At the outset, Shri. P. B. Patil, Additional Chief Executive Officer, Zilla

Parishad, Satara representing Member Secretary welcomed Dr. Ankur Patwardhan,

Hon. Chairman, High level Monitoring Committee (Eco Sensitive Zone of

Mahabaleshwar and Panchgani Region), Hon. Collector, Satara and other Members

and officers present for the meeting.

Subject No.(1) - The minutes of the meeting held on 17th February,2016 were

confirmed.-\

Subject No.(2) - Action taken report on the issues of the previous meeting dated 17th

February, 2017 .

2.1 Tourism Master Plan -

As per discussion of the HLMC meeting held on1710212016, M.T.D.C.

representatives were asked about the action taken.

M.T.D.C. representative reported that the required action on Tourism MasterPlan is being taken by the Office of Assistant Director, Town Planning, Satara.

It was decided that the action should be completed within 15 days and

the astion taken report should be submitted in the next meeting.

About the Panchgani Tablg Land :-

In respect of action taken about the development works to be

compteted on Panchgani Table Land in accordance with the orders of the

Hon'ble High Court; Bombay, the Chief Officer, Panchgani MC stated that, forthe completion of said entire work, the approval of the Heritage Committee

has been taken .

The Collector, enquired whether the demand of grants have been

raised or not. The Tahsildar, Mahabaleshwar reported that the action will be

completed within one month.

It was decided that a report will be submitted in the next meeting.

About the l l leoal Construction at Vil laqe Dandeqhar Survev No. 87/1D.

On action taken regarding the illegal construction at Village Dandeghar

Survey No. 87/1D, the SDO, Wai informed that Civil Suit bearing Number

51912015 was pending in the Hon'ble District Court, Satara and hence no

action can be taken.

The SDO, Wai fufther stated that her office has informed the

concerned person to submit the related documents to legalize illegal

construction, but the concerned person did not respond.

The SDO Wai was asked to report the same to the Hon'ble Court,

Satara and keep the Comrnittee informed of the status of the matter at the

next meeting.

Debi Goenka's application about illeoal tree cuttino on Duchess road and

illeoal construction qf Blue Vallev.

On enquiry about the application of Debi Goenka relating to illegal tree

cutting and illegal construction of Blue Valley, the SDO, Wai reported that the

branches of trees that were an obstacle for the vehicles on the road was

reported to the PWD and the PWD department had cut such branches. The

Collector, Satara, asked for a report to be submitted immediately.

Shri. Sunil Limaye, said that the i l legal construction of Blue Valley is

under jurisdiction of Tahsildar, Mahabaleshwar, so further action against this

illegal construction should be taken by Tahsildar, Mahabaleshwar. The

Collector Satara asked the Tahsildar, Mahabaleshwar to enquire and submit a

report.

The Committee asked all the concerned officials to take immediate

action against illegal constructions and submit a report at the next meeting.

The eollector Satara also suggested that the CO of both the municipal

councils and the concerned officers for the rest of the region should take a

round (Shivarferi) once in 15 days to keep a track of illegal constructions in

the area.

About the Survev No. 527 A/3 Taiohat Green, Z,one :-

On enquiring about the construction under Green Zone in Survey No.

527N3, the CO Panchgani reported that the said issue is pending with the

Office of the Assistant Director, Town Planning, Satara. The CO further

informed that the construction has stopped and the revised plan has been

submitted to Town Plannning Office. On this issue Dr. Rahul Mungikar

suggested that there should be a time limit for action to be taken on the

concerned issue.

It was decided that action on the concerned issues will be taken within

15 days.

2.6 About the plastic qarbaoe i.n the forest area.

.-The Chairman enquired about the action taken on plastic garbage in

the forest area.

Shri. A.M. Anjankar, Deputy Conservator of Forest, Satara reported

that they have created awareness among the taxi drivers about not to litterplastic garbage in the forest area. Due to this awareness, the taxi drivers

collect plastic garbage in bags and then the garbage is destroyed. The RO

water purifier is installed and RO water supplied to the tourists for just Rs. 5/-.

