Background/Discussion

Under Part 9 Section 204 of the Local Government Regulation 2012, the Local

Government is required to prepare a financial report which the Chief Executive Officer

presents at a meeting of the local government once a month.

The financial report must state the progress that has been made in relation to the local

government’s budget for the period of the financial year up to a day as near as

practicable to the end of the month before the meeting is held.

Conclusion

Council is tracking reasonably well against budget however the reduced level of user

pays revenue is of major concern for the remainder of this financial year and into the

future. Whilst this is currently projected to be able to be offset through reduced

expenditure, the situation is being very closely monitored and reviewed as part of the

December budget review.

The level of capital delivery and projected capital expenditure by year’s end is also a

focus for the budget review currently underway.

8.3 OPERATIONAL PLAN 2014/2015 - 2ND QUARTER REVIEW

Purpose

The purpose of this report is to advise of the progress made during the second quarter to

implement the 2014/2015 Operational Plan.

Background/Discussion

The Local Government Regulation 2012 requires Council to receive a written

assessment of the organisation's progress towards implementing the annual operational

plan at a meeting of Council held at regular intervals of not more than three months.

The second quarter review of the 2014/2015 Operational Plan is provided for Council's

review and information. The details and explanations of variances in performance

targets are detailed within the attached Operational Plan.

Consultation and Communication

The document has been prepared in consultation with the Managers and Directors

responsible for each activity.

The final document will be published on Council’s website to allow the community the

opportunity to review Council’s progress in implementing the 2014/2015 Operational

Plan and achieving the Corporate Plan objectives.

Resource Implications

The Operational Plan is designed to measure implementation of the Corporate Plan

objectives and to ensure appropriate resources are allocated to priority areas.

identified in attachment 1 in accordance with section 235 of the Local Government

Regulation 2012.

Background/Discussion

Reef Catchments Limited is a not-for-profit company that delivers natural resource

management projects in partnership with the community and stakeholder organisations

across the Mackay Whitsunday Isaac region. Reef Catchments Limited facilitates on

ground change and works for long-term solutions to protect the natural resources of the

region, through partnerships with local, state and federal governments and agencies as

well as the community and private sector. They are a locally-based company

employing technical staff across a range of scientific disciplines.

Council engaged Reef Catchments Limited to prepare a Natural Environment Plan for

the region, which was finalised and approved by Council on 17/10/12. As part of the

implementation of this plan, priority projects are identified each year under the

headings of Coasts, Waterways, Plains and Ranges, and funding has been approved

from the Natural Environment Levy, as part of the 2014/15 budget approval. Council

received a briefing on the projects for 2014/15 on Wednesday 4th

June 2014.

Council will be working closely with Reef Catchments Limited regarding the planning

and delivery of these projects. There are a number of waterway priority projects that

achieve a mutually desirable outcome and as such Reef Catchments Limited are keen to

co-invest in a dollar-for-dollar arrangement in order to ensure these outcomes are

realised. As part of the delivery of these projects it is proposed that Reef Catchments

manage the delivery of 2 of the 12 waterways priority projects, at no cost to Council

other than a 10% administration fee. It is proposed to enter into a contract with Reef

Catchments Limited to facilitate this.

The value of this contract is deemed a medium-sized contract as it is valued between

$15,000 and $200,000 (Excluding GST). This would typically require an invitation for

written quotes under section 225 of the Local Government Regulation 2012. However

under section 235 of this Regulation, a local government may enter into a medium-

sized contract without first inviting written quotes if (b) the local government resolves

that, because of the specialised or confidential nature of the services that are sought, it

would be impractical or disadvantageous for the local government to invite quotes or

tenders. Due to Reef Catchments Limited employing specialist scientists who currently

work closely with Council staff across a range of projects including the Coasts and

Communities Project and the Natural Environment Plan, its staff are well placed to

liaise with the key stakeholder organisations to coordinate the delivery of the priority

projects.

The awarding of the contract to Reef Catchments Limited satisfies the requirements of

the Sound Contracting Principles pursuant to section 104 (3) of the Local Government

Act (2009) by providing value for money to Council due to project management fees

not being charged for delivering the works. The administration fee is considered to

represent good value for money as it covers administration costs only, with specialist

staff time for project management being contributed at no cost, in recognition of the

partnership nature of the projects. Reef Catchments will be contributing a minimum of

$60,000 funding towards waterways priority projects in 2014/15.

The priority projects proposed to be managed by Reef Catchments Limited are included

as an attachment to this report.

