The petitioner named above respectively showeth under
1. Tamil Nadu Electricity Board, was a State Electricity Board constituted under
section 5 of the Electricity (Supply) Act, 1948 and was in the business of
Generation, Transmission and Distribution of Electricity in the State of Tamil Nadu.
2. TNEB was restructured into TNEB Ltd and two subsidiary companies viz. Tamil
Nadu Generation and Distribution Corporation Ltd and Tamil Nadu Transmission
Corporation Ltd.
3. Tamilnadu Generation and Distribution Corporation Ltd., (TANGEDCO) was
incorporated on 01.12.2009 and the Certificate for commencement of business was
obtained on 16.03.2010.

4. The Government vide G.O.(Ms.) No.100, Energy (B2) department, dt 19.10.2010
has issued Tamil Nadu Electricity (Reorganisation and Reforms) Transfer Scheme,
2010 for the purpose of transfer and vesting of property, rights and liabilities of the
Tamil Nadu Electricity Board in the State Government and re-vesting thereof by the
State Government into corporate entities and also for the transfer of personnel of
the Tamil Nadu Electricity Board to corporate entities and for determining the terms
and conditions on which such transfer and vesting will be made. The opening
balances of assets and liabilities are transferred based on the 2008-09 un-audited
balance, which was the latest available data at that time. TANGEDCO started
functioning independently from 1.11.2010 onwards.
5. As per clause 9(1) of the transfer scheme the assets transfer is provisional for a
period of one year and employees transfer is provisional for a period of three years
from the effective date of transfer, i.e. 1.11.2010. The Government has been
addressed for one more year extension i.e. up to 31.10.2012 for finalising asset
transfer and the same has been approved vide G.O.(Ms.) No.2, Energy (B2)
department, dt 02.01.2012.
6. As per Section 46 of Electricity Act, 2003, the State Commission authorise a
distribution licensee to charge from a person requiring a supply of electricity any
expenses reasonably incurred in providing any electric line, or electrical plant used
for the purpose of giving that supply.
7. In addition to Revenue from sale of power, TANGEDCO is collecting
Miscellaneous charges from consumers on account of service connection
charges,Meter Rent, Meter caution Deposit,Re-connection charges,Registration
charges etc.
8. Accordingly, as submitted by TNEB the Hon’ble Tamil Nadu Electricity Regulatory
Commission has issued Order on Non- Tariff related Miscellaneous Charges dt
31.08.2004 without any increase for the rate pervailed from 1999.
9. This application for the revision of Miscellaneous charges, is being filed before
the Honourable Tamil Nadu Electricity Regulatory Commission hereinafter submitted
to as Hon. Commission and it is prayed to approve the proposed miscellaneous
charges and TANGEDCO requests the same may be effective from 01.08.2012
or earlier.

10. Need: 1., The TANGEDCO has witnessed substantial increase in its operational costs on
account of increase in its cost of inputs, wage – salaries of employees as well as
the inflationary conditions, while the miscellaneous charges continues to remain the
same for the past 11 years from 1999.
2. It is submitted that the objects for which revision now requested such as meter
caution deposit, security deposit, are not covered in the approved Aggregate
revenue requirement for the year 2012-13 by the Hon’ble commission .Further it is
submitted that the proposed and approved operation and maintenance charge
based normative tariff regulation escalations of 4 % will be of very much less than
the average and actual O&M expenses. The marginal increase in revenue from
these charges would compensate the balance requirement for the year 2012-13
and it is prayed to adjust the variation if any based on the audited accounts of
2012-13.
11. Proposed Miscellaneous Charges I. SERVICE CONNECTION CHARGES: 1. It is submitted that as per section 46 of the Electricity Act 2003, the State
Commission shall authorise a distribution licensee to charge from a person requiring
supply of electricity in pursuance of Section 43 any expenses reasonably incurred in
providing any electric line or electrical plant used for the purpose of giving that
supply.Accordingly , for connecting up an installation, the TANGEDCO shall be
entitled to collect the entire cost of the service lines including material, transport
and labour from the consumers.
2. The cost of the service line including men and materials right from the nearest
tapping pole upto the metering point in the case of overhead system and from the
nearest pillar box or jointing location as the case may be upto the metering point in
the case of cable system may be collected from the consumer.

