Preliminary Information
What is an AltMoC issued by FOCA?
The EASA homepage on the internet states (as of end 2016):
‘Since AMCs are non-binding, regulated persons may choose alternative means to comply with the rule. In this case, however, they lose the presumption of compliance provided by the EASA AMC, and need to demonstrate to competent authorities that they do comply with the law.
The implementing rules for Aircrew licensing, Air Operations, Aerodromes and Air Traffic Controller licensing describe the process to be used by regulated persons and competent authorities when they intend to use an AltMoC to comply with the rules.
Implementing Rules establish that the implementation of AltMoC by organisations is subject to prior approval by the competent authority and indicate what needs to be done in order to obtain the approval.
Implementing Rules also establish the obligations of competent authorities when giving the prior approval to an organisation and when they adopt themselves an AltMoC that can be used by the regulated organisations under their oversight.
One of the obligations stipulated in the Implementing Rules is to notify EASA of such AltMoCs. Competent authorities are requested to use the EASA prepared AltMoC Notification Form for notifying AltMoCs proposed by organisations or used by themselves.

To these statements FOCA would like to add the following additional information:
- AltMoCs may not only be issued as alternative to an already existing AMC. FOCA may as well publish AltMoCs that cover issues where no AMC is available. Therefore, the term alternative may be slightly missleading in some cases.
- AltMoCs may be seen as an administrative ordinance in traditional Swiss legal doctrine. However, conditions, issuing power and legal effects are pure products of Union legislation. Legal practitioners, attorneys and courts in Switzerland, therefore, should not attempt to categorise AltMoCs under traditional national principles of administrative law. They should always bear in mind that AltMoC are genuine legal instruments of the EU aviation safety regulation.
What are the effects of an AltMoC issued by FOCA?
AltMoCs issued by FOCA have basically the same legal status and effect as AMCs. Except that the author of AltMoCs is not EASA but FOCA. AltMoCs are not evaluated by EASA in advance but are only reviewed during regular standardisation. Therefore, once released by FOCA, AltMoCs become immediately applicable to all parties under Swiss jurisdiction. In other words, they immediately may be used as an alternative to existing AMCs or they must be used if no such AMC is available. In either case they provide presumption of conformity with the essential requirements and the implementing rules.
However, AltMoCs do not have cross-border effect: an operator under foreign jurisdiction has no legal claim to his competent authority to allow use of an AltMoC issued by FOCA. And FOCA will not automatically accept in its jurisdiction the use of an AltMoC issued by foreign competent authorities.

Different matters are AltMoCs developed and requested by an ATO, operator or regulated person and which are not issued but only approved by FOCA. These have effect for the applicant only. Third parties must submit a complete application for their own including full proof that their AltMoC fulfils the legal requirements.
AltMoC may motivate EASA to initialise own rule making aiming an additional IR or additional AMC. The start of such rule making procedure does senso stricto not have any effect on the AltMoC until the time where a revised IR or a new AMC legally replaces the AltMoC. However, such rule making activities might increase the likelihood that competent authorities accept the underlying foreign AltMoC.

This AltMoC intends to standardize the assessment procedure of management personnel for the safety divisions «flight operations» and «aircraft» of the Federal Office of Civil Aviation (FOCA) Switzerland. It furthermore details the FOCA required competences of nominated persons, other management personnel and their appointed deputies.

The purpose of this AltMoC is to provide:
A guideline of the assessment process of a nominated person or other management personnel
Clarification for the operator of the existing AMC's according to the implementing rules

This AltMoC defines and clarifies the review process by the competent authority upon receiving a change of a management person according to ARO.GEN.330 or M.B.706. It also defines the minimum requirements of nominated persons and other management personnel.

For planned changes of nominated persons or other management personnel (according to ARO.GEN.330 or M.B.706), operators shall follow the guidelines defined in this AltMoC.