Consultation and Communication

Consultation has been held with Council staff, including Manager Procurement and

Plant and Manager Parks and Environment as well as the Natural Environment

Advisory Committee regarding the funding of the Natural Environment plan priority

projects and their delivery. Council also received a detailed briefing on the priority

projects for 2014/15 on Wednesday 4th

June 2014.

Resource Implications

The proposed contract with Reef Catchments Limited will be for the delivery of

waterways projects to the value of $60,000 which are funded as part of the 2014-15

budget.

Risk Management Implications

If council does not resolve to award the contract to Reef Catchments Limited to deliver

the identified priority projects, it is unlikely that the projects will be completed by the

end of the financial year.

Conclusion

Recognising the collaborative working arrangement between Council and Reef

Catchments Limited, it is proposed to enter into a contract with Reef Catchments

Limited to manage the delivery of the Natural Environment Levy funded projects

identified in Attachment 1.

8.6 COMMUNITY AND CLIENT REFERENCE GROUP

Author Chief Operating Officer Water & Waste Services

Purpose

The purpose of this report is to seek endorsement for the formation of a Community

and Client Reference Group for Water Services.

Background/Discussion

Water and Waste Services has recognised the need to significantly improve the extent

of engagement with the community on water and sewerage related issues in order to

continue to improve the level of satisfaction with the services provided. It has been

identified that arm’s length engagement such as surveys will not be effective in

facilitating effective communication on some of the key issues and opportunities that

face Water Services into the future. The types of issues that will arise over coming

years that will require improved levels of engagement include:

Information provision through the MiWater Client Portal;

Review of invoice arrangements

Updating of the Water and Sewerage Strategies for the Region;

Implementation of the new Sewage Pump Station Code of Practice and the

strategies for managing overflows and inflow and infiltration;

Response times and service levels as Water Services continues to aim for reduce

operational costs.

It is therefore recommended that a Client and Community Reference Group be formed

to enable improved two way communication. A draft Terms of Reference is detailed in

Attachment 1.

The Terms of Reference for the Community and Client Reference Group has been

modelled on the successful processes run by larger water authorities including

Queensland Urban Utilities, Unity Water and Yarra Valley Water.

Expression of Interest shall be sought for the selection of the group.

Consultation and Communication

The community has not been consulted in the formation of this report. The formation

of the Community and Client Reference Group will result in a step change in the extent

of engagement on water and sewerage related matters for Mackay Regional Council.

The Terms of Reference were also reviewed through separate briefings with

Councillors, the Strategy Leadership & Performance Team and the Transport &

Drainage Advisory Board.

10. RECEIPT OF PETITIONS:

Background/Discussion

In terms of Council’s Standing Orders, Council has three options with regard to

Petitions that are tabled and these are;

• the petition be received and consideration stand as an order of the day for the

meeting; or for a future meeting; or

• the petition be received and referred to a committee or officer for consideration and

a report to the local government; or

• the petition not be received.

The petition meets the requirements as per the Standing Orders, in that it is legible and

has more than 10 signatures.

Petitioners request that Camelzulis Road and Glenora Drive Balnagown be included in

the short term planning program for sealing with bitumen to reduce and eliminate the

high level of dust pollution which is a major problem faced by the residents on these

two roads. Residents state that there is no town water supply to this area and they rely

on rainwater tanks for drinking. The high level of dust pollution created by traffic

settles on the roofs of the homes and sheds. When it rains the dust contaminates the

drinking water they consume.

Petitioners state the condition of the roads causes damage to vehicles and the railway

crossing requires larger pipes for run off from rain.

Consultation and Communication

That the petitioners, through the lead petitioner, be informed that Council

acknowledges receipt of the Petition and that it has been accepted as a formal

submission. The issues raised will be addressed in a report to be tabled before Council

in the future.

Resource Implications

Nil at this stage as the recommendation relates only to the preparation of a report on the

matter including cost estimates.

Risk Management Implications

NIL.

Conclusion

It is proposed that as the petition meets the necessary requirement for consideration by

Council, that the petition be referred to the Chief Executive Officer for a report to be

prepared for further consideration by Council.

11. TENDERS:

11.1 MRC 2015-038 NEBO ROAD SUPPORT IMPROVEMENT - ROOF

REPLACEMENT

File No MRC 2015-038 Nebo Road Support Improvement – Roof Replacement

Purpose

To present to Council for approval, tenders submitted for MRC 2015-038 Nebo Road

Support Improvement – Roof Replacement.

