2. Approval of Closed Session Minutes from July 6, July 20 and
July 27
Action: Adoption of Minutes
3. Resolution to Set Public Hearing on Annexation Petition for
ANX-10-08, 5001 Old Stage Road
Rachel Blalock has petitioned to annex property located at
5001 Old Stage Road resulting from a request to connect to
public water. The petition is sufficient under state law to
proceed with the annexation process. This Resolution sets
December 6, 2010 as the public hearing date on the annexation.

4. Retention Pond Conversion at Timber Crossings Shopping Center
The Town’s Water Supply Watershed Protection Plan approved by
the State in 2003 requires new Storm Water Best Management
Practices (BMP’s) and retrofitting some existing detention
pond sites. The Town Attorney has negotiated the purchase of
an easement needed for the conversion of the detention pond to
a retention pond at Timber Crossings Shopping Center in the
amount of $6,000. The Town Attorney recommends the purchase
be approved and authorize him to proceed with acquisition of
the easement.

5. Ordinance Amending the 2010 – 2011 Operating Budget
This budget amendment reflects proceeds and costs
associated with the $6,050,000 bond issue on October 5, 2010.
The General Fund is amended to provide funding for bond issuance
cost ($16,000) in excess of the amount that can legally be paid
from bond proceeds; transfers Timber Drive Reserves to Capital
Projects Reserves($2,509,250) and establishes Future Capital
Projects reserve fund; amends the White Deer Park Capital Project
fund to reflect amounts from Debt Proceeds to actual amount
issued ($3,200,000), premiums received from debt issue ($29,527)
and provide funding for debt issuance cost($63,997); establishes
the Timber Drive Extension Capital Project Fund and reflects
funding from debt issuance ($2,500,000), premiums received from
debt issuance ($23,068) and provide funding for debt issuance
cost ($49,998)and establishes Vandora/Buffalo Roundabout Capital
Projects Fund and reflects funding from debt issuance ($350,000),
premiums received from debt issuance ($3 232) and provide funding

I NEW/OLD BUSINESS
1. Town of Garner Streetscape Plan
Presenter: Brad Bass, Planning Director
One of the recommendations from the North Garner Plan was to
design and implement streetscape improvements along Main
Street. The proposed Streetscape Plan implements the design
portion of this recommendation. Revisions requested by the
Council at July 2010 work session are included in this amended
Streetscape Plan.
Action: Consideration of Adoption on the December 6, 2010
2. Discussion of Town’s Nominees to Garner Volunteer Fire-Rescue,
Inc. (GVFR, Inc.) Board of Directors
Presenter: Hardin Watkins, Town Manager
Based upon the Town of Garner’s new contract and recently
amended GVFR, Inc. bylaws, the Town now has the opportunity to
select three members of the GVFR, Inc. Board of Directors.
GVFR, Inc. has requested that the Town provide the names of
these nominees in early November 2010. A new GVFR, Inc. Board
will be constituted in early November and these persons will
need to be ready to take their seats. Terms will be either
one year or two years.

3. South Wake Landfill Partnership Agreement, Amendment No. 2
Presenter: Rodney Dickerson, Assistant Town Manager
This amendment to the South Wake Landfill Partnership Agreement
defines the distribution schedule for annual rebates generated
from tipping fees. The first distribution will be paid to each
Partner by June 30 based on unaudited revenues and expenses as
of June 15. The second distribution will be paid by December
31 based on audited financial records for the system, less the
first distribution in June.

PETITIONS AND COMMENTS
Paula Smith, 1407 Foxwood Drive, said she is a resident of Garner Townes and
is representing that community. She said they are working diligently to
upgrade the neighborhood that has suffered several years of neglect. They
want to upgrade the lighting and clean up the pool area. She said she will
be talking with the Council more and more and is hoping for assistance. Shethanked the Town for offering Reginald Buie, to come to their Homeowner’s
Association Meeting. Council Member Johns asked what major item they are
working toward. Ms. Smith said the pool; they are collecting bids to get the
pool reopened.
Frank Livingston, 207 Avery Street, said he has been in the area for four
years. He has 40 years of fire service and emergency management experience.
He said he is well versed in disaster situations and offered his assistance
to evaluate emergency services.

