1 Introduction
This appendix contains written and oral comments received from federal, state, and local agencies, the
general public, and Native Americans during the public comment period for the Draft Environmental
Impact Statement (EIS) for the Four Corners Power Plant and Navajo Mine Energy Project. The Notice of
Availability for the Draft EIS appeared in the Federal Register on March 28, 2014. This initiated a 60-day
comment period, which was subsequently extended for 31 days. The comment period ended on
June 27, 2014. During the public review period, the Office of Surface Mining Reclamation and
Enforcement (OSMRE), Western Region, Denver, CO, held nine open house public meetings from April
30, 2014, to May 9, 2014. Public comment was encouraged at each of the public meetings, in
newsletters, public service announcements, and other publications.
In accordance with the National Environmental Policy Act (NEPA), public and agency written and oral
comments were reviewed and incorporated into this Final EIS. Both written and oral comments were
given equal treatment in this process. These public and agency comments were taken into consideration
by OSMRE in preparing the Final EIS as well as in its decision making process. The following presents
the OSMRE comment and response process.
1.1 Comment Receipt and Review
Comment Receipt
Comments on the Draft EIS included both written correspondence and oral testimony received during the 91-day public comment period. All written and oral comments received during that period are included in Section 4 of this appendix. Oral comments were received only at the nine public meetings held during the comment period, and were given to licensed court reporters either directly or through the use of a Navajo or Hopi translator. The testimony is also provided in this appendix.
Comment Review
In accordance with 40 Code of Federal Regulations (CFR) 1503.4, comments were assessed and
considered as follows:
Each written or oral comment was assigned an identification number. Comment letters were
numbered sequentially based on when they were received by OSMRE.
Each written and oral was reviewed carefully. Within each comment, substantive comments were
identified, bracketed, and assigned into a category based on technical sections within the EIS.
Three guidelines were used for determining substantive comments:
1. The comment questioned components of the proposed action or alternatives associated with
the Four Corners Power Plant and Navajo Mine Energy Project;
2. The methodology of the analysis or results was questioned;
3. The use, adequacy, or accuracy of data was questioned.
Those written or oral comments that did not present a substantive comment as described above, are
included in this appendix, but have no response associated with the comment letter or oral testimony.
The bracketed comments were reviewed by appropriate environmental resource specialists who
drafted responses. There were some comments that were made frequently enough that OSMRE
prepared “master responses” to these comments. Those comments and their responses are

2.1 Deficient Analysis
OSMRE received comments stating that the Draft EIS is deficient in its analysis of the full economic,
environmental and human health impacts of this project, or that the Draft EIS did not take a “hard look” at environmental consequences. Council on Environmental Quality (CEQ) guidelines (40 CFR §1502.16)
state that an EIS shall include discussions of:
direct effects and their significance;
indirect effects and their significance; and
possible conflicts between the proposed action and the objective of federal, regional, state, local,
and tribal land use plans, policies, and controls.
OSMRE NEPA Implementing Regulations further state that it is necessary to systematically assess the
impacts of a proposed action on individual environmental resources, factors or concerns. Environmental
resources, factors and concerns suggested as a guide for consideration include: public health and safety,
air quality, land, surface water and groundwater resources, vegetation, fish and wildlife populations and
habitats, existing and future land use, transportation and utilities, socioeconomic characteristics, public
services, noise and ground vibration, recreational resources, cultural resources, and aesthetics.
The analysis provided in the EIS meets or exceeds these requirements. Additional issues identified during
scoping are analyzed. The level of analysis for most resource categories, including socioeconomics, air
quality, climate change, water quality, public health and ecological conditions all rely on technically-sound,
peer-reviewed methodologies as applicable, in many cases recommended by the agency with jurisdiction
over the issue. The analysis of the full economic, environmental, and social impacts of the project are

addressed in Section 4 of the Draft EIS. Each section in Section 4 includes the description of affected
environment for that resource, the environmental consequences of the Proposed Action and alternatives
on that resource, and proposed mitigation for any identified major effect. These analyses are at the
project level. The cumulative impact analysis and the environmental justice analysis takes a broader view,
considering the effects of past, present, and reasonably foreseeable future projects on the environmental
resources within the study area, including multi-media effects.