Background/Discussion

The Nebo Road Water Treatment Plant (WTP) is the sole source of potable water

supply for Mackay City and neighbouring localities including north to Seaforth, west to

Walkerston and south to McEwans Beach (and Sarina in the future). Monitoring and

control of this critical asset takes place in the WTP’s Main Control Building. Also

accommodated in this building is the NATA accredited MRC Laboratory which

conducts regulatory compliance testing of water and wastewater samples from all

MRC’s water/wastewater facilities.

The location of the WTP Main Control Building is shown in Figure 1.

The WTP Control Room and Laboratory (both located on the top floor of the Main

Control Building) have been experiencing water ingress and damage through leaks in

the roof for several years attributable to a combination of the flat roof profile and

inadequate flashings at roof penetrations and joints. This has been exacerbated by

building extensions and the retrofit of mechanical items (air-conditioning and vents) on

the roof. A condition assessment of the WTP roof undertaken in 2013, indicated that

the roof, fascia and laboratory ceiling are in poor condition and that the air-conditioning

system requires renewal due to inadequate ducting/insulation and age/condition of the

mechanical units. The inadequate insulation/venting of the air-conditioner ducting has

resulted in condensation in the ceiling space of the Laboratory.

The combination of roof leaks and air-conditioner condensation in the ceiling space has

caused water damage to ceilings (particularly in the Laboratory) and caused a partial

collapse. Replacement is needed to prevent the risk of further damage to the building

fixtures and critical electrical and control equipment required for WTP and Laboratory

operations.

Mackay Regional Council (Council) issued tender documents seeking a suitably

experienced contractor to undertake building works at the Nebo Road Water Treatment

Plant (WTP) including:

Replace the roof of the Main Control Building including the fascia, all

flashings, box gutters and seals;

Replace the ceiling in the Laboratory;

Provide insulation and box gutter overflows;

Provide a new air-conditioning system to the Control Room and Laboratory

area.

Due to the requirement for the WTP and Laboratory to remain fully functional during

the works, Tenderers were requested to provide, in the submissions, a methodology for

how the works would be undertaken to minimise disruption to these operations.

Tenders were invited on 15 November 2014, via Council’s website and advertised

locally in the Daily Mercury.

The following submissions were received by the closing time of 10.00am on 16

December 2014:

Of the respondents, SJ Taylor Constructions Pty Ltd is the only local business with FK

Gardner & Sons Pty Ltd, Thomas and Coffey (Qld) Pty Ltd and Zined Property

Services Pty Ltd having offices in Mackay.

An initial compliance check was conducted on 22 December 2014 to identify

submissions that were non-conforming with the immediate requirements of the Request

for Tender (RFT). This included compliance with contractual requirements and

provision of requested information.

Due to the nature of the works involved, all tenderers must hold the relevant licences in

accordance with the Queensland Building and Construction Commission (QBCC).

PJM Civil Contractors Pty Ltd was deemed as non-conforming as at the time of

tendering they were unlicensed with the QBCC. All other submissions were progressed

through to the Qualitative Criteria Assessment on the basis that all terms, conditions

and mandatory requirements of the RFT had been met.

During the evaluation, tenderers were assessed against the nominated Qualitative

An initial Qualitative Criteria Assessment was carried out by the Evaluation Panel on

19 January 2015 with the Evaluation Panel scoring the tenders according to the

Evaluation Matrix.

All applicants were assessed against the Qualitative Selection Criteria. Specific criteria

were weighted according to their importance as perceived and agreed by the Evaluation

Panel. Relative weightings were published within the RFT.

Tender Information Requests (TIR) were issued to all tenderers.

Zined Property Services Pty Ltd was requested to provide clarifications of relevant

experience, onsite key personnel including those of sub-contractors, proposed

methodology and construction program including the management of risks associated

with the requirement for continual operations of the Laboratory and Water Treatment

Plant during construction. The Evaluation Panel also requested clarification on safety

provisions during the Project and the technical specifications of the proposed air

conditioner to be installed.

FK Gardner & Sons Pty Ltd and Thomas and Coffey (Qld) Pty Ltd were issued TIRs

requesting confirmation that the tendered price included all safety aspects of the works

and requesting the technical specifications of the proposed air conditioner to be

installed.

TIRs were issued to SJ Taylor Constructions Pty Ltd requesting clarification on

relevant experience, onsite personnel including sub-contractors, proposed methodology

and construction program including the management of construction associated with

the requirement for continual operations of the Laboratory and Water Treatment Plant.

