlarge the NUJ office space as were done by the 1st floor tenant and the next door tenants. A brand new photocopier was purchased by the Union with facsimile and scanning capabilities including colour printing. 25. FUNDRAISING DRIVE The Union initiated a fundraising drive from 2013 till May 2014 to collect funds to pay for the NUJ 52nd Anniversary Celebration which include anniversary dinner, forum and Penang visit. The anniversary celebration was supposed to be held in 2012 as the NUJ 50th Jubilee Celebration but was shelved by the then exco. The Exco of 2012-2014 made a decision to hold the celebration as soon as possible and made it a reality. The remaining funds will also be channeled to refurbishing the Union office and for legal costs. NUJ also came up with a souvenir programme towards that end.