Resolution Declaring Trash Collection Projects
This Resolution declares the Town’s unprepared trash pick-up special projects
for 2010/2011 as provided by our solid waste ordinance. Pickup dates for the
fall unprepared waste cleanup will begin the weeks of October 31, November 7and November 14, 2011. The spring unprepared cleanup will begin the weeks of
April 4, April 11, April 18, 2011. These projects will be based on the
normal garbage collection routes.

Staff requests authorization to declare this property as surplus andauthorizes the Town Manager to sell this item by private sale at a negotiated

OLD/NEW BUSINESS
Engineering Services Agreement for Utility Capacity Study
Presenter: Frank Powell, Town Engineer
Mr. Powell reported this contract is for Engineering Services from Hazen and
Sawyer, P.C. for the proposed Utility Capacity Analysis Study. The contractis broken down into two phases. Phase I will determine the amount of
additional water and wastewater capacity that the Town may wish to purchase
from the City of Raleigh for a fee of $24,900. Phase II will look at the
financial impact and investigate possible alternatives available to fund the
purchase of that capacity. Phase II has a fee of $8,300 but it is noted in
the agreement that this amount may be negotiated based upon the Phase I
findings. The $8,300 figure is a reasonably in depth look at financing
alternatives. If the Phase I findings results in the Town deciding to
purchase only a minor amount of capacity then the Phase II effort may can be
reduced or possibly even eliminated. It is noted that the original budgetfor this study was $30,000. If Phase II is accomplished in its entirety then
the total cost of the study will be $33,200 and the budget will need to be
increased. Mr. Powell noted the initial fee proposed by the consultant was
$34,700. After a meeting with the consultant to discuss the scope of
services in detail we were able to reduce that fee by $1,500. The
Engineering Department initially sent a request for proposals for

Council Member Kennedy said he feels that Hazen and Sawyer have a good approach
to this project. He said their project manager has relevant experience and
worked in the Raleigh area on water use characteristics.

Town of Garner Transportation Plan 2010
Presenter: Brad Bass, Planning Director
Mr. Bass presented the staff report. The Town Council authorized thedevelopment of a new Transportation Plan in October 2008. It will replace the
current Transportation Plan that was adopted in 1999. The new Transportation
Plan establishes a vision and a set of suggested strategic transportation
improvements that will guide future budget and capital program considerations
for Garner. It is also anticipated that Garner will utilize the
Transportation Plan as a guide to provide input to CAMPO, Wake County, NCDOT
and Triangle Transit for consideration of future transportation service
investments. The Town retained the consultant services of the Louis Berger
Group to develop the plan. A Steering Committee was appointed by Council toassist Staff and the Consultant with this effort. The project kicked-off in
January 2009. The Steering Committee held ten meetings over the course of
the last year with Staff and the Consultant to work on the new 2010 Garner
Transportation Plan. The Transportation Plan Steering Committee met on
January 20, 2010 to review the final working draft of the new Garner
Transportation Plan including some of the major recommendations contained in
the Plan. After this review, the Committee concluded it was appropriate to
move forward with a Public Open House Workshop to gain public review and
comment on the draft Plan. The open house was held on March 3, 2010 for
public review and comment. Approximately fifty people attended the meeting.The Plan was reviewed by the Town Council at its July 27, 2010 Work Session
and a public hearing was held on August 2, 2010.
Mr. Bass recognized Scott Lane and asked him to present highlights of the
plan. Mr. Lane began by presenting the plan’s vision statement and four
goals of the plan. “Garner’s transportation system provides its citizens and
businesses with efficient and safe travel options for auto, bicycle,
pedestrian, and public transit users that serve transportation needs in a
balance with land use development patterns as well as regional and localpartnerships.”
1. The Garner Transportation Plan will be a visionary document that
includes a variety of strategies and partners from adjacent communities
and our own to address transportation needs.

