East of Island Park Dr (GWP 4058-01-00) Location : City of Ottawa Dear Mr. MacDonald: Thank you for providing the Ministry of Tourism, Culture and Sport (MTCS) with the Notice of Public Information Centre for the above-noted project. MTCS’s interest in this EA project relates to its mandate of conserving Ontario’s cultural heritage, which includes:

• Archaeological resources, including land-based and marine; • Built heritage resources, including bridges and monuments; and, • Cultural heritage landscapes.

Under the EA process, the proponent is required to determine a project’s potential impact on cultural heritage resources. Project Summary

This project involves the rehabilitation and widening of Hwy 417, from west of Maitland Ave to east of Island Park Dr., as well as other undertakings, including the rehabilitation of the Merivale Road bridges and the widening of the south bridge. Please note that the Standards and Guidelines for Conservation of Provincial Heritage Properties (S&G), prepared pursuant to Section 25.2 of the Ontario Heritage Act (OHA), came into effect on July 1, 2010. All Ontario government ministries and public bodies that are prescribed under Ontario Regulation 157/10 must comply with the S&Gs. They apply to property that is owned or controlled by the Crown in right of Ontario or by a prescribed public body. Identifying Cultural Heritage Resources

While some cultural heritage resources may have already been formally identified, others may be identified through screening and evaluation. Aboriginal communities may have knowledge that can contribute to the identification of cultural heritage resources, and we suggest that any engagement with Aboriginal communities includes a discussion about known or potential cultural heritage resources that are of value to these communities. Municipal Heritage Committees, historical societies and other local heritage organizations may also have knowledge that contributes to the identification of cultural heritage resources. It is the sole responsibility of proponents to ensure that any information and documentation submitted as part of their EA report or file is accurate. MTCS makes no representation or warranty as to the completeness, accuracy or quality of the any checklists, reports or supporting documentation submitted as part of the EA process, and in no way shall MTCS be liable for any harm, damages, costs, expenses, losses, claims or actions that may result if any checklists, reports or supporting documents are discovered to be inaccurate, incomplete, misleading or fraudulent. Please notify MTCS if archaeological resources are impacted by EA project work. All activities impacting archaeological resources must cease immediately, and a licensed archaeologist is required to carry out an archaeological assessment in accordance with the Ontario Heritage Act and the Standards and Guidelines for Consultant Archaeologists. If human remains are encountered, all activities must cease immediately and the local police as well as the Cemeteries Regulation Unit of the Ministry of Government and Consumer Services must be contacted. In situations where human remains are associated with archaeological resources, MTCS should also be notified to ensure that the site is not subject to unlicensed alterations which would be a contravention of the Ontario Heritage Act.

This EA project may impact archaeological resources and you should screen the project with the MTCS Criteria for Evaluating Archaeological Potential to determine if an archaeological assessment is needed. MTCS archaeological sites data are available at [email protected]. If your EA project area exhibits archaeological potential, then an archaeological assessment (AA) should be undertaken by an archaeologist licenced under the OHA, who is responsible for submitting the report directly to MTCS for review. Built Heritage and Cultural Heritage Landscapes

The MTCS Criteria for Evaluating Potential for Built Heritage Resources and Cultural Heritage Landscapes should be completed to help determine whether your EA project may impact cultural heritage resources. The Clerk for the City of Ottawa can provide information on property registered or designated under the Ontario Heritage Act. Municipal Heritage Planners can also provide information that will assist you in completing the checklist. The draft MTO Ontario Heritage Bridge Guidelines for Provincially Owned Bridges screening criteria have also been established for cultural heritage evaluation of bridges under the Class EA for Provincial Transportation Facilities. A Cultural Heritage Evaluation Report (CHER) is used to determine the cultural heritage value or interest of a potential Provincial Heritage Property. If potential or known heritage resources exist, MTCS recommends that a Heritage Impact Assessment (HIA), prepared by a qualified consultant, should be completed to assess potential project impacts. Our Ministry’s Info Sheet #5: Heritage Impact Assessments and Conservation Plans outlines the scope of HIAs. Please send the HIA to MTCS and the City of Ottawa for review, and make it available to local organizations or individuals who have expressed interest in heritage. Environmental Assessment Reporting