2.2 Renewable Energy Alternatives
OSMRE received comments, both during scoping and as comments to the Draft EIS, requesting analysis
or approval of a renewable energy alternative. CEQ guidelines (40 CFR §1502.14), require that a lead
agency consider a reasonable range of alternatives, including alternatives outside the agency’s jurisdiction. For alternatives eliminated from detailed study, the agency must briefly discuss the reasons
for their having been eliminated.
Section 3.3.1 of the Draft EIS discusses OSMRE’s evaluation of conversion of the FCPP to several Non-
Coal Fired Energy Options, which includes renewable energy resources. Five options proposed by
commenters during the scoping period for the proposed project were considered: natural gas, solar, wind,
geothermal, and biomass. Each of these options was compared to the selection criteria for an alternative
to be carried forward for full analysis, including compliance with the Purpose and Need, technical
feasibility, and cost feasibility (Section 3.3.1.4). Based on this evaluation, OSMRE determined that the
conversion of FCPP to a non-coal energy plant does not meet the purpose and need of the Proposed
Project, nor is it economically feasible. Consequently, this alternative was not carried forward for full
evaluation. In addition, Stipulation 16 of FCPP Lease Amendment 3 requires that the primary fuel used at
FCPP shall be coal. For any non-coal alternative, the Navajo Nation would have to review and approve a
new lease for the site, which BIA would have to review to fulfill its tribal trust responsibilities. Therefore,
any non-coal alternative for FCPP would be the functional equivalent of No Action.
Similar to the non-coal fired energy options alternative, OSMRE considered a solar thermal/coal hybrid
alternative in Section 3.3.2. OSMRE’s evaluation of this alternative determined that it did not meet all of the selection criteria, specifically technical or economic feasibility. Based on these evaluations, OSMRE
has not carried forward a renewable energy alternative for detailed analysis in the Draft EIS.
2.3 Alternative Lease and Permit Terms
OSMRE received comments suggesting approval of a shorter lease term for the FCPP and shorter permit
term for the SMCRA permit. OSMRE’s action is to approve or disapprove the SMCRA permit application for the Pinabete Mine area. In accordance with the SMCRA regulations at 30 CFR 750.12(c)(1)(ii) and
773.19(c) limiting the permit terms to no greater than five years, the Pinabete permit application includes
a proposal to submit permit renewal applications, including the initial permit term, at 5-year intervals
through the life of the permit. The permit application did not include proposal to increase the initial permit
term beyond five years, in accordance with the provisions of the regulations at 30 CFR 778.17. OSMRE
has no justification for disapproving the 5-year permit term intervals proposed within the Pinabete permit
application. Regardless of the permit term proposed or potentially approved within the Pinabete permit
application, all impacts for the life of this permit, if approved, are analyzed in the EIS, i.e., there would be
no difference in the impacts identified regardless of the permit renewal intervals proposed or approved
within the permit application.
Regarding the FCPP, the lease renewal under consideration for approval by Bureau of Indian Affairs
(BIA) was drafted and approved by the Navajo Nation for a specific time period (25 years). BIA
regulations do not grant authority to revise a lease prepared and approved by tribal authorities; rather, the
action is to either approve or disapprove of the Navajo Nation’s agreed-upon lease terms. Consideration

of a different lease period would therefore entail denial of the lease renewal (that is, selection of the No
Action Alternative) and resubmittal of a revised lease agreement by the applicant and the Navajo Nation.