So, they do not throw empty water bottles in the forest.

The Chairman praised the project and congratulated Forest officers

and asked them to give wide publicity to the project through media.

Shri. A.M. Anjankar, Deputy Conservator of Forest, Satara also

informed that he is going to install some more RO water Purifier Units and hasplanned to collect the garbage thrown by tourists with the help of trekkers.

Also a campaign with tourist guides and taxi drivers has been initiated

creating awareness against littering of plastic garbage in Mahabaleshwar.

When the Chairman enquired about the proposal, it was reported that

after the compliance by the concerned person, NOC order number

DC/MAG tzltKAVt- 260t2017 dated 13t0212017 has been issued to children

Park and Amusement Park.

As the action has been completed, it was decided that this subject

stands closed.

Mapping of Eco - Sensitive Zone.

As the concerned person was not present for the meeting, it is decided to

discuss the issue at the next meeting.

About giving permission for the Polo Ground'

Sh{!.A.M. Anjankar, Deputy Conservator of Forest, Satara informed that even

for removal of stones from the Polo Ground, permission of Central

Government is required. Nevertheless, the permission is yet to come' The

Govt. has also not taken any decision about the Polo Ground'

It was decided that the use of Polo Ground should only be for natural things

and for no other Purpose.

The Dy.CF, Satara was asked to submit the report in next meeting.

Metqutad. Tal. Mahabaleshwar

As per decision in the previous meeting, the NA order has been issued

so this issue of NA stands closed.

Jawali. Dist. Satara

Assistant Town Planner reported that for the Buffer Zone, Satara Draft

Regional plan nutes apply, which are yet to be finalized. A Proposal will be

submitted by taking into consideration the provisions under final rules.

It was decided that a report will be submitted before the next meeting.

2.12 Discussion about. the remarKs received froF the , Divisional

As per decision taken at the fast HLMC meeting, this issue stands closed.

2.13 About the presentatiqn of . Smaft city Mahabaleshwar presented bv

Mr. J.K. Bhosale. CEO. City Corporation Ltd.

It was decided that this proposal will not be pursued further as there has been

no further follow-up by the CEO of City Corporation Ltd

2.14 About formation of Local Biodiversitv Management Conlmittee accordinq to

Biodiversitv Act for Mahabaleshwar Panchgani Eco Sensitive Zone.

CO, Mahabaleshwar MC informed that the Committee has already

been formed and the Panchgani MC has not formed the Committee.

The CO, Panchgani MC was asked to form the Committee at the

earliest.'.-lt

was discussed and decided that along with both the municipal

councils, a Committee for the rest of the Region will be formed at the earliest

and the report of the same should be tabled before the Committee in the next

meeting. lt was also further decided that the concerned officers will approach

Dr. Rahul Mungikar for his expertise.

2.15 About,Mr.Shrirai Satarawala's application about tree cuttino :-

It was informed that the applicant has withdrawn his application.

2.16 Shri. Shriraj Satarawala's application about the plastic garbage collected from

the forest area :-

Deputy Conservator of Forest, Satara informed that Hospitals and

Hotels from Mahabaleshwar dump their plastic garbage at Lingmala.

It was suggested that CO should have a meeting with Hospitals and

Hotel owners and ask them about their disposal plans.

President of P-anchgani MC stated, that they were not getting MPCB's

Relmission fOr installation of Plastic Garbage processing unit.

The Committee asked the COs of Mahabaleshwar and Panchgani to

take required action and apply for the permission of the State Environment

Department and submit the report before the next meeting.

2.17 About the Proposal of Deputy Directgr. Social Forestrv Dep,artment. gatara

Division to build compound wall and qhain link fencino to the forgst plot No. Q9and 70.