1.1 Initial nomination or change of a Nominated Person and other management personnel Ch. 1.1 ISS 2 / REV 0 / 01.09.2016
The Federal Office of Civil Aviation (FOCA) shall be informed of any changes of the following nominated persons and management personnel latest 30 days before the change should become valid:
Accountable Manager (ACM)
Nominated Person Flight Operations (NPFO)
Nominated Person Crew Training (NPCT)
Nominated Person Ground Operations (NPGO)
Head of Training (HT)
Chief Flight Instructor (CFI)
Chief Technical Knowledge Instructor (CTKI)
Compliance Monitoring Manager (CMM) or Quality Manager (QM)
Nominated Person Continuing Airworthiness (NPCA)
Nominated Person Airworthiness Review Staff (NPARS)
After the review of the application FOCA will decide if the candidate can be accepted based on a previously performed assessment, if he can be accepted with restrictions or if there is a requirement for an initial assessment or a reassessment.
Based on the result of the assessment performed and the background of the candidate FOCA may approve the candidate without or with restrictions in the described area for a particular organization.
If a candidate does not pass the assessment, FOCA may not accept him in the described area for a particular organization.

1.2 Requirements of Nominated Persons, Deputies or other Management Personnel Ch. 1.2 ISS 2 / REV 0 / 01.09.2016
The requirements that a Nominated Person, Appointed Deputies and other Management Personnel shall fulfil are listed in the following paragraphs.
1.2.1 Personnel related to Air Operations Ch. 1.2.1 ISS 2 / REV 0 / 01.09.2016
1.2.1.1 Accountable Manager (ACM). The appointed person should have:
(1) knowledge about business economics;
(2) extended leadership experience and knowledge about the Swiss working law;
(3) the contractual and legal power (authority to sign) as well as the independency to lead the organization;
(4) the power over the financial budget to finance flight operation and maintenance according to the legal requirements;
(5) the power to employ and lay off the required employees;
(6) the power to build up and change the organisation structure as well as processes;
(7) the power to buy the required tools etc.
1.2.1.2 Nominated Persons should be expected to possess the experience and licensing provisions that are listed in (a) to (d). Exceptionally, in particular cases, the Federal Office of Civil Aviation may accept a nomination that does not meet these provisions in full. In that circumstance, the nominee should have comparable experience and also the ability to perform effectively the functions associated with the post and with the scale of the operation.
(a) Nominated Persons should have:
(1) practical experience and expertise in the application of aviation safety standards and safe operating practices,
(2) comprehensive knowledge of:
(i) the applicable EU safety regulations and any associated requirements and procedures;
(ii) the AOC holder’s operations specifications or high risk specialised operation authorisa-tion details; and
(iii) the need for, and content of the relevant parts of the AOC or SPO authorisation holder’s operations manual or;
(iv) the aviation relevant EU legislation as well as the national law;
(3) familiarity with management systems preferably in the area of aviation;
(4) familiarity with the safety management system (SMS) preferably in the area of aviation;
(5) appropriate management experience, preferably in a comparable organisation; and
(6) 5 years of relevant work experience of which at least 2 years should be from the aeronautical industry in an appropriate position.
(7) Deputies of nominated persons and other management personnel should have a minimum of 2 years aviation experience.
(b) Flight Operations (NPFO). The nominated person should hold or have held a valid flight crew
licence and the associated ratings appropriate to a type of operation conducted under the AOC or SPO authorisation. In case the nominated person’s licence and ratings are not current, his deputy should hold a valid flight crew licence and the associated ratings. Further he should have

