Executive summary

The Final Dissemination Report for the LIVE_FOR Project illustrates the activities carried out by the consortium to reach the overall objectives of WP5 – Dissemination. This report covers the period from November 2016 to January 2019, a period during which the project partners’ dissemination activities have been numerous and diverse. The overall objective of WP5 on dissemination has been to disseminate the project findings and to identify and reach stakeholders in order to raise awareness regarding best practices developed by the consortium. Specific sub-objectives include the dissemination of the project results; establishment of effective communication channels and tools; representation of the project through the organization of events and dissemination of outputs, the participation in third party conferences and the publication of papers in scientific journals. The present document elaborates and develops the content of the midterm report and is structured according to the described activities foreseen in WP5:

Led by UPC, the WP5 has been followed up with the dissemination plan set by in the Midterm Report as well as the maintenance and nurturing of the project website and the project’s social media accounts on LinkedIn1, Facebook2, Twitter3 and YouTube4. The activities concerning public media presence have been led by VUB and have aimed at reaching a wider audience and general public. The LIVE_FOR consortium has been active on conferences and events, promoting LIVE_FOR activities and engaging in discussions about the European Investigation Order (hereinafter EIO) and other matters related to the Law enforcement cross-border access of electronic evidence in cloud computer environments. During the second year, LIVE_FOR has organized two roundtable discussions, the first one in January 2018 and the second one in May 2018. In addition, two educational workshops have taken place in March 2018 and September 2018 respectively. The following table summarizes the outputs foreseen for WP 5 and indicates what has been reached by the consortium during the two-year duration of the project5 :

1 Introduction: Summary of progress towards objectives

WP: 5 Dissemination Time: Month 1 to 24 Work package Leader: Vrije Universiteit Brussel (VUB) The overall objective of WP5 on dissemination has been the identification and reaching of stakeholders in order to raise awareness regarding the findings and activities of the consortium and to encourage them to attend LIVE_FOR event and support its recommendations. Specific sub-objectives include the following:

1) To disseminate the project results;

2) To produce effective communication channels and tools;

3) To access relevant media, conferences and professional journals.

LIVE_FOR dissemination activities have been diverse, touching on the above-named objectives. In particular LIVE_FOR has been very engaged online (website and social media) as well as engaging with stakeholders and disseminating items. Under consideration of the aforementioned objectives the report at hand is structured according to the foreseen main activities in relation to dissemination under WP5:

2 Web and social media presence

In this section the project’s social media accounts: LinkedIn6, Facebook7,Twitter8 and YouTube9 are reviewed.

2.1 Website The project’s website is one of the main sources of information about the project available to most stakeholders. The website was established immediately following the project’s start by JSI and will be maintained for at least two years after the project comes to a conclusion. Its content has been updated on a regular basis according to the project’s progress. All partners have assisted in this by providing input and materials relevant and related to the project. To increase visibility, several consortium partners have listed a link to the website on their own organization’s website. The LIVE_FOR website can be accessed using the following address: http://live-for.eu .

The project website was accessed by visitors from all over the world (leading USA) including European countries such as the United Kingdom, Italy, Romania, France, Spain, Germany, Poland, the Czech Republic and the Netherlands. There has been an increase in views regarding to the first year of the project, supposedly due to the greater dissemination in social networks and to the workshops given.

The website’s visit history (Figure 4) shows an increase in visits towards the last months of the project (November, December). Some interesting statistics of the web have been:

• Total number of visits: 73,968

• Average number of visits per day: 91

• Visitors who visited once: 19,968

• Repeated visitors: 6.127

2.2 Social media The project’s social media presence, especially via Twitter, constitutes one of the main dissemination channels. All accounts (LinkedIn10, Facebook11,Twitter12 and YouTube13) were created by UPC in December 2016, immediately following the project’s start in November 2016. Their content is updated on a regular basis under assistance of all project partners. To increase visibility, several consortium partners have followed the social media accounts by their personal or University social media accounts.

On Twitter, LIVE_FOR followed like-minded researchers as well as stake holders. As of 18th January 2019, the project’s Twitter account has 90 followers. The consortium partners have tweeted 247 times in total, with 165 own tweets and remaining in form of retweets. On a regular basis, the project’s Twitter account informs its followers about the process of the EIO Directive’s implementation.

