NOW THEREFORE BE IT RESOLVED, the Board shall move into Executive Session to discuss the above referenced matter.

BE IT FURTHER RESOLVED, that the minutes of the executive session will provide as much information as possible without violating any applicable privilege or confidentiality so that the public can understand what was discussed and when available what the Board decision was.

BE IT FURTHER RESOLVED, that the minutes of the executive session will be released to the public in an appropriately redacted form within a reasonable period of time.

BE IT FUTHER RESOLVED, that the redacted portion of the executive session minutes will not be released until such time as the privilege or confidentiality is no longer applicable.

IV. Reconvene

The Executive Session of the Wayne Board of Education Regular Meeting of September 6, 2012, was convened in the Conference Room of the Wayne Board of Education, 50 Nellis Drive, Wayne, NJ 07470.

NOTE: Revision reflects the addition of cheerleaders to the already adopted policy which covered student-athletes providing the same safeguards and safety measures to both.

"that the Board approve Policy #2622--Pupil Assessments-­second reading for action, having been recommended at the July 19,2012 Education Committee, as per attached."

NOTE: Revision reflects the inclusion of the names of the State assessments and has updated the term "pupil with Limited English Proficiency (LEP)" to "English Language Leamer (ELL)."

Approval of Policy #6470--First Reading for Consideration P-13-07 -RECOMMENDED ACTION:

"that the Board approve Policy #6470--Payment of Claims--first reading for consideration, having been recommended at the August 23, 2012 Finance Committee, as per attached."

NOTE: This mandated policy was revised to comply with updated statutes. In addition, however, verbiage was included to allow the Business Office to pay claims where there is a legal and/or contractual need to pay invoices upon receipt, such as insurance claims and utilities. Inclusion of this verbiage in the policy will eliminate the need for the Board to approve a motion regarding these payments every year.

Approval of Policy #6471--First Reading for Consideration P-13-08 -RECOMMENDED ACTION:

"that the Board approve Policy #6471--School District Travel--first reading for consideration, having been recommended at the August 23, 2012 Finance Committee, as per attached."

NOTE: This mandated policy was revised to increase the allowable amount for registration fees per employee for regular business travel (meetings, required conferences) that do not require Board approval. Increases are limited to the CPI index.

Approval of Policy #6472-Second Reading for Action P-13-09 -RECOMMENDED ACTION:

"that the Board approve Policy #6472--Tuition Assistance-­second reading for action, having been recommended at the June 28, 2012 Education Committee, as per attached."

NOTE: Revision reflects new statute N.J.S.A. 18A:6-8.5 impacting tuition assistance and additional compensation paid for a staff member who acquires additional academic credits or completes an advanced degree.

Approval of the Bills List S-13-01 -RECOMMENDED ACTION:

"that the Board approve the September 6, 2012 Bills List in the total amount of $2,953,765.20, as per the attached."

Approval of 2012-2013 Agreement for E-rate Consulting Services S-13-02 -RECOMMENDED ACTION: -

"that the Board approve the 2012-2013 Agreement for E-rate Consulting Services with BTU Consultants, LLC, to serve as our agent for E-rate filing for Funding Year 2013-2014, in the amount of $7,120.00, as per the attached."

NOTE: The District receives approximately $200,000 in credits and/or revenue through the E-rate program. This amount has been budgeted for the 2012-2013 school year.

Approval of Change Order S-13-03 -RECOMMENDED ACTION:

"that the Board approve Change Order with Open Systems Integrators Inc. in connection with State Project #5570-087-12-1000 for JFK Elementary School and State Project #5570-078-12-1000 for APT Elementary School Phone/lntercom/Clock Projects, in a total amount of $3,518 for additional audio reinforcement and a clock in both gymnasiums and in the cafeteria in APT, as per the attached."

NOTE: This change order is needed to ensure safety and security in the common areas in these school facilities. The change order is still within the total amount budgeted and approved by the State for these projects.

Approval to Authorize the Execution and Delivery of Grant Agreement -RECOMMENDED ACTION:

"that the Board authorize the execution and delivery of the

Educational Facilities Construction and Financing Act Section 15 Grant Agreement for the Wayne Hills Metal Shop Conversion Project, DOE Project #5570-055-05-1000 in the amount of $14,815; and further, that the Board delegate authority to the Business Administrator for supervision of the school facilities project."

NOTE: This project dates back to 2005. Because the District had acted as the general contractor for this project since all bids that were received were over the estimated project cost, the total project costs were not eligible for reimbursement from the State. After working with the State on closing out this project, the NJSDA did finally agree to reimburse the District for its share of the architectural fees incurred. This resolution is required so that the District can receive its 40% of the costs for the fees incurred.

The Board of Education shall organize annually at a regular meeting held on any day of the first week in January following the November school election.

This day shall be determined and shall be advertised accordingly. If the organizational meeting cannot take place on the specified day by reason of lack of a quorum or for any other reason, said meeting shall be held within three days thereafter.

The order of business shall be for the School Business Administrator/Board Secretary to open the meeting, and then shall administer the oath of office to new Board members. He/she will serve as temporary chairperson and will conduct the election of the President. When a President is elected, he/she will assume the chair. The Vice-President shall then be elected.

The organizational meeting shall constitute a regular meeting of the Board for the transaction of business.

The Board of Education recognizes the value of public comment on educational issues and the importance of allowing members of the public to express themselves on school matters of community interest.

