Chairman Kevin Martin and Commissioners Michael Copps, Jonathan Adelstein and Nashvillian Deborah Tate were present; Robert McDowell was absent. Martin opened the proceedings and at the end of his remarks received an ovation when he stated, “I also want to briefly touch upon an issue of interest to many of you here today -- payola. The FCC has longstanding rules prohibiting payola. These rules serve the important purpose of ensuring that the listening public knows when someone is seeking to influence them. Broadcasters must comply with these rules. We will take enforcement action if they uncover violations of the payola rules.” (Continued on Page 6) Capitol’s Foster To Universal South Capitol Sr. VP/Marketing Fletcher Foster has been named Sr. VP/GM for Universal South, joining Mark Wright who was recently named the label’s President. “We’ve attracted the highest quality of leadership with Fletcher,” says Wright. “Throughout his career, he has not only demonstrated true leadership in a variety of situations, but an unwavering commitment to the ACTIVATOR CHART BOWS JAN. 8 Country Aircheck will launch a new “Activator Chart” in the Jan. 8 Music Edition. Please include 25-54 ratings info for the past year -- shares and rank -- and a current playlist that includes artist, title and number of weekly spins. In addition to being ratings winners, Activator Reporters must maintain a minimum current percentage of 25% and be willing to submit ADDS in the case of Mediabase monitored stations, and current airplay lists and ADDS in the case of non-monitored reporters. FCC Continued...The first session examined issues affecting the music recording industry and featured 14 speakers including Country stars George Jones, Porter Wagoner, Naomi Judd, Dobie Gray, Cowboy Troy and Big & Rich’s John RichandKenny Alphin.AlsoappearingwereNashvillemusician’s union President Harold BradleyandsongwritersCraig WisemanandRick Carnes.Thelonecommercialbroadcaster was Cromwell Radio President Bud Walters;Sharon Kay, GM of Fisk University’s WFSK, was also on thepanel. As might be expected from a panel heavily populated with artists, their five-minute testimonies centered on the difficulties artists have being heard in a consolidated media world. After describing the difficulty he’s had getting his music on the air, Cowboy Troy told the FCC Commissioners, “If my music is good enough for the Grand Ole Opry, I would humbly submit it is good enough for the radio.” Rich bemoaned the lack of Country radio in New York, LA and San Francisco, calling it “an absolute travesty,” saying such a gap not only doesn’t serve the public, but ensures that country artists get “clubbed over the head” by not getting their music heard in those markets. “That is the most anti-American thing I’ve ever heard in my life,” he said, attributing the lack of Country stations in those markets to the decisions of radio “bean counters.” Big Kenny urged the FCC not to pass rules allowing greater media ownership to a few companies. He said, “The onlythingweaskisthatwedoeverythingwecantokeeptheairspacefreeandopentoeveryonesowecanhavealittlemore airspace between raising hell and ‘Amazing Grace.’” Rick Carnes, President of the Songwriters Guild Of America, testified to the affect radio consolidation has had onsongwriting,tellingtheCommissioners,“I’vespentmyentire life getting to the truth in 3 1/2 minutes. I can wrap-up my thoughts in five words: Big radio is bad radio.” He

radio groups, “We’re not all big, and even the biggest are not all bad. I personally have issues with Clear Channel. But it’s not because of the quality of their radio stations.” Referring to complaints from the artistic community, Walters added, “The music business is different from the radio business. Granting a license to use the public airways doesn’t guarantee access to those airways by everyone who thinks they should have it.” He concluded by asking the FCC for “fair rules” so that broadcasters could continue to bring localism to free radio airwaves.” Thehearing’ssecondpanelwastoprovideanoverviewof the Nashville market and issues affecting broadcasters and independent programmers. He said, “The homogeneous programming that has resulted from radio consolidation limits opportunities for songwriters, artists and listeners alike.” Wiseman also added “a large number of people in corporate radio wouldn’t know a transmitter from a transvestite.” George Jones got a standing ovation when he concluded hisremarkswith,“Whenmylife,family,income,professionandneedsofmyfansareaffectedbymediaconsolidation,you don’t need to make another move in the wrong direction…. Please don’t make it any rougher for people like me, or tomorrow’s rising stars.” Naomi Judd spoke of meeting people all across America who are disturbed by what they are seeing and hearing in themediathesedays.Shechallengedthemwith,“Peopleinivory towers have no mind for the people they’re supposed to serve. They rape us and pay us a small pittance…. I urge you five chosen people to hear the voice of public interest and not special interests.” Bud Walters, radio’s lone defender, told the assembled, “Has consolidation worked? The short answer is yes…. In the early ‘90s half the radio stations were losing money. Many small market stations are viable today because of consolidation…. It takes a cluster of several stations in a community to get the audience and advertising one station could deliver several years ago.” Noting that the more than 11,000 U.S. radio stations are ownedby3,000distinctparentcompanies,Walterssaysthat’smore diversity of ownership today than in 1972.