3 Public media presence

Led by VUB task 5.3, has aimed at the communication and dissemination of the project’s activities and findings to a wider audience and general public. In the first stage of the project, predominantly analytical activities such as the survey and the two joint-meetings were conducted. Based on this groundwork, educational and awareness raising activities were planned and designed for the second year. In that respect during the second term of the project two (2) round tables were held and two (2) workshops were organized involving both face to face trainings and webinar activities (see section 4). The LIVE_FOR consortium has tried to engage in communication with the general public. In January 2017, the project and its goals were presented to a wider audience through the GPEN Newsletter Issue 40.

A representative of the Slovenian press agency STA attended the morning session of the joint-meeting in Ljubljana and published news about the event both in Slovenian and English (access to the full news at their web site is not free of charge; the full news contains also short interviews with Miha Šepec and Tomaž Klobučar).17 In the context of the creation of the info centre located in Spain, a press release was issued on January 29, 2018 through UPC institutional website, precisely announcing the creation of the Info centre at the UPC’s Network Security Emergency Coordination Unit (esCERT-UPC) while also highlighting the purpose of project LIVE_FOR.18

A second press release was issued by UPC right after the celebration of the final Joint meeting in Barcelona 2019 highlighting the links to access the presentations and recordings of the event. In addition, the press release emphasised LIVE_FOR’s Best practices in cloud forensics briefly describing its content. A translated version of the press release into English is foreseen to be ready by the end of February 2019.22 The press release also refers to the info centres created by LIVE_FOR.

4 Scientific publications

As part of the dissemination goals three scientific papers have been published in specialized and scientific magazines and conference proceedings. VUB has published the following two articles.

The first paper titled “The Cybercrime Convention Committee´s 2017 guidance note on Production Orders: unilateralist transborder access to electronic evidence promoted via soft law” was published in Computer & Law and security Review, and was authored by Paul de Hert, Cihan Parlar, and Juraj Saijfert.

The contribution reflects on recent cases involving cross-border data production orders such as Yahoo Belgium, Skype Belgium and Microsoft Ireland. Paying attention to cross-border data production orders, the paper examines the challenges these instruments pose to sovereignty and enforcement jurisdiction and to the voluntary cooperation of companies for which the legal framework is currently lacking. In addition, third paper was published in January 2019 by Jožef Stefan Institute in the proceedings of the "International Conference on Information Technology & Systems 2019”:

5 Conferences and events

The LIVE_FOR consortium partners have been very active on conferences and events, promoting LIVE_FOR and engaging in discussions about the EIO as well as on the latest legislative events in the field of e-evidence. In that regard, in addition to examining and studying the challenges faced by MS on implementing the EIO during the second year of the Project, LIVE_FOR partners have been strongly attentive to the adoption of the U.S, Clarifying Lawful Overseas Use of Data Act Cloud Act (hereinafter CLOUD Act) in March 2018 and the EU proposal for a Regulation on Production and Preservation Orders in April of the same year (hereinafter EPO Regulation). In that line during the second year the LIVE_FOR consortium has attentively followed the latest novelties in the field and engaged with the relevant stakeholders involved.

5.1 First party events: round tables training workshops and joint meetings In the first stage of the project comprising the period of October 2016 to November 2017, the project held two joint-meeting, one in Brussels (April 2017) and the second in Ljubljana (May 2017) attracting more than 50 participants from all over Europe,

For the second year, comprising December 2017 to January 2019, the consortium has organized two round tables in Belgium and two training workshops, one in Belgium and the second in the Czech Republic. Finally, in December 2018 the consortium final joint meeting was held in Barcelona.

a) Roundtables

The first-round LIVE_FOR table was held on the 15th of January 2018 in Brussels, entitled “The European Investigation Order: Challenges to Fundamental Rights and Sovereignty in the Digital Age” it addressed four major issues of cross border access to electronic evidence and

judicial cooperation.24. The roundtable discussed issues relating to cross border access to electronic evidence and judicial cooperation by examining its fundamental elements and addressing some of its current and future challenges. In that sense the notions sovereignty, territoriality and jurisdiction, individual´s fundamental rights and the work of law enforcement authorities in the digital era were stressed and developed by the speakers. The event was structured in two sessions, the first was led by Professor Mireille Hildebrandt who focused on the history of sovereignty and its practice. The second was convened by Professor Catherine Van de Heyning and discussed Law enforcement and procedural elements of e-evidence gathering. Each of the two sessions were additionally discussed and commented upon by Professor Gloria González Fuster and Professor Paul De Hert. In addition to the attending audience, the roundtable was recorded and uploaded to Live-FOR´s YouTube channel receiving more than 100 views since its publication in January 2018.25 Moreover, a summary of the event was published and uploaded to the LIVE_FOR website and VUB website for further dissemination26.

