The Rehabilitation of Offenders (NI) Order 1978 followed similar legislation in England and Wales four years earlier. It is recognised that getting employment was a key feature of successful resettlement and it was aim was “to restore the offender to a position in society no less favourable than that of one who has not offended”. It introduced the concept of “spent” convictions following a “rehabilitation period” varying from 6 months to 01 years depending on the age of the offender and the length or type of sentence.

Provided the person was not reconvicted during the period of rehabilitation, the convictions(s) would become “spent” and therefore no longer had to be disclosed, making it appropriate for the ex-offender to say “no” when asked the question “do you have a criminal record?” An employer was not entitled to ask for information regarding “spent” convictions, and the order made it illegal for an employer to use a spent conviction to reject a job application or as grounds for dismissal.

Under the Rehabilitation of Offenders (Exceptions) (NI) Order 1979 a range of posts/professions are exempted from this legislation. However, the legislation is inclusive of only those who receive sentences of less than 30 months in custody (immediate or suspended). Any custodial sentence in excess of this never becomes spent and would always have to be declared.