Regarding the bicycle and pedestrian recommendations, he noted that there are
a number of crossing improvements recommended in the Plan. The sidewalk
costs are for a sidewalk on one side of the street only. High priority
projects are shown first and short-term projects afterwards.
Mr. Lane said the public transportation focuses on shopping centers and
roadways to downtown Raleigh. The plan recommends a new bus service around
Garner connecting with existing routes provided by Raleigh and Triangle
Transit. Additional recommendations on potential future rail stations are
also discussed in the Plan. Mr. Lane thanked the Council for their
participation and patience. Council Member Marshburn noted the plan should
be reviewed every five years. Mr. Lane agreed and said it has been ten years
since the last plan was reviewed. He added that this is a living document
and can be tweaked or modified.
Mr. Bass said he wanted to formally recognize the Steering Committee and
personally thank them for volunteering their time to assist us with this
project.
Council Member Singleton said there is lots of detailed information and this
is a plan that will serve us well in the future. At the work session, he
expressed concerns about traffic and safety at the area high school and
middle schools. Garner Senior High School now has 2500 students and he feels
we need to look at the streets before installing sidewalks. He said he wouldlike to authorize staff to move forward with traffic analysis in those areas
and focus on improvements that need to be made to make it a safe.
Council Member Kennedy said this involved a lot of regional planning efforts
and thanked Mr. Lane for making the meetings interesting and productive; he
said it was a rewarding experience.
Mayor Williams agreed this is an excellent plan. He said he was glad to see
plans regarding transit; there was little discussion about transit in theearlier plan. Mayor Williams said at the July 3 Celebration lots of people
talked about what a good job Garner is doing.

Resolution Authorizing the Issuance and Sale of General ObligationPublic Improvement Bonds
Presenter: Lin Jones, Finance Director
This Resolution authorizes the issuance and sale of general obligationbonds. A bond order was authorized and adopted on August 22, 2000 in
order to finance street improvements, recreational facility
improvements and park improvements. The Town shall issue its General
Obligation Public Improvement Bonds (the “Bonds”) in the aggregate
principal amount of $6,050,000, pursuant to and in accordance with the
Bond Orders entitled:
“STREET IMPROVEMENT BONDS IN AN AGGREGATE PRINCIPAL AMOUNT NOT
EXCEEDING $17,000,000, FOR THE PURPOSE OF PROVIDING FUNDS,
TOGETHER WITH ANY OTHER AVAILABLE FUNDS, FOR PROVIDING STREETIMPROVEMENTS IN SAID TOWN, INCLUDING, BUT WITHOUT LIMITING THE
GENERALITY OF THE FOREGOING, CONSTRUCTING, RECONSTRUCTING,

Discuss Proposed Contract with Garner Volunteer Fire Rescue, Inc. (GVFR)
Mr. Watkins presented changes to the contract between the Town of
Garner and the Garner Volunteer Fire Rescue, Inc. as discussed with
Interim Chief Matt Poole.
The Composition of the Board of Directors shall consist of seven persons,
including the President.
Three (3) directors shall be selected by the volunteer members of GVFR,
Inc. from amongst the membership;
Three (3) directors shall be Town of Garner citizens or business ownersappointed by the Town Council;
One (1) director shall be called President and will be selected by
GVFR, Inc. The President will preside over Board of Directors
meetings. The President will not vote on any Board matters unless a
tie exists, in which case the President will vote to break said tie.
Each party to this contract may offer suggestions and submit names to the
other party regarding persons that would be good nominees for the Board ofDirectors. Neither party has an obligation to accept or utilize any names
provided in such an exchange of names.
All individuals appointed to the Board of Directors by the GVFR shall reside
in either the Town Limits or Garner fire service district.
All individuals appointed to the Board of Directors by the Town shall reside
or operate a business in the Town Limits of Garner.
Terms for all Board of Directors members shall be two years in length withstaggered terms to ensure continuity.
Term for the President shall be one year in length.
All appointments shall be consistent with other provisions of this contract.
The Board of Directors shall elect the appropriate officers annually as it
sees fit in accordance with GVFR, Inc. bylaws.
GVFR bylaws will be amended immediately to reflect governance changes
contained herein.
Mr. Watkins said the Board of Directors will be voted on in November as
well as changing the by-laws. Mr. Poole will need the Town’s
membership by November 1.

Council Member Kennedy said he attended the Planning and Services
Action Advisory Committee. The Committee is looking at specific goals
that will be brought to attention of Board of Directors at the N.C.
League of Municipalities Conference in October.
Council Member Marshburn said he has been attending the Wake County
Sustainability Task Force meetings over the last couple of months. He
said he will keep the Council updated on their progress.
MANAGER REPORTS
1. Star Tracker. He updated the Council on the CAT bus shelter by
informing them that Mr. Beasley and representatives from the
City of Raleigh and Wal-Mart will meet via a conference call to
work out some issues.
2. Planning Commission Summary. He reported VIP Awards will be
presented at the November 1 meeting.

