Commissioner Kalo said county’s responsibility is around $2,000 for this project. Administrator Cordes said yes, but it is not general fund monies, this money is from growing corn in the fields. He stated that several people look at the Ohio Checkbook on line, which is good transparency but they do not know how to read it. It looks like the airport is getting all this money from the general fund, which is not true, if you have questions, call or email us. It is the same with the transit budget; these funds are from fare boxes, ODOT, advertising, etc. Commissioner Lundy said this is frustrating because they can explain and put everything out there, but people make comments and when he asks Clerk Upton, Assistant Shanahan, Budget Director Hobart or Assistant Strohsack if anyone has emailed and called and they all say no, then how can the people be truly informed.

Purchasing Department, publicly opened and read aloud. The Engineer’s Opinion of Probable Cost is $105,352.50.We have reviewed all bids and tabulated the results. Based on our review, we recommend Axtell’s, Inc. be awarded the project in the

amount of $43,847.00. The award of this amount is subject to availability of Lorain County and ODOT funds.If you have any questions please feel free to call our office.”

WHEREAS, the Lorain County Commissioners were awarded $200,000 by the United States Environmental Protection Agency for Brownfield redevelopment planning; and

WHEREAS, qualified planning consultants will be competitively procured in accordance with Federal, State and Local Procurement regulations.

BE IT RESOLVED, by the Lorain County Board of Commissioners we advertise for Request for Proposals (RFPs) for Qualified Planning Firms to conduct planning activities that lead to the an Area-Wide Redevelopment Plan for the Lorain Pellet Terminal docks and the surrounding Broadway and 28th Corridor.

NOW, THEREFORE, BE IT FURTHER RESOLVED, all such proposals must be responsive to the Scope of Services section of this RFP and must meet the content of Proposal criteria. WHEREAS, Keith A. Bailey, Director, Lorain County Solid Waste Management District, by memo dated May 23, 2017, submitted the following:

“On January 3, 2017, we issued a public request for proposals to transport, recycle and dispose of waste materials accumulated by the District's Household Hazardous Waste Collection Program. Six qualified proposals were received.

After reviewing all of them, we have determined that the proposal from Ross Environmental Services, Inc. of Elyria, Ohio is the one best suited to satisfy our requirements.

Based on their proposal, we have negotiated a contract with them, and had its form and legal sufficiency approved by the Prosecutor’s Office. A copy of that contract is attached.

I recommend approval of this contract with Ross Environmental Services, Inc., to start immediately and continue until the end of 2019. All expenses related to this contract will be paid from Account Number 2260-0000-100-000-05-6200-0000, titled Contractual/Purchased Services.”

“We have reviewed the bids that were received for the Kipton-Nickle Plate Road, (TR-52) Bridge No. 0184 Replacement project in Pittsfield Township. The respondents to this bid were:

Senghas Construction $274,255.55Denes Concrete $322,864.00N & N Construction $329,925.21

Senghas Construction to complete all work by October 31, 2017. Senghas Construction does not propose any substitutions but have listed PS Construction, Wadsworth, Ohio and ARL, Richfield, Ohio as subcontractors for this project.

We recommend that the contract for the Kipton-Nickle Plate Road (TR-52) Bridge No. 0184 Replacement project be awarded to Senghas Construction, LaGrange, Ohio in the amount of $274,255.55. The Engineer’s estimate on the project was $322,650.00. The project includes the replacement of an existing steel beam bridge with a new reinforced concrete deck structure. Construction activities also includes minor roadway work on either side of the new bridge. This project is being proposed due to the existing condition of the current steel beam bridge.

The Ohio Public Works Commission will be contributing 89% of the project cost as a grant. The balance of the project funding will be provided by the Lorain County Engineer through the Engineer's MVGT funds.

We are requesting the Purchasing Department to issue a Notice to Proceed on or about July 10, 2017. Thank you for your cooperation in this project.”;

2. Appropriate care shall be provided to the Police Dog and physical control of the Police Canine maintained by Lorain County, Ohio, its successors and assigns so as to avoid any risk of harm or injury to the Police Canine or any other animals or persons with whom the Police Canine has contact;

3. LORAIN COUNTY, OHIO TAKES THE POLICE CANINE “AS IS”. THE CITY OF CENTERVILLE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF FITNESS FOR USE AND MERCHANTABILITY AND LORAIN COUNTY, OHIO AGREES TO RELEASE THE CITY FROM ANY FURTHER RESPONSIBILITY OR LIABILITY ASSOCIATED WITH THE POLICE CANINE;

Commissioner Kalo said according to the surveys there was participation at Coles, Cork Tree and Jackalope. Ms. Kennedy said yes, but there was no feedback from the restaurants to gauge participation and meals. She stated that many people noted they tried the Strip for the 1 st time and others noted they made the trip to the Jackalope . This allowed people to try restaurants they normally wouldn’t.

Commissioner Lundy said he visited 2 restaurants during this week and as an observer the 1 restaurant was not, or at least the wait staff was not clear on menu, or even offered a card, the other restaurant went well beyond expectations.

JOURNAL ENTRYINDIGENT ATTORNEY FEES

Court Appointed Counsel/Indigent Court Attorney Fees – Jennifer Reidthaler-Williams, Bar Association President. Attorney Williams said also here today are Jeannie Motylewski, Executive Bar Association, Attorney Bill Wills and Court Administrator Domestic Jody Barilla. She stated that the indigent attorney fees are inadequate, have not been raised for over 20+ years and it is becoming a crisis to get attorneys to represent because of the rates. There are fewer attorneys willing to accept the assignments and is a crisis in the processing of legal matters in the criminal and domestic courts. She stated that all criminal defendants in Ohio, not merely those charged with felonies, have a right to the assignment of counsel if they aren’t able to afford one beginning at the time of arraignment. The statutory mandates require that juvenile defendants charged with felonies be appointed counsel. We don’t have a choice. In addition to this, in certain cases, it is required that guardian ad litems be appointed to represent the best interest of minors in a range of proceedings, including juvenile delinquencies and requires that the parents or guardians of juvenile offenders with pending cases in juvenile court also have the right to assigned counsel if they qualify. Again the fees are inadequate and standards are very low compared to like size counties of our statue as well as even with the Ohio Public Defenders office. As of now, it is $40 in court/$50 out of court for criminal and $35 in court and $30 out of court for domestic juvenile.