3. Separate charges for Single phase and three phase SCs:
Separate charges for single phase and three phase has been proposed in the
petition, since now a days most of the consumers are opting for the three phase
supply. Hence, the incurred expenditure for developing infrastructure in
respect of the three phase SCs are more when compared with single phase SCs. If
the charges for three phase and single phase SCs are bundled, the same will
increase the burden to those opting for single phase SCs (economically weaker
section) and also financial loss to the TANGEDCO. Hence, in order to charge the
reasonable expenditure to be incurred for both single phase and three phase SCs,
separtae charges are being proposed for single phase and three phase SCs
separately.
4. Seperate charges for i). Low Tension Three Phase service connections with less than 18.6KW ii). Low Tension Three Phase service connections with Connected Load between 18.6KW and 50 KW iii). Low Tension CT service connections with Connected Load between 50kw and 112 kw:
a. In the existing order on the Non- Tariff related Miscellaneous Charges
w.e.f. 01.10.2004, Three phse LT services with a connected load upto 112 KW are
charged equally.
b. In case of LT Three Phase SCs with a connected load of 18.6 kw to 50
KW, in addition to the provision of MD recording and pf billing, the additional man
power in the level of Assistant Engineer is required, the licensee incurs more
expenditure than LT service connections with connected load of less than 18.6 KW.
c. Similarly ,in case of LT Three Phase SCs with LTCTs (50kw to 112 kw),
LTCT in addition to the man power requirement for providing service connection,
the additional man power of MRT wing are required, and the licensee incurs more
expenditure than other LT service connections which is equivalent to High Tension
Service Connetions.
d. Hence, it is submitted that it is proposed to charge seperate SC charges
for

18.6 KW and 50 KW
iii). Low Tension CT service connections with Connected Load between 50 KW and
112 KW:
5. Introduction of charges for Agriculture and Hut Services:
It is submitted that the service connection charges for agriculture
consumers are also proposed. Considering hut consumers as BPL category and due
to socio-economic condition, less service connection charges for hut consumers are
now proposed.

11. II. Meters:
1. It is submitted that as per Regulation 5 (11) of Tamil Nadu Electricity
Supply Code of Honb’le commission stipulates that meter rental charges shall be
payable by the consumer, unless the consumer elects to purchase a meter, in
accordance with the rates by the Commission from time to time.
2. Under the heading of Meters, at present the following charges are being
collected :
(A). Meter Rent
(B). Meter Related Charges
i. Changing of Meter Board
ii. Changing of meter at the request of the consumer not due to increase
in consumption
iii. For Testing, if it is proved to be correct within the prescribed limit
(challenge Test)
iv. Installation Testing
3. Now,under the heading of Meters, the following charges including above
charges /modification of above charges and new charges are submitted for
collection from the consumers:
(A). Meter Rent
(B). Meter Related Charges
i. Changing/Shifting of Meter Board/ Meter box for LT, LTCT & HT and
ii. Changing of Meter at the request of the consumer without any
dispute in accuracy of the meter
iii. For inspection and Testing of Meter when dispute arises in the
accuracy (Challenge test)