2.4 Mercury Deposition and Fish Consumption
OSMRE received comments concerned about the levels of mercury in fish and fish consumption warnings
at nearby lakes. These comments did not specifically identify a link to the project, nor did they reference
analyses (present or absent) in the Draft EIS. However, this topic received extensive analysis in the Draft
EIS, and OSMRE directs the commenters to the following areas of discussion of mercury deposition in the
Draft EIS:
A complete characterization of regional mercury deposition and monitoring and FCPP contribution
to atmospheric mercury is provided in Section 4.1.2, beginning on page 4.1-61.

2.5 Climate Change
The Draft EIS takes a hard look at climate change and provides a robust discussion of potential impacts
of climate change (see Section 4.2). The impacts analysis quantifies the CO2e emissions of the FCPP
and mobile source emissions in the context of regional, national, and global emissions. The discussion
includes reference to the primary literature sources on the topic, and their findings. Implementation of the
U.S. Environmental Protection Agency’s (EPA’s) Federal Implementation Plan (FIP) for Best Available
Retrofit Technology (BART), while not designed for greenhouse gas (GHG) emission reduction, still had
the additional effect of reducing greenhouse gas emissions by 26 percent; this reduction was incorporated
as part of the baseline. The analysis concludes that the Proposed Action would not result in a major
contribution to adverse effects associated with climate change. When compared to other sources of GHG
in the region, the reduced contribution from FCPP is considered minor. As such, no additional mitigation
measures are recommended.
The analysis considers the societal costs of climate change, and concludes, as stated on page 4.2-23,
"while the Proposed action would contribute to the effects of climate change, its contribution relative to
other sources would be minor in the short- and long-term." Although the effects of the project on climate
change are inherently cumulative, and Section 4.2 is both project-specific and cumulative in approach,
Section 4.18 (cumulative impacts) also considers climate change. In this section, the focus is on multi
media effects including streamflow and ecosystem impacts.

2.6 Recirculating the Draft EIS
OSMRE received several comments requesting that the Draft EIS be recirculated, or be supplemented with
additional analysis and recirculated. CEQ guidelines (40 CFR §1502.9) require a supplemental EIS when:
The agency makes substantial changes in the proposed action that are relevant to environmental
concerns; or,
There are significant new circumstances or information relevant to environmental concerns and
bearing on the proposed action or its impacts, or,
When the agency determines that the purposes of NEPA will be furthered by doing so (40 CFR
Section 1502.9[c]).
The Final EIS has been modified from the Draft EIS as a result of comments to the Draft EIS, updates
based on the completion of the Section 7 Endangered Species Act consultation, and updates based on
the completion of the Section 106 National Historic Preservation Act consultation. None of the
modifications changes the results of the analysis, nor do they trigger recirculation based on the CEQ
guidelines. Therefore the Draft EIS will not be recirculated.
2.7 SMCRA Permit Transfer to NTEC
Several comments suggested that the transfer of the SMCRA permit to NTEC should be considered as a
connected action to the proposed action in this EIS. Connected actions are defined in the CEQ guidelines
(40 CFR §1508.28) as follows:
1. Actions are connected if they:
i. Automatically trigger other actions, which may require environmental impact statements.
ii. Cannot or will not proceed unless other actions are taken previously or simultaneously.
iii. Are interdependent parts of a larger action and depend on the larger action for their
justification.
As discussed on page 2-35 of the Draft EIS, “The Proposed Action evaluated in the permit transfer EA is independent and not connected to the proposed outcomes being evaluated in this EIS. This finding is
supported by at least three factors: (1) the Navajo Nation resolution authorizing the formation of NTEC did
not identify supporting continued operation of FCPP as a purpose of the action; (2) BHP Navajo Coal
Company’s (BNCC’s) most recent permit transfer application dated September 3, 2013, initiated the
process regardless of the outcome of this action; and (3) the October 16, 2013, decision by the Navajo
Nation Council allocated $4.1 million from the Navajo Nation’s Unreserved, Undesignated Fund Balance to fund initial and immediate costs and obligations associated with the completion of negotiations and
transactions for the acquisition of Navajo Mine from BHP Billiton (Legislation 0305-13), r egardless of the
outcome of this action. Therefore, the permit transfer is not dependent on the EIS because it would
proceed regardless of the outcomes being evaluated by the EIS.”
