ANACT to provide for the protection, conservation and manage­ment ofwildmammals, freshwater fishes,amphibians, crusta­ceans and reptiles, and for purposes connected therewith.

1. This Actmaybe cited as the ­

FORESTRY AND WlLDLIFE ACT.

2. In this Act-"alien wildlife" means any species of wildlife not indigenous to

Dominica;

"closed season" means the period in which a specified species or agroupofspecies of wildlife maynotbehunted for, fished forortaken;

"conservation officer" meansapersonwhose primary responsibility isthe enforcement of this Act and the rules and regulations asprovidedherein;

"deleterious substance" means anysubstance if addedto waterwouldendanger the subsistence and maintenance of fish and otheraquatic life residing in the water;

"Director"means theDirector of theForestry andWildlife Division ofthe Ministry of Agriculture, Lands andFisheries;

"fishing" means fishing for or catching fish by anymethod;

"fishing licence"means a licenceissuedundersection 48 of this Act;

"forest officer" has the meaning assigned to it by the ForestsAct;"Form", identified by anumber, means theFormof thatnumberasset

out in the SeventhSchedule; SeventhSchedule.

"game mammal" means those animals specified in theFiJSl Schedule; First Schedule.

"game bird" means those birds specified in the Second Schedule;

"hunting licence" means a licence issued under section 48;

"hunt" includes seeking, stalking, shooting at, pursuing, killing orcapturing or attempting to kill or capture any bird or mammal ormolesting or taking any bird nest or eggs;

"Minister" means the Minister responsible for forests and wildlife;

"motor vehicle" has the meaning assigned it in the Motor Vehicle andRoad Traffic Act;

"national park" means any area ofland or water declared to be nationalpark by or under the National Park and Prohibited Areas Act;

"open season" means that period in which a specified species or groupof species of wildlife may be hunted for, fished for or taken;

"owner" in relation to private land includes a lessee, mortgagee inpossession, title holder, or any person authorised by lessee,mortgagee or title holder to act on his behalf in his absence;

"protected mammal" means a mammal specified in the Fourth Sched­ule;

"protected bird" means a bird specified in the Fifth Schedule;

"protected shrimps or crabs" means shrimps or crabs specified in theSixth Schedule;

"specially protected birds" means the Sisserou Parrot (Amazonalmperialis) and the Jaco Parrot (Amazona Arausiaca);

"take" means pursuing, shooting, hunting, killing, capturing, snaring,trapping, netting or placing or using any net, traps or device forprocuring wildlife;

"regulations" means any rules, regulations or by-laws made under thisAct;

"the Division" means the Forestry and Wildlife Division establishedunder section 4;

"wildlife" means animals of the following groups living beyond thecontrol of man:

mammals (including feral pigs); birds and the eggs thereof;frogs and the eggs thereof; reptiles and fishes, their fry and eggs,and crustaceans found in fresh water streams orimpoundments;

"wildlife reserve" means any area declared to be such under section22.

4. There is established in the Ministry of Agriculture, Lands and Forestry and

(d) issue permits for keeping wildlife in captivity, and specify­ing conditions under which the wildlife shall be kept, anddisposed of;

(e) advise the Ministeron the dispositionofapplications for thecollecting of wildlife.

8. For these purposes they may -

(a) enterinto contractoragreements with individuals, agenciesor companies for construction of trails, roads, boundarymarkers, buildings, forest nurseries, fish hatcheries, andother works; for carrying out studies or surveys for thecontrol or disposition of wildlife products or trophies, forthe preparation and printing of reports and informationalmaterialor forthe accomplishmentofotheractivities forthepurpose of carrying out the provisions of this Act;

(b) conduct scientific surveys and studies on wildlife and for­estry problems;

(c) establish, administer and develop zoological gardens,aquariums, laboratories of natural science, and any neces­sary related services;

(d) sell forest products and enter into commercial activities forthe purpose of developing forest oriented enterprises;

(e) lease tracts of land and let concessions for services toprovide facilities for tourists and visitors to forest reserves,wildlife reserves and natural areas;

if) engage in other activities deemed necessary or advisable incarrying out the purposes of this Act.