COUNCIL REPORTS
Council Member Marshburn
• He recognized Chamber of Commerce and the Garner Volunteer Fire and
Rescue for successful recent events.
• There will be a Broadway series coming to the Historic Auditorium.
Season tickets are $50.00
• He reported hearing gun shots in the vicinity of Thompson Road.
Council Member Singleton said there is a firing range located in thatarea, but it is in the County’s jurisdiction.
Mayor Pro Tem Behringer
• She asked about the recent break-ins on Winterlochen Road. Mr. Watkins
said he is aware of those and noted the Police are working on the case.
• She asked about the criminal investigation regarding Garner Rescue
former chief. Mr. Watkins said he cannot comment on that matter.
Council Member Singleton
• He directed staff to prepare language for the November 1 consent agenda
regarding approval consideration of the study of traffic and
accessibility at the two middle schools and the high school as
mentioned in the 2010 newly adopted Transportation Plan.

• He reported one of the arms on the train track is malfunctioning at the
intersection of Vandora Springs Road and Garner Road. The arm on the
west side is late coming down.• There is a clogged drainage ditch on the north side of the road between
US 70 and Main Street.
• He reported that water drains into the home instead of the drainage
ditch at 230 New Rand Road near Smith Drive.
Mayor Williams
• He reminded the Council of the 5:30 appointment on October 14 for
portraits.• He said he feels the Garner Rescue sign needs to be removed from the
site at their former location on Vandora Springs and Foxwood Drive.
• He said he had a discussion with Jeff Hammerstein at the Fireman’s Day
event and said Mr. Hammerstein offered a Wake EMS vehicle for local
events, i.e. Garner Homecoming Game.

Presentation of New Tiered Water Rate Structure for City of Raleigh
Utility Customers in Raleigh & Garner
Presenter: John Carman, Director, City of Raleigh Utilities
Raleigh Utilities officials came to present the details of the new
tiered rate structure that goes into effect on November 1, 2010 for all
City of Raleigh and Town of Garner utility customers. Mr. Carman
introduced Karen Haney, who gave a presentation on the City of Raleigh
tiered water billing system that begins November 1. Ms. Haneyexplained that a majority of the customers will fall within the first
two tiers. The higher tier rate is form irrigation customers.
Communication will be sent to utility customers in the October and
November bills. The new system changes the billing to monthly and will
have a shorter billing cycle. Ms. Haney’s presentation illustrated a
sample of the new water bill.

Garner Streetscape Plan Summary
The Garner Streetscape Plan was authorized by the Town Council in October 2008. The Council
appointed a Steering
Committee
(separate
from
the
Transportation
Plan
Committee)
to
assist
with the development of this plan. One of the recommendations from the North Garner Plan
was to design and implement streetscape improvements along Main Street. The proposed
Streetscape Plan implements the design portion of this recommendation. The Steering
Committee held a series of meetings in 2009 with Staff and the Consultant to work through
the development of the Plan. An informal Open House meeting was held in April 2009 to
gain public input on the preliminary design concepts. Staff and the Consultant continued
to evaluate
the
preliminary
document
while
waiting
for
the
Historic
Downtown
Garner
Plan
to evolve in order to ensure the two planning efforts were properly coordinated. An Open House meeting was held in March 2010 for the public to view both the Streetscape Plan and
the 2010 Garner Transportation Plan. Council reviewed the draft Streetscape Plan at its July
2010 work session requested staff and the consultant to make several revisions to the draft.
The revisions have been made and we are now presenting the revised Streetscape Plan to
Council for further review. If Council is comfortable with the revisions, staff requests Council
to place this matter on the December 6, 2010 agenda for adoption consideration.
Summary
Design Process The foundation of Garner’s Streetscape Plan has been the value of
workshops and the charrette process. This problem‐solving
process utilized in the development of the master plan established
a clear vision along with identifying opportunities and constrains
from which the project design alternatives would be developed.
The outcome of the Garner’s Streetscape Plan process was a
clearly defined
vision,
an
understanding
of
opportunities
and
constraints, and the development of a consensus based master
plan that addressed project principals.

Core:
The design proposed along Main Street transforms the existing streetscape into a visual spine between
New Rand and Benson Road. This visual spine is a town scaled boulevard with a community gathering
place in its center. The new town square is an important community space that provides the Town of
Garner a location for special events, Informational, Directional, and Cultural Signage. In addition this
space acts as a speed table providing traffic calming measures as well as increasing automobile and foot
traffic for local business along Main Street.

