The Public Board Meeting was called to order by Dr. Howe, remotely, at 7:02 PM.

E. SUPERINTENDENT’S REPORT – Dr. Rocco Tomazic

1. Final Budget Presentation

Dr. Tomazic turned the meeting over to Dr. Howe to make his final budget presentation for FY 21. Dr. Howe, then presented his power point on the final budget report for the coming year. Dr. Howe reviewed the budget and possible changes that will be ahead of the District with so much being uncertain with the state budget. After making his report, he then asked anyone from the public wishing to speak on the budget to unmute themselves. Hearing none the public hearing on the budget was closed.

2. Calendar/Announcements

Student count remains the same as last meeting with 1,671 in district, 17 out of district for a total of 1,688 students.

COVID updates: the Governor’s press release stated that the school will remain on virtual learning for the remainder of the year, and a decision is pending for the summer programs. There are committees across the state working on reopening plans.

With the anticipation that schools will be closed the summer programs would have to be done virtually. We have now abandoned Plan A where we would have returned to school and are focused on Plan B for a virtual year end. The 8th Grade Graduation, retrieval of personal items, return of technology and other various topics are being discussed and plans are being made to achieve these goals. There are also plans being discussed for the orientation for middle school and the transition from FLC to PAE. There are meetings planned and once decisions are reached the parents will be notified.

Facilities Update: All construction work by Newport and Parlamas is completed and we are just waiting on paperwork with the State to close out the projects. The DEP has approved the final site plan for FLC and we are looking at the cost for the fencing that needs to be installed. The HVAC project at PAE will be moved to the summer of 2021 however, the roof top units that were also a part of the project for FLC will be done this year.

Our next Board meeting is scheduled for June 1st unfortunately we will not be able to have our awards presentation at that time. The students will still be recognized and certificates will be printed. The Agenda for this meeting will also have the re-appointment of staff for the new year at the new salaries.

Dr. Tomazic informed the Board that there would not be a closed session following the public meeting and closed his report.

The Superintendent recommends the following motion to the Freehold Borough Board of Education for approval:

H. ADMINISTRATION

1. Resolution Approving the Terms of a Memorandum of Agreement with Freehold

Borough Education Association and Approving a Successor Collective Negotiations Agreement for the Period of July 1, 2020 through June 30, 2023 Whereas, the Borough of Freehold Board of Education (“FBBOE”) and Freehold Borough Education Association (“FBEA”) engaged in negotiations for a successor Collective Negotiations Agreement (“Agreement”); and Whereas, the FBBOE and FBEA agreed to the terms and conditions set forth in a Memorandum of Agreement (“MOA”); and Whereas, the FBEA has ratified the terms contained in the Agreement and the FBBOE wishes to approve the MOA. NOW THEREFORE, BE IT RESOLVED by the Board of Education of the Borough of Freehold, County of Monmouth, State of New Jersey, as follows:

1. The Board of Education hereby approves and accepts the terms and conditions of the MOA,

incorporated herein by reference, and approves incorporating those terms into a successor collective negotiations agreement;

2. The Board of Education directs counsel to incorporate the terms contained in the MOA into a successor collective negotiations agreement; and

3. This Resolution shall take effect immediately.

2. Adjustment of Employee Evaluation Requirements for 2019-2020

WHEREAS the below district policies require an annual evaluation of individual district employees: 3221 Evaluation of Teachers 3222 Evaluation of Teaching Staff Members, Excluding Teachers and Administrators 3223 Evaluation of Administrators, Excluding Principals, Vice Principals, and Assistant Principals 3224 Evaluation of Principals, Vice Principals and Assistant Principals 4220 Employee Evaluation; and

WHEREAS due to the Coronavirus outbreak the New Jersey Department of Education on April 15, 2020 issued guidance on AchieveNJ, requiring evaluation of non-tenured staff, but directing that all other tenured staff be designated as “not evaluated”; and WHEREAS it is the intent of the district to ensure that all evaluation practices are consistent and fair throughout the district;

NOW BE IT RESOLVED that the district will, per the New Jersey Department of Education requirement, evaluate all non-tenured secretaries, teachers, administrators and other staff working in a certificated position; and BE IT FURTHER RESOLVED that the district will, per the New Jersey Department of Education requirement, score evaluations as “not evaluated” for all tenured secretaries, teachers, administrators, Principals, Vice Principals and other staff working in a certificated position; and BE IT FURTHER RESOLVED that for district consistency and fairness that all other employees, other than those herein listed above, will also receive a “not evaluated” summative for the 2019-2020 school year; and BE IT FURTHER RESOLVED that all “not evaluated” summatives will be memorialized in writing with the unique circumstances that mandated this action, including a copy of the April 15, 2020 memorandum from the New Jersey Department of Education and/or this resolution, and such documentation shall be placed in the individual member’s personnel file for future reference.