Video recording (January 2018) Following up with adoption of the U.S Cloud Act in March 2018 and the publication of the Commission’s proposal for an e-evidence package in April 2018, the second-roundtable was organized the 9th of May 2018 in cooperation with the Brussels Privacy Hub: Law enforcement Data Access Series27 and brought together the expert views of from main actors. With the title of “The New EU Framework on e-evidence”, the roundtable was opened and chaired by Prof. Paul de Hert from Vrije Universiteit Brussel who gave a first overview of the e-evidence proposals highlighting some of the current challenges in the collection, exchange and analysis of e-evidence from diverse angles.

Prof. Mari Angela Biasotti, project Coordinator of EU Project EVIDENCE28, commented on the major findings of the project while highlighting the importance of harmonizing the treatment for exchange of evidentiary material. In that respect Prof Biasotti emphasized the development of the e-CODEX tool and after focusing on its design she then went to elaborate on its aim of ensuring a “secure exchange of data and evidence” among Member States in the context of the European Investigation Order and Mutual Legal Assistance procedures.

Second Round table (Brussels, May 2018)

The subsequent contribution was provided by Mrs. Lani Cossette Director, EU Government Affairs, Microsoft who welcomed in general terms the legislative move of the Commission. However, Mrs. Cossette also highlighted several aspects of the draft Regulation that in her view still did not yet provide a response to some of the challenges faced in cross border cooperation between service providers and LEAS’s. The third and final speaker of the event was for Mrs. Laure Baudrihaye-Gérard, Senior lawyer at Fair Trials International, who critically assessed certain aspects of the proposed Regulation, particularly with regard to the safeguards foreseen in the first draft and the potential imbalances it could generate between law enforcement and prosecution and the suspects and accused.

The event closed with a debate between the panellists and a session of Q&A from the audience. As part of the aforementioned Brussels Privacy Hub: Law enforcement data access series and managed to successfully gather representatives of the project’s target groups, academic institutions and general public. Notably a great number of the registered attendants belonged to the private sector. An element that otherwise shows the increasing relevance of private entities and particularly internet service providers in e-evidence matters and the interest these actors have in understanding their potential role and responsibilities in future criminal proceedings.29

b) Educational workshops

The first LIVE_FOR educational workshop was titled the “European Investigation Order and Digital Forensics” took place in March 2018 in Belgium. The workshop was structured in two parts a Webinar on March 7, 2018 and a Face-to-face training event on March 14, 2018 in Brussels. Further details about the content of both events are provided in D3.2.

In terms of dissemination the event was advertised through different channels including the publication of announcements in LIVE_FOR website as well as through the partners’ institutional websites30. Additionally, a dissemination campaign was launched in February addressing to the project’s subscriber mailing list. The educational workshop was also disseminated by the partners via leaflets distributed at third party events. In that respect, LIVE_FOR attended the Academy of European Law workshop held in Trier in February 2018, with the title of “Applying the European Investigation Order “31. There among 50 leaflets were shared with the attendees, including law enforcement agents, members of the judiciary and legal practitioners. Other dissemination of the event was performed through the social media channels of the project particularly in Twitter and LinkedIn and the LIVE_FOR website. Both the webinar and the face to face meetings resulted in fruitful discussions and lead participations to exchange own experiences and best practices in the field cross border access to e-evidence and digital forensics. Precisely these contributions nourished the content of the Best practices on digital evidence handling and Forensics science presented to the Commission and which have been uploaded and made available to the public through the LIVE_FOR Info centres32. The second workshop took place in Brno, Czech Republic during September 2018 and followed the structure of its predecessor, thus being based on the organization of a webinar on September 13, 2018 a “face-to-face” training on September 13, 2018. The face-to-face training took place in Masaryk University, Brno, Czech Republic and was focused on the technical sides of cross border access to evidence in the cloud. Participants were able to personally get acquainted the cybernetic polygon KYPO through hands-on training in cybersecurity and different areas of cybercrime. The event was advertised through different channels including the publication of announcements in LIVE_FOR website33.

