    CASE MANAGEMENT ORDER

    This cause came before the Court on July 14,2015 for a Case Management Conference

    pursuant to the Court's notice and order. This case has been assigned to Div 43, Complex

    Business Litigation Court pursuant to Administrative Order No.: 2003-17-05 in the Ninth

    Judicial Circuit, Orange County, Florida. After conferring with Counsel and the Parties,

    reviewing the Case Management Report, and being otherwise fully informed in the premises, it

    is,

    THEREFORE, ORDERED AND ADJUDGED that unless later modified by Order of this

    Court, the following schedule of events shall control the management and proceedings in this

    case.

    2. All pleadings related thereto shall be electronically filed with the Clerk of theCourt.

    PRELIMINARY FINDINGS & DEADLINES

    3. Any motions for leave to amend the pleadings to add additional parties or otherwise,

    shall be filed no later than October 09, 2015.

    4. The parties are directed to comply in all respects with the Complex Business Litigation

    Court Rules located at:

    MOTIONS. DISCOVERY. ALTERNATIVE DISPUTERESOLUTION AND TRIAL

    5. Any motions to dismiss or other preliminary or pre-discovery motions shall be filed

    and briefed on or before N/A.

    6. The trial of this case shall occur during the trial period beginning May 09,2016. The

    parties estimate the trial will be completed in 5 Days. ( JURY _X_, NON JURY )

    7. A pre-trial conference is scheduled on April 25r 2016 at 9:30 am in Hearing Room

    20-8. The parties shall prepare in advance and provide at least ten (10) days prior to the pre-trial

    conference a pre-trial statement comporting with BCR 9.2.

    8. The parties shall have until December 18, 2015 to conduct and conclude discovery. It

    is fuither ordered that the setting of the discovery deadline will not limit any party from filing

    summiry judgment motions during the period, but any such motions should be narrowly drawn

    to address only issues on which discovery has been completed. If there are still motions pending

    after the discovery period, the Court will set a briefing schedule at that time.

  • 9. The Parties are limited to two (2) expert witnesses per side. In all other respects, thepresumptive limitations on discovery contained in the Complex Business Litigation Court

    Procedures shall apply.

    10. The Party bearing the burden of proof on any claim shall designate the expert

    expected to be called at trial and provide all information specified in BCR 7.6 by October 01,

    2015. With this disclosure, the Party shall provide three (3) dates on which the expert isavailable for deposition within thirry (30) days. The Party responding to any claim shalldesignate the expert expected to be called at trial and provide all information specified in BCR

    7 .6 by October 30, 2015. With this disclosure, the Party shall provide three (3) dates on which

    the expert is available for deposition within thirty (30) days.

    11. Dispositive and Daubert Motions shall be filed by January 22,2016.

    12. Motions in Limine shall be filed by February 26,2016 and heard before the pre-trial

    conference if oral argument is granted.

    13. The parties are ordered to advise the Court, in writing, by December 18,2015 of the

    date and time of the mediation and the identity of the mediator. The Parties shall conduct

    mediation by January 15,2016. The Plaintiffs counsel is ordered to advise the Court, in writing,

    of the outcome of the mediation no later than five (5) days following the conclusion of themediation conference.