I. BUSINESS

1. Approve the following resolution:

PUBLIC HEARING AND ADOPTION OF THE 2020-2021 SCHOOL YEAR BUDGET

Adoption of the 2020-2021 School Year Budget

And Tax Levy

Recommend the Board approve the following resolutions: WHEREAS, the Freehold Borough Board of Education adopted a tentative budget on March 16, 2020 to be submitted to the Executive County Superintendent of Schools for approval, and WHEREAS, the tentative budget was approved by the Executive County Superintendent of Schools on April 2, 2020 and WHEREAS, the tentative budget was advertised in the legal section of the Asbury Park Press on April 10, 2020; and WHEREAS, the tentative budget was presented to the public during a public hearing on May 4, 2020; and Travel and Related Expense Reimbursement

WHEREAS, the Freehold Borough Board of Education recognizes school staff and Board members will incur travel expenses related to and within the scope of their current responsibilities and for travel that promotes the delivery of instruction or furthers the efficient operation of the school district; and WHEREAS, N.J.A.C. 6A:23A-7.2 et seq. requires Board members to receive approval of these expenses by a majority of the full voting membership of the Board and staff members to receive prior approval of these expenses by the Superintendent of Schools and a majority of the full voting membership of the Board; and

WHEREAS, a Board of Education may establish, for regular district business travel as defined in NJAC 6A:23A-1.2, which includes attendance at regularly scheduled in-State county meetings, Department or Association sponsored events or in-State professional development activities for which the registration fee does not exceed $150.00 per employee or board member, where prior Board approval shall not be required unless the annual threshold for a staff member exceeds $1,500 in a given school year (July 1 through June 30); and WHEREAS, the Freehold Borough Board of Education established $75,000 as the maximum travel amount for the current school year and has expended $13,516.35 as of this date; now THEREFORE, BE IT RESOLVED, the Board of Education approves travel and related expense reimbursements in accordance with N.J.A.C. 6A: 23A-7.3, to a maximum expenditure of $75,000 for all staff and board members for the 2020-2021 school year.

RESOLVED, that the amount required for school purposes in the school district of Freehold Borough, County of Monmouth for the 2020-2021 school year is $10,775,172 and is required to be levied for local school district purposes. WHEREAS, Article VIII, § IV, ¶ 1 of the New Jersey Constitution requires the Legislature to provide for the maintenance and support of a thorough and efficient system of free public schools; and

WHEREAS, to satisfy this Constitutional mandate, the Legislature adopted the School Funding Reform Act of 2008 (“SFRA”), P.L. 2007, c. 260 (N.J.S.A. 18A:7F-43 to -63), which established a school funding formula “to develop an equitable and predictable way to distribute State aid;” and WHEREAS, N.J.A.C. 6A:23A-8.1(a) requires each district board of education adopt a budget that provides for a thorough and efficient (T&E) education; and WHEREAS, considering the inadequacy of the State aid provided to the District, District Administration has done its best to prepare a budget which attempts to provide for a T&E education; however, additional State aid – in accordance with SFRA – would enable the District to provide for a T&E education. WHEREAS, on or about December 9, 2018 the Freehold Borough Board of Education agreed to a stipulation of dismissal in the Office of Administrative Law Matter EDU 04455-2018S entitled The Board of Education of the Borough of Freehold et al. v. State of New Jersey et al.; and WHEREAS, pursuant to that stipulation of dismissal the Board and the State agreed to dismiss the instant case based upon the passage of P.L.2007, c.260, amending P.L.2007, c.62, and repealing section 5 of P.L.2007, c.260, an “Act concerning State and local financing of school districts,” and on information and belief of the Board the current distribution of funding to the district by the State is being performed pursuant to that law commonly known as “S-2” for Fiscal Year 2021.

NOW THEREFORE, BE IT RESOLVED that the Board hereby approves the 2020-21 budget as prepared by District Administration and authorizes the Superintendent and the School Business Administrator/Board Secretary to implement the 2020-2021 budget pursuant to local and state policies.

2. Payment of Bills – May 4, 2020 2019-2020 School Year Approve the claims for goods received and services rendered and certified to be correct by the Business Administrator/Board Secretary as of May 4, 2020 as follows:

4. Treasurer of School Funds Report for March, 2020 The March, 2020 Treasurer of School Funds Reports are in agreement with the March 2020 Reports of the Board Secretary for the 2019-2020 school year.

The Board of Education certifies, pursuant to N.J.A.C. 6A:23A-16.10(c)4, that as of March 2020 after review of the Board Secretary’s monthly financial reports (appropriations section) and Treasurer’s Report and upon consultation with appropriate district officials, to the best of our knowledge no major account or fund has been over-expended in violation of N.J.A.C.6A:23A-16.10 and that sufficient funds are available to meet the district’s financial obligations for the remainder of the fiscal year.

5. Transfers – March 2020 The Superintendent, at the request of the Board Secretary, recommends that the Board approve line item transfers for the 2019-2020 school year through March 31, 2020.