This issue was discussed and the Committee was informed that theproposal for chain link fencing was rejected by the Forest Department. Hence

the Committee agreed to the decision that that the fencing should be

biological.

2.18 The l l leqal Construction at Chrjst Church.

CO, Mahabaleshwar MC informed that the FIR has been filed about the

illegal construction. The Court has issued the stay order. The action taken by

CO was appreciated and it was stated that such action against illegal

.onriiu"tions inould be taken hereafter.

It was decided that a report on the status of the matter should be filed

regularly before the Committee.

2.19 About the permission for drifrki.nq Water pipeline and construction of tocal

roads in the Forest area.

The Committee opined that if the proposal is in accordance with Forest

Laws, then there should be no objection. Further the Committee decided a

site visit to be organized before the next meeting for final approval.

It was decided that the Forest Department should organize a site visitand submit the report in the next meeting.

2.20 Reqardinq the permission to parkino at the bottom of Fort Pratapoad.Shri. Anjankar, Deputy Conservator of Forest, Satara told that he has

surveyed the spot and fixed the place / spot for the parking purpose andsubmitted the propojal.

It waS discussed that a completion report needs to be submitted in thenext meeting.

As above minutes of previous meeting were discussed thoroughly, the

Agenda items were taken.

Subject No. (3)- Discussion about presenl status of Zonal Master Plan.

3-4. Develqpment Plan for Mahabaleshw.ar Mu.nicipal Council

Shri. A. R. Kamble, Assistant Town Planner, Satara stated that part of

the Mahabaleshwar Development Plan (Second revised) has been sanctioned

vide order dated 2810312013 and E.P. part of the Development Plan has been

sanctioned vide order dated 0110312016. The Government of Maharashtra has

submitted the proposal for permission to the MoEF&CC vide letter dated

0211212014 and the same is pending at MoEF&CC for sanction.

It was decided that a copy of the Report, DCRs and Plans submitted to

the MoEF&CC will be submitted to the Committee so that the Committee can

follow up with the MoEF&CC.

3-8. Development Plan for Panchqani Municipal Council:-

Shri.A. R. Kamble, Assistant Town Planner, Satara, stated that the part

Panchgani Development Plan (Second revised) was sanctioned vide order

dated 0410612012 and E.P. Part of the Development Plan has been

sanctioned vide order dated 0610812015. The Government of Maharashtra has

submitted the proposal for approval to MoEF&CC vide fetter dated 2710312015

and is pending at MoEF&CC for sanction.

It was decided that a copy of the Report, DCRs and plans submitted to

the MoEF&CC will be submitted to the Committee so that the Committee can

follow up with the MoEF&CC.

3-C. Traffic and Tourism Plan :-

Shri. A. R. Kamble, Assistant Town Planner, Satara, stated that the

opinion of the Town Plannlng office to the Tourism Master Plan prepared by

the MTDC has been given vide letter dated 1110212010.

The CO Panchgani informed that, there is problem of Parking lot, and a

meeting of hotel owners was held. The Committee was informed that there is

suffigient space for parking within the campuslpremises of New Police Station.

Option of one way traffic was suggested by the Committee.

The CO informed that the Plan for the parking has been prepared andthe same will be presented at the next meeting.

The Collector stated that the plan for parking lot should be prepared at

the earliest and Mapro should plan their own parking provision.

It was decided

(1) a copy of the letter dated 1110212016 should to be submitted to the

Committee,

(2) the CO of municipal councils and the concerned officers for the

Region along with the Police Department should conduct a joint inspection

and submit the proposal at the next meeting.

3-D. Forest Development Plan -

Shri. A.S. Patil, Chief Conservator of Forest (Territorial), Kolhapur

stated thatall the works in Forest area are being done according to the

notification of Ministry of Environment and Forest Department Dated 17thJa1qary,2001. So there is no need of any other plan.

This issue stands closed.

3-E. sanctioned Resional Plan for MPESZ dated 07th Auqust. 2015.

