Factory Built Structureor is it a Tiny Home

• What are factory built structures?

• What codes or regulations are they constructed to?

• Who inspects or certifies the units as meeting codes and regulations?

• How to identify units in the field?

• Who has jurisdiction at the site of occupancy?

Recently “tiny homes” have received a lot of attention and interest. Today’s program will hopefully clarify some of the issues as to what is a “tiny home” and what is a factory built structure. Most of what will be covered is about the factory built structures, as “tiny home” is a phrase and not much else.

HUDManufactured Homes

Manufactured Homes used to be called “mobile homes”. In 1976 a national program under the jurisdiction of HUD was created.

HUD Manufactured Homes are constructed to the Code of Federal Regulations: 24 (CFR) 3280 Construction and Safety Standards. The standards are preemptive and no state or locality may establish or enforce rules exceeding those construction standards.

HUDManufactured Homes

Manufactured Home:

• Transportable in one or more sections

• 8’ or more in width, or

• 40’ or more in length, or

• When erected on site is more than 320 square feet,

• Built on a permanent chassis,

• Used as a dwelling,

• With or without a permanent foundation.

Calculations for square footage based on structures exterior dimensions.

CFR 3280.11 - Each transportable section must have a certification label attached.

CFR 3280.5 - The label shall be located at the tail-light end of each transportable section.

Each home shall have a data plate affixed in a permanent manor near the electrical panel or other readily accessible and visible location.

Data Plates: Each data plate shall contain the following info:

• The name and address of the manufacturing plant where the manufactured home was manufactured.

• The serial number and model designation of the unit and the date the unit was manufactured.

• The statement: This manufactured home is designed to comply with the Federal Manufactured Home Construction and Safety Standards in force at the time of manufacture.

• A list of the certification (HUD) label numbers that are affixed to each transportable section.

• Name of the agency that approved the design.

Data Plates: Each data plate shall contain the following info:

• The statement: This manufactured home is designed to comply with the Federal Manufactured Home Construction and Safety Standards in force at the time of manufacture.

• A list of the certification (HUD) label numbers that are affixed to each transportable section.

• A list of major factory installed equipment and appliances.

• The roof load zone, heating design area, and wind load zone design the home was constructed for.

• A statement regarding the requirement of installation of storm shutters. (high wind zone area).

MN State Building CodeChapter 1350

MSBC 1350: Manufactured Homes

• Installation rules and sales rules

• HUD units installed to manufacturers instructions

• Pre-HUD units installed to generic 1350 standards

• All new and used manufactured homes sited in MN shall have installations inspected at time of installation by: certified building official, or engineer, or architect.

• Each home shall receive MN installation seal and certificate from a licensed installer.

No regulation may prohibit earth sheltered construction as defined in section 216C.06, subdivision 14, relocated residential buildings, or manufactured homes built in conformance with sections 327.31 to 327.35 that comply with all other zoning ordinances promulgated pursuant to this section.

• "Manufactured home" has the meaning given in Minnesota Statutes, section 327.31, subdivision 3, and for the purpose of determining occupancy separations, is considered a Group IRC-1 occupancy.

• MSBC 1360.0100 Subp. 2.

• The purpose of this chapter is to govern the construction of, and provide for the certification of, prefabricated buildings for those manufacturers who construct not more than three prefabricated buildings for permanent installation in Minnesota in a calendar year. Manufacturers of prefabricated buildings other than those regulated by this chapter or that produce more than three prefabricated buildings for permanent installation in Minnesota in a calendar year, must comply with the industrial/modular buildings rules, chapter 1361.

Prefabricated Buildings

• "Prefabricated building"

• MSBC 1360.0200 Subp. 15.means any building or building module intended for use as an IRC-1, one- or two-family dwelling, or a U, (accessory building from IBC) or a IRC-4 (from MSBC) which is of closed construction and which is constructed, off the building site, for installation, or assembly and installation, on the building site, but does not include relocatable contractors offices or storage buildings that are 1,500 square feet or less in floor area, that are designed for temporary use by a contractor at a construction site, not to be used by the general public or as a sales office, and that will be removed prior to or upon completion of the construction project.

• MSBC 1360.0200 Subp. 5.

• "Closed construction" means any building manufactured in such a manner that all portions cannot be readily inspected at the installation site without disassembly, damage to, or destruction thereof.

These buildings are usually constructed by high schools, technical colleges, retail lumber yards.

Prefabricated Buildings

Each building will have a construction seal located inside the unit. In a home it will located under the kitchen sink area along with the required data plate.

Each building will have a data plate containing information about roof and floor design loads, energy design, service panel, serial number, and construction label number.

Data will also indicate items that would be furnished or completed at the site of occupancy.

• 1360.1200 Standards and Requirements

The standards and requirements for manufacture and installation of pre-fabricated buildings must be in compliance the current Minnesota State Building Code.

• All site built portions of Pre-Fab Buildings shall meet the minimum requirements of the MSBC.

• MSBC 1360.1000 On-site inspection by local code enforcement agency

Local code enforcement agencies shall:

• Inspect the installation of pre-fab homes.

• Inspect without causing undue delays.

• Not require removal of permanent parts of the structure.

• Report non-compliances to the State Inspector.

• MSBC 1360.1100 Local zoning issues are the Responsibility of, and

are entirely reserved to the local municipalities.

Industrialized ModularBuildings

• Minnesota is a member of the Interstate Industrialized Building Commission. MN Statute 326B (since 1995)

• Adopted Industrialized Building Commission, Model Rules and Regulations (MRR) for Industrialized/Modular Buildings. 1361.0300

• Regulates Buildings and Building Components of closed construction.

• Any building type or occupancy that complies with the building codes adopted by the receiving state.

"CLOSED CONSTRUCTION" means any building, building component, assembly, or system manufactured in such a manner that concealed parts or processes of manufacture cannot be inspected at the building site without disassembly, damage, or destruction. The definition shall not include products, such as structural, electrical, and plumbing fixtures and equipment which are tested, listed, labeled, and certified by a nationally recognized testing laboratory.

Industrialized ModularBuildings

• 1-label required per each module, or

• For panelized units 1-label for every 125 lineal foot of panelized (closed) wall.

• In homes labels are usually located under the kitchen sink area, bath vanity area, or in a closet.

• In commercial units labels are usually located near the electrical panel or junction boxes.

Industrialized ModularBuildings

Data Plate:

• Every building must have a data plate designed and installed by the manufacturer.

• Data plates will contain constructions information, occupancy type, construction type, design loading, construction items that are to be completed on-site, and all IBC label numbers for units making up the building.

• Data plates in homes usually under kitchen sink area and in commercial units near the main electrical panel.

Industrialized ModularBuildings

Local authority having jurisdiction:

• Shall issue permits and certificates of occupancy for Industrialized Modular Buildings,

• Shall not withhold issuance of building permits for buildings containing certified building components which in all other respects comply with the codes.

• Local enforcement agencies shall inspect all industrialized/modular buildings or building components upon, or promptly after, installation at the building site to determine whether all site-built work is in accordance with the plans filed with the permit application, the installation instructions, and the conditions listed on the manufacturer's data plate. This may include tests for tightness of plumbing connections done onsite and for malfunctions in the electrical system, and a visual inspection for obvious nonconformity with the approved plans or the code.

• May receive IIBC labels or certification, (July 2017)

• Will not receive MN Prefabricated labels or certification.

• Would require permits, reviews, and approvals from the LAHJ.

• Would need MN engineers sign off of review for structural design and use.

• Would require foundation to the MSBC designed by MN engineer or to MSBC.

• Would require MN engineers anchoring design to the foundation or in accordance with MSBC.

Used shipping containers are now also being converted into homes and other occupancy type buildings.

Do not confuse them with a HUD manufactured home as they look very similar in most cases.

The labeling and type of construction are different.

Recreational Park Trailer: “trailer type unit that is primarily designed to provide temporary living quarters for recreational, camping, or seasonal use”.

• Name and address of the manufacturer,

• Serial number of VIN of the unit,

• Capable of being cleaned without removing or obscuring the data.

Campers & Recreational Vehicles (RVIA):

• Built in accordance with NFPA 1192,• Vehicular type unit that is primarily designed as temporary living quarters

for recreation, camping, or seasonal use,• Has its own mode of power or is mounted on or towed by another vehicle,• Is regulated by the National Highway Traffic Safety Administration as a

vehicle or vehicle equipment,• Does not require a special highway use permit for operation on the

highways,• And can be easily transported and set-up on a daily basis by an individual.

Recreational Vehicles& Campers

NFPA 1192:

Regulated by the National Highway Traffic Safety Administration (NHTSA)

• May not exceed 8 ½ feet wide,

• Affix a label that is riveted or permanently affixed (label content as per 49 CFR 567.4),

• Certification label to contain Gross Vehicle Weight Rating (GVWR) and Gross Axle Weight Rating (GAWR)

• Vehicle Identification Number (VIN) as required in 49 CFR 565,

• Individual states have brake requirements, typically for trailers greater than 3,000#

Tiny House

• In most cases has no label or certification of any type of code compliance or inspection, (structurers or frames)

• Could be built by individuals or corporations,

• No installation or set-up rules required.

• They could also be labeled units with HUD, MN Prefabricated, IIBC, or RVIA certification labels on the units.

• If labeled all on-site installation rules and regulations including foundation designs would be required as per MSBC.