All technical heritage studies and their recommendations are to be addressed and incorporated into EA projects. The Notice indicates that the TESR approved in 2008 will be utilised for this project. Please advise MTCS if this changes and requires further technical heritage studies for the EA project, and provide them to MTCS before issuing a Notice of Completion or commencing any work on-site. If your screening has identified no known or potential cultural heritage resources, or no impacts to these resources, please include the completed checklists and supporting documentation in the EA report or file. Hi Kate/Lincoln, I requested that Nelson Edwards attend the Public Information Centre for this MTO study on August 11, 2015 at the J A Dulude Arena, 941 Clyde Ave Ottawa in my place. The following are comments and observations made by Nelson as a result of his attendance at this meeting. Our issues of interest as part of the Transportation Planning Branch primarily include:

Impact to pedestrians and cyclists during construction

Enhancement of the environment for cycling and pedestrians at end state

Clearance for LRT operation on Carling Avenue. Observations: The consultants are MMM Group and Lincoln MacDonald is the contact there (Anita Scott of MMM is supporting planner)

Hwy 417 widening to 4 lanes continues and this segment is from west of Maitland to East of Island park Drive. No changes are proposed to the Maitland overpass nor to how the hwy ramps intersect the arterial road.

No changes proposed for the on and off ramps in the vicinity of Carling Ave.

Clyde, Kirkwood, Carling EB and Carling WB overpasses have all been previously replaced in preparation for the hwy widening. Island Park Drive overpass has also been modified.

Only Merivale Road overpass is slated for widening as part of this phase. Widening will occur to the south and north sides. While the existing Hwy bridge will be widened to accommodate the 4 lanes, the existing span and abutment location over Merivale Road will not change.

MTO and its consultants will be making a presentation to Transportation Committee on Sept 2. Area of interest to the City includes: Construction Detours During the realignment of on and off ramps to accommodate the widening to 4 lanes in each direction, there will be requirements for detours. The illustrations show the use of arterial and possible collector roads to return traffic to their original destinations. A traffic study (including traffic volumes and directions) is being finalized and will be circulated to the City. Cycling & Pedestrian Post construction: No modifications to the intersection of ramps with city roads and as a result no new opportunities seem possible to create more space for future cycling facilities. The bridge span over Merivale Road will not be widened with the widening of the Hwy overpass bridge deck. The narrow span over Merivale Road has already been identified as limiting cycling facility continuity. The maintaining of the abutments and existing span limits opportunities to provide cycling

facilities under the overpass. The only opportunity would be if the entire overpass was replaced instead of widened – but at this time that does not appear to be the recommended option. During construction and rehab of the existing bridge and abutments, pedestrian walk areas traffic lanes will have to be deviated and narrowed. The study illustrations are showing 2 lanes 3.5 m wide and a 1.5 m pedestrian walkway – all guided by temporary concrete barriers. I noted to the consultants and project manager that during construction, accommodation and awareness for cycling through the reduced lanes areas must be part of the program. These could include identification of cycling detours, signage at the construction zone, flagmen during peak periods, lighting during day time for enhanced visibility, etc. Noise There are long stretches of hwy that do not have acoustical barriers. The noise sensitive land uses such as home and churches adjacent to this segment of the corridor are limited. Some lengths of existing noise wall are present and will be replaced. It was unclear if after the abatement measures, that noise generated will been within City guidelines. Bundling with City Projects There could be opportunities to bundle City infrastructure renewal and improvements with this hwy work. Some has already occurred as part of previous bridge replacements. There could be opportunity to bundle the hwy widening with Stage 2 if the Queensway was to serve as BRT Detour Route during LRT construction. Stage 2 an the Carling Transit Priority Corridor Both the Queensway and Carling Avenue have been identified as possible BRT detours routes during the construction of the WLRT. Carling Ave is identified as a Transit Priority Corridor – Continuous Measures (bus lanes) to be implemented in the first phase of the TMP. The WB 417 off-ramps to WB Carling Ave is among one of the most challenging merges with an arterial along the 417 corridor. No modifications to the of ramp intersection is indicated in the MTO study. Clarity regarding the potential increase in peak traffic volumes using the off ramp and the impacts on the Kirkwood intersection may be a concern and require further information. Traffic analysis should be reviewed. This may also have impact on the function of a potential boulevard side curb lane continuous transit priority measures through this area. Staging Areas The use, and eventual restoration of city lands in traffic islands and medians for staging. The restoration of landscape in these areas post construction will be important. Restoration should not only be based on the inventory of existing trees but on the landscape plans for the area since some tree planting has been deferred to accommodate previous and future staging area requirements. Landscape The opportunity to renew and restore the landscape tree and shrub massings along the Queensway and mitigate the loss of vegetation and visual quality that has deteriorated over time and been diminished by previous incremental changes and actions. A more complete landscape plan will be prepared by the consultants. These are a number of locations that are highly visible from the Highway and adjacent arterials that would benefit from landscape renewal. The city should have the opportunity to review and provide comment.

