The class action

is moving forward

Thursday June 18, 2009

Good Afternoon,

As we wait patiently for the hammer to drop , I would like to bring a cou-ple of things to light.

The speed at which this will be done is directly related to the amount of funds.

The class action is moving forward and the judicial review application is pro-ceeding. Both of these efforts will continue until the funding is exhausted.Monies collected by PLCAO [ Professional Lawn Care Association of On-tario ] have gone directly to this effort and were paid directly to the lawyers.

I am currently working with organizations from outside Ontario that have of-fered financial support, but they are stunned about the lethargic efforts by the

industry in Ontario. Please take the time to speak to everyone you know in theindustry and ask them if they are making an effort.

Funding for this project has been provided by a small number of companies. At this point M–REP Communications has not recouped their cost for the provincial project. At this point, further efforts will not be explored.

Landscape Ontario [ LO ] has asked to meet on the subject of a government

relations plan and an update on our current efforts. We have not decided at this point if we are going as we are not under contract with LO.

I would suggest everyone that has not forwarded any funding to PLCAO [ Pro-fessional Lawn Care Association of Ontario ] to contact them and com-mit to an amount.

Some people believeit is time to re – assess whether these groups deserve our support, since, in des-perate times, they have utterly failed us. So far. Perhaps the money that they receive from the industry should be re–directed towards those who are cur-rently defending it from those who conspire to prohibit pest control products.

We may well have reached the point of asking all people in the «« G G r r e e e e n n S S p p a a c c e e I I n n d d u u s s t t r r y y »» to CCAANNCCEELL their memberships with those trade associationsand groups that have a grade of «« f f a a i i l l u u r r e e »», for failing to challenge the prohibi-tions. One current bright spot in L.O. is Tony DiGiovanni. We should all thank DiGiovanni for hisefforts.

CropLife Canada.

«« C C r r o o p p LL i i f f e e C C a a n n a a d d a a »» is the group that representsthe manufacturing sector. «« C C r r o o p p LL i i f f e e C C a a n n a a d d a a »» is thetrade association representing the manufacturers, de- velopers, and distributors of plant science innovations ─ pest control products and plant biotechnology ─ for use in agriculture, urban and public health settings. worth has personally spoken out against terrorists and prohibitions on a VV EE RRYY frequent basis. Unfortunately, Hepworth appears to be a lone voice among those manufacturers who arerefusing to get more directly involved to fight the prohibitionconspiracy, except, of course, for «« D D o o w w AAg g r r o o S S c c i i e e n n c c e e s s »», thecompany that is currently challenging the Quebec prohibition.

The Golf Industry.

Incredibly, the «« G G o o l l f f I I n n d d u u s s t t r r y y »» has declared itself SS AATT II SS FF II EE DD with the

Ontario prohibition, without regard for the much larger implications to the en-tire «« G G r r e e e e n n S S p p a a c c e e I I n n d d u u s s t t r r y y »». It is unfortunate that the near – sightedness of this industry’s leaders will prevent it to ever join forces with «« P P r r o o f f e e s s s s i i o o n n a a l l LLa a w w n n C C a a r r e e I I n n d d u u s s t t r r y y o o f f O O n n t t a a r r i i o o »» (P.L.C.A.O. ). The same «« e e n n v v i i r r o o n n m m e e n n t t a a l l t t e e r r r r o o r r i i s s t t »» groups that once pressured the «« G G o o v v e e r r n n m m e e n n t t o o f f O O n n t t a a r r i i o o »» to leg-islate the «« C C o o s s m m e e t t i i c c P P e e s s t t i i c c i i d d e e s s B B a a n n AAc c t t »» will soon set their sights on theEE LL II MM II NNAA TT II OO NN of the GGOO LL FF EEXX CC EE PP TT II OO NN SSTT AATT UUSS.

A personal «« h h o o n n o o u u r r a a r r y y m m e e n n t t i i o o n n »» should be made inrecognition of Jeffrey Lowes, who, with the blessing fromP.L.C.A.O., has conducted himself immaculately. Professional Lawn Care association of Ontario.

The «« P P r r o o f f e e s s s s i i o o n n a a l l LLa a w w n n C C a a r r e e AAs s s s o o c c i i a a t t i i o o n n o o f f O O n n t t a a r r i i o o »» (P.L.C.A.O.), in conjunction with its membership, and JeffreyLowes, has been VV EE RRYY decisive regarding the Ontario«« C C o o s s m m e e t t i i c c P P e e s s t t i i c c i i d d e e s s B B a a n n AAc c t t »». It has recently launched a legal action.

This legal challenge will be expensive. Fifty to one–hundred thousanddollars will likely be the price tag for a lawsuit that challenges the «« C C o o s s m m e e t t i i c c P P e e s s t t i i c c i i d d e e s s B B a a n n AAc c t t »». mately cost one–hundred and twenty–five thousand dollars. People seemto forget that when you lose a challenge, you must pay the opposition’s legal bills as well as your own.

Force of Nature was launched for continuous transmission on the Internet on January 1st, 2009. Itis a series of e–newsletters destined for the Green Space Industry, the environmental move-

ment , politicians, municipalities, and the media, nation–wide across Canada, and parts of the UnitedStates. Force of Nature is produced in two parts. First. The Media Report itself that reports on

the current events affecting the future of the Green Space Industry. Second. Independent Per-

spective, which is a running commentary, which is sometimes more technical in nature.

Force of Nature is the brainchild of William H. Gathercole and his entourage. The opinions ex-pressed in these e–newsletters, even though from an INDEPENDENT PERSPECTIVE, may not reflectthose of everyone in the Green Space Industry, or Mr. Gathercole’s many associates. However, this position has not precluded him from criti-cizing the industry itself. Nonetheless, his vast knowledge of our long journey with environmental issuesis undeniable.