The Committee asked for a final copy of the Regional Plan containingall the modifications of the state and the centre to be submitted at the nextmeeting.

Subject No. (4)- Creatinq awareness about Eco Sensitive Zone -

It was suggested that in Mahabaleshwar and Panchgani there should

be sign boards against littering of garbage. The CO should also createawareness about Eco sensitive Zone with the help of handouts, pamphlets,

interpretation centre, seed museum, etc. various activities.

Subject No. (5) -About parkinq at Venna Lake

It was decided that the Forest Department and Police Departmentshould plan parking on the land in front side of Venna Lake and a parking plan

to be prepared before the beginning of this year's tourist season. Also illegalsialls and hawkers should be prohibited in this area.

Tahsildar, Mahabaleshwar informed that, the notice has been issued to

the concerned person in this regard and the Writ Petition No 374812015 is

pending in the Hon. High Court, Mumbai.

It was decided by the Committee that if there is no stay order of the Hon.

court, the illegal construction should be demolished.

6-C. About illegal activities of velocitv :-

Tahsildar, Mahabaleshwar informed that cunently there were no

activities going on at Velocity.

It was decided that the issue stands closed

6-D. About the iHegal construction of Shri. Prekash Laxman Hirave and Shri.

Ramchandra Baburao Hiraye in City Survev No.59 at Mahabaleshyrrar: -

The Collector,satara suggested there should be a joint enquiry by Sub

Divisional Officer, Wai, Tahsildar, Mahabaleshwar, Chief Officer,

Mahabaleshwar MC and Deputy Superintendent of Land records,

Mahabaleshwar and a report should be submitted by sth October,2017.

It was decided that the SDO, Wai will take appropriate action as mentioned

above.

6-E. About illegal Construction at Mahabaleshwar City Survey No. 92 by Shri.

Aaba Maruti Jiman.

The Collector, Satara suggested that there should be a joint inquiry by

Sub Divisional Officer, Wai, Tahsildar, Mahabaleshwar, Chief Officer,

Mahabaleshwar MC and Deputy Superintendent of Land records,

Mahabaleshwar an$ a report shoutd be submitted by 5th October,2017.

Pralhad Rathi has applied for the permission of construction on Plot

No.22,28 & 29in City Survey No.12011N1i1B at Kshetra Mahabaleshwar,

Tal. Mahabaleshwar.

The Taluka lnspector Land Records, Mahabaleshwar submitted report

thafpresentfy, there is a sparse forest on the same plot. So it is looking as like

a forest. According to revised report of Deputy Superintendent of Land

records, Mahabaleshwar, The Plot No.22 in the City Survey No. 12011N1118

has been visited personally and verified on OtnApril 2017 and reported 17

trees on the Plot in the measurement map it is noted that there is sparse

forest on the plot.

The Applicant has requested for the permission on the NA Plot which is

noted as forest alike by Dy. Superintendent of land Records, Mahabaleshwar,

but there is no any Court order so the permission should be granted subject to

decision of Writ petition No. 7308i 1998 PIL No. 39/2003 or any other Court

Order.

In this Sub Divisional Officer, Wai stated that there is a suit filed in

Hon'ble Green Tribunal Court. He stated further that there is no term like

"Forest Like'.lt is either Forest or no forest.

On this issue, the Committee suggested the applicant should approach

to Hon'ble Green Tribunal Court.

Srlbjqct No, (13)- Discussion about Forest like area at Metatale, Tal.

Mahabaleshwar, Dist. Satara Survev no. 1/5A, 1/58. 1/64 and 1/68.

Shri.Vinay Ashok Chugera R/o. Pune has applied vide application

datdd 27th iune 2017 for the NA Order for residential purpose in City Survey

No. 1/5A, 1/58, 1/6,4 and 1/68 total area 2.68.1 Hectare R. In this case,

Deputy Superintendent of Land records Mahabaleshwar has informed that

according to letter dated tgth -luly,2017 Survey No. 1/5 and 1/6 has been

measured and there is sparse forest on the above mentioned plot (Faint

Green Colour ). According to this report the applicant has requested on 2nd

August 2017, that his property is not forest like. Sparse forest doesn't mean

forest like so the permission should be granted.

