The reply for the above mentioned Lok Sabha Question approved by Competent Authority is as

follows:-

Institutes closed during the last three years are

given in Annexure-I.

Regarding the control exercised by AICTE

over fees to be charged by the private

institutes/colleges. It is informed that :

As per the Hon’ble Supreme Court of India

directions in the case of T.M.A. Pai Vs State of

Karnataka judgment dated October 31, 2002,

Islamic Academic of Education Vs State of

Karnataka dated 14.08.2003 and Inamdar Vs

State of Maharashtra judgment dated August 12,

2005, a National Level Fee Committee needs to

be appointed which will provide guidelines for

fees in various disciplines in technical

institutions. However, until such time the

National Fee Committee gives its

recommendations, a State Fee Level Regulatory

Committee be appointed to provide the

guidelines for fees to be charged in technical

institutions.

Most of the States have established Fee

Regulatory Committee to regulate the fees that

is to be charged in the technical institutions.

These Committees are generally headed by

retired High Court Judge; Director, Technical

Education; Principal Secretary, Technical

Education of the State and Chartered

Accountant. However, the Union Territories are

not having the Fee Regulatory Committee.

AICTE had constituted a Committee under the

Chairmanship of Justice Ranganathan Mishra,

Former Chief Justice of India for prescribing

guidelines for charging of tuition and other fees

and admission of students in technical

institutions. Four meetings were conducted on

12.08.2008, 14.08.2008, 08.09.2008 and

06.11.2008 respectively. However, the final

report was not submitted because of illness of

Chairman of the Committee. Justice

Ranganathan Mishra is now no more. Hence, it

was necessary that the Committee be

reconstituted.

Based on the Ministry of HRD letter Reference

No.F.7-15/2010-TS.II dated 03.01.2014, AICTE

has re-constituted the following Committee

under the Chairmanship of former Supreme

Court Justice Shri B.N. Srikrishna:

i. Shri Kumar Jayant, IAS,

Commissioner of Technical

Education, Govt. of Tamil Nadu;

ii. Dr. (Smt.) Jayanti Ravi,

Commissioner, Education, Govt. of

Gujarat; and

iii. Shri Ajay Jain, Secretary, Deptt. of

Education, Govt. of Andhra Pradesh;

iv. Dr. M. Abdul Salam, Vice Chancellor,

v. University of Calicut, Kerala;

vi. Prof. S.K. Kak, Vice

Chancellor,Jaypee University of I.T.,

Wakhnagar, Solan, H.P;

vii. Shri Anilbhai T. Patel, Ganpat

University, Mehsana, Gujarat;

viii. Shri Yogendra Tripathi, Financial

Adviser (HRD), Ministry of HRD,

New Delhi;

ix. Prof. V.M. Topkar, Deptt. of Civil &

Environmental Engg., Mumbai.

x. Dr. R. Sheoganokar, Director, IIT,

Delhi

The above Committee held its first meeting on

30.06.2014 and is expected to complete their

report in a period of six months.

AICTE have notified the regulations for the

creation of Ombudsman within the Universities

and Complaint Redressal Committee within the

Institutions respectively. A copy of AICTE

Regulations is attached herewith. (Annexure-II)

The Ombudsman shall exercise powers as given

in Section-IV page no.11.

If grievances are received from students in the

AICTE Office, the same is attended to by

seeking explanation from the Institute and

addressing the complaint based on the

provisions of the Approval Process Handbook

Chapter-IV. A copy of the provision is attached

herewith (Annexure-III). Further, if no relief is

provided, an action can also be initiated against

the Institute.

In continuation to the reply for the above mentioned Lok Sabha Question, please find the additional information as desired by you:

Reasons for closure of the institutions

The specific reasons for closure of the institutions are as follows:

1. There is less demand for institutes located in rural areas for admission, as the institutes are not able to provide an industry-institute-interface and campus placements. It may be noted that generally the students are interested in migrating to cities for education.

2. The demand for certain branches of engineering is less and institutes offering only such branches face the problem of not getting the seats filled up.

3. Attracting good faculty in educational institutions situated in rural areas is also difficult as there are no other openings for their spouses and children for employment and studies which in turn affect the quality of education and thereby the demand for such colleges is less.

In general, as the demand decreases in such institutions, the viability of running the institution is difficult and hence closures. However, generally it is seen that 92% of the Institutes are in the private sector and technically anyone can apply for closure. AICTE procedure for closure requires that NOC from the State Government and the Affiliating University is required for closure. An Expert Visiting Committee is then sent to inspect the college for liabilities. Report of the Expert Visiting Committee is placed before the Regional committee for discussion Approval of the Regional Committee is placed before the Executive Committee (EC) for approval. When the EC approves the Institute is closed.

Chapter IV

1 Action in case of violation of Regulations

1.1 An Institution running any Program / Course in Technical Education in violation of

Regulations, shall be liable to appropriate initiation of Penal Civil action including withdrawal

of approval, if any, and / or criminal action by the Council against defaulting Societies /

Trusts / Companies / Associated Individuals and / or the Institution, as the case may be.

