No. SO(I&C)/L&DD/_______, In exercise of the powers conferred under Section 25 of the Punjab Animals Feed Stuff and Compound Feed Act 2016, the Governor of the Punjab is pleased to make the following rules:-

1. Short title, extent and commencement.-(1) These rules may be cited the Punjab Animals Feed Stuff and Compound Feed Act 2016.

(2) They shall come into force at once.

2. Definitions._ (1) In these rules:

(a) “applicant” means the owner or his authorized agent who intends to obtain a license;

(b) “authorized officer” means the officer so authorized by the Government under these rules;

(c) “Director” means Directors Livestock of all Divisions and includes any other officer so authorized by the Government;

(d) “License” means authority given to manufacture feed stuff, compound feed or customer formula feed and feed ingredients to be used in compound feed.

(e) “license fee” means the fee charged from the applicant for the grant of license;

(f) “TMR” means it is combination of grain, milling by products, minerals and vitamin mixture, straws, silage/fodder which fortifies all the nutritional requirements of respective physiological stage and production of animals during 24 hours.

(g) “HAY” means after evaporating/drying the moisture up to 15% during sunshine is called Hay.

(h) “Silage” means fermented fodder which is prepared in the absence of air by addition or not of the special inoculum for fermentation.

(i) “Compound Feed” it is a combination of grains, cakes/meals, minerals and vitamins which provides all nutritional requirements of animals.

(j) “Customer Formula Feed” A feed which is formulated on the basic nutritional requirements at different physiological functions.

(k) “Feed Stuff” These are the nutrients organic and inorganic compounds which are chemically of nutritional worth.

(l) “NOC” means the authority to establish a feed mill for manufacturing and marketing animals compound feed or customer formula fed on the conditions mentioned in section 4 of the Ordinance; and

(m) “Act” means the Punjab Animals Feed Stuff and Compound Feed Act 2016.

(2) All other words and expressions used in these rules, but not defined shall have the same meanings as are assigned to them in the Act.

3. Conditions for grant of license.-1. (1) A person who desires to establish a feed mill (Compound feed, meals ,cakes ,TMR and any kind of material produced in raw or processed shape to feed the animals)to manufacture and market animals compound feed and to obtain license for the purpose, may submit an application in the Form prescribed in Schedule-I to the Feed Inspection Officer(Directors Livestock of all Divisions and DLOs of each district and as notified by the Government) for obtaining the NOC and shall annex with the application a non-refundable review fee of rupees Five thousand in the form of a bank draft favouring the Government.

(2). Delegations: Government may delegates all or any of its power and functions under this act to Directors or any other Officer by Name or Designation.

(3). Power to make Rules: Government may frame/ amend the rules for purpose of carrying out into affect the provisions of this act.

(4). Every license granted under the ordinance shall be displayed at a prominent place within the licensed premises and shall be open to inspection by Feed Inspector of each District. (5 ). Each Concerned Officer nominated by L&DD Department shall maintain a register, permanently bound and serially paged, containing the name and addresses of license holders and applicants for licenses and the location of their premises. (6). Every license shall be renewed annually and the annual renewal, and the cancellation or suspension or imposition of a penalty shall also be recorded therein. The register shall show the disposal of the applications and in the case of rejection, the grounds for such rejection.

(7). Each DLO shall provide the particulars regarding the name, address, the nature and the location of the business for which a license has been granted, cancelled or suspended by the Feed Inspector to The Director Livestock of each Divisions of the area in which the premises is situated.