Next Steps These observations should be shared with the primary contact person/reviewer for the City (Steve Lyon?) and with MTO and its consultants. Thank you for informing the Ministry of Aboriginal Affairs (MAA) of your project. Please notethat MAA treats all letters, emails, general notices, etc. about a project as a request forinformation about which Aboriginal communities may have rights or interests in the projectarea.

As a member of the government review team, the Ministry of Aboriginal Affairs (MAA)identifies First Nation and Métis communities who may have the following interests in thearea of your project:

While I can facilitate your progress through these processes, each person is responsible for their own role. Generally speaking copy the other three project managers when dealing with one of us on general matters (e.g., area to be occupied, change in schedule, scope, etc.), so we stay informed. Caroline alone deals with the money side of the real estate. The different processes can occur in parallel. Most of us manage high workloads, so it’s up to the proponent to keep us aware of deadlines and proactively submit any needed information.

Hi David, I wanted to follow up on our phone call a few weeks ago, where we discussed Hampton Park. As I mentioned during our conversation, the small area identified for MTO Temporary Limited Interest (TLI) use, located immediately north of Highway 417 between Merivale Road and Island Park Drive, to facilitate access to MTO property, is no longer required. At the most recent meeting between NCC, MTO and the MTO’s design consultant MMM in late March, we discussed the 2009 Federal Land Use, Design and Transaction Approval to purchase 0.4 hectares of land for the construction of a stormwater detainment swale on lands immediately north of Highway 417, west of the intersection of Merivale Road with Island Park Drive, in Hampton Park. That agreement was the result of discussions between MTO and NCC, and revisions to MTO’s original plan of constructing a retaining wall in this area. In order to meet MTO’s current schedule of advertising the contract this summer (2016), it has been recommended that the purchase be changed to an easement, which I confirmed during our discussion MTO is agreeable to. remain unchanged, and in our discussion you noted that you will confirm if the Approval can be modified to reflect the change to an easement. In order to obtain the easement in Hampton Park, MTO will follow NCC’s four step process as follows:

1. The necessary environmental screening paperwork is being prepared for submission shortly

2. The federal land use approval from 2009 will require revision by NCC to reflect an easement instead of a purchase

3. The property must be assessed as soon as possible by NCC to allow the property discussions to commence

4. A land access permit must be obtained from NCC for the construction of the slope, swales and associated landscaping (how long is the permit valid for? Our construction project is expected to run from fall 2016 to fall 2020, however the contractor may not be in Hampton Park until 2018).

As you noted, we may work on all four steps concurrently, and I believe we will have to in order to clear the property in advance of our August 2016 contract advertising date – we need the property to be cleared by June/ July to avoid any delays. If you have any questions or concerns regarding this summary or the project as a whole, please contact me to discuss. During our discussion you mentioned another project at Stony Swamp. As I’m not involved in that project and mixing the two may cause unnecessary confusion, I would recommend that you speak directly with Nancy Sinclair, the Head of our Property Section. Thanks, Kate

In terms of the context sensitive design initiative, here a few comments. I believe there were a few conversations between NCC & MTO staff about the CSD results from the first phase, from Nicholas to the Split. My understanding is that we encouraged the MTO to enlarge the maple leaves on the street light poles by 15% to 20% to make them more visible. In terms of the patterns of the arrangement of the colours of the noise barrier panels, we encourage the MTO to pay attention to the arrangement, and have a design professional arrange them in a pattern in some locations, instead of only a random pattern. We believe that more effort could be applied to this aspect of the CSD intiative.
