CASE STUDY #1Sample Use of the Notices - Photograph

Hypothetical Case

Jane Arcana is the proprietor of Terrific Tarot. Her business website is terrifictarot.com (fictional website and if that site actually exists, there is no relation between this hypothetical and the actual website). Jane published a blog post on her website with a photograph that she took herself. Here is the photograph:

The link to that blog post is terrifictarot.com/blog/everybodylovestarot.html (again, a fictional URL). On February 1, 2015, Jane discovers that Warren Pentacle, an aspiring tarot reader, has reproduced that photograph on his website, Razzle Readings, at razzlereadings.com/about/ with no credit attribution to Jane or her business Terrific Tarot. Jane further notices that Warren has had her photograph up on his site since January 15, 2015.

What Jane Decides to Do

First, Jane takes screenshots of the infringing webpage on Warren Pentacle’s website, Razzle Readings, and saves those screenshot image files with metadata that will preserve date and time. Every day thereafter, Jane will check Warren’s website to see if the infringing photograph is still up and if it is, she will take another screenshot and again, document the date and time taken.

Additionally, Jane locates Warren’s contact information, such as his e-mail address, [email protected]. She will then e-mail the following Demand to Cease and Desist letter to Warren:

The Fool is the harbinger of new beginnings, and represents a life of unbound potential. She might even want to get a third party buddy to check Warren’s website and note the copied material so that Jane has a witness. You never, ever know when you’ll need a witness to testify on your behalf.

Additionally, Jane e-mails the following Demand to Cease and Desist letter to Warren:

If the copyright infringing persists, then Jane should consult with an attorney who specializes in intellectual property law to see what legal recourse she has against Warren Pentacle.

CASE STUDY #3Sample Use of the Notices – Text (C&D Sent to Service Provider)

Hypothetical Case

Pretty much the same fact pattern as Case Study #2, only let’s say Jane Arcana posts her monthly newsletter on her website and the link to it is terrifictarot.com/newsletters/March2015 and furthermore, Jane is able to determine the webhost or service provider for Warren Pentacle’s site, Razzle Readings. Let’s say that Razzle Readings is being hosted by SwordPress.com, and Warren’s blog site address is razzlereadings.swordpress.com.

What Jane Decides to Do

In addition to doing what Jane did in Case Study #2, Jane also sends a letter to SwordPress. She finds SwordPress’s contact information for their Designated Agent and sends them the following notice:

Please be advised that I hold the copyright of said Content.

The unauthorized use of Terrific Tarot Content constitutes copyright infringement under Title 17 of the United States Code. Specifically, this letter is a Notice of Infringement as authorized in 17 U.S. Code § 512(c). I hereby declare that I have a good faith belief that use of the Terrific Tarot Content as described herein in the manner complained of is not authorized by the copyright owner, its agent, or the law. I declare under penalty of perjury pursuant to the laws of the United States that all information provided herein is true and accurate, and that I am authorized to act on behalf of the owner of the copyright for Terrific Tarot Content.