2. Note:a. Registration of all feed materials and feed stuff is necessary.

Feed mill should have all the precautions regarding the safety protocols for the labour working in the area.

b. Lab protocols for DM, CP, Fiber, EE, Ash and Minerals should be well established. Mill management should hire an animal nutritionist /professional for lab analysis and feed formulation.

c. Mill management should hire services of professional Animal Nutritionist who will supervise all the operations from ingredient receiving till dispatch of finished product.

d. Lab should be well equipped to do complete proximate analysis and to get analysis of quality of a feed ingredient. The results should be cross checked from other nominated Laboratories as notified by the department.

e. There will be complete analysis of imported items including raw material and additives. Minerals premixes will be analyzed for its composition. Importer should provide/ intimate the source from where it is imported and provide the analysis report. Which could be cross verified from the Government designated labs.

f. Punjab Animal Feed Registration Authority (PAFRA) will be established working under the supervision of Secretary Livestock Punjab.

1- PAFRA can ban/ stop the local /imported uses of ingredient in the province if they found it harmful for animal health/ human health.

g. PAFRA will check the warehouse/ storage area of feed mill to check the quality of the ingredients. Feed unit management should give access to all material stored/ used as feed ingredient. PAFRA can seal a feed mill if anything found with wrong practice or hidden material used for animal feed.

h. The list of the processing machinery feed including Plant Machinery, Choppers, and Bailers etc. should be provided to PAFRA.

i. PAFRA will check the quality of feed, silage, Hay, TMR Meals, Cakes, and Wanda before it is brought to in the market. Substandard Feed, silage, Hay, TMR ,Meals, Cakes, and Wanda sale can be banned.

(2) The NOC shall be issued in the Form prescribed in the Schedule-II within fifteen days from the receipt of the application provided that the Feed Inspection Officer is satisfied that the conditions, mentioned of Schedule-I, are fulfilled.

(3) The NOC shall be valid for a period of two years from the date of issue. (4) After the mill has been established, the applicant who desires to obtain a

license for manufacturing and marketing animals compound feed may submit an application to the Feed Inspection Officer in the Form prescribed in Schedule-III and shall annex with the application an advance license fee of twenty thousand for feed and five thousand for preparation of marketing of hay and silage in the form of a bank draft favouring the Government.

(5) If the Feed Inspection Officer is satisfied that the conditions mentioned in sub-rule 3 have been fulfilled by the applicant, the Feed Inspection Officer shall, within one month of the receipt of the application, issue a license to the applicant in the Form prescribed in Schedule-IV or otherwise.

(6) A person shall be granted a license for the manufacture of compound feed, Customer Feed Formula/Hay/silage/Meals/Cakes/TMR unless:

a) he has an automatic or semi automatic feed plant;b) he has a laboratory of the standard prescribed by the Government

having facilities to carry out proximate analysis and mycotoxin estimation of compound feed or customer formula feed and the feed stuffs used for manufacture of the same in accordance with standards of proximate analysis as mentioned in schedule (V and VI);

c) he has experimental facilities for livestock or other animals to conduct biological trials of compound feed or customer formula feed.;

d) he has employed a qualified animal nutritionist(as whole or part time.e) he has given an undertaking that he shall manufacture compound feed

or customer formula feed:

i. for livestock according to the standard prescribed in Schedule (V and VI); and

ii. for other types of animals, according to such standard as the Government may frame from time to time, determine.

(7) In case, the grant of license is refused, the license fee shall be refunded to the applicant.

(8) A license granted under sub-rule (5) may be renewed annually on payment of renewal fee of rupees five thousand in the form of a bank draft favouring the Government.

4. License for existing feed mill.-(1)A person, who has established a feed mill and other requisite facilities for manufacturing and marketing animals compound feed or customer formula feed before the commencement of these rules shall, within one month from the date of notification of these rules, make an application for the grant of a license in the manner given in rule (3)

(2) The Feed Inspection Officer may direct the applicant to rectify such defects, make such improvements and add such facilities within such time as are mentioned in the notice.

(3) No license shall be granted until the order made under sub-rule (2) is complied with to the satisfaction of the Feed Inspection Officer. 5. License fee.-(1) The license fee, as prescribed in rule 3, paid by the applicant in any month of a calendar year shall be deemed to be the license fee for that calendar year.