The purpose of this memorandum is to distribute the final form for Amendment No. 2 to the South
Wake Landfill Partnership Agreement. The purpose of Amendment No. 2 is to define the distribution
schedule for annual rebates generated from tipping fees collected at the South Wake Landfill.
As reviewed and discussed at the local government manager’s meeting of October 13, 2010, at Wake
Forest Town
Hall,
landfill
rebates
will
be
distributed
two
times
per
year.
The
first
distribution
of
rebates
will be paid to each Partner by June 30th based on unaudited revenues and expenses incurred by the
system as of June 15th. Using June 15
th as the cut‐off date, the first distribution of rebates should be
approximately 60% to 70% of the full‐years rebate. The second distribution will be paid by December
31st based on audited financial records for the system, less the first distribution in June.
The next step in the process is to request each local government to route this amendment through their
respective elected
board
for
approval.
Once
all
approvals
have
been
completed,
Wake
County
staff
will
route a signature document to all local governments and then distribute the final signed document back

RECITALS:
WHEREAS, the Parties to this Amendment No. 2 have previously entered into an
Interlocal Agreement dated September 5, 2006 (the “2006 Interlocal Agreement”) that
established a joint undertaking of the Interlocal Solid Waste Management System(System); and
WHEREAS the Parties to the 2006 Interlocal Agreement (the “Partners”) agreed
to share the economic benefits and responsibilities involved in securing an economical
25-year public landfill solution to their Municipal Solid Waste (MSW) disposal needs;
and
WHEREAS, Tipping Fees collected for services at the East Wake Transfer
Station and at the South Wake Landfill minus System Operating Costs constitutes Net
Landfill Revenues which are distributed proportionately to the Partners each year

WHEREAS, the County desires to distribute Net Landfill Revenues two times
per calendar based on the availability of Net Landfill Revenues for each fiscal year; and
WHEREAS the distribution of Net Landfill Revenues for each fiscal year must
comply with the North Carolina Local Government Budget and Fiscal Control Act, and
generally accepted accounting principles, as well as federal and state laws and regulations
for government accounting and reporting practices, and
WHEREAS, the Partners desire to enter into this Amendment No. 2 pursuant to
the statute authorizing interlocal agreements, N.C.G.S. §§160A-460 to 160A-464, in
order to pursue the above-stated goal.
NOW THEREFORE, for and in consideration of the mutual promises and
covenants contained in this Amendment, the sufficiency of which is hereby
acknowledged, the Partners agree the 2006 Interlocal Agreement shall be amended as
follows:
ARTICLE I
Purpose
The purpose of this Amendment is to establish the approximate periods each year when
the County will distribute Net Landfill Revenues for each fiscal year to the Partners based
on the availability of funds.
ARTICLE II
Net Landfill Revenue Distribution Schedule
Fiscal year Net Landfill Revenues will be distributed to the Partners two times per
calendar year.
First Distribution
The First Distribution of a fiscal year’s Net Landfill Revenues will be paid to each
Partner by June 30th of that same fiscal year. The amount of the First Distribution will be
based on unaudited estimates of the fiscal year’s Net Landfill Revenues calculated using

approximately six month’s after the First Distribution (by December 31st). The Second
Distribution will be calculated using the fiscal year’s audited total Net Landfill Revenues
minus the amount of the First Distribution.
ARTICLE III
Miscellaneous
All other terms and conditions of the 2006 Interlocal Agreement and Amendments
remain in full effect, and are not altered or amended in any manner with this Amendment
No. 2, thereto.
IN WITNESS WHEREOF, the Partners have caused this Amendment No. 2 to
the 2006 Interlocal Agreement to be ratified by resolution of their governing Boards or
Councils as evidenced by the minutes of their governing Boards or Councils, and
executed by their duly authorized officers as of the date first above written.

Subject: Investment Report for September 30, 2010
General Fund investments have increased by $271,912 since August 31, 2010. GeneralFund Investments increased $248,339 during the same period last year. Total investments for allfunds increased $272,629 in September. As of September 30, approximately $2.9 million hasbeen advanced for White Deer Park construction. These funds will be recovered on October 26when proceeds from the October 4th bond issue are received.
Interest rates at the North Carolina Capital Management Trust were .15% for September
which represents a .03% decrease from August. Interest rates for the past year are indicated inthe following chart:
