2. A new regulation, to stand as regulation TA, is inserted after regulation 7,as follows:

Alternative to Individual Sfarapinq of Instruments.TA. (1) The Commissioner may approve of any company, firm, or person,

making monthly payments of the stamp duty payable on instruments in lieu of theindividual stamping of such instruments.

When this method of payment is approved, a return in duplicate, containingsuch information as II, e Commissioner flay require, aud verified by statutory declara-tion, together with a remittance for the amount of stamp duty payable, shall befurnished to the Commissioner by the Company, firm, or person to wham approvalwas give,) immediately after the close of each and every month.

The Commissioner shall hnpress stamps, to the value of the remittance, onone copy of the return.

Establishment of Brigade.1. On the resolution of tile Board to estabhsll, maill-

tam and equip a Bush Fire Brigade under tile provisionsof the Busil Fires Act, 1937, and regulations thereunder,tile BI-igade shaH lie formed in accordance with thesehi--laws and a lame silail he given to the Brigade andapplieatioii accompanied by a copy of these by-lawsshall he made to the Minister for Lands for its regis--tration accordingly.

The Beard shall appoint Bush Fire Control Officersin accordance with the requirements of the districtand may prescribe the area over which each such officershall have jurisdiction. Thc employment, dismissal andpayment for services of persons (other than officers)employed for duties under this Act, shall be vested inthe chairman and secretary of the Board conjointly.

Duties of Officers.The duties of all officers appointed under these

by-laws shall be as laid down in the provisions of theBush Fires Act, 1937, and each officer so appointedshall be supplied with a copy of the Act and regula-tions. The captain shall have full control over themembers of the Brigades whilst engaged in fire fight-ing and shall issue instructions as to the methods to beadopted by the firemen. In tim absence of the captain,the first lieutenant; and in the absence of the first, thesecond lieutenant or senior officer of the Brigade present at the fire shall exercise all the power and duties ofthe captain. The captain shall when so directed by theBoard instruct all land owners or occupiers to plougha break or breaks on all cleared land or land underpasture.

Membership of Brigade.(1) The me]nhership of a Bush Fire Brigade may

consist of the following:(a) Subscribing members;(b) Fire fighting members; and (c) Associate mem-bers.

(2) Subscribing members shall be those personswho, being interested in forwarding the objects ofthe Brigade, pay all annual subscription to the fundsof the Brigade at the following rates:

(3) Fire fighting members shall be those persons,being able-bodied men over 18 years of age who arewilling to render service at any bush fire when calledupon, and who sign an undertaking in the form con-tained in the First Schedule to these by-laws.

(4) Associate members shall be those persons whoare willing to supply free motor transport for firelighters or equipment, or are prepared to render otherapproved assistance, and who sign an undertaking inthe form contained in tile Second Schedule to theseby-laws.

(5) No fees or subscriptions shall be payable eitherby fire fighting members or associate members, andthe enrolment of persons as such members shall inevery case be subject to the approval of the Board.

(6) A subscribing n,ember shall be eligible for en-rolment as a fire fighting member.

Finance.S. The expenditure incurred by the Board in the

pnrchase of equipment, etc., payment for services andgenerally for the purposes of this Act, shall be acharge on the ordinary revenue of the Board, but thesecretary shall keep a separate record of the expendi-ture incurred under this Act.

Meetings of Brigade.9. To be called when deemed necessary.

These by-laws, under the Bush Fires Act, 1937,were passed by a resolution of the Moora Road Board(a local authority under tile provisions of snch Act)at a meeting held at Moora on the lath day ofSeptember, 1941.

Establishment, Maintcnnnee, and Equipment of BushFire Brigades for the Road District of Murray.

Establishment of Brigade.Oa the resolution of the Board to establish, main-

fain, and equip a Bush Fire B]-igade under the provi-sions of the Bush Fires Act, 1937, and regulationsthereunder, the Brigade shall be formed in accordancewith these by-laws, and a name shall be given to theBrigade and application, accompanied by a copy of theseby-laws, shall be made to the Minister for Lands forits registration accordingly.

A Bush Fire Brigade may be established for thewhole of the road district or for any specified areathereof: Provided that, unless the resolution of theBoard establishing a Bosh Fire Brigade specifies thereinonly a part of the district as the area for which suchBrigade is established, the Brigade shall be deemed tobe established for the whole of the said road district.