(2) The license renewal fee shall be paid by the licensee on or before 31 st

January of every calendar year.

(3) If a licensee fails to apply for the renewal of license within the prescribed period, the Licensing Authority may renew the license: (a) up to 31st March on payment of renewal fee and penalty equal to 100% of the renewal fee; and (b) up to 30th June on payment of renewal fee and penalty equal to 200% of the renewal fee.

(4) If a licensee fails to apply for the renewal of license up to 30 th June, the license shall automatically stand cancelled.

6. Packing and Marking-(1) The compound feed or customer formula feed shall be packed in cotton or polypropylene woven bags or any other suitable material.

(2) Each packing material containing compound feed or customer formula feed shall have the following particulars legibly printed thereon:

(a) name and address of manufacturer; (b) license number; (c) type of compound feed or customer formula feed, date of manufacture and

batch number; and (d) net weight of the bag.

(3) In addition to the above, the licensee shall attach with the bag of compound feed or customer formula feed a printed tag bearing information regarding following nutrients and additives:

a) percentage of crude protein;b) percentage of crude fat;c) percentage of crude ash;d) batch or code number; ande) date of manufacture and date of expiry.

7. Procedure of samples.- Where an Inspector collect a sample, he shall prepare a declaration in triplicate as per Schedule-(VII) and shall hand over a copy of the declaration to the person from whose custody such sample was collected.

8. Procedure for analysis of samples by private persons. (1) If any person desires that a sample of feed stuff, compound feed of customer formula feed purchased by him, shall be analyzed by the Government in any of its approved laboratories, he may make an application to the Inspector in whose jurisdiction such person resides or carries on business.

(2) The applicant shall pay such fee for chemical analysis and biological trial as the Government may notifies/prescribes, from time to time, determine. 9. Precautions in taking samples.- The Inspector shall observe the following precautions at the time of taking samples of feed stuff, compound feed or customer formula feed.

(a) he shall take samples at a place not exposed to damp air, dust or sort; (b) the instrument to be used for sampling shall be clean and dry; (c) the capacity of the container to be used for filling samples shall not be

more than 0.5 kg; (d) after filling the container with sample, it shall be sealed, air tightened and

marked with details such as the date of taking sample, date of manufacturing and any other relevant particulars in the

presence of complainant or feed mill representative; and (e) he shall take samples in the ratio given below:

(f) he shall prepare four different sets of samples, weight of each sample shall be about 0.5 kg which is to be taken from the top, middle and bottom (randomly) of

each bag of feed stuff, compound feed or customer formula feed and the sample so taken shall be thoroughly mixed before its submission for analysis. Note: Precautions in taking samples of Hay and Silage: The Inspector shall observe the following precautions at the time of taking samples of Hay and Silage.

10. Standards for approval of analytical laboratories.-The Government may approve analytical laboratories in public sector under section 10 of the Ordinance if a laboratory has the following facilities:

(a) has a distinct building and infrastructure;(b) has employed qualified animal nutritionist or chemist holding at

least graduate degree in the discipline; (c) has the requisite support staff; (d) has facility for proximate analysis including moisture %, crude protein %,

crude fat %, crude fiber % and total ash % , and minerals and quantitative aflatoxins determination; and

(e) such other facilities as the Government may specify.

11. Preparation of result of chemical analysis.- (1) The Incharge of the approved laboratory shall prepare the result of the analysis carried out by him in the form prescribed in schedule VIII.

(2) In case the analysis is carried out on the application of a private person, a copy of the result of the analysis shall be supplied to him on payment of such fee as the Government may determine.

12. Representation.- (1) A person aggrieved by an order refusing to grant an NOC or a license under these rules may, within fifteen days from the communication of such order prefer a representation against such order to the Divisional Director and the Director shall decide the representation within thirty days.

(2) Any person aggrieved by an order passed by the Director under sub-rule (1) may, within fifteen days from the communication of the order, prefer a second representation to Secretary to Government of the Punjab, Livestock and Dairy Development Department and the Secretary shall decide the representation within sixty days.

damaged raw material shall not be allowed.

Parameters of manufacturing unit of feed stuffs and compound feed A person shall not be granted a license for the manufacture of compound feed/ Customer Feed Formula/Hay/silage/Meals/Cakes/TMR unless:

a) He/she has an automatic or semi automatic feed plantb) He/she has a laboratory of the standard prescribed by the Government having facilities to carry out proximate analysis and mycotoxin estimation of compound feed or customer formula feed and the feed stuffs used for manufacture of the same in accordance with standards of proximate analysis as mentioned in schedule V and VI or the sample may be get analyzed from a public/private laboratory having prescribed facilities as mentioned below in section 4 of this document.c) He has experimental facilities for livestock or other animals to conduct biological trials of compound feed or customer formula feed or feed testing system pertaining to feed performance from client farm.d) He has employed/consulted a qualified animal nutritionist;

Parameters of production, packing, transportation, and storagePacking and Marking: The compound feed or customer formula feed shall be packed in sound and lean packing made of jute or cotton or polypropylene or any other suitable material.

Each bag containing compound feed or customer formula feed shall have the following particulars legibly printed thereon:

(a) name and address of manufacturer; (b) license number; (c) type of compound feed or customer formula feed, date of manufacture and batch

number; (d) net weight of the bag.

In addition to the above, the licensee shall attach with the bag of compound feed or customer formula feed a printed tag bearing information regarding following nutrients and additives:

a) minimum guaranteed percentage of crude protein;d) maximum percentage of crude ash;e) minimum guaranteed batch or code number; andf) date of manufacture.

Feed testing laboratoryGovernment may approve analytical laboratories in public sector under section 10 of the Ordinance if a laboratory has the following facilities:

(a) has a distinct building and infrastructure;(b) has employed qualified animal nutritionist or chemist holding at least

graduate degree in the discipline; (c) has the requisite support staff; (d) has facility for proximate analysis including moisture %, crude protein %,

crude fat %, crude fiber % and total ash % and quantitative aflatoxin determination; and

(e) such other facilities as the Government may specify.

Parameters of green fodder crops (roughages).

(I).The crops used for Green fodder should be indigenous

i.e. Rabi or winter season crops, Oats, Lucerne (Alfalfa), Berseem, Ryegrass.

Kharif or summer season crops, Maize, Sorghum, Bajra, Goar, Cowpeas and Mott grass.

(II). Fodder crops used as green fodder should be harvested at panicle, head initiation and pod

formation stages.

(III).NPK (Sodium, Phosphorus and potassium elements should be used as

recommended by Agriculture Department for each and every fodder crops as

nutrient.

Parameters of silageWhile preparing silage from a crop the following parameters should be considered.

PARAMETERS FOR MANUFACTURING UNITS, PRODUCTION, PACKING, TRANSPORTATION AND STORAGE OF SILAGE

For these parameters followings are the basic requirements.

Power (Tractors), combine harvester/ Forage harvester cum Chopper, Hydraulic dumper,

Bunkers / Bailers, Wrapper, manpower, UV sheet (20µ), jute thread for small bails and inner net

for large bails, well drained ground with four wall for storage, land & fork lifter etc.

PARAMETERS OF HAYWhile preparing hay from a crop the following parameters should be considered.

Crop should be harvested = at panicle, head initiation, and pod formation stages.Dry matter in plant = 85-88%Moisture contents in plants = 12-15%Crude protein =depending upon crop or material ADF (Acid Detergent Fiber) = 31-45 %NDF (Neutral Detergent Fiber) = 40-65%Ash/ Total Minerals =8-11%Physical Appearance (colour ) = Light green or greenishCutting height of the crops =3-4 inches above ground.Fodder Crops suitable for hay = Lucerne, Berseem, Ryegrass, Oats, cowpeas, Rhodes