Tender submissions from the two highest priced offers, Thomas and Coffey (Qld) Pty

Ltd and FK Gardner and Sons Pty Ltd, were well presented with both recognising and

addressing the Project requirements. However, the two lowest conforming bids from SJ

Taylor Constructions Pty Ltd and Zined Property Services Pty Ltd were deficient in

many aspects; particularly Zined Property Services' bid. The Evaluation Panel

reviewed TIR submissions and conducted an assessment of responses on

3 February 2015.

Zined Property Services Pty Ltd is a project management company that utilises mostly

sub-contractors to complete the works. The Evaluation Panel reviewed and analysed

the submission from Zined Property Services Pty Ltd thoroughly and sought

clarification through a series of four TIRs, however, considers that this tenderer has not

adequately demonstrated their capacity to complete the works. In particular, the

evaluation process determined that Zined Property Services Pty Ltd did not successfully

demonstrate their understanding of the complexities of the work and specifically

undertaking the works whilst the operation of the laboratory and WTP remained in

place.

SJ Taylor Constructions Pty Ltd is a local Contractor with experience in commercial

building construction and refurbishment. SJ Taylor’s original submission was deficient

in some details and did not provide a methodology for ensuring the continuity of WTP

and Laboratory operations. Subsequent TIRs resulted in SJ Taylor providing an

amended Tender price and methodology for providing this operational continuity. The

Evaluation Panel and Water Services WTP officers had a follow-up meeting with SJ

Taylor Constructions Pty Ltd to clarify their TIR submission and discuss in further

detail their proposed methodology and construction program.

The Project is considered complex in nature particularly given the need to maintain

operations and minimise disruptions to the Laboratory and consideration of Tenderers

of construction methodology was a key criteria in the evaluation process. The

Evaluation Panel considered information received from submissions and responses to

TIRs and based on SJ Taylor Constructions Pty Ltd revised lump sum price of

$442,006.00 combined with their qualitative scores from the Evaluation Panel, the price

score matrix lists them as the preferred tenderer.

SJ Taylor Constructions Pty Ltd demonstrated they have the experience, capacity and

resources to complete the works to the quality as specified in the RFT. Through the TIR

process, SJ Taylor Constructions Pty Ltd demonstrated an understanding of Council’s

project requirements, developing a satisfactory methodology for undertaking the works

whilst ensuring continuity of the Laboratory and WTP operations.

The evaluation of the tender was conducted by:

other Programs within Water Services through the course of the Project development.

Resource Implications

The funding for these works is in the WWS Water Capital Budget 2014/2015, 60053 –

WTP-Nebo Road Support Improvements/Upgrades. The 2014/2015 capital budget for

this Project is $1,060,750, with $700,000 of this budget allocated to the re-roofing

component.

Risk Management Implications

The Nebo Road Water Treatment Plant (WTP) is the sole source of potable water

supply for Mackay City and neighbouring localities. Monitoring and control of this

critical asset takes place in the WTP’s Main Control Building. Also accommodated in

this building is the NATA accredited MRC Laboratory which conducts regulatory

compliance testing for all MRC’s water/wastewater facilities.

The roof of the Main Control Building is in a poor condition and existing leaks risk

damage to critical control equipment and WTP/Laboratory functions. Replacement of

the roof and associated components (fascia, gutters, air-conditioning system, water-

damaged ceilings) is therefore required to maintain security of critical WTP functions.

Conclusion

That awarding the contract to SJ Taylor Constructions Pty Ltd represents the most

advantageous outcome and demonstrated value for money to Mackay Regional Council

based on their experience and demonstrated understanding of Council’s requirements.

The Mayor presented to David McKendry, Executive Officer Sustainability &

Collaboration, the 2014 UDIA Qld Awards for Excellence trophy for the Affordable

Housing category won recently for the Woodlands Estate at Andergrove. As the State

winner the Woodlands Estate has been nominated for the National Awards to be

announced in Sydney on 19 March 2015.

The Mayor advised Queensland Rail had presented to her for presentation to Council a

framed poster of the original tourism advertising for Mackay in celebration of the

Steam Trains 150 Years.

The Mayor advised that the MECC will be hosting a Testimonial Dinner for the two (2)

retiring Mackay MP's, Ted Malone and Tim Mulherin on Tuesday 24 March 2015.

Tickets are available from the MECC box office.

The Mayor thanked Cr Paul Steindl on behalf of Council for his time and dedication to

ensuring the 2015 Sports Expo was again a success.

The Mayor thanked Kevin Jefferies, Director of Development Services, on behalf of

Councillors for his services during his time with Council and wished him every success

in his new role.

Mrs Jackie Camilleri spoke to issues relating to rezoning of seven (7) properties her

husband currently holds for development. Mrs Camilleri expressed her concerns with

the rezoning and also raised with Council the issue of parking in the CBD. The Mayor

invited Mrs Camilleri to wait after the meeting to discuss this matter further with her

directly.