Appointment of Officers.The Board shall appohmt a captain, a first lieuten-

ant, a second lieutenant, and such additional lieuten-ants as it shall deem necessary to act as officers of theBrigade, and who in the Board's opinion have thenecessary qualification and knowledge of the districtrequired in such capacities.

The secretary of the Board, or such other per-son cc the Board ntay appoint, shall be the secretaryof the Brigade.

4. Tl,e Board may appoint an Equipment Officer,who shall be responsible for the custody and inainten-alice in good order and condition of all equipment andappliances acquired by tlio Board for the purposes ofthe Brigade. Such officer ma)- station such equipmentat a depot approved by the captain, where, if possible,motor trncks c-an easily be called upon. If there aremore titan one such depots in the area, the EquipmentOfficer shall appoint at each depot a person to lookafter the equipment and have it ready fur immediateisa when required.

5. The Board shall appoint Bnsh Fire ControlOfficers ia accordance vith tIm requiremeats of the dis-I net and may prescribe the area over which each suchofficer shall have jurisdiction. The employment, dis-missal, and payaient for services of persons (other thanofficers) employed for duties under tIns Act shall bevested in the chairman and secretary of the Board con-jointly.

Duties of Officers.6. The duties of all officers appointed under these

by-laws shall be as laid down in the provisions of thel3tisli Fires Act, 1937, and each officer so appointedsl,all h,e supplied with a copy of the Act and regulations.The captain shall have full control over the me,nbersof the Brigade whilst. engaged in firo-fighting, and shallissue instructions as to the methods to ho adopted bythe firemen. In the al,sence of the captain, the firstlieutenant, and, in time absence of tl,e first, the secondlieutenant or senior offleor of the Brigade present atthe fire, shall exercise all the power and duties of thecaptain. Tl,e captain shall, when so directed by theBoard, histruct all land owners or occupiers to plougha b,-eak or breaks oil all cleared laud or land underpasture.

Membership of Brigade7. (1) The membership of a Bush Fire Brigade may

consist of tile following :----(a) Subscribing members;(b) fire-fighting ,nembers, mind (e) associate members.

(2) Subscribing nmen,hers shall be those persons, who,being interested in forwarding the objects of thel3rigade, pay an annual subscription to the funds of theBrigade at the following rates

LAND OPEN FOR SELECTION.IT is hereby notified, for general information, that theareas scheduled hereunder are available f or selectionunder Part V. of the Land Act, 1933-1939, and theregulations appertaining thereto, subject to the pro-visions of the said Act.

Appilcations must be lodged at the Land AgencyOffice as specified hereunder not later than the datespecified, but may be lodged before such date if sodesired.

All applications lodged on or before such date will betreated as having been received on the closing day, andif there are more applicants than one for any block, tbeappilcation to he granted will be determined by theLand Board. Should any lands remain unselected suchwill continue available until applied for or otherwisedealt with.

If a Land Board sitting becomes necessary, the appli-cants for the blocks will be duly notified of the date,thue, and place of the meeting of the Board, and thereshall be an interval of at least three days between theclosing date and the sitting of the Bonrd.

If an applicant wishes to appear before the LandBoard in person he may apply to the Head Office orto the Clerk in Charge of any of the District or BranchLand Offices for a certificate to the Railway Depart-ment which, on presentation at the nearest RailwayStation will entitle him to a Return Ticket, at Conces-sion Rates, to the place where the Board will sit, available for seven days from the date of issue.

THE Court of Arbitration of Western Australia doth herebymake the following Award in connection with the industrialdispute between the abovenamed parties

AWARD.

1 Interpretation.For the purpose of this Award the following words simll

have the nteanings set against thom(a) Officer in charge '' shall mean the engineer or super-

visor controlling any specific work.(h) Department '' shall mean nny department by which

work to which this Award applies is being carriedout.

(e) Metropolitan District '' shall mean all that area ofland comprised within a circle of which the centreis the General Post Office and the radius of whichis fifteen (15) nuiles.

(ci) Ballast pit " :A ballast pit is a place from whichballast is obtained. The work of stripping, ifnecessary, and of loading and unloading same shallnot be termed ballast pit work.

The getting amid, loading into railway wagonsmaterial for metalling station yards and roadapproaches shall be paid at ballast pit rates.

Ballast '' is broken stone, sand, or gravel used inlifting, packing, and boxing up of rails and sleepers

(e ) "'I'imbermnan " shall meau a worker who hangs centresand fixes sets and poles off laths, lays keels, fixesframes, or lays decking, or who is omployed hand.hing timber in shafts when buildings are beingurnderpinned.

2.Area and Scope.This Award shall apply to workers who are eligible for muem-

bership in the applicant union and who are employed by therespondents throughout the State on the following classesof work; provided it shall not apply to workers covered byany other Award of the Court of Arbitration or any IndustrialAgreement registered under the Industrial Arbitration Act,19 12-35

Railway construction.Roads and bridges construction.Country water supply, drainage and irrigation con-

struction, excepting any work comprised in orconnected with the Mundaring-Kalgoorlle watersupply undertaking, or the Metropolitan watersupply, sewerage, and drainage undertaking.

(ci) Laml clearing.

3.Payment of Fares and Sustenance Allowance.The department shall pay railway and other transport

fares., or shall provide transport free of charge from the placeof engagement to the place of work, and when the workers'services are terminated because there is no further workavailable return fares or transport to place of engagementshall also be paid or be provided by the department pro-vided that, in the event of any worker leaving the work ofhis own accord, or being dismissed on account of misconductor unsatisfactory work, within six (6) weeks of time of engage-ment, the amount of the fare to the job may be deductedfrom any amounts due to such worker at the time of dis-missal, and lie shall forfeit privileges of free retmu-n to placeof engagement.

Notwithstanding the above, the transport conditionsuniv operating in regard to part-time sustenance workersshall continue in regard to such workers whilst the presentworking conditions of such wom-kers are in force.

4.Accidents, Transportation, etc.In eases of accident the departsuent shall pay the railway

and any other transportation fare of the injured worker to thenearest hospital town Provided that, when it is deemednecessary by the officer in charge or ganger that an attendantshall accompany an injured person, the department shall notonly pay him the transportation fare but also pay his wage,not exceeding eight (8) hours per day, for the actual timeoccupied oa the journey.

5.Payment of Wages.'Workers whoa discharged or who resign during or on

completion of the work shall be paid wages due by cash orcash order, and, as far as practicable, the wages shall bepaid at the particular place whem-e such worker has beenworking.

When a worker has been discharged or has resigned, lieshall be paid the wages due within twenty-four (24) hoursafter the timukeeper has been notified of such discharge or re-signation, or twenty-four (24) horn's after the worker has ar-rived at the main camp, and for all working time duringwhich workers are kept waiting for their wages beyond suchtwenty-four (24) hours they shall be paid at ordinary mates.

6.Hours.Subject, and except as hereinafter provided, the ordilnary

working hours shall not exceed eight (8) hours on Monday'Tuesday, Wednesday, Thursday, Friday, and four (4) onSaturday: Provided that, with time approval of the parties.the working week of forty-four (44) hours may he workedfront Monday to Friday iuclusive.

Provided that, at the discretion of the officer in charge,the hours to be worked on railway construction during thetime a locomotive is in uso shall ho spread over six (6) daysof eight (8) hours each and five (5) (lays of eight (8) hourseacb, in alternate weeks ; Saturday to be the off day in thefive (5)-day week. This proviso shall apply only to workerswhose work is dependent upon the work of the loco.

7.OvertinuoAll time worked outside of or in excess of the usual

hours shall he paid, for the first four (4) hours after the usualstopping timetime and a half, aud thereafter double timeprovided that workers called to start work within one hourand a half (li) of tIme usual starting time shall be paid at timeand a half until time usumal starting time.

Double time shall be paid for work requh-ed to bedone on Sundays, excepting to seven-day a week men, andexcepting shift workers commencing not earlier than 11 p.m.oa Sunday night to suit transport facilities.

Double time shall be paid for all work done on GoodFriday, Labour Day, and Christntas Day, and tha]-e shall beno deduction from accrued holidays imm regard to workersrequired to work on any of the said holidays.

Except as hereinafter provided, all work pci-formedduring time recognised meal hour shall be paid at time and ahalf, and such rate shall continue until the worker knocksoff for ins meal.

The exceptions referred to above are as followsPowder-monkeys and their assistants.Workers engaged not more than 15 minutes

immediately after the commencement of timeusual lunch period on somo process in course(e.g., concreting).

Workers engaged omm emergency repairs to plant,etc., or other essential emergency work, to enablethe job to restart at the expiration of tiuo lunchhour.

Shift workers.Horse :lrivers performing duties covered by their

attendance allowance.workers who ordinarily have their lunch whilst

working (e.g., pumpers unwatering trenches).Workers on ballast or material trains.A worker who is engaged continuously for macre

than five (5) consecutive days between timehuours of 12 noomu and 1 pan. or any usual mealhours on afternoon or night slmifts : Providedthe lunch hour is taken between 11 arn.,nd 2p.m., at time sante regular hour eneim day.

8.Holidays.\Vom-kcrs, including part-time workers hut excluding casuals,

shall receive, inclusive of all public holidays taken, Imolidaypay equivalent to one (1) days' pay of eight (8) hours for eacimmnonth of continuous scm-vice, and the proportiomm of a day's payfor a broken period of a mnontim, including ammy Sundays occur,'-ing in such broken period, calculated on time basis of the daysin the mommthu in whicim paynment is nmade. week (Monday to Saturday). If not employed on such classesof work for any portion of a week they shall be paid for theclass of work actuaUy performed.

20.Water Bags and Firewood.The department shall provide, free of charge, on each

work, water bags which in the opinion of the officer in chargeare suitable. Firewood shall he snpplied free of charge, whereconsidered necessary by the officer in charge.

21.General Application of Wages Schedule.The rate to be paid for auy class of labour omitted from

the Schedule or any section of work covered by this Awardshali be that provided under any other Schedule of thisAward for similar work.

22.New Classifications.The future rate for any class of labour not specifically

mentioned Ia any of the Schedules of tius Award shall befixed by mutual arrangement between the parties hereto,and, failing agreement, by the Board of Reference Provided,however, that the rate so fixed shall, if the date from whichit is to take effect has not been agreed upon, be determinedby the Board of Reference.

23.Van for Plate-Laying.The department shall provide a van for conveying plate-

layers to and from work.

24.Protection from Weather.Suitable tarpanbas shall be supplied by the department

for men travelling to and from camp to work per motor truckdurng winter months.

25.Casual Workers.A casual" worker is one for whom less than one (1)

week's continuous work is provided by the department. Cas-ual workers shall be entitled to receive ten per cent. (10%)in excess of the rate prescribed for their class of work Pro-vided that no penalty rate shall be payable ia eases where theworker is employed regularly for less than one (1) weekcontinuously, owing to his being employed under the part-time or rationed system.

26Shift Work.Ia connection with shift work jobs the first shift in

two.shift work shali work eight (8) hours, not includingany crib-time all other shifts shali be of eight (8) horn's,including half (f) an hour crib-time, i.e., 71- hours actualworking time.

Workers employed on night shift (from 5p.m. to 730ala, without rotation) in dismantling the receptacles knownas cement boxes," or in preparing fresh boxes to receivethe concrete mixture shall be paid one shilling (1/) pershift above the basic wage.

27.Preference.Preference of employment in respect of the classes of

workers covered by this Award shall be given to financialmembers of the A.W.U.: Provided that any worker orapplicant for employment who is a member of another re-cognised industrial union and who produces proof of such atom-bership, shall he entitled to equal preference Provided thatsuch worker or applicant shall, within fourteen (14) daysof the expiry of his current ticket with the other union, makeand complete an application for membership with the A.W.U.

28.Union Representative.The duly appointed local representative of the union

shall be recognised by the gauger and departmental officersas the official of the union on the job.

29.Inspection of Wages Sheets,The wages sheets of the department shall be open for

inspection at the local or head office by the secretary orother authorised member of the union, upon reasonable noticebeing given of his desire to inspect same.

