Nominations for “Excellence in Government Service” Award Due February 20 Last year the Federal Communications Bar Association established an award, to be provided annually, to recognize the contributions of federal government employees to the field of communications. The first recipient of the award was Daniel “Mack” Armstrong, who was honored at a reception in June of 2008. FCBA President Mark Schneider will appoint a selection committee, and the second recipient will be announced in Spring 2009. All current federal government employees in communications-related positions (not limited to attorneys or FCBA members) are eligible nominees. DEAR MEMBERS :

The present holiday season marks a time of transition formany of us in many different ways. As 2008 turned to 2009,we await the inauguration of a new President, and with him, anumber of changes and “firsts” internationally and nationally,as well as at the heart of our practice. Many of our companiesand firms also are responding to the challenging economicenvironment as they look toward the new year. At the FCBA,our charitable and educational goals have not wavered. I amproud to report that our programs have continued to be leaders in simultaneouslyoffering our members the opportunity to come together to provide support for ourcommunity, and also to learn about, and debate, the most important topics in ourfield.

On the charitable front, last month I recognized the stellar work of the YoungLawyers Committee and the Charity Auction committee in raising more than$91,000 for Horton’s Kids and the FCBA Foundation’s scholarship program. Thismonth I thank Pam Cooper, David O’Neil and Mary Plantamura for coordinatingthe FCBA’s holiday gift drive, which raised donations totaling nearly $11,000 in cashand gift cards. Special thanks to Karen Brinkmann, who in addition to being afrequent participant in McKenna’s Wagon, led her firm’s donation of 300 sets ofblankets and sheets to the hypothermia shelters operated by Families Forward, Inc.Finally, I would like to thank Joanna Georgatsos for coordinating the FCBA’s staffingof McKenna’s Wagon this year, and leading our effort to deliver food from Martha'sTable to the homeless one Sunday every month.

On the educational front, in addition to our regular CLEs and committee luncheons,I look forward to at least two leading events on the transition and future of the FCCearly in 2009. In this issue we announce a luncheon with FCC CommissionerRobert McDowell on Monday, February 2, 2009. Commissioner McDowell willaddress the transition at the FCC and his views on its prospective operation in anew administration. Three weeks later, on Tuesday, February 24, 2009, the FCBAwill host an all-day program on “The Communications Act and the FCC at 75:What Will the Future Bring?” As discussed elsewhere in this issue, the program willfeature the highest level and quality speakers on panels focusing on key policies ofFCC decision-making and anticipated crucial issues for Commission attention as weenter a new era. The program, co-chaired by Michele Ellison, Adam Krinsky,Nancy Victory and Chris Wright, is being designed to provide both a sophisticatedanalysis of key legal issues and a stimulating discussion of important policy issuesfor the new Congress and Commission.

Finally, one other transition matter: immediate past FCBA president Diane Cornellhas begun work on the Nominations Committee’s task of selecting candidates fornext year’s slate of officers and other elected FCBA and FCBA Foundation positions.In addition to Chair Diane Cornell, this year’s Nominations Committee will includeAnn Bobeck, Carolyn Brandon, Scott Delacourt, Jerry Fritz, Tarah Grant, JordanGoldstein, Kathleen Ham, Linda Kinney, John Nakahata, Celia Nogales, JamisonPrime, and Colin Sandy. Please provide your suggestions for candidates for the newofficers, Executive and Nominations Committee members, and FCBA FoundationTrustees to Diane or any other Nominations Committee member.

New EnglandChapterThe New England Chapter of the FCBAheld a Steering Committee call in earlyDecember in order to do a post-mortemon our November 18th event, A Reviewof The National Elections; as well as,began the process to further plan aseries of programs for 2009. SteeringCommittee was very pleased with thesubstance of the November 18th eventbut had hoped for better attendance.Various recommendations wereprovided to increase attendance whichthe Chapter will utilize including effortsof the Steering Committee to bettercommunicate the events movingforward. In addition, Boston Universityhas invited FCBA to do anothercollaborated program in the Fall of2009. Plans for that program will occurin the early part of 2009.

Planning is underway for a brown baglunch in collaboration with the NewHampshire Bar Association’s Utility LawSection for the March 2009 timeframe.Steering Committee Member SusanGeiger will be working with othermembers of the Committee to finalizethe program and publicize the event.Various topics have been discussed thusfar, including broadband deploymentefforts, pole attachment issues and theFairpoint Communications cut-overscheduled for January 2009. Theprogram will likely includeCommissioners and Senior Staff of theNew Hampshire Public ServiceCommission so that the membership

and attendees can benefit fromintroductions and further networkingwith the New Hampshire Commission.

In addition, the Steering Committee ismaking plans to collaborate with theNew England Consortium of PublicUtility Commissions for their AnnualSymposium on SmartGrid technology.This exciting program will provide NEFCBA an opportunity to collaborate ona panel that will provide backgroundabout the issue from experts from boththe telecommunications and energysectors; and is on the forefront ofemerging issues in the states. FormerNE FCBA Co-Chair Doug Denny-Brownand other members of the SteeringCommittee will spearhead this effort inconsultation with NECPUC. TheAnnual Symposium dates are not yetavailable but the location this year willbe in Newport, RI.

More planning is underway for anadditional brown-bag event possiblywith the Maine Public ServiceCommission later in 2009, as well as, amembership favorite program whichreviews the status oftelecommunications issues in NewEngland, other regions and inWashington, DC.

New York ChapterOn December 8, 2008, the New YorkChapter of the FCBA, along with theTelevision & Radio Committee of theNew York State Bar Association’sEntertainment Arts & Sports LawSection and the TelecommunicationsLaw Committee of the New York CityBar Association, jointly presented aprogram on White Spaces. BarrySkidelsky (who co-chairs both theFCBA NY Chapter and the NYSBA TV& Radio Committee) moderated a livelydiscussion involving panelists DavidDonovan (President, MSTV), SteveSharkey (Senior Director of Regulatory& Spectrum Policy, Motorola), and GaleBrewer (NYC Council member, chairTechnology in Government committee).A diverse group of about 40 peopleattended the program and networkingreception. The Internet’s development has amazedeven its early pioneers and its ability toconfound skeptics suggests that calls forchange should be taken with a grain ofsalt. At the same time, it seems difficultto imagine that the Internet’s future willnot feature any number of innovationsthat will change how it operates.Indeed, issues such as security, mobility,increased machine-to-machinecommunications, and the advent of real-time applications challenge some of thedesign principles of the currentInternet. In any event, the network ofthe future will be shaped not merely bytechnological change, but alsoeconomics, the needs of users, andpolicy directives.

This conference will imagine theInternet’s future, discuss its economicand social implications, and contrastdifferent prescriptions for Internetpolicy. It will do so by bringingtogether a top flight group of academics,policymakers, and industry leaders todiscuss these issues along fourdimensions. First, we will evaluate thetechnological, economics, social, andpolicy challenges that are emerging onthe horizon. Second, we will discussthe changing architecture of theInternet, the role of networkmanagement, and the significance of thetransition away from an end-to-endarchitecture. The third panel willevaluate whether existing institutions—be they the Federal Trade Commission,the Federal CommunicationsCommission; standard setting bodies

like the Internet Engineering TaskForce; self-regulatory bodies; or privatecontracting—are up to the task ofoverseeing Internet communications,including ensuring the reliable servicedelivery across different networks. Thefinal panel will discuss the majorchanges in how the Internet servesconsumers and how the market forInternet content is evolving. In alldiscussions, we will bring together therelated technological, business, andpolicy themes that are shaping theInternet and the future of innovation inthe information industries.

Afterserving as chief legislative aide to amember of the Virginia House ofDelegates, he attended the Marshall-Wythe School of Law at the College ofWilliam and Mary. Upon his graduationfrom law school, McDowell joined theWashington, D.C., office of Arter &Hadden, a national law firm based inCleveland.

Extensively involved in civic andpolitical affairs, McDowell has served onnumerous boards and commissions. Hewas appointed by Virginia GovernorGeorge Allen to the Governor’s AdvisoryBoard for a Safe and Drug-Free Virginia,and to the Virginia Board forContractors, to which he wasreappointed by Governor Jim Gilmore.A veteran of several presidentialcampaigns, he was counsel to the Bush-

Cheney Florida Recount Team in 2000.His work during the 1992 presidentialcampaign is cited in the Almanac ofAmerican Politics, 1994. Among hisother endeavors, McDowell has twicebeen a candidate for the VirginiaGeneral Assembly. He currently servesas Chairman of the Board of the McLeanProject for the Arts.

McDowell is admitted to practice lawbefore the courts of the Commonwealthof Virginia, the U.S. District Court forthe Eastern District of Virginia, the U.S.Courts of Appeals for the District ofColumbia, First, Fourth and FifthCircuits and the U.S. Supreme Court.He resides in Fairfax County, VA, on thefarm where he grew up, with his wifeJennifer and their three children.

FCBA FoundationNow AcceptingApplications forFunding of UnpaidLegal Internships atGovernmentAgenciesFor the sixteenth consecutive year, theFederal Communications BarAssociation (FCBA) Foundation willaward stipends to law students from itsChairman Robert E. Lee Scholarshipand Internship Fund. In 2009, theFoundation will award at least five$5,000 stipends to law studentsemployed as unpaid summer interns inpositions with the FCC and othergovernment agencies or entities with aconnection to the communicationsindustry (i.e., broadcasting, cabletelevision, telephony, satellite, wireless,and information technology).

In addition, the Foundation will selectone outstanding intern among thosechosen to receive an additional stipendof $600 for the summer—the “MaxPaglin Award.” Mr. Paglin was theformer General Counsel and ExecutiveDirector of the FCC, and the founder ofthe Golden Jubilee Commission onTelecommunications, which compiled adefinitive legislative history of theCommunications Act.

Applicants will be selected on the basisof: (1) a demonstrated interest in thecommunications field, (2) havingsecured or having pending, an unpaidsummer position (internship) for atleast 8 weeks in communications with agovernment agency, (3) dependence onfinancial assistance in order to acceptthe unpaid internship in a governmentagency or entity involved incommunications; and, (4) communityactivities. To the extent a recipientreceives unanticipated funding for theunpaid internship, the FCBAFoundation’s general policy is to reduceits scholarship awards by any amount

that a recipient’s total funding(including all sources) for theinternship would otherwise exceed$7,000.

On-street parking is available. Volunteersare asked to bring food if possible, (e.g.,cold cuts, bread, peanut butter, jelly,vegetables and potatoes) because thecenter often runs out of donated food.

McKenna’s Wagon is a mobile soup andsandwich wagon that goes “on location”to deliver food to the needy. For thosewho have volunteered, it has been awonderful experience and a great wayto help the needy in the D.C.

community. This is an especially goodexperience for the teens and pre-teensamong us who do not have a fullappreciation of the many privileges theyenjoy. Community service credits arealso available.

The Wagon is a white van that is loadedup with sandwiches, snacks and soup.We meet at Martha’s Table at 4:45 p.m. incomfortable clothes and shoes. Martha’sTable is located in a yellow building at2114 Fourteenth Street, NW, in theDistrict, near the intersection of 14th andU Streets. On-street parking is available.

Upon arrival we get assignments (someof us will distribute snacks andsandwiches, others will serve soup), andput on aprons before we depart in thevan to 5th and New York Ave., NW(near the new Convention Center). Weare driven by one of our experiencedvolunteers and the trip to distribution

location takes about 10-15 minutes.

We serve about 30-75 people per visitincluding a few mothers who come forfood for their families. The area is wellpatrolled by police. Interested in Hosting an FCBA event?The FCBA greatly appreciates the support of our members’ firms and companieswho provide space for our brown bag lunches, committee meetings, and CLESeminars throughout the year. We are, however, always looking for newlocations that can host FCBA events. We will be experimenting with some newpresentation technology in future CLE seminars, which require more technicalsupport than we have needed in the past.

In general terms, we need conference rooms that can seat at least 30 (more ifpossible) people at tables for brown bag lunches and committee meetings andconference rooms that can seat a minimum of 60 for CLE seminars. Firms andcompanies hosting brown bag lunches provide beverages and desserts; firmsand companies hosting CLE seminars provide beverages and snacks. CLEseminars are generally held from 6:00 – 8:30 p.m. Additionally, for CLEseminars we need facilities that can provide technology support formicrophones for as many as six speakers on a panel, the ability to tie the housesound system into a teleconference bridge, video projection capabilities forPowerPoint presentations, and access to the internet for presentations byspeakers. Nominations Open for 2009ElectionsPursuant to Article V, Section 20 of the Association’sBylaws, the FCBA’s Nominations Committee is beginningthe process of preparing the ballot for the 2009 annualelection. Positions to be filled are: President-Elect;Secretary; Assistant Secretary; Assistant Treasurer;Chapter Representative to the Executive Committee;three (3) members of the Executive Committee;Representative to the American Bar Association; three (3)members of the Nominations Committee; and four (4)FCBA Foundation Trustees.

The first step of this process is for members to notify theNominations Committee of their interest in beingnominated, or to recommend other members forconsideration for nomination. Nominations should be sentto FCBA Past President and Chair of the NominationsCommittee, Diane J. Cornell, via email [email protected]. Please give the name of themember to be considered for nomination and the officethey are being recommended for by January 16, 2009.

The Nominations Committee will present a slate ofnominations to the membership via email and thenewsletter. At that point, members will have the option ofmaking additional nominations as outlined in the Bylaws.