In order to pennit the fair and orderly expression of such comment, the Board shall set aside a portion of every Board meeting, the length of the portion to be determined by the Board, for public comment on any school or school district issue that a member of the public feels may be of concern to the residents of the school district.

Public participation shall be governed by the following rules:

1. A participant must be recognized by the presiding officer and must preface comments by an announcement of his/her name, place of residence, and group affiliation, if appropriate;

2. Each statement made by a participant shall be limited to five minutes' duration.

3. No participant may speak more than once on the same topic until all others who wish to speak on that topic have been heard;

4. All statements shall be directed to the presiding officer; no participant may address or question Board members individually;

5. The presiding officer may:

a. Interrupt, warn, or tenninate a participant's statement when the statement is too lengthy, abusive, obscene, or irrelevant;

b. Request any individual to leave the meeting when that person does not observe reasonable decorum;

c. Request the assistance of law enforcement officers in the removal of a disorderly person when that person's conduct interferes with the orderly progress of the meeting;

PUPIL ASSESSMENTS (M)

The New Jersey statewide assessment program has been designed to measure the extent to which all pupils at the elementary, middle, and secondary levels have attained New Jersey's Core Curriculum Content Standards. The Board of Education will comply with implementing the schedule of the New Jersey State Board of Education statewide assessment program.

Assessments

The Superintendent shall develop and present to the Board annually for its approval an assessment program that complies with rules of the State Board of Education.

Records

The Board shall maintain an accurate record of each pupil's performance on Statewide assessments in accordance with N.J.A.C. 6A: 8-4.2. Notwithstanding Policy 8330, information regarding individual pupil test scores shall be released only to the pupil, hislher parent(s) or legal guardian(s), or individuals eligible by court order and school personnel and school officials deemed authorized by Federal and State law.

Dissemination of Information

In accordance with the requirements of N.J.A.C. 6A:8-4.S, the school district is required to report annually to the State Board of Education and the public on the progress of all pupils and pupil subgroups in meeting the Core Curriculum Content Standards as measured by the Statewide assessment system by publishing and distributing the Department of Education's annual New Jersey School Report Card in accordance with N.J.S.A. 18A:7E-2 through 6 and the New Jersey Open Public Records Act. N.J.S.A. 47:1A-l et seq.

Parental Notification

Parent(s) or legal guardian(s) shall be informed of the district assessment program and of any special tests that are to be administered to their children.

PUPIL ASSESSMENTS (M)

Pupils with disabilities shall participate in all state assessments systems in accordance with provisions as outlined in N.lA.C. 6A:14-4.10. Accommodations and modifications approved by the New Jersey Department of Education for the administration of the Statewide assessment shall be provided when detennined necessary by the Individual Education Plan (IEP) team to pupils with disabilities who participate in general Statewide assessments. Pupils with disabilities shall participate in the Alternative Proficiency Assessment (APA) as provided for in N.lA.C. 6A:14-4.1O(a)2.

English Language Leamer (ELL)

An English language learner is a person who is in the process of acquiring English and has a first language other than English. ELLs are the same pupils who are sometimes referred to as limited English proficient (LEP). All shall participate in all statewide assessments and may be provided appropriate accommodations or modifications as approved by the New Jersey Department of Education.

All ELLs shall satisfy the requirements for high school graduation according to N.J.A.C. 6A:8-5.l , except that any ELL may demonstrate they have attained State minimum levels of proficiency through:

I. Passage of the Alternative High School Assessment (AHSA) process in their native language and passage of an English fluency assessment approved by the New Jersey Department of Education; or

2. Passage of the AHSA process in English with appropriate accommodations.

Pupils with disabilities as defined in N.1.A.C. 6A:14-1.3 or eligible under Section 504 of the Rehabilitation Act and who participate in the AHSA process are not required to participate in repeated administrations of the High School Proficiency Assessment (HSPA).

Tuition Assistance

The Board of Education recognizes the importance of advanced educational experience, coursework, and degrees for employees. The Board of Education may provide tuition assistance to an employee in accordance with contract provisions in a collective bargaining agreement, an individual employment contract, or as per any other employment agreement or contract approved by the Board.

In accordance with the provisions of N.J.S.A. ISA:6-S.5, in order for the Board of Education to provide tuition assistance to an employee for coursework taken at an institution of higher education or additional compensation upon the acquisition of additional academic credits or completion of a degree program at an institution of higher education:

1. The institution shall be a duly authorized institution of higher education as defined in Section 3 of P.L.19S6, c.S7 (C.1SA:3-15.3);

2. The employee shall be required to obtain approval from the Superintendent of Schools prior to enrollment in any course for which tuition assistance is sought. In the event the Superintendent denies the approval, the employee may appeal the denial to the Board of Education. In the case of tuition assistance for the Superintendent of Schools, the approval shall be obtained from the Board of Education; and

3. In accordance with the provisions of N.J.S.A. lSA: 6-S.5.c., tuition assistance or additional compensation shall be provided only for a course or degree related to the employee's current or future job responsibilities.

In addition, the standards set forth in Board Policy No. 1620, Administrative Employment Contracts, concerning tuition assistance or reimbursement and additional compensation apply to Superintendents, Deputy Superintendents, Assistant Superintendents, and School Business Administrators.

Nothing in N.J.S.A. lSA:6-S.5 shall be construed to limit the authority of the Board to establish more stringent requirements for the provision of tuition assistance or additional compensation. The provisions of this Policy and N.J.S.A. lSA:6-S.5 shall not be deemed to impair an obligation set forth in a collective