11. Memorandum of Understanding by and between the Freehold Borough Board of Education and The State of New Jersey This Memorandum of Understanding (Agreement), made and entered into between the New Jersey Office of Emergency Management, hereinafter referred to as the “NJOEM,” and the Freehold Borough Board of Education officially domiciled at 280 Park Avenue, Freehold, NJ 07728 hereinafter referred to as the Subgrantee relating to application for grants under the Federal Emergency Management Agency (FEMA) Public Assistance and/or Hazard Mitigation programs for presidentially declared major disasters.

WHEREAS, The NJOEM, on behalf of the State of New Jersey, is the Grantee receiving funding under the FEMA Public Assistance and/or Hazard Mitigation programs as authorized under the Stafford Act and has the fiduciary responsibility to ensure those funds are spent on eligible Subgrantee facilities and activities, and are properly reimbursed to the Subgrantee; and

WHEREAS, under current information provided, FEMA has determined that the Subgrantee is eligible to apply for and/or receive FEMA funding under the Public Assistance and/or Hazard Mitigation programs, subject to approval of a Project Worksheet for Public Assistance or application for a Hazard Mitigation grant; WHEREAS, this agreement is part of the application for Disaster Assistance and will become effective and binding upon approval of a Project Worksheet or Hazard Mitigation Grant and signature on behalf of NJOEM. NOW THEREFORE BE IT RESOLVED that the Board authorize the Assistant Superintendent of Business to enter into this Memorandum of Understanding and apply for any and all grant funds that may be available related to declared emergencies.

12. Acceptance of Chapter 192/193 Non Public Funding for 2019-2020

Professional Software for Nurses, Inc., 2020-2021 School Year Recommend that the board approve the renewal and support services for the 2020-2021 SY of SNAP Health Center Annual support and maintenance contract (Serial Number 2889D44E) from Professional Software for Nurses, Inc., Amherst, NH, at a cost of $1593.72 appropriated from GAAP Account 11-000-219-390-00-00-04.

14. Parent Transportation Contract 2020-2021 School Year WHEREAS, the Freehold Borough Board of Education has been unable to obtain reasonable transportation services for special needs Student # 7751204457 who attends the Freehold Intermediate School, Freehold, New Jersey, and WHEREAS, the student will be transported to and from school by parents of SID # 7751204457, NOW, THEREFORE BE IT RESOLVED, that the Freehold Borough Board of Education approve the reimbursement for said services to parents of Student # 7751204457 at the rate of $50 per day for the extended school year (24) days, not to exceed $1,300 and $50 per day for the regular 2020-2021 school year (180 days), not to exceed $9,000 as per the agreement signed by all parties payable from GAAP 11-000-270-514-00-00-09. Payment pending guidance from the New Jersey Department of Education on payments of parent transportation contracts during remote instruction.

Appointment of FEMA Reimbursement Consultant Whereas, the Governor of New Jersey has declared a state of emergency via Executive Order 103 on March 9, 2019 due to COVID 19; and Whereas, pursuant to N.J.S.A. 40A:11-6, a contract may be awarded without public bidding regardless of the bid threshold in circumstances where an emergency affecting the public health, safety or welfare of our citizens requires the immediate delivery of goods or the performance of services; and Whereas, pursuant to N.J.S.A. 19:44A-20.12, emergency contracts awarded for purposes of coronavirus response are excepted from Pay-to-Play due to public exigency; and

Whereas, consultants will need to be retained to respond to this emergency; and Whereas, the Freehold Borough School District may be entitled to reimbursement of funds from FEMA or FEMA programs as a result of the Corona Virus and COVID 19: and Whereas, the firm of Millennium Strategies, LLC located at 60 Columbia Road, Building B, Suite 230, Morristown, New Jersey, has the necessary experience and expertise as a consultant to obtain FEMA grants management and administrative professional services in seeking emergency appropriations from FEMA; and Whereas, the Freehold Borough School District seeks to enter into a contract with Millennium Strategies, LLC to act as consultant on behalf of the District; and Whereas, the Borough of Freehold has engaged this consultant and it is desirous for the municipality and Board of Education coordinate emergency management and reimbursement efforts, and Whereas, Millennium Strategies, LLC will provide services at a rate of $180.00 per hour. NOW THEREFORE BE IT RESOLVED by the of the Freehold Borough School District, in the County of Monmouth, New Jersey, that an emergency is hereby declared to exist which will not permit for the advertisement for public bids, subject to the verification of funds by the Assistant Superintendent of Business of the Freehold Borough School District. That the Freehold Borough School District, hereby enters into a contract with Millennium Strategies, LLC., at the blended rate of $180.00 per hour not to exceed $25,000 and acknowledge that seventy-five percent 75% of this cost is reimbursable by the Federal Emergency Management Agency; and The Assistant Superintendent of Business is hereby authorized to execute a contract with

Millennium Strategies, on behalf of the Freehold Borough School District, the form of which is

attached hereto.
