Activities covered under the new rules include produc- tion, processing, selling and buying, importing and exporting, and transporting raw leaf tobacco. Applica- tions for producer certificates must be made annually, at least 30 days before the intended first planting date. There are monetary penalties for engaging in raw leaf tobacco activities without having the proper registration certificate in place. These penalties can be substantial – up to $20,000 for repeat offenders. The Ministry also has the power to deny, suspend or cancel a farmer’s registration as a tobacco producer. The process of challenging decisions that affect tobacco farmers has also changed. Under the previous regime, tobacco producers were regu- lated by the Ontario Flue- Cured Tobacco Growers’ Marketing Board, a “local board”, given authority under the Farm Products Marketing Act(which legislation applies to many other farmers in Ontario). Tobacco farmers seeking a review of a board decision had a right of appeal to the Agriculture, Food and Rural Affairs Appeal Tribunal. Under the amendments to the Tobacco Tax Act, in cer- tain circumstances the Min- istry of Finance will hold a “show cause” hearing, where the farmer affected is given an opportunity to explain why a Ministry decision should be reversed. The Ministry has not yet published a written procedure to be followed for these show cause hearings, as it has in other cases, such as tobacco retailers seeking to challenge a Ministry decision to pro- hibit sales of tobacco products. In the case of a seizure of T his will be the first year of a new system for regu- lating the Ontario tobacco industry. The Ontario Ministry of Finance is now responsible for overseeing all aspects of the tobacco supply chain – from planting through to sales and export. Tobacco farmers need to familiarize themselves with the new rules, regulations and pro- cedures imposed by the Ministry of Finance as a result of amend- ments to the Tobacco Tax Act. What’s New? An application to court mayalso be made where there is adispute over the interpreta-tion of a provision of theTobacco Tax Actor its regula-tions and the Minister ofFinance agrees that the dis-pute is a matter of publicinterest.

What’s Not New?For tobacco farmers, the

r ules int roduced by thetobacco board over the pasttwo years will have preparedthem somewhat for the newregime.

With the production certifi-cate application, farmersmust state their planned pro-duction for the season andprovide evidence that theyhave a contract with a pur-chaser that accounts for theirentire anticipated tobaccocrop.

By June 30, they must con-

firm the acreage planted andidentify their growing andstorage locations. Inspectionsby provincial tobacco inspec-tors will continue as in 2014.

In some respects the newsystem is less onerous thanwhat the tobacco board had inplace last year.

For instance, the labelingrequirement for baled tobacco– each bale of tobacco had tobe labeled with informationabout the grower and pur-chaser as soon as it was baled– is not part of the Ministry ofFinance regulations.

With respect to acreageconfirmation, the tobaccoboard’s practice of accuratelyconfirming planted acreageby GPS measurement is alsonot part of the new rules.

Expect growing painsThe Ministry of Finance

was already responsible forregulating the production andsale of cigarettes, cigars andother tobacco products. Ittook over responsibility forregulating raw leaf tobaccofollowing the passage of Bill

186 – Supporting Smoke-FreeOntario by Reducing Contra-band Tobacco Act.

As its name suggests, thenew laws are intended to curbthe production and sale ofi l lega l tobacco th roughgreater provincial oversight.

As a result, tobacco farm-ing has effectively been takenout of the regulatory environ-ment that other Ontario farm-ers operate in, and into a newregime managed exclusivelyby the Ministry of Finance.

Tobacco farmers can expectthere will be some growingpains, as the Ministry ofFinance begins to implementits own procedures and gets abetter handle on what isneeded to reduce the risk thatraw leaf tobacco is divertedinto the black market.

While the Minist ry ofFinance has published severalbulletins and guidelines on itswebsite which generally out-line the new rules and regula-tions (www.fin.gov.on.ca/en/tax / t t / rawleafproducers.html), tobacco farmers look-ing to navigate their waythrough the new regulationsmay want to consult legalcounsel to assist them.(Daniel Chitiz and Alastair