9. The Director shall have supervision of the other officers andshall be responsible for all activities of the Division, including theenforcement of this Act. He may delegate any responsibility orauthority he may have to other officers of the Division.

10. The Director, such other employees of the Division as consid­ered appropriate by the Director, and the Dominica Police Force shallhave the rightsand privileges ofconservation officers forthe enforcementof the provisions of this Act.

12. Every conservation officer may stop and detain any person Rights of officers

WILDLIFE MANAGEMENT

A. PROJECTION

21. Wildlife maybetakenonlyunderconditions andin accordancewithregulationsprescribedin thisAct,andregulations pertainingtothisAct promulgated by the Minister andpublished in the Gazette.

22. Uponthe recommendation of the Directorand the PermanentSecretary, theMinistermaydeclareanyarea, anystream, impoundmentor portionthereofto be a wildlife reserve in whichhunting, fishing ortakingofoneor morespecies shallbe prohibited. Thedeclaration shallbe published in theGazette.

23. Anypersonwhoin awildlife reserve hunts, fishes, or takesanymammal, bird,fish,shrimporcrabspecified asprotected is guiltyof anoffence.

24. Huntingisprohibited within theboundaries ofanynationalparkor national monument.

37. Hunting of birds is prohibited between one half-hour aftersunsetand one half-hour beforesunrise.

38. (1) Nopersonmayhuntforor fish for anywildlife duringthatperiod for which the season is closed for that particular species ofwildlife, norshallapersonhuntfororfishforanywildlife in anareaforwhich hunting or fishing for that particular species of wildlife isprohibited.

(2) Notwithstanding the provisions of subsection (I) of thissection andofsection33andsubjectto theprovisions ofsection35,anyperson may, where it is necessary for the protection of agriculturalcrops,hunt anddestroyferalpigs duringthe closedseasonand in anyarea.

. 39. Itis prohibitedtouseanydevice fortakingwildlife whichcausesa firearm to be discharged without a personpressing uponthe trigger.

40. No firearm shallbe usedfor hunting whichis capableof firingmore thanonceas a resultof one pressure uponthe trigger.

LICENCES AND PERMITS

48. Licences for hunting and for fishing in freshwater streams or Licence issued by

51. Every licence shall be valid only for the person to whom it isissued; it shall not be transferable, shall not be used by anyone exceptthat person to whom it was issued, and no refunds can be made after thepurchase thereof.

52. Every holder of a licence or a permit shall carry the licence orpermitupon his person when engaged in any activities authorised by thelicence or permit, and exhibit the licence or permit to any conservationofficer who requests him to do so, and inform such officer ofhis nameand address.

53. The fees for licences and permits shall be prescribed by theMinister and shall be published in the Gazette.

54. Upon recommendations of the Director orin consultation withthe Director, the Minister may issue permits to collect wildlife toofficers or employees of recognised scientific, cultural or educationalorganisations. The permits shall specify the wildlife permitted to becollected, the period of validity of the permit, the methods which maybe used to collect the wildlife, the disposition ofthe wildlife, the personor persons authorised to make the collections, and any otherconditionsconsidered to be appropriate by the Minister. The permit shall be inForm 4.

55. Any permit issued under section 54 may be cancelled at any timeby the Minister.

56. Where any licence or permit has been lost, stolen or destroyed,the holderofthe licence or permitmay apply for a duplicate, which maybe issued. The fee forthe duplicates shall be set by the Ministerand shallbe published in the Gazette.

57. Any licences or permits issued under this Act shall not conferupon the licencee or permitee the right to enterupon the lands or watersof another for the purpose of taking wildlife.