Commissioner Kalo said he serves on a committee through CCAO and Lorain County is the poster child with the lowest rates around and it has been 27 years ago since the rates have been raised. After through discussions there would be a 2 tier increase. Starting July 1, there will be a $5 increase in general division as well as felony juvenile and $5 increase in juvenile misdemeanant then again a $5 increase January 1, 2018.

Jody Barilla, Court Administrator – Domestic Relations thanked the Commissioners for their supportAttorney Willis thanked the Commissioners and allows attorneys to keep practicing fairly across the board for all clients. Commissioner Kalo said when Terry Boose, was State representative but now a Huron County Commissioners he tried to get the State to

take this over since they have mandated it to the locals, they need to have control.Commissioner Kokoski said it is not popular to give attorneys money but this is needed for fair representation.Jeannie Motylewski, Director – Lorain County Bar Association thanked the Commissioner and on behalf of the members of the bar

WHEREAS, to provide fair legal counsel appointed by the Court to represent indigent criminal defendants in the courts of Common Pleas and Domestic Relations we hereby adopt the increased fee schedule which is set forth herein which the revised fee schedule shall be reviewed annually, along with all other general fund expenditures during appropriation proceedings.

Reimbursement for expenses associated with representation of an indigent criminal defendant shall be made when submitted with the Attorney’s fee certificate and approved by the trial judge. Allowable expenses include, but are not limited to, such items as expert witness fees, polygraph examination costs, investigation costs, and other necessary items as may be approved in the discretion of the Court.

An investigator shall not be employed by defense counsel except by leave of Court being first obtained. Counsel shall make written application to the trail court for permission to hire an investigator who shall be paid an hourly rate not exceeding $30.00 per hour. The investigator's statement shall be attached to the attorney’s fee certificate, and the trial court shall establish the compensation to be paid to the investigator.

From time to time, case arise that warrant the compensation of the court appointed attorney at a rate in excess of the maximums established by the Board of Commissioners for Lorain County and the State of Public Defender commission because of extraordinarily complex issues, multiple offenses, length of trail, or other reasons. The Board of Commissioners for Lorain County chooses to provide for extraordinary payment of court appointed counsel in these cases. If the trail court approves the payment of extraordinary fees, the maximum fee contained in this schedule may be increased upon the further condition that the Board of Commissioners for Lorain County and the State Public Defender Commission, also, approve, in writing, the payment of said extraordinary fees.

A request for payment of court appointed counsel fees and reimbursement of expenses shall be approved for payment by the Lorain County Auditor only if the following conditions are met:

1) The request is submitted on the attorney fee certificate identified as form OPD-10256.2) Attached to the certificate is the completed and signed affidavit of indigence of the State Public Defender Commissions3) For appointments in the General Division of the Lorain County Common Pleas Court, attached to counsels’ fee certificate is

Lorain County’s affidavit of indigence and indigence information sheet.

Commissioner Kokoski said this past Friday, she attend the Mental Health meeting at LCCC, then her and Commissioner Kalo attended OPWC meeting at Carlisle Fire Station then she stopped at the Dog Kennel. At the previous commissioners meeting on Wednesday there were 30 days available and as of Friday when she stopped there were only 10 more available.

Commissioner Kokoski attended FIDO’s fundraiser at Wood & Wine, Avon, there were a lot of raffle baskets and Ron won the 50/50 and donated back

Commissioner Kalo said the OPWC meeting at Carlisle was represented by counties of Lorain, Medina & Huron and discussed projectsCommissioner Kalo said waiting for information from Solid Waste because we will start to discuss the next 5 year plan. He also

requested the community grants be increased by $75,000 because the City of Lorain came on to the cart system and do not want anyone that have been participation to be penalized because that is a bigger city

Commissioner Kalo said they will be participating in the memorial day parades in Elyria & Lorain

Barb Christian, Oberlin – Juneteenth 2017 Unveiling of Oberlin Tuskegee Airman. Speaker will be Delbert L. Spurlock, Jr., “Investiture: Tuskegee Airmen Memorial”. Also here today is Martha Wilkens, Sister of Tuskegee Airman William A. Johnston, Jr. On Memorial Day they will be celebrating at Wright Park at 10:30 a.m., laying a wreath for Mr. Ferrier H. White, a Tuskegee Airmen who died in Italy. A monument to his life and service stands in Florence, Italy to this dayShe stated that Mr. Richard Williams was instrumental in staring this history, because his brother was an Airman. He was unable to continue so her and his wife Shirley Williams have taken on the task, the battle is not over. She wrote a book detailing Oberlin Tuskegee Airmen” last year detailing the story of African-American men who wanted to join the Army Air Corps. A monument will have on it a plaque with the names of the nine men from Oberlin who served with the unit during World War II. They are James Cannon, Gilbert Cargill, William A. Johnston Jr., Norman E. Proctor, Wayman E Scott, Ferrier H. White, William L. Williams Jr., William Young and Perry H. Young Jr.

Commissioner Kalo thanked her for all her time and effort. Ms. Christian said African American history is important. She said the united airlines has filed discrimination and will not stop fighting. She asked if we could get this book over to Elyria high school.