iv. Installation Testing arising out of failure or replacement.
v. Charges for rating / re-rating of installation at the instance of the
consumer
vi. Resealing charges where seals are found broken
vii. Replacement of Glass and Meter
viii. Charges for replacement of damaged / burnt meter by the
consumer
ix. Special meter reading charges as per the request of the consumer
4 (A) Meter Rent:
a. It is submitted that, as per the provison under section 47 (1(b)) and
section 55 (1) of the Electricity Act, 2003, the TANGEDCO is entitled to collect a
meter rent. As per section 47(4) of the Electricity Act, 2003, the consumer is
entitled to receive interest at the bank rate to be specified by the Commission for
the meter security deposit paid by the consumer.
b. In Honb’le commission’s order on non-tariff related miscellaneous
charges w.e.f.1.10.2004, it has been stated that the meter rent for LT services and
the interest on MCD will be a meagre amount and it is proposed to match both and
further, this will eliminate considerable accounting works in computing the interest
for small amounts and issuing credits through consumption bills or cash payment
and accordingly, no meter rent has been collected and inturn no interest has been
paid for the Meter Caution Deposit.
c. Now, it is submitted that since the billing of LT SCs are computerised,
there will not be any difficulty in calculation of interest for the Meter Caution
Deposit. Hence, the meter rent may be imposed and interset for MCD may be paid
to the LT consumers.

d. Further, as per Central Electricity Authority Regulation on meters, all the
service connections are to be provided with electronic meters with Automatic Meter
Reading (AMR) facility. TANGEDCO is in the process of implementing the same and
in order to augment the replacement of existing meters/provision of new meters, it
is prayed to approve the proposed meter rent as submitted below:

b. Fees for Periodical Inspection:
It is submitted that, as per Rule 46 of I.E. Rules, 1956 framed by the
CEA which is in vogue, the fee for periodical inspection and testing of consumer’s
installation shall be determined by the Central or State Government. The
inspection and testing fee have been prescribed by the Government in G.O. Ms.
No.31, Energy (B1) Department, dt. 1.4.2002 (copy enclosed) and its subsequent
amendments/revisions. Therefore, the fee prescribed for the LT installations, M.V.
and H.V. installations in the said G.O. or any other charges to be fixed from time to
time shall be collected from the consumer, wherever the services are inspected for
safety aspects as per the form prescribed in Rule 46 of I.E. Rules 1956 by Board’s
Officials during mass inspections or any other inspection conducted and the same
may be approved.

Note Submission no. :- 1. This amount will be charged without prejudice to the
right of the TANGEDCO to take any other action or impose penalty on the
consumer as per the prevailing rules. Since, in such case, the meter has to be sent
to the MRT lab, the meter changing charges shall be levied additionally.
Note Submission no.: -2. This amount will be charged without prejudice to the
right of the TANGEDCO to recover the estimated cost of theft of energy. Principles
of natural justice shall invariably be followed and opportunoty of being heard given
to the conumer before levying such charge.

(ix) Charges for Replacement of damaged/burnt meter by the act of consumers
a. The cost of burnt out meter shall be collected either in cash or by crossed
cheque and burnt out meter shall be replaced by a good meter immediately without
any lapse of time.The released burnt meter shall be examined MRT wing of the
Licensee. If the meter is burnt out due to mistake of Consumer or fault in the
Consumer premises, there shall be no refund of the cost of meter collected by the
Licensee and if it is due to the technical reasons like voltage fluctuation etc,
attributable to the system constraints, the cost of meter collected by the Licensee
shall be adjusted against the future consumption charges of the Consumer under
intimation to the Consumer.It is prayed to approve the proposed charges as

11.III. Meter Caution Deposit: The provision under section 55 of the Electricity
Act, 2003 stipulates that the licensee may require the consumer to give him
security for the price of a meter.

11.V. Reconnection Charges:
a. It is submitted that as per Regulation 5 (8) of Tamil Nadu Electricity

Considering socio economic condition, the Hut consumers are proposed
to be charged lesser reconnection charges. Basis for the proposed charges are
submitted in Annexure- VIII.
ii. LTCT Services: Reconnection charges for the LTCT services is being
proposed as Rs.2500/ per service. Further, in respect of LTCT services remaining
disconnected for more than 6 months, testing of meter by MRT personnel would be
required. Hence, it is proposed to charge an amount of Rs.3500/- per service to the
LTCT services remaining disconnected for more than 6 months.
iii. HT Consumers: Reconnection charges for the HT services is being
proposed to be revised from Rs.3000/ per service to Rs.4000/- per service. Further,
in respect of HT services remaining disconnected for more than 6 months, testing
of meter by MRT personnel would be required. Hence, it is proposed to charge an
amount of Rs.6500/- per service to the HT services remaining disconnected for
more than 6 months. it is prayed to approve the proposed reconnection Charges
LTCT and HT consumers and as submitted below:

11.VI. Replacement of Consumer Meter card: Meters:
1. It is submitted that Regulation 5 (9) of Tamil Nadu Electricity Supply
Code of Honb’le Commission stipulates that the licensee shall collect charges at the
rate specified by the Commission for replacement of consumer meter card card if
lost or demaged.
2. Further, it is submitted that at present there is no charges for issuing
meter card at the time of effecting service connection and now it is submitted that
considering printing and card cost,Transport,estsblishment charges, it is prayed to
approve the same and equivalent charges for replacement, lost or damaged card
and used up as follows:

11. VII. Charges for dishonoured cheque:
a. It is submitted that Regulation 5 (10) of Tamil Nadu Electricity Supply Code of
Honb’le Commission stipulates that the licensee shall collect service charges as
specified by the commission time to time from the consumer when a cheque given
by consumer is returned by the bank for any reason whatsoever.

b. When Cheques given by Consumers either for current consumption
charges or towards any other charges of current consumption deposit/Additional
current consumption deposit are returned by the Bank for any reason, a service
charges of Rs.250/- is being collected for both LT and HT consumers.
c.Even though the no. of HT consumers are less compare to LT consumers, the
energy consumed by the HT consumers are more and hence the current
conssumption charges payable by the HT consuemrs are also high. Moreover, they
are paying the charges for the energy already consumed by them. As such, when
the cheque issued by a LTCT consumer / HT consumer for the energy already
consumed by them, is returned by the Bank as dishonoured, the day to day
financial planning of the TANGEDCO gets affected very much and the resulting
financial hardship would be considerable.
d. In this connection, it is submitted that in Regulation 15 (3) of Tamil
Nadu Electricity Supply Code, differentiation has been made between LT and HT
consumers as regards to the minimum levy of additional service charges in the
event of dishonour of cheque for the second occasion.
e. Hence, it is prayed to approve the proposed charges for dishonoured
cheque depending upon the cheque amount for the financial hardship caused for LT
CT/HT services plus service charges in respect of HT/LT consumers as submitted
below:

11. VIII. Charges for Name Transfer of Service
a. It is submitted that as per regulation 4(2) of Tamil Nadu Electricity Supply
Code of Hon’ble commission, Name Transfer Charges shall be recoverable from the
consumers, by the Licensee. In Regulation 5(7) of the above Supply Code, the
details of documents to be furnished for considering the name transfer have been
indicated.
b. In order to effect Name transfer, it would be essential to verify all the
necessary documents mentioned in Regulation 5(7) of the Supply Code and to
ensure whether the service is live or under disconnection. Based on the activities
involved and man power requirement, it is prayed to approve the proposed Name
Transfer Charges as submitted below:

11.IX. Development Charges: i. LT Category: a. It is submitted that as per section 46 of the Electricity Act 2003, the State
Commission shall authorise a distribution licensee to charge from a person requiring
supply of electricity in pursuance of Section 43 any expenses reasonably incurred in
providing any electric line or electrical plant used for the purpose of giving that
supply.Accordingly , for connecting up an installation, the TANGEDCO shall be
entitled to collect the entire cost of the service lines including material, transport
and labour from the consumers.

b. It is submitted that the development charges are being collected to recover
atleast a part of the cost of creation of necessary infrastructure facility for extension
of supply. it is prayed to approve the proposed development Charges as submitted

(iii) Further it is submitted that the above development charges at the

(i) Whenever the consumer applies for additional loads in the existing service connection.
(ii) When application for conversion of single phase service into three phase service is received, the difference between the charges fixed for three phase service and single phase service maybe collected.
(iii) As regards, temporary supply one fourth of the Development charges for the respective category may be collected.
11.X. Registration Charges:
a. It is submitted that Regulation 5(12) of Tamil Nadu Electricity Supply
Code of Hon’ble commission stipulates that Licensee shall collect the Registration
Charges at the rates specified by the Commission. In this connection, the following
is submitted before the Hon’ble Commission for consideration:
b. The Registration of application involves not only the registration of
appliction but also involves the investigation for processong the application. . On
investigation only, it can be ascertained whether the application involves any
extension or improvemnets to the distribution network which is necessary to
prepare the necessary estimate and obtaining the sanction accordingly.