extended leadership knowledge and experience as well as knowledge about the Swiss working law.
(c) Crew Training (NPCT). The nominated person or his/her deputy should be a current type rating instructor on a type/class operated under the AOC or SPO authorisation. The nominated person should have a thorough knowledge of the AOC or SPO authorisation holder’s crew training concept for flight, cabin and when relevant other crew (e.g. task specialist).
(d) Ground Operations (NPGO). The nominated person should have a thorough knowledge of the AOC or SPO authorisation holder’s ground operations concept. Further, if the companies’ operation control centre including flight dispatch etc. is located in his area of competence he has to show knowledge about the basic flight planning rules as well as flight duty limitations.
(e) Safety Manager (SM). The safety manager should act as the focal point and be responsible for the development, administration and maintenance of an effective safety management system.
1.2.2 Personnel related to Training Organisations Ch. 1.2.2 ISS 1 / REV 1 / 01.09.2016
Head of Training (HT). An HT shall be nominated. The HT shall have extensive experience as an instructor in the areas relevant for the training provided by the ATO and shall possess sound managerial capability.
1.2.3 Personnel related to Training Organisations providing training for CPL, MPL and ATPL Ch. 1.2.3 ISS 1 / REV 1 / 01.09.2016
(a) Head of Training (HT). Except in the case of ATOs providing flight test training, the nominated Head of Training shall have extensive experience in training as an instructor in the areas relevant for the training provided by the ATO and shall possess sound managerial capability.
The nominated HT should hold or have held in the 3 years prior to first appointment as HT, a professional pilot licence and associated ratings or certificates issued in accordance with Part-FCL, related to the flight training courses provided
(b) Chief Flight Instructor (CFI). The ATO providing flight instruction shall nominate a CFI who shall be responsible for the supervision of flight and flight simulation training instructors and for the standardisation of all flight instruction and flight simulation instruction. The CFI shall hold the highest professional pilot licence and associated ratings related to the flight training courses conducted and hold an instructor certificate with the privilege to instruct for at least one of the training courses provided.
The CFI should, except in the case of ATOs providing flight test training, have completed 1 000 hours of flight time as pilot-in-command (PIC). At least 500 of those hours should be on flying instructional duties related to the flying courses provided, of which 200 hours may be instrument ground time.
(c) Chief Theoretical Knowledge Instructor (CTKI). The ATO providing theoretical knowledge instruction shall nominate a CTKI who shall be responsible for the supervision of all theoretical knowledge instructors and for the standardisation of all theoretical knowledge instruction. The CTKI shall have extensive experience as a theoretical knowledge instructor in the areas relevant for the training provided by the ATO.

1.2.4 Personnel related to Continuing Airworthiness (CAMO) Ch. 1.2.4 ISS 2 / REV 1 / 01.04.2017
(a) Nominated Person or group of persons should have:
(1) practical experience and expertise in the application of aviation safety standards and safe operating practices;
(2) a comprehensive knowledge of:
(a) relevant parts of operational requirements and procedures;
(b) the AOC holder’s Operations Specifications when applicable;
(c) the need for, and content of, the relevant parts of the AOC holder’s Operations Manual when applicable;
(3) knowledge of quality systems;
(4) five years relevant work experience of which at least two years should be from the aeronautical industry in an appropriate position;
(5) a relevant engineering degree or an aircraft maintenance technician qualification with additional education acceptable to the approving competent authority. ‘Relevant engineering degree’ means an engineering degree from aeronautical, mechanical, electrical, electronic, avionic or other studies relevant to the maintenance and continuing airworthiness of aircraft / aircraft components;
The above recommendation may be replaced by 5 years of experience additional to those already recommended in paragraph (4). These 5 years should cover an appropriate combination of experience in tasks related to aircraft maintenance and/or continuing airworthiness management (engineering) and/or surveillance of such tasks
(6) thorough knowledge with the organisation’s continuing airworthiness management exposition;
(7) knowledge of a relevant sample of the type(s) of aircraft gained through a formalised training course. These courses should be at least at a level equivalent to Part-66 Appendix III Level 1 «General Familiarisation» and could be impacted by a Part-147 organisation, by the manufacturer, or by any other organisation accepted by the competent authority.
‘Relevant sample’ means that these courses should cover typical systems embodied in those aircraft being within the scope of approval.
For all balloons and any other aircraft of 2'730 kg MTOM and below the formalised training courses may be replaced by demonstration of knowledge. This knowledge may be demonstrated by documented evidence or by an assessment performed by the competent authority. This assessment should be recorded.
(8) knowledge of maintenance methods;