About this issue it was decided that District Superintendent of land

record Satara and Deputy Conservator of Forest, Satara should undertake ajoint survey and submit their report. But District Superintendent of land record

Satara informed through a letter dated gth August 2017 that there is a sparse

forest on this.

SDO, Wai stated that there is a suit in the Hon'ble Green Tribunal

Court and there ls no term as 'Forest like'. There is either 'Forest' or 'No

Forest'. - So the Committee suggested the applicant should approach to

Fion'ble Green Tribunal Court. .

Subject No. (14)- About permission fgr pav and parkino in Sr.{rvev frlo. 112 and 1/5at Kshetra Mahqbaleshwar - proposal of Mr.Pralhad Narayafrdas Rathi.

Mr. Pralhad Narayan Rathi has requested vide application dated

21912015 for the permission of pay and park on Survey No. 112 and 1/5. The

Assistant Director, Town Planning , Satara submitted the report that the

Applicant can use his land for the pay and park according to the letter dated

3oth Nov, 2016 i.e. Mahabaleshwar Panchgani Regional plan 2002-2022

article No. 14.7 (G) anybody can provide pay and parking facility out ofMunicipality area through BOT.

It was decided that after getting report from SDO, Wai further action

shall be taken. Action taken report shall be submitted in the next meeting.

Subject No. (15) - About the proposal of permission fof proposed Maha-pratapcable car Project (Mahabaleshwar Lodwick Point to pratapqad)

Shri. Bharat Patil, representatives of SAIO lnfra gave a presentation

about proposed MahaPratap Cable Car Project. He stated that there will becable car project from Mahabaleshwar Lodwick Point to Pratapgad and thecompany to which project is given for implementation has completed more

than 15,000 such ropeway projects.

The Collector, Satara suggested to take all types of permission / NOCabout the land acquired for the project. The Collector further stated that thecompany must take responsibility and give guaranty of security of tourists.

Also a presentation of previous projects that was completed by the Companywas called for.

It is decided a sub Committee shall be formed headed by SubDivisional Officer, Sub Division Wai, along with Members of Sub Committeebeing - Dr. Rahul Mungikar (Member, HLMC), representatives of PublicWorks Department, Geological Survey and Development Agency,Maharashtra State Electricity Distribution Company Ltd., Forest Department,

and Land Records and Dr. Aparna watve as subject expert.

It was decided that inputs from institutes like National EnvironmentalEngine€ring Research Institute (NEERI), Nagpur or who conduct Environmentimpact Assessment Surveys, Ecological assessment, Flora-faunaauthentication surveys shall be taken.

Subject No. (16) - About the Permission lor revised construction on Survev No.77A. 78A, 79 at Mahabaleshwar

Assistant Town Planner, Satara stated that Town Planning'Departmenthas recommended to grant the permission for the construction for Hotel andLodging on Survey No. 77A,78A,79.

It was decided that CO Mahabaleshwar MC shall submit a report in the

next meeting.

Subject No. (17) - About the installation of 19.5 Kw and 10.5 Kw Wind Solar HybridSystem in Panchgani Municipal Council area -

It is decided to write to MoEF&CC for nominating the Collector, Sataraas Member Secretary, HLMC instead of CEO, ZP Satara with joint signatureof Hon'ble Chairman and Member Secretary of HLMC.

19.1. Permission for the construction of bridqe on Venna River and l inkino Road atMahabaleshwar Venna lake road:-

Executive Engineer, PWD (West) has submitted letter dated 6thSeptember 2017 seeking permission for construction of bridge on Venna river(Dam) and the l inking road.

Since the Executive Engineer or his representative was not present, itwas decided that PWD shall submit a report in the next meeting.