OSMRE completed an Environmental Assessment (EA) for their action pursuant to the SMCRA permit
transfer, and the EA considered the environmental consequences of the permit transfer through the end
of the current coal supply agreement—July 2016. Although the mine sale and permit transfer are not
connected actions to the Proposed Action of the Draft EIS, the Draft EIS summarizes the impacts
described in the EA as a component of the baseline during the interim period (2014 to 2018). The Draft
EIS also includes an analysis of Navajo Mine operations from 2016 to 2061 (includes reclamation and
bond period) as a component of consequences of continuing operations (within the post-2014 baseline).

2.8 Draft EIS Comment Period Was Too Short
Several comments suggested that the time available to review the Draft EIS and provide comments was
too short. The following guidance for determining the comment period is drawn from the U.S. Department
of the Interior (DOI) OSMRE Handbook on Procedures for Implementing NEPA of 1969:
2.E.3.n. Public Comment Period on the Draft EIS -- The public comment period for the draft EIS must not end less than 60 days from the date of transmittal of the EIS to EPA, and must not end less than 45 days from the date of the EPA Notice of Availability in the Federal Register (40 CFR 1506.10(c)). Anyone may submit a written request for an extension of the comment period. For compelling reasons of national policy, a Federal agency can grant an extension of the comment period. Failure to file timely comments shall not be a sufficient reason for extending the comment period. (40 CFR 1506.10(d)).
The public review period for the Draft EIS was initially established as 60 days from the date of the EPA
Notice of Availability. Based on requests for an extension, OSMRE provided a 31-day extension, for a
total of 91 days. More than 5,000 comment letters were received, some in excess of 100 pages, which
suggests that sufficient time was provided to review the document.
2.9 Public Meeting Format
Several comments suggested that a different pubic meeting format should have been adopted. OSMRE
guidance for implementing NEPA (U.S. DOI OSMRE Handbook on Procedures for Implementing NEPA of
1969) states the following with respect to the public meeting format (Section 3.D.3.a):
“Determine Whether to Hold a Hearing or Meeting -- An informal meeting is generally preferable unless a hearing is required by law.”
The OSMRE implementing regulations do not require a formal hearing with a microphone provided to
individual speakers, sometimes known as a town hall format. OSMRE has chosen to conduct public
participation and outreach for the project in an open house versus a town hall format because it provides
for person-to-person interaction, encourages two-way communication, and provides information that is
responsive to an individual's information needs. This meeting format was vetted with the Navajo Nation.
OSMRE maintains that the town hall format excludes participation by individuals who would not speak in
public due to fear of public speaking or because they do not agree with other opinions being expressed.
OSMRE received multiple comments both complaining and complimentary of the meeting format.
OSMRE hosted nine public meetings around the Four Corners region in order to involve Native American
populations to the greatest extent possible. The locations were selected to ensure that Navajo and Hopi
tribal members would be able to access the venues, and as such meeting were held in Hotevilla Village,
the Burnham Chapter House, Nenahnezad Chapter House, Shiprock High School and the Navajo Nation
Museum, in addition to meetings in larger cities including Farmington, Albuquerque, Cortez and Durango.
Public announcements for the public meetings made via media releases in newspapers, public service
announcements, notification fliers, and radio announcements. The public service and radio
announcements were translated into native languages and all types of announcements were made widely
available, including in remote areas.
The public meeting announcements were distributed in a variety of newspapers, including the Navajo-
Hopi Observer, the Hopi Tutuveni and the Navajo Times, to ensure that the notification was provided in
the periodicals that the Navajo and Hopi tribal members are most likely to read. Media announcements
were provided multiple times to increase the likelihood that tribal members would read the announcement
and to provide enough time for people to prepare for the meetings and make arrangements to attend.
