February 7, 2017 @ 6:00 PM

Mr. Garfinkel called the meeting to order by congratulating Father Phil Pelikan on the birth ofhis

gran ddaughter.

Mr. Garfinkel called for any discussion or revision to the February 7, 2017 PB meeting agenda. Mr.

Hall moved to approve the agenda. A11 ayes.

Old Business:

Mr. Garfinkel reviewed the items the PB was tasked with from the BOC: 1. RMU and possible

Changes; 2. Update zonmg Pemit application; 3. Definitions: in section 15 1.037 reference be made to

Weed ordinance - Mr. Hughes passed out a copy ofthe old ordinance that addressed keeping vacant

On it has to be cleared at least 3 times per year: June, August & October. Mr. Rubel asked why the

ordinance was removed. Commissioner Fowler said he it was removed when the new Ordinances were

Written. Mr. Hughes suggested a “cleared vacant lot’’be included in the ordinances. Mr. Rubel

recommended “any improved lot must be maintained.” He also asked about lots that in “natural state”

and have never been cleared. Mr. Ha11 asked how to legislate the clearing ofvacant lots. Mr. Rubel

Said the town is better offnot having overgrown lots. Mr. Garfinkel asked what would be the standards

to which the owners of「ots be held to clear away noxibus growth. Mr. Rubel sald Way屯rer’s Coveii

in violation of the current ordinance because there are numerous structures on that property and nothing

has been done to keep the noxious growth cleared. Mr. Rubel asked is this something that benefits the

town to extend the ordinance to include “a cleared or improved lot” from a lot with a dwelling: Section

91.02 Property to be kept clean. Mr. Rubel said the order would be a natural state, Cleared or improved.

Mr. Rubel said premise is a very broad tem and could mean an unimproved lot and/or a dwelling. Mr.

Garfinkel said the tem premises needs to be defined or replaced・ Mr. Ha11 moved to table the matter so

the board can establish a better definition for premises. All ayes.

Mr. Garfinkel tumed the meeting over to Mr. Rubel. They all were glVen COPies ofthe revised UDO

WOrking document. Mr. Rubel explained the changes and additions made at the previous meeting, Why

they were made and how they were integrated into the UDO.

1. 151、037 Term-Definitions-

A. New definitions to be include in the section:

There are three new definitions. There are no more changes in the first two from the previous meeting.

The third one is addressing the differences in modular and manufactured homes. The definition for

manufactured homes is su触cient. A definition is added for modular homes and referencing “offframe”

modular homes.

B. Modified definitions:

L On-frame Modular home is changed to On-Frame Manufactured Home.

II. Mobile or manufactured home: (last sentence) the tem Mobile or Manufactured home shall

not include an OffLFrame Modular home as defined herein. Modular and manufactured homes are built

tota11y differently to different standards.

C. Remove Definition: Planned Unit Development (ServeS nO PurPOSe because the PUD

OVerlay was removed).

2. 15 1. 197(e) Mobile/Manufa,Ctured Home Park: nO Change. Formatting error online.

3. 151.197 (e) 15 Changes: add “on frame” after 3rd word in the first sentence and remove “on-frame

modular homes" from first sentence and remove mobi獲e home” from the last sentence of the paragraph.

4. 151.164 R-M - Multi family Dwelling District

(This section is a mator rewrite ofthe existing RM wording and integrates two separate sections thatWere in the ordinance that treated single family and multi-family separately)

A. - Purpose: This district is established for moderate densdy single-family and low density

multi-family development- Ofvaryingtypes-and葛designs-Itis- Currently unclear, because it- is- nOt

SPeCifically referenced in RMU exactly the pass through ofRM. This sets up RM to include and

address that which is going to be spec綿cations for RMU.

B. Permitted uses: nO Changes

C. Special uses: adding ofswimming pool and utilities.

D. Development standards. (rewritten) All uses and structures pemitted in the R-M District

Shall meet the applicable development stands established in this section and a11 other applicable

Mr. Hall said Arlington Place has areas they rent for wedding venues and isn’t that commercial? Mr.

Mr. Rubel said we have definitions in the ordinances that show up in multiple places as opposed to one

section ofall definitions. He recommends a consolidation ofall definitions into one section at the

begiming- Ofthe ordinanees-for. ease of referenee.

Mr. Garfinkel thanked Mr. Rubel for all ofhis diligent, hard work on the revisions ofthe UDO. Mr.

Rubel suggested everyone digest the changes and vote on these changes at the next meeting. Mr.

Rubel wi11 send updates before the next meeting.