(b) For Organisations issuing or extending Airworthiness Review Certificates the respective Airworthiness Review Staff shall have:
(1) For all aircraft used in commercial air transport, and aircraft above 2'730 kg MTOM, except balloons, these staff shall have acquired:
(a) at least five years' experience in continuing airworthiness, and
(b) an appropriate license in compliance with Annex III (Part-66) or an aeronautical degree or a national equivalent; and
(c) formal aeronautical maintenance training; and
(d) a position within the approved organisation with appropriate responsibilities.
(e) Notwithstanding points (a) to (d), the requirement laid down in point M.A.707(a)1(b) may be replaced by five years of experience in continuing airworthiness additional to those already required by point M.A.707(a)1(a).
(2) For aircraft not used in commercial air transport of 2'730 kg MTOM and below, and balloons, these staff shall have acquired:
(a) at least three years' experience in continuing airworthiness; and
(b) an appropriate license in compliance with Annex III (Part-66) or an aeronautical degree or a national equivalent; and
(c) appropriate aeronautical maintenance training; and
(d) a position within the approved organisation with appropriate responsibilities;
(e) Notwithstanding points (a) to (d), the requirement laid down in point M.A.707(a)2(b) may be replaced by four years of experience in continuing airworthiness additional to those already required under point M.A.707(a)2(a).
(c) The Accountable Manager (ACM) should have corporate authority for ensuring that all continuing airworthiness management activities can be financed and carried out in accordance with Part M.
(d) The Quality Manager or Compliance Monitoring Manager (QM or CMM) should have the responsibility of ensuring that the organisation is always in compliance with this Subpart. Such person(s) shall be ultimately responsible to the accountable manager.
(e) For commercial air transport, the accountable manager shall designate a nominated Postholder Continuing Airworthiness (PCA or NPCA). This person shall be responsible for the management and supervision of continuing airworthiness activities, pursuant to paragraph (d).
(f) All paragraph (d) and (e) persons shall be able to show relevant knowledge, background and appropriate experience related to aircraft continuing airworthiness.
(g) For organisations extending airworthiness review certificates in accordance with points M.A.711(a)4 and M.A.901(f), the organisation shall nominate persons authorised to do so, subject to approval by the competent authority (Airworthiness Review Staff).

Step Description

Latest 30 days before the planned nomination of a nominated person, the operator shall send the following documents and information about the new nominated person to the Federal Office of Civil Aviation (FOCA):
Name, contact data and address;
Planned area and planned date of nomination;
Summarised CV showing the evidence of the required experience and education;
Copy of Certificates of performed education relevant to the position;
If a (flight crew) licence is required (operation or training) a copy of the EASA licence (and medical), and
Signed Form 44.20 and Form 4 (For CAMO only Form 4).
2 FOCA will check the application, release an acknowledgement of receipt and will issue a restriction if required (e.g. «no practical nomination before approval» or «more evidence of suitability is required»). If one of these restrictions applies the FOCA will invite the person for an assessment.
3 If the candidate can be accepted without formal assessment (e.g. due former positions hold), he will receive an approval letter together with the stamped and signed Form 4.

All other candidates will be invited by the FOCA for an assessment which consist of the following parts:
Interview about different topics (leadership, aviation and working law, SMS etc.)
General knowledge written examination
Field competence written examination

If the candidate passes the assessment with the required standard, he will receive an approval letter together with the stamped and signed Form 4.
If the FOCA feels that there is a need for additional training or the experience is too low, the acceptance will be connected to additional obligations.
If the candidate does not pass the assessment, FOCA will not accept the candidate.