Two notifications were provided on the days immediately prior to the dates of the local public meeting
(assuming that the newspaper was published daily). A public service announcement providing the dates
and times of the local public meetings was distributed to 31 local radio stations. The public service

announcement was translated and recorded in Navajo and Hopi. The English release and the Navajo and
Hopi audio files were disseminated to radio stations based on the language of the radio station.
In addition, fliers announcing the public meetings were posted at various chapter houses on the Navajo
Nation Tribal Trust Lands and Hopi Tribal Trusts lands, including the Chinle, Coalmine Canyon,
Nenahnezad, Shiprock, Tiis Tsoh Sikaad (Burnham), and Upper Fruitland chapter houses, as well as
throughout local communities at community centers, post offices, libraries, grocery stores, gas stations,
trading posts, town halls, and other gathering places to further reach tribal community members and remote
locations where interested stakeholders potentially resided. Many tribal members indicated that they had
learned about the public meetings through the various means of communication discussed above.
2.10 Translation of the EIS into Navajo Language
Recognizing that some members of the affected community do not speak English and may also be
unfamiliar with the public meeting process, an introductory video explaining the project and the public
meeting process in the Navajo and Hopi languages was available for viewing during all meetings.
OSMRE also provided Navajo language interpreters to assist in the communication process during the
public meetings conducted on the Navajo Nation, and to translate oral comments on the FCPP and
Navajo Mine Energy Project Draft EIS to court reporters. This ensured that all people attending the public
meetings could ask questions, express any concerns they may have and share their real-life experiences.
Further, OSMRE prepared a video summarizing the Draft EIS that was translated into both Navajo and
Hopi to disseminate to individuals and/or groups that were unable to attend any of the nine public
meetings or read the Draft EIS. OSMRE and BIA determined that translating the entire Draft EIS into
Navajo and Hopi was not reasonable; translating the entire Draft EIS (1,560 pages) into Navajo would
lead to a recording with a duration of a minimum of 9,360 minutes (156 hours). Therefore, the video
summary of the Draft EIS was determined to be a more effective way to communicate the document
findings and solicit comments.
2.11 Covenant Not To Regulate FCPP Lease Area
The FCPP lease (1960, et seq.), including Amendment No. 3, between the Navajo Nation and Arizona
Public Service Company (APS) includes Covenant 17, which releases APS of tribal regulation:
“The Tribe recognizes that the purpose of this lease is for the Company to construct a power plant on the Reservation which it will operate to produce power and energy which the Company will sell, at wholesale
or retail, in the conduct of its business. The Tribe covenants that, other than as expressly set out in this
agreement, it will not directly or indirectly regulate or attempt to regulate the Company or the construction,
maintenance or operation of the power plant and transmission system by the Company, or its rates,
charges, operating practices, procedures, safety rules, or other policies or practices, or its sales of power;
provided, however, that this shall not be deemed a waiver of whatever rights the Tribe may have to
regulate retail distribution on the Reservation, and further provided that the Tribe will not attempt to
regulate the sale of power by the Company to Utah Mining, referred to in Section 2(f) hereof. Nothing
herein shall convey to the Company any rights to engage in retail distribution on the Reservation, other
than the sale of power to Utah Mining as referred to in Section 2(f) hereof.”