c. Similarly, in the case of HT services also, preliminary investigation is
considered necessary to ascertain the technical feasibility for considering the
request of the consumer as per the application.
d. Hence, it is appropriate to change the nomenclature as “Registration –
cum – Processing Charges”.
e. Considering the activities involved and the man power requirement, the
following is submitted

(iv) Whenever the consumer applies for shifting of services/lines
(v) When application for the assets like poles/lines damaged by the accident
have to be replaced at the cost of the party who caused the accident under
DCW estimate.

(vii) Whenever the application for Name transfer and for any other purposes
11.XI Tariff Change:
It is submitted that at present there is no charge collected for tariff
change and now it has been proposed to collect the charge from the
consumer,considering registration, verification,processing,sending intimation, taking
revised test report are needed. It is prayed to approve the charges for tariff change
as submitted below:

Industrial consumers and HT consumers. It is prayed to approve the Earnest Money
Deposit charges submitted below:

collected at the time of extending supply for sanctioned load for LT services

11.XIV. Electricity Customer Service Charges:
It is submitted that the following Electricity Customer Service Charges
are proposed for providing Electricity services to the consumers of TANGEDCO. This
charge is meant for meeting the expenditure of the licensees on account of meter
reading, preparation of bills, delivery of bills, collection of revenue and maintenance
of customer accounts etc. Further, the entire fixed charges could not be recovered
from the existing or proposed retail tariff. The licensee is bound to meet customer
service charges irrespective of the level of the consumption of the consumer. It is
prayed to approve the Electricity Customer Service Charges as submitted below:

set or Breaker and CT/PT etc for metering at consumer end for the HT/EHT
applicants excluding the meter cost.
ii) If the application is incident in an area where a Distribution
Main (LT/HT/EHT) is not available and needs erection of new HT/LT
feeder.
a) To charge the consumer the entire cost of estmate for the line from the
nearest Distribution licensee premises (i.e) sub station/Distribution Transformer
upto consumer installation.
b) To charge the special pole structure, metering equipments such as metering
set or Breaker and CT/PT etc for metering at consumer end for the HT/EHT
applicants excluding the meter cost.
c) To charge the cost of estimate for erection of sub station equipments such
as Breaker along with CT/PT etc if new HT/EHT feeder is proposed .
iii) If the application is incident in an area where a Distribution
Main (LT/HT) is not available, with erection of new distribution
transformer/power transformer and new feeder.
a) To charge the consumer the entire cost of estimate for the line at higher
voltage (i.e) from EHT/HT sub-staion premises to substation/Distribution
Transformer
b) The cost of line at the required voltage from substation/distribution
transformer upto consumer installation.

c) To charge the cost of estimate for the line from the tapping pole to
metering point with special pole structure and cost of estimate for erection of
equipments such as metering set/ breaker for the EHT/HT and CT/PT etc incuding
their cost required for metering at consumer end for the HT.
d) To charge the cost of estimate for erection of sub station equipments
such as Breaker along with CT/PT etc excluding the cost of distribution
transformer/power transformer.
iv) If the existing line requires improvement such as
strengthening/bifurcation
To charge the cost of estimate for the line for strengthening of existing
LT/HT/EHT line.
v) Extension, improvement or alteration to service lines to meet any
additional demand will also be charged on above lines upto consumer installation.
vi) In all the above cases, the consumer will be furnished with an estimate
of the cost of the work and this amount is payable in advance. On completion of
the work, a bill for the actual amount payable will be forwarded to the consumer
and any difference shall be paid by the consumer or deducted by the TANGEDCO in
the Current consumption bills as the case may be.
