The threat of picketing against ABCby Italian-Americans because of therma-tionality of the �heroes� of _92The-&#39;-l>{n-rouchghles of diminished �last week fol-lowing a meeting between two ABCo�icials and Rep. Alfred E. Santangelo D-N. Y.! and colleagues in Washingtonlast week.

Mr. Santangelo met with ThomasW. Moore, ABC programming vicepresident, and Alfred Schneider, ABCvice president for administration. TheNew York congressman charged that�the use of Italian~named gangsters o1{�the program depicting the racket-rid�lklen 19205 defamed all Italian AmeriiJeans.� He also questioned the use othe documentary approach on the pro-gram which gave viewers the idea thatthe action was reenacted from reallife.

The ABC of�cials explained that thenetwork had taken steps some monthsago to minimize the use of Italiannames, and that some weeks ago ithad begun labeling the program as�based on fact� but with dramatic,

�ctional license taken.ABC_insisted, however, that it re-

tains the right to judge whether ornot any defamation is involved in anyprogram on its network. This Mr.Santangelo and his colleagues agreedwas ABC�s right; they denied any at-

Television, like any other medium of cormnuni-cation, is subject to the libel laws, and the courts are avail-able to any person who feels wronged by a televisimi per-formance. If Mr. Bennett thinks he or his bureau has been

damaged, he has the right available to any citizen to me.No matter what the nature of the program in question,

Mr. Bennett muifed the last one;KQV is owned by ABC but it&#39;s aradio station.

All stations announced they wouldcarry the program, despite Mr. Ben-nett�s threats.

apparently prison guards everywhere,were scenes which indicated that

guards transporting Capone by trainfrom Georgia to San Francisco Bayhad their hands out for bribes.

In responding to Mr. Bennett�s �rsttelegram, ABC General CounselOmar F. Elder Ir. said that he didn�tbelieve the tv audience regards theunfavorable portrayal of one or twoindividual guards as representativeof others. Mr. Elder said the net-work must "respectfully" decline therequest. Mr. Bennett had said he

wanted the second part postponeduntil he could confer with the Attor-ney General and with the FCC.

Prison head protests V�Untouchables� stations�James Vkiliennett, federal director of

prisons, F day asked FCC for permis-sion to appear in opposition to licenserenewals for nine tv stations whichcarried second part of Al Capone storyon ABC�s The Untouchables. He tookaction as he had threatened to do afterall stations disregarded his request theynot run program see page 62!.

Mr. Bennett also sent communica-ion to Senate and House Commerce

Committees, asking for meeting to dis-14;cuss Capone program, which he alleged�;maligned federal prison o�icers byshowing some of them in collusion withgangsters. -

In second show last Thursday night,ABC issued disclaimer that show in-tended to re�ect� on good name ofFederal Bureau of Prisons or its per-sonnel. This was done voice over clos-ing credits.

�We found we couldn&#39;t lick the script problem on limited appear-ances,� he says. �We were pretty much playing it by ear when -westarted, and we tried one show without the Elliott Ness character andsaw it wouldn&#39;t work. That&#39;s when I agreed to do them all. Nessseems to be the focal point of the show, and without him it doesn&#39;t work.�

Stack, like many another rising fihnstar, naturally is concerned abouta series� effect upon his availability, price and stature on the featureside. He thinks the series has already helped in terms of price andstature. �It feels good to let the other guy play the flash role. Inpictures, I was always the neurotic, I had the �ashy roles, and in a waythese limit an actor. In the series I�ve got the �good guy� role, and itseems to be making an impression on the public."

As to price, show has had a noticeable effect, with current talkfinding Stack�s pic price jumping about $30,000 to around $120,000 perpic. He feels it&#39;s due to the series, if for no other reason than thefact that his availability has been tightened. Actually, he thinks it&#39;smore than that, that the show has an �inside� �avor in terms ofbeing viewed by the key Hollywood people, and the change of pace inhis characterization is a factor as well. As to availability itself, hehopes to wind production in May, to be available for e picture. Mean-while, Metro is prepping release of �The Last Voy;§� which shouldcover his theatrical exposure till then.

Apart from working hard at tv and liking it, largely because of thekind of production values going into the show � �night for night"shooting, for example - Stack won&#39;t deny the incentive of his financialinterest in the series -� he owns 25% through his Langford Produc-tions, which may produce indie films as well. But for the present, it&#39;s,all television as far as he&#39;s concerned. &#39;