The Navajo Nation has stated that the Tribe has never conceded that Covenant 17 in the original 1960
lease (Covenant 22 in the 1966 lease supplement) prevented the application of tribal regulation on the
FCPP lease area; however, the Navajo Nation does not intend to regulate the FCPP lease area due to its
interpretation of the stipulations provided in FCPP Lease Amendment No. 3 (2011). APS contends that
Covenant 17 allows for the operation of FCPP without compliance with Navajo Nation environmental
standards. Both parties agree that the FCPP lease area will not be subject to tribal regulation if
Amendment No. 3 is approved by DOI. Therefore, the EIS assumes that tribal regulation will not apply to
the FCPP lease area if any alternative but the No Action is selected. The Navajo Nation has been

delegated authority on some federal regulations, in particular the Clean Air Act and Clean Water Act,
where the Navajo Nation possesses the responsibility to permit and enforce these standards. Operation
of FCPP is subject to all federal regulations, including those where the Navajo Nation is charged with
permitting and enforcement.
For purposes of this Federal NEPA analysis, this EIS includes Navajo Nation environmental standards
even though FCPP would not be subject to tribal regulations. For those resource areas where the Navajo
Nation is delegated federal oversight (i.e., water, air), it is expressly stated in those sections that the
Nation is responsible for permitting and enforcement. All other sections may include Navajo Nation
environmental standards to provide the reader with an understanding of how FCPP operations relate to
tribal regulations.
2.12 New Enforceable Conditions to the SMCRA Permit or Lease Amendment No. 3
OSMRE, as the SMCRA regulatory authority, can require the applicant to modify the Permit Application
Package to meet the requirements of SMCRA regulations at 30 CFR 750. OSMRE, as the Lead Agency,
can recommend mitigation measures through the NEPA process, but cannot revise the application or
Lease Amendment No. 3. It is beyond the BIA to modify the SMCRA permit application or Lease
Amendment No. 3. As stated in Section 1.4.2.1, BIA can issue three decisions on the FCPP Lease and
ROWs: 1) approve, 2) deny, or 3) approve with conditions. A decision that contains additional conditions
would be included in the Record of Decision (ROD), not a lease revision, where BIA may prescribe
enforceable mitigation measures in the ROD for the protection of tribal trust lands/resources.
Furthermore, the FCPP Lease Amendment No. 3 accounts for the possibility that there may be additional
stipulations derived from the environmental compliance process(es); Covenant 6 of Lease Amendment
No. 3 states, in summary, that there may be additional “prerequisites necessary to conduct the operations of the Plant, Transmission Lines, and Communication Sites”. All conditions recommended in the EIS applicable to the FCPP will be considered by BIA in the development of the ROD.
OSMRE can recommend mitigation above that required by regulatory compliance, even if it is outside its
jurisdiction to enforce. CEQ addresses this issue in its “NEPA’s 40 Most Asked Questions” (Mitigation Measures 19b), as follows:
All relevant, reasonable mitigation measures that could improve the project are to be identified, even if they are outside the jurisdiction of the lead agency or the cooperating agencies, and thus would not be committed as part of the RODs of these agencies. Sections 1502.16(h), 1505.2(c). This will serve to [46 FR 18032] alert agencies or officials who can implement these extra measures, and will encourage them to do so. Because the EIS is the most comprehensive environmental document, it is an ideal vehicle in which to lay out not only the full range of environmental impacts but also the full spectrum of appropriate mitigation.
For clarification, the paragraph above has been added to the introduction of Section 4 where the role and
applicability of mitigation measures is discussed. CEQ goes on to discuss identifying mitigation measures,
even when these measures would be beyond the authority of the permitting agency, as follows:
However, to ensure that environmental effects of a proposed action are fairly assessed, the probability of the mitigation measures being implemented must also be discussed. Thus the EIS and the Record of Decision should indicate the likelihood that such measures will be adopted or enforced by the responsible agencies. Sections 1502.16(h), 1505.2. If there is a history of nonenforcement or opposition to such measures, the EIS and Record of Decision should acknowledge such opposition or nonenforcement. If the necessary mitigation measures will not be ready for a long period of time, this fact, of course, should also be recognized.