1.2 Provided that, if any Technical Institution contravenes any of the provisions of concerned

regulations, the council after making such inquiry as it may consider appropriate and after

giving Technical Institution concerned, an opportunity of being heard, under appropriate

regulations, withdraw approval to the concerned Technical Institution / Program / Course.

Provide further that in case of such a withdrawal, the operations of the said Technical

Institution / Program / Course shall not be started again before completion of two academic

years from the date of such a withdrawal.

Provided further that, the students admitted to the Institute whose approval has been

withdrawal, shall be redistributed to other Institutions in the jurisdiction of the affiliating

University by the competent authority of the respective State Governments.

Such Institution where the approval has been withdrawn, the restoration is as per the

procedure for setting up a new Institute as defined in Chapter I

2 Non submission / Incomplete submission of application for extension of approval

The Technical Institutions shall submit the application for extension of approval in the

prescribed Format along with the enclosures to the concerned Regional Office of AICTE each

year for extension of approval by the Council, even in cases where the approval to the

Program / Course was granted for more than one year. The last date for receipt of such

application with or without Late Fee shall be as mentioned in the schedule.

Non submission / incomplete submission of application for extension of approval shall invite

appropriate penal action against the Institution. The Institution shall be liable to the

following punitive action from any one or more of the following by the council.

1. Suspension of approval for supernumerary seats for one academic year

2. No admission status in one / more courses for one academic year

3. Withdrawal of approval for Program / course

4. Withdrawal of approval of the Institution

3 Excess admissions

3.1 Excess admissions over the sanctioned intake shall not be allowed under any circumstances.

In case any excess admission is reported to / noted by the Council, appropriate penal action

will be initiated against the Institution. The Institution shall be liable to following punitive

action from any one or more of the following by the council.

1. Excess admission fee amounting five times the total fees collected per student shall be levied against each excess admission.

2. Suspension of approval for supernumerary seats for one academic year

3. No admission status in one / more courses for one academic year

4. Withdrawal of approval for Program / course.

5. Withdrawal of approval of the Institution.

3.2 Amount in respect of Excess admission fee shall be remitted to “Member Secretary, AICTE”

as per instructions issued by the council.

4 Non fulfillment of requirement of qualified Principal / Director

4.1 Institutions not having qualified Principal / Director for period, more than 18 months shall be

liable to following punitive action by the council.

No admission status for one academic year

5 Non fulfillment in Faculty: Student ratio, not adhering to pay–scales and/or qualifications

prescribed for teaching staff

5.1 Institutions not maintaining prescribed Faculty: Student ratio, not adhering to Pay scales, or

qualifications prescribed for teaching staff for more than 18 months, shall be liable to

following punitive action by the council from any one or more of the following.

1. Suspension of approval for supernumerary seats, if any for one academic year

2. No admission status in respective courses for one academic year

3. Withdrawal of approval in the respective course

4. Withdrawal of approval of the Institution

6 Non fulfillment in Computer, Software, Internet, Printers, Laboratory Equipments, Books,

Journals, Library facilities requirements

6.1 Institutions not maintaining prescribed Computer, Software, Internet, Printers, Laboratory

Equipments and Books, Journals, Library facilities shall be liable to following punitive action

from any one or more of the following by the council.

1. Suspension of approval for supernumerary seats, if any for one academic year

2. No admission status in one / more courses for one academic year

3. Withdrawal of approval for Program / course

4. Withdrawal of approval of the Institution

7 Non fulfillment in additional Essential requirements for Technical Institution

7.1 Institutions not maintaining prescribed requirements shall be liable to following punitive

action from any one or more of the following by the council. [

1. Suspension of approval for supernumerary seats, if any for one academic

year

2. No admission status in one / more courses for one academic year

8 Non fulfillment in Built up Area

8.1 Institutions not fulfilling prescribed built up area requirements shall be liable to following

punitive action from any one or more of the following by the council.

1. Suspension of approval for supernumerary seats, if any for one academic year

2. No admission status in one / more courses for one academic year

3. Withdrawal of approval for Program/course

4. Withdrawal of approval of the Institution

9 Refund cases

Institutions not following guidelines issued by the Council regarding refund of fees on

cancellations of admissions or delaying refunds shall be liable to following punitive action

from any one or more of the following by the council.

1 Fine for non compliance of refund of fees levied against each case shall be twice the total fees collected per student.

2 No admission status in one / more courses for one academic year

3 Withdrawal of approval for Program / Course

4 Suspension of approval for supernumerary seats, if any for one academic year

10 Amount in respect of Fine for non compliance of refund of fees shall be remitted to

“Member Secretary, AICTE” as per instructions of the council.

11 Procedure for restoration against punitive actions

11.1 Applicant makes an application for restoration on the Web Portal along with the

application for extension of approval of the next academic year.

11.2 The restoration is subject to Expert visit

11.3 The expert Visit Committee shall verify all the requirements as per the approval process

hand book.

11.4 Expert Visit Committee report shall be placed before Standing Complaint Committee.

11.5 Recommendations of the Standing Complaint Committee shall be placed before Executive

Committee for necessary Approval/ratification.

11.6 The Institute may appeal as per the procedure of appeal in Chapter I if the status quo on

punitive action is maintained.