The organization of the educational workshop was announced to the target audience through the distribution of leaflets in third party events such as the “Brussels privacy Hub Law enforcement data access series”34 and at the ERA Workshop on Encrypted data and the privilege against self-incrimination held the 28 and 29th of May in Rome35. The dissemination of the results of the event involved the recording and presentations of the speakers and their subsequent uploading to the LIVE_FOR website and the project info centres36.

Finally, the conclusive LIVE_FOR event took place on December 18, 2018 in the city of Barcelona with the title the “European Investigation Order (EIO) and digital forensic analysis”. The event was organized in three sessions combining both the presentation of LIVE_FOR project’s findings with the exposition of expert invited views.

The first session titled “Best Practices in e-Evidence handling and EIO implementation” was chaired by Prof. Manel Medina, director esCERT-inLab-UPC. The panel involved the presentation of Charlotte J. Farrar from Europol and who analysed existing tools used by LEAs to deal with encrypted and electronic evidence. Thereafter Antonio Rodriguez from UPC presented LIVE_FOR best practices for cloud forensics.

(Barcelona December 2018) Its first presentation was carried by Claudia Pina, investigating Judge from the Lisbon Criminal Investigation Court, who provided with a practical vision of the process of validation and issuance of the EIO in the context of e-evidence. Secondly Tanja Fachathaler from Fair Trials International addressed the challenges to fundamental rights posed by access to e-evidence during the different stages of criminal investigations. The third and last session addressed the “New horizons for cross border gathering of e-evidence: legal and technical insights”. The panel started with the presentation of Spanish Court Prosecutor Tais Deus, who provided a comparison of the evidence exchange platforms and practical insights in the context of e-evidence gathering.

Then Gemma Davies from Northumbria University discussed and compared the cross-border access to electronic evidence both in the EU and US focusing in the similitudes of the U.S Cloud Act and the latest versions of the Commission’s Proposal for a Regulation on a Production and Preservation order. Finally, Sergi Vazquez Maymir from Vrije Universiteit Brussel looked at the Impact Assessment accompanying the Commission’s e-evidence package and elaborated on the arguments used in the said document to criticise the usefulness and inadequacy of current instruments for cross border cooperation in the field of electronic evidence gathering in the EU.

5.2 Third party events: attended conferences Besides the events and conferences directly organized by LIVE_FOR, the project partners have also been active on numerous third-party events, including collaboration with other EU funded projects addressing e-evidence matters such as Information data Exchange for courts and evidence (EVIDENCE) 37 and the Cross-Border Access to Electronic Data in EU Judicial Cooperation in Criminal Matters (JUD-IT) 38.

Carlota Urruela from UAM represented the LIVE_FOR project at the Octopus Conference on the 16-18 November 2016 in Brussels. The conference was organized by the Council of Europe and is one of the biggest and finest platforms of exchange in cybercrime gathering experts from 80 countries, international organizations, private sector and academia. Carlota Urruela introduced LIVE_FOR during her contribution addressing the collaboration between prosecutors and law enforcement officers in the fight against cybercrime.

LIVE_FOR was further introduced on two events in the Czech Republic on the 3 April 2017 (Training Workshop Czech Police) and 13 April 2017 (Seminar on Judicial Academy with focus on Cybercrime). During the DFRWS conference39 in Germany (21-23 March 2017), attended by over 160 IT-security and digital forensics experts, LIVE_FOR was promoted by the project partner Hochschule Albstadt-Sigmaringen.

Moreover, at the Conference “Law Enforcement Challenges in the Online Context” in Luxembourg on the 25-26 April 2017, more than 70 LIVE_FOR Leaflets were disseminated to participants from all over Europe and the US. The conference in Luxembourg was visited by practitioners such as judges and prosecutors but also by scholars as well as private sector stakeholders. Vaclav Stupka from MU introduced LIVE_FOR at a two-day conference organized by Právnické fakulty in the Czech Republic in September 201740, during a session on electronic evidence, chaired by Vaclav Stupka. The conference was attended by over 90 people, mostly practitioners such as public prosecutors, attorneys and police investigators.