For example, the Draft EIS included a mitigation measure to address the EPA’s draft rule of coal
combustion residue (CCR) disposal (see Section 4.15.1.2). After the Draft EIS was issued, the EPA
issued their final rule on CCR disposal; therefore, the mitigation measure in the Draft EIS is no longer
applicable because the applicability to tribal lands is now made clear. The Final EIS now treats regulatory
compliance requirements of the final CCR rule. However, as an example of how mitigation measures
were developed for the EIS, the treatment of the formerly draft CCR rule is illustrative and is described in
the following. EPA’s draft rule took into consideration CCRs being managed as a hazardous waste under Subtitle C or as a solid waste under Subtitle D of RCRA. As written, if the draft CCR rule of treating CCRs
as a solid waste under Subtitle D was selected, these regulations would not have applied to tribal lands or
tribal trust lands. The mitigation measure closed this regulatory gap by recommending that CCR disposal
on tribal lands would be handled in the same manner as for the state of New Mexico. In the discussion of
this measure, the probability of the measure being put in practice was considered high due to APS’s position in their Draft EIS public comment letter that took the position that Subtitle D requirements of the
draft CCR rule would be “self-implementing” (APS 2014) and that they would comply with this requirement regardless of the DFADAs being located on tribal trust lands.” While not strictly enforceable, this addition
satisfied CEQ’s recommendations of providing a full-spectrum of mitigation measures and the probability
of that mitigation being applied.
2.13 Cost of Electricity
Several comments requested that the EIS quantify the effect to ratepayers of increased environmental
protections at FCPP. It is beyond the scope of NEPA to forecast the cost of electricity as result of
additional regulatory requirements being implemented at FCPP. Any additional marginal cost of
operations would be addressed through the ratemaking processes of each state’s utilities commission
(e.g., Arizona Corporation Commission, New Mexico Public Regulation Commission). Any increases in
cost of electricity are subject to a thorough review process, outside the NEPA process. For example in
Arizona, “The Arizona Corporation Commission sets rates that provide the company a fair rate of return while balancing the needs of ratepayers. Rate cases are lengthy processes that begin with a company's
application stating what they would like the new rate to be along with supporting testimony as to why the
increase is justified. Then the Commission staff and other interested parties begin examining and auditing
all of the costs associated with providing service in Arizona. Rate cases typically involve months of sworn
testimony, audits and examinations to ensure the basis for the rate is legal and justified. Ultimately, the
Commissioners vote on the rates in public Open Meetings” (Arizona Corporation Commission Frequently
Asked Questions - http://www.azcc.gov/divisions/utilities/electric/faqs.asp).
2.14 No Action Alternative and Environmental Baseline
NEPA regulatory guidance, including CEQ, DOI, Bureau of Land Management (BLM), BIA, and EPA are
relatively general in defining baseline conditions, and determining the No Action alternative, leaving
latitude and discretion to the analyst to address project-specific conditions. In new development projects,
the No Action alternative is typically equivalent to the Environmental Baseline. In a project of continuing
operations such as the Four Corners Power Plant and Navajo Mine Energy Project, the No Action
Alternative is typically different from the Environmental Baseline.
The NEPA implementing regulations for DOI (43 CFR 46.30) defines No Action as follows:
“No action alternative.
(1) This term has two interpretations. First ‘‘no action’’ may mean ‘‘no change’’ from a current management direction or level of management intensity (e.g., if no ground-disturbance is currently underway, no action means no ground-disturbance). Second ‘‘no action’’ may mean ‘‘no project’’ in cases where a new project is proposed for implementation.

(2) The Responsible Official must determine the ‘‘no action’’ alternative consistent with one of the definitions in paragraph (1) of this definition and appropriate to the proposed action to be analyzed in an environmental impact statement. The no action alternative looks at effects of not approving the action under consideration.”
This definition describes two cases. One is the case of a new development project, for which No Action is
typically the same as the Environmental Baseline. The second case recognizes the scenario of the
Proposed Action consisting of continuing operations, such as at FCPP, Navajo Mine and transmission lines.
