Natural Resources, to which was referred House Bill No. 4993 introduced byRepresentatives Del M ar, Banaag, G ullas and Durano, entitled:

“AN ACT

CONFIRMING AND DECLARING, SUBJECT TO CERTAIN EXCEPTIONS,THE VALIDITY OF EXISTING TRANSFER CERTIFICATES OF TITLE ANDRECONSTITUTED CERTIFICATES OF TITLE COVERING THE BANILAD

FRIAR LA NDS ESTATE , SITUATED IN TH E FIRST DISTRICT OF THE C ITYOF CEBU”

has considered the same and has the honor to report it back to the Senate with thefollowing amendments:

1. On page 2 line 8, after the word “thereof’ add a proviso “ ; EXCEPTWHEN, IN A GIVEN CASE INVOLVING A CERTIFICATE OF TITLEOR A RECONSTITUTED CERTIFICATE OF TITLE, THERE ISCLEAR EVIDENCE THAT SUCH CERTIFICATE OF TITLE ORRECONSTITUTED CERTIFICATE OF TITLE WAS OBTANEDTHROUGH FRAUD, IN WHICH CASE THE SOLICITOR GENERAL

OR HIS DULY DESIGNATED REPRESENTATIVE SHALLINSTITUTE THE NECESSARY JUDICIAL PROCEEDING TOCANCEL THE CERTIFICATE OF TITLE OR RECONSTITUTEDCERTIFICATE OF TITLE, AS THE CASE M A Y BE, OBTAINEDTHROU GH SUCH FRAUD.”;

On page 2, lines 9 to 11, delete Section 2; and.

3. Renum ber the sections accordingly.

Be it enacted by the Senale and House of Representarives of the Philippities inCongress assembled:

1 SECTION 1 . All existing Transfer Certificates of Title and

2 Reconstituted Certificates of Title duly issued by the Register of Deeds of

3 Cebu Province and/or Cebu City covering any portion of the Banilad Friar

4 Lands Estate, notwithstanding th e lack of signatures and/or approval of the

5 then Secretary of the Interior (later Secretary of Agriculture and Natural

Resources) and/or the then Chief of th e Bureau of Public Lands (later Director

of Public-Lands) in the copies of the duly executed Sale Certificates andY