Manel Medina from UPC as well as Vaclav Stupka from MU attended the 6th ENISA-EC3 Workshop on "Cooperation between CSIRT and LEA communities" in The Hague from the 16-17 October 2017, promoting actively LIVE_FOR and disseminating leaflets. Furthermore, Vaclav Stupka promoted the project on the Europol – Enisa IoT Security Conference (18-19 October 2017). On November 10, 2017, Manel Medina and Antonio Rodriguez (UPC) participated at the ENFSI FIT EWG meeting in Barcelona, presenting the Live-FOR project goals and the preliminary results of the survey on the implementation of EIO conducted during the first joint meeting organized by the consortium.41

Figure 27: Manel Medina during the ENFSI FIT EWG In 2018, Sergi Vazquez Maymir from the Vrije Universiteit Brussel (VUB) attended and participated in the task force meetings organized by the EU funded Project JUD-IT in July and September.42 Sharing LIVE_FOR findings and promoting its activities among the attending experts, included legal practitioners, members of the judiciary and civil society organizations. In terms of dissemination, during those meetings leaflets were distributed and experts were personally engaged into to explain the goals of LIVE_FOR. This resulted in an effective dissemination of the Project activities and the participation and attendance of some of those experts in posterior LIVE_FOR events.

Manel Medina (UPC) presented the LIVE_FOR project at the EU symposium on electronic crime research eCrimeEU 2018 on 17 September 2018 in Krakow, Poland. The event was organized with the support of CERT.pl and NASK (National Research Institute supervised by the Polish Ministry of Digital Affairs) and gathered counter-cybercrime managers and forensic professionals in the private and public sectors.

On 22 of September 2018, Prof. Borka Jerman Blazic from the Jožef Stefan Institute presented LIVE_FOR at the Hack Instanbul 2018. Prof Blazic addressed the “New Legal instruments for Cross-border Crime Investigation in EU”, and she also participated in a round table organized in the context of the same event on the topic of “Information Security.43

of emergency response teams (CERT). As part of the event LIVE_FOR training activities and recommendations about implementation of EIO were presented to the attendants.44

On the 22 and 23rd of November 2018, Professor Paul de Hert from Vrije Universiteit Brussel participated at the Academy of European Law workshop on Freedom and Security- killing the zero-sum process- and held at Europol headquarters in The Hague.45 Professor De Hert moderated the first panel of the event titled “Data as the new oil? Risk and opportunities for citizens and law enforcement” which addressed the risks and opportunities of data usage in the private as well as in the public sector.

The event was highly promoted “due to the high visibility of its speakers and due to the relevance of its topics. Its audience gathered law enforcement officials, data protection officers, members of Europol's Data Protection Experts Network (EDEN), representatives of private industry, NGOs, academia and other stakeholders interested in data protection matters in a law enforcement context46, and thus allowing a positive dissemination of LIVE_FOR’s activity.

The list of conferences/events in WP5 concentrates on active participation by project members and lists the stakeholders on such conferences/events, whereas the list in WP4 primarily list attended events, on which interviews were conducted or leaflets disseminated.

6 Conclusion

WP5 had for objective the dissemination of project results, production of effective communication channels and tools as well as access to relevant media, conferences and professional journals. In its life cycle LIVE_FOR has established relations with other EU projects researching e-evidence (e.g. INTLI, EVIDENCE and JUD-IT) and has liaised with a wide group of stakeholders through the various channels described above. Great attention has been paid to maximize impact including the ability to reach out across all Member States and various sectors. The project partners have disseminated information via web and social media as well as participation on conferences concerning electronic evidence and the European Investigation order to prosecutors, judges, policy makers, private sector stakeholders as well as academics. In that aspect the consortium successfully promoted LIVE_FOR on third-party events. By providing up-to-date information on the project and the European Investigation Order via the project website and social media accounts as well as the newsletter, the LIVE_FOR consortium has been able to reach a wide audience and its goal to raise awareness on the importance of improving the competences of stakeholders. Dissemination activities during the second year heavily focused on the organization of the LIVE_FOR events and communicate their outputs. In that respect the consortium has fulfilled its objectives and organized two round tables, two educational workshops and a final joint meeting. The outputs of these events included video clips on YouTube, recordings and summaries that have been made available in the Project website and info centers. In addition, two scientific papers have been published and a third has left the drafting stage and has been accepted for publication by Springer journals in the first quarter of 2019. LIVE_FOR plans to continue its dissemination activities regarding social media, website and the availability of info centers and generated educational material for at least three years after from conclusion of the project.