In this case, No Action is not equivalent to the Environmental Baseline. The No Action alternative is the
denial of the SMCRA permit, and the disapproval of the FCPP lease. The No Action alternative would lead
to the cessation of the existing condition of mining operations and burning the coal to generate electricity.
The Environmental Baseline for the analysis of continued operations that OSMRE has set forth follows EPA
NEPA guidance (as stated on page 4-1 of the Draft EIS), as follows: “The current condition is frequently used as the benchmark for comparing the environmental effects of the alternatives. However, in cases of
continued operations, the current condition may not adequately represent how actions have impacted
resources in the past, are currently impacting resources, or how resources might respond to future impacts.
Designating existing environmental conditions as a benchmark may focus the environmental impact
assessment too narrowly, overlooking cumulative impacts of past and present actions or limiting
assessment to the Proposed Action and future actions. For example, if the current environmental condition
were to serve as the condition for assessing the impacts of relicensing a dam, the analysis would only
identify the marginal environmental changes between the continued operation of the dam and the existing
degraded state of the environment. In this hypothetical case, the affected environment has been affected for
more than 50 years with accompanying declines in flows, reductions in fish stocks, habitat loss, and
disruption of hydrologic functions. If the assessment took into account the full extent of continued impacts,
the significance of the continued operation would more accurately express the state of the environment and
thereby better predict the consequences of relicensing the dam (EPA 1999).”
As such, the NEPA analysis of the FCPP and Navajo Mine Energy Project, the analysis of the effects of
continued operations identifies ongoing environmental impairments relative to an environmental
benchmark, specific to the resource category as applicable, rather than to the No Action alternative. This
environmental baseline addresses more consequences than would be addressed through using No
Action as the baseline, because it includes analysis of operational impacts of components that do not
have physical changes proposed.
The text underlined below has been added to page 4-1 of the EIS to address public comments concerning
the analysis of historic FCPP and Navajo Mine operations as it related to baseline characterization,
“There have been two completed federal actions that may affect the continuing operations at FCPP, and
at Navajo Mine. At FCPP, the EPA has made its ruling with respect to BART to control air emissions
(Section 2.4.2). For Navajo Mine, OSMRE has approved the SMCRA permit transfer from BNCC to NTEC
(Section 2.4.1). These completed federal actions form part of the environmental baseline to which the
effects of continuing operations and the Proposed Actions are compared. In each description of the
environmental setting, the measured current conditions (prior to 2014) are described first. In addition to
evaluating the environmental consequences of the physical changes to the environment that would result
from the Proposed Action, the EIS also analyzes the consequences of historic operations by evaluating
the effects of the past 50 years of operations of the FCPP and the Navajo Mine through comparison of
current conditions to environmental benchmarks (e.g., NAAQS, water quality standards, and current best
management practices for environmental protection); historic data collected prior to FCPP and/or Navajo
Mine operations; and appropriately identified resource specific data (e.g. hydrologic data collected
upgradient and/or upstream of FCPP and/or Navajo Mine operations).” This description is followed by the
expected conditions as a result of BART compliance or as a result of the SMCRA (interim period: 2014
2018) permit transfer. Environmental consequences are then determined relative to this baseline
condition.”

In some cases, the two completed federal actions do have long-term consequences to continuing
operations that are considered in this EIS. For example, installation of SCR equipment on Units 4 and 5
requires the transport of large quantities of ammonia to FCPP; the environmental consequences of the
ammonia transport, storage, and use are analyzed in the EIS as the continuing operations of FCPP, even
though this requirement has not yet commenced. Further, the transfer of the SMCRA permit to NTEC may
have long-term socioeconomic effects to the Navajo Nation, the State of New Mexico, and San Juan
County. These effects are analyzed in this EIS; however, by acknowledging the changes from these
federal actions in the environmental baseline, the Draft EIS avoids attributing beneficial impacts (e.g.,
reduced air emissions) to the Action alternatives.