30.Pieceworkers.(a) The rate of payment for any systcnt of piecework shall

be fixed on the basis that it shall be sufficient to yield toa worker of average capacity for a full week's work of the or-dinary hours at least ten (10) per cent above the minimumtime rate of pay as prescribed herein for such week's workProvided that, where a worker works part of a full week atpiecework rates and part at time rates, he shall be paid somuch as ho is entitled to receive under such piecework ratesplus the proportionate amount which be is entitled to receiveunder this Award at time rates of pay.

(b) All disputes between the department and the union, asto any matters relating to payment by results, including anyquestion as to whether the rates or prices are properly bssedon the capacity of an average workman, and as to the extensionof any system of payment by results by the department toworkers, shall, in default of agreement between the depart-moat and the union, be referred to the Board of Reference,

(e) As far as reasonably practicable the provision of thisAward, relating to accommodation, tent allowance and holidaypay, fares, accident transportation, pitching, striking, andremoving camp, medicine chest, water supply, stores, sanitaryservice, and preference shall apply to pioeeworkers. Tentallowance and holiday pay shell only be payable when theofficer in charge is sotisfied that the pieceworker has qualifiedfor such payments.

31.Contract of Service.1. Subject to the provisions of sub.clnuse 2 the following

provisions shall applyIf for any reason whatever during nay portion of the

working horn's of any week no work is available or performed,the worker will only be pnid for the time actually worked atthe rate of pay as above prescribed (per week of 44 hours)apportioned to the time actually worked during the week.

There shall be no obligation on the part of the employeror the worker to give a week's or any other noticeto determine the employment, the position being ia thisrespect the same as if the worker were employed at an hourlywage.

2. If a worker is not notified before he leaves the jobat the end of the day or shift that his services will not berequired on the next day or shift, and such worker presentshimsoif for work at the appointed starting time, he shall bepaid for that day : Provkled, however, that if the unemploy-saent is on account of causes beyond the control of the manage-mont he shall be entitled to only two (2) hours' pay and benotified of the cause why lie cannot be employed: Providedfurther, that when the worker llves or resides in such closeproximity to the work that he is under no necessity to incuraay extra expense by a delayed notification of his services notbeing required, then such notice shall be doomed sucientif given at least one (1) hour before the nsual starting time,

3. A worker who has actually commenced work and isknocked off from any cause whatsoever shall be entitledto a minimum of two (2) hours' pay for the day or shift.

4. The decision as to whether it is too wet to work shallrest with the officer in charge of the job.

32.Long Service Leave.The conditions governing the granting of long service leave

to full-time Government wages employees generally shall applyto workers covered by this Award.

(o) In the event of aw orker being employed by anemployer for portion only of a. year, he shall only heentitled to such holidays on full pay as aretionate to his length of service during that period withsuch employer, and ii such holidays arc not equal to theholidays given to the other workers, lie shall not beentitled to work or pay whilst the other workers of suchemployer are on holidays on full pay.

4.Ovcrtin,e.Except- as provided in clauses 16 1 lid 20, a11 time

5.Sunday a id holiday Work.Except as provided hereunder, and also in cIa uses

16 and 20, nil work performed on Sunday, New Year'sDay, Good Friday, Easter Monday, Labour Day, Christuias Day, and Boxing Day shall be paid for at donbletime rates.

All time worked beyond eight (5) hours on Sun-day, Christmas Day, New Year's Day, or Labour Dayshall be deemed overtime and shall be paid for at theprescribed overtime rates, calculated at the special rateprescribed for ordinary work on the particular day onwhich such overtime is worked.

6Proportion of Juniors.The employer shall be entitled to employ one joui'

and, thereafter additional juniors may be employed inthe proportion of one junior to every four (4) or frac-tion sf four (4) workers ia receipt of the full adultrate of pay.

7.Higher Duties.A worker required to (10 work which is entitled to a

higher rate under this Agreement than that wIdth lieusually performs shall be entitled to payment at thehigher rate whilst so employed.

S.Timc- and Wages Record.The employer shall keep and cater up, or cause to

(a) The name of the worker.(b) The class of work performed by each worker.(e) The wages and overtime (if any) paid to each

employed.The ages of junior workers.

11.Payment for Sickness.(a) - A worker shall be entitled to payment for non-

attendance, on the ground of personal ill-health, fqr onehalf (I/j) day for each completed mouth of serviceProvided that payment for absence through such ill-health shall be limited to six (6) days (one week's pay)

in each calendar year.
