audits that are necessary as part of an investigation of a guardian as a result of a

complaint filed for certain purposes with a designee of the Office of Public and

upon that office’s request; providing that any such clerk or Office of Public and

Professional Guardians investigator has a duty to maintain the confidentiality of such

for a person under a specified age who knowingly possesses a tobacco product or

product from a person or a vending machine; requiring the Department of Highway

Safety and Motor Vehicles to issue, reinstate, or renew any driver license or driving

privilege without fee which the department has withheld issuance of, suspended, or

Criminal Justice Data Collection; Citing this act as the “Criminal Diversion Racial and

Ethnic Impact Data Collection Act”; Requiring each law enforcement agency to report to

the Department of Law Enforcement the number of persons arrested and released

without being charged and the race and ethnicity of those persons; requiring each state

attorney to report to the department the number of persons against whom formal

charges were brought and subsequently dismissed and the race and ethnicity of those

persons; requiring each clerk of the circuit court to report to the department the number

of persons admitted into programs for diversion from prosecution and the race and

ethnicity of those persons, etc.

Court of Claims; Proposing amendments to the State Constitution to require the

Legislature to establish a Court of Claims by general law, to provide for a judicial

nominating commission for the court, and to provide that Court of Claims judges are

subject to impeachment and trial by the Legislature for misdemeanors committed in

Ethics Reform: Repeals provisions relating to state, state university, & community college

employee lobbyists; prohibits certain public service announcements; prohibits public

authorizes Commission on Ethics to investigate certain disclosures; prohibits certain

compensated representation for specified period following vacation of office; deletes

provision prohibiting former legislators from acting as lobbyists before certain entities &

business entities are deemed held by public officers or employees in certain situations;

provides ethics training requirements; prohibits certain governing board members from

voting in official capacity on specified matters; requires certain members of municipality

governing body to file disclosure; provides for future repeal of provisions relating to local

government authority to enact rule or ordinance requiring lobbyists to register with local

government; provides for future repeal of provisions relating to registration & reporting

for lobbying water management districts; requires Commission on Ethics to create Local

Government Lobbyist Registration System; requires lobbyists to register with commission

before lobbying specified governmental entities; provides responsibilities of Governor;

provides civil penalties. Effective Date: July 1, 2018

Financial Reporting: Requires counties, municipalities, special districts, water

management districts, & district school boards to submit certain budget & financial

information to specified entities; requires certain budget information to remain posted

on such entity's official website for specified period of time; revises reporting deadlines,

with exception; provides penalties; requires Office of Economic & Demographic Research

to develop forms for reporting certain budget information. Effective Date: July 1, 2018

County and Municipal Public Officers and Employees: Requires that request to travel

outside of state by county & municipal public officers be approved by governing board at

publicly noticed meeting; limits travel expenses of public officers & employees to

expenses incurred in specified time period; prohibits travel expenses of public officers &

employees for foreign travel; limits lodging expenses of public officers & employees;

requires public officers who are candidates for elected office to make campaign finance

reports available online; requires public officers to report travel expenses to certain

commission on ethics or to Commission on Ethics; requires public officers to comply with

constitutional financial disclosure requirements. Effective Date: July 1, 2018

the guide if they are made available; prohibiting a county court judge or clerk of the

circuit court from issuing a marriage license unless he or she is first presented with a

statement verifying that both parties have obtained and read the guide or have viewed

are held by clerks of the court and law enforcement agencies; removing the scheduled

repeal of the exemptions, etc. Effective Date: 10/1/2018

Public Records/Identity Theft and Fraud Protection Act; Citing this act as the “Identity

Theft and Fraud Protection Act"; requiring an agency to review for information

susceptible to use for purposes of identity theft or fraud before making postings to a

publicly available website; requiring an agency to establish a policy providing for

requests to remove an image or a copy of a public record containing information

susceptible to use for purposes of identity theft and fraud, etc. Effective Date: 7/1/2018

Public Meetings; Specifies that certain boards and commissions are subject to public

meetings requirements; revises public meeting notice requirements; provides that

member of public has right to speak at public meeting; requires members of board or

commission to respond to questions made at public meetings within a specified

timeframe; repeals provision relating to reasonable opportunity to be heard at public

meetings; provides penalties.
