FDA Ruling on Medical Device Data Systems

The Food and Drug Administration (FDA) has issued a final rule that reclassifies medical device data systems (MDDS) as Class I devices that are subject to general regulatory control and exempt from premarket notification requirements. The final MDDS rule applies to all manufacturers including hospitals, healthcare facilities or any other organization that does any of the following:

• Makes any modifications to the MDDS that are outside the parameters of the original manufacturer’s specifications for the device, for purposes of the user’s clinical practice or otherwise for commercial distribution

• Purchases hardware or software and modifies it to transfer, store, convert or display medical device data for clinical use

• Develops in-house software with an intended use consistent with an MDDS

• Develops an in-house system, using multiple components of devices, that has an intended use consistent with an MDDS

Brings Specialists to Rural Areas• Hospitals and healthcare systems are increasingly taking advantage

of Telemedicine – the use of computers and telecommunications to connect big-city hospitals to often under served rural areas, where specialty doctors are scarce.

• Besides electronically monitoring the intensive care units of remote hospitals, these technologies are also being used to link specialists with patients, including stroke victims and women with high-risk pregnancies.

Reduces CostsA 2008 study by University of Texas Medical Branch (UTMB), “The Telehealth Promise: Better Health Care and Cost Savings for the 21st Century”, found that the use of telemedicine could save our nation’s healthcare system more than $4 billion annually – just from the reduction of unnecessary patient transfers. [i] Those projections do not consider remote monitoring, interpretative services such as teleradiology, or other telehealth approaches that save money and potentially save lives by identifying and treating emerging medical issues sooner.

Saves Lives• A review of 13 tele-ICU studies found that telemedicine in the e-ICU

reduced ICU mortality by 20%, and reduced the average length of ICU stays by an average of 1.26 days.

• A study in Canada found that rural patients examined with the aid of a technology called Telestroke received an important stroke drug, tPA, at the same rate as patients treated in specialized urban centres, says Dr. Thomas Jeerakathil, a neurologist at the University of Alberta Hospital. The drug tPA (tissue plasminogen activator) is used to break up blood clots, and can help reverse stroke damage if administered within 4.5 hours of the onset of symptoms.

Expands Physicians’ Practices • Nationwide, there is an average of 104.5 primary care physicians per 100,000 residents in urban areas, compared to 65 primary care

physicians per 100,000 residents in rural areas. “Rural physician shortages are expected to worsen as older doctors retire and health care coverage expands under the health system reform law,” according to an article by Carolyne Krupa at amednews.com.

• Revenue streams for physicians have been limited to fee-for-service. While these can be lucrative scenarios, small physician practices or solo practitioners in rural and metropolitan areas still face declining patient volumes and deteriorating reimbursement from Medicare.

• Patients in rural or remote locations face an even more insufferable outcome - inadequate access to quality health care professionals and specialists. Telemedicine enables access to better quality healthcare.
