Following are two Jury Instructions that the Court will use during the trial.

The Instructions are included now to assist you in answering the questions.

INSTRUCTION NO.___ The burden is upon the State to prove beyond a reasonable doubt that the Defendant is guilty

of the crime charged. It is a strict and heavy burden. The evidence must overcome any reasonable

doubt concerning the Defendant’s guilt. But it does not mean that a Defendant’s guilt must be

proved beyond all possible doubt.

A reasonable doubt is a fair, actual, and logical doubt based upon reason and common sense.

A reasonable doubt may arise either from the evidence or from the lack of evidence. Reasonable

doubt exists when you are not firmly convinced of the defendant’s guilt, after you have weighed

and considered all the evidence.

A Defendant must not be convicted on suspicion or speculation. It is not enough for the

State to show that the Defendant is probably guilty. On the other hand, there are very few things in

this world that we know with absolute certainty. The State does not have to overcome every

possible doubt.

The State must prove each element of the crime by evidence that firmly convinces each of

you and leaves no reasonable doubt. The proof must be so convincing that you can rely and act

upon it in this matter of the highest importance.

If you find that there is a reasonable doubt that the Defendant is guilty of the crime, you

must give the Defendant the benefit of that doubt and find the Defendant not guilty of the crime

under consideration.

INSTRUCTION NO.___ Under the law of this State, a person charged with a crime is presumed to be innocent. This

presumption continues in favor of the accused throughout the trial of this cause. To overcome the

presumption of innocence, the state must prove the accused guilty of each essential element of the

crime charged, beyond a reasonable doubt.

The accused is not required to present any evidence to prove his/her innocence or to prove

or explain anything.

You should attempt to fit the evidence to the presumption that the accused is innocent if you

can reasonably do so.

If the evidence in this case is susceptible of two (2) constructions or interpretations, each of

which appears to you to be reasonable, and one of which points to the guilt of the accused, and the

other to his/her innocence, it is your duty, under the law, to adopt that interpretation which is

consistent with the accused’s innocence, and reject that which point to his/her guilt.

You will notice that this rule applies only when both of the two possible opposing

conclusions appear to you to be reasonable. If, on the other hand, one of the possible conclusions

should appear to you to be reasonable and the other to be unreasonable, it would be your duty to

adhere to the reasonable deduction and to reject the unreasonable, bearing in mind, however, that

even if the reasonable deduction points to the defendant’s guilt, the entire proof must carry the

convincing force required by law to support a verdict of guilt.

During the early morning hours of July 6, 2014, Gary Indiana Police Officer Jeffrey

Westerfield was patrolling in his marked squad car in the area of 25th Avenue and Van Buren Place

in Gary, Lake County, Indiana. During that shift, Officer Westerfield was shot while performing his

duties. It was determined that Officer Westerfield died from facial, neck, and head injuries due to

gunshot wounds. Carl Le Ellis Blount stands charged in the matter.

QUESTIONS ABOUT THE DEATH PENALTY

If the jury determines at the conclusion of the trial of the case that Mr. Blount is guilty

beyond a reasonable doubt of the murder of Officer Jeffrey Westerfield, the jury’s service will not

be over. The same jury must also decide, at a second sentencing phase of the trial, whether or not

Mr. Blount will be sentenced to death, to life imprisonment without the possibility of parole or to a

term of years (45-65 years). If Mr. Blount is sentenced to life imprisonment without the possibility

of parole he will spend the rest of his life in prison and never be released.

The questions in this section are not meant to imply that Mr. Blount is guilty. However, in a

case where jurors may have to consider lifetime incarceration and death as possible punishments, it

is important that we know your opinions and feelings regarding punishment.

The decision whether or not to impose a sentence of death is one the law leaves entirely up

to the jurors. If confronted with the situation, each juror must ultimately make a unique individual

moral judgment about whether to sentence a defendant to death, life imprisonment without the

possibility of parole or to a term of years. The law never requires any member of the jury to vote

for a sentence of death.

During a sentencing phase, if one is required, the government presents information as to

certain things referred to in the law as “aggravating factors,” which are circumstances that could

support the death penalty. The defendant presents information about what are referred to as

“mitigating factors.” Mitigating factors are circumstances about the crime, the defendant, his

background, or anything else relevant that would suggest that death is not the appropriate

punishment. Mitigating factors do not excuse or justify the crimes, but are simply facts and

circumstances that may cause a juror to believe that a sentence of death is not the appropriate

penalty. The law does not require that there be a connection between the mitigating evidence and

the crime committed. And unlike aggravating factors, the law does not require that a mitigating

factor be found unanimously by all twelve jurors. Any single juror may find, and consider, any

mitigating factor.

At the conclusion of a sentencing phase if, and only if, all 12 jurors decide that death is the

only appropriate sentence, then a death sentence will be imposed. The sentence unanimously

imposed by the jury is final. The judge must follow the jury’s sentencing determination.

This is only an overview of the law about a jury’s consideration of the punishments of a

term of years, life imprisonment without the possibility of parole and the death penalty. If this case

requires a sentencing phase, the judge will instruct the jury in greater detail about its duties.

Following are two Jury Instructions that the Court will use in the event that this case goes

into a second sentencing phase. The two Jury Instructions are not meant to imply that Mr. Blount is

guilty or that you will, in fact, be called upon to decide punishment in this case. The Instructions are

included now to assist you in answering the questions.
