2.0 AREAS OF NOTE
The following areas of note were observed during the site inspection: • Extensive debris was noted across the site including an unmarked 55-gallon drum, tires,
construction debris, empty bleach bottles, broken sections of brick wall, broken concrete, and rusted metal appliances.
• A steep slope exists within the site that leads to a dry creek bed. Multiple pieces of debris were observed in and along eroded areas of the slope and dry creek bed.

• Undulating topography was observed in the grass field within the northern section of the site that could be fill dirt covering previously deposited debris.
• Multiple residential properties are located within 1,000 feet of the site.
• The New Life Wesleyan Church is located approximately 650 feet northwest of the site, and an area used seasonally as a corn maze is located approximately 600 feet south of the site.
• Multiple wells within 1,000 feet of the site are currently in use due to lack of municipal water connection in the vicinity. A water supply well classified as a Transient Non-Community well within the Public Water Supply System section of the North Carolina Department of Environment and Natural Resources, Division of Environmental Health services the above-referenced church.
3.0 SITE LOCATION RESEARCH SUMMARY
Marshall Miller & Associates, Inc. (MM&A) has completed an assessment of the pre-
regulatory landfill site listed as the Garner Trash Dump located in the Town of Garner,
Wake County, North Carolina. The assessment included historical research and a site
inspection to confirm the site location, to develop an understanding of the operational and
development history, and to evaluate the current site and vicinity conditions.
3.1 SITE SUMMARY
3.1.1 Site Ownership and Dates of Operation
According to records available from the Wake County Register of Deeds, the property
encompassing the site was sold to Roy Jones Walker and his wife Viola Wheeler Walker by
Sarah Frances Jones and her husband J. P. Jones on October 24, 1942 (Deed Book 889, Page
344). After Mr. Walker’s death, the property was conveyed to his legal heirs according to
the Last Will and Testament of Roy J. Walker, Sr., dated December 26, 1947. A copy of
this will was not available at the time of this report. On July 27, 1971, the remaining heirs
of the Walker Estate conveyed to Roy J. Walker, Jr. and his wife Alice W. Walker their
respective interests in Tract Number 3 of the Walker Estate (Deed Book 2006, Page 213) as
shown on the plat of the Roy Jones Walker Estate surveyed by Moses Farmer (Book of
Maps 1971, Page 231). Tract Number 3 is the property that currently encompasses the site,
and this deed is the most recent transfer of title for the property. Copies of these deeds and

plat as well as the Wake County Real Estate Data - 2010 Account Summary are provided in
Appendix A.
No historical documentation was available to confirm the years of operation of the landfill.
An interview with Roy and Alice Walker’s son, Ken Walker, revealed that the site accepted
yard waste and stumps during his youth, which would have placed the dumping operations
around the late 1960s to early 1970s. Upon review of the historical aerial photographs,
dumping likely began in the mid to late 1960s and could have continued through the mid
1970s.
The North Carolina Department of Environment and Natural Resources (NCDENR),
Division of Waste Management, Superfund Section, Inactive Hazardous Sites Branch, Pre-
Regulatory Landfill Unit (the Unit) obtained permission to access the site from Ken Walker
on behalf of Alice Walker. During this site visit, and during previous task orders associated
with Garner Trash Dump, MM&A interviewed numerous long-term residents of the area.
Copies of these communication logs are included as Appendix B.
3.1.2 Site Location
The site is located approximately 4.25 miles south of Garner Town Hall (900 7th Avenue)
with a bearing of 174 degrees from true north. The site location and the surrounding area
are depicted in the various maps included with this report (Figures 1 through 4).
3.1.3 General Site Description
The site is located in the Panther Branch Township of Wake County outside of jurisdiction
but in close proximity to the Town of Garner. The site is bordered to the south, east, and
northeast by undeveloped forestland, and to the west and northwest by a cleared field.
The property on which the site is located occupies an area of approximately 40.43 acres and
has an irregular polygonal shape. The site is approximately 1.43 acres and is centrally
located in the northern portion of the property.

The site is comprised of two distinctly different areas in terms of topography and vegetation:
a grass field in the northern section and a wooded area in the southern section. The site
gently slopes to the southeast in the grass field and changes to a steep slope in the wooded
section with a total relief of 40 feet. There is an unnamed creek in the wooded section that
was dry at the time of this investigation and slopes from southwest to northeast. According
to the United States Department of Agriculture, Natural Resources Conservation Service’s
Web Soil Survey, the soils within the site are classified from west to east as Appling
gravelly sandy loam and Cecil sandy loam.
3.2 SITE AND PROPERTY CONDITIONS
The following sections discuss the conditions of the site based on historical research and the
site inspection. Captioned photographs are included in Appendix C to illustrate the
condition of the site as observed during the site visit that was performed on June 1, 2011. A
copy of the Field Reconnaissance Sheet is included as Appendix D.
3.2.1 Structures on the Property
No historical or current structures were observed on the site or identified in historical aerial
photography or topographic maps. The property currently has one residential structure and
five barns. The residential structure is a historic farm house located approximately 400 feet
west of the site. The farm house is well maintained, but it is not known if it is currently
occupied.
3.2.2 Current Property Usage
The primary use of the property is for agriculture and storage of supplies related to Ken’s
Produce, Ken Walker’s garden and farm supply business. Ken’s Produce is located on an
adjacent parcel which fronts Benson Road and was subdivided from Tract 3 of the Roy
Jones Walker Estate by Niall Gillespie, R.L.S. (Book of Maps 1995, Page 197). See
Appendix A for a copy of this plat. Along with various barns and greenhouses, fill dirt is
stockpiled for sale on the property, with the majority of the fill dirt piled in the northwest
portion of the site. Mr. Walker also has a portion of his approximately 6.4-acre corn maze

on the property that is popular in the area with families during the harvest season.
3.2.3 Water Supply Wells and Intakes
There are three water supply wells currently being used on the property (Wells 1-3, as
indicated on Figures 1 and 2). Mr. Walker stated that he is not connected to municipal
water service and that the wells are used for drinking water and irrigation of the plants
associated with Ken’s Produce. The locations of these wells were recorded with a Trimble
GeoXT® handheld global positioning system (GPS) unit differentially corrected by the
North Carolina Continuously Operating Reference Station (NC CORS) RALR.
3.2.4 Surface Water Features
Beginning at a confluence of terrain features approximately 1,700 feet south of the site, an
unnamed intermittent stream flows north along the eastern boundary of the property where it
turns northeast and follows the southern boundary of the Indian Creek Overlook subdivision
and empties into Swift Creek approximately 2,700 feet east of the site (Figures 1 and 2).
The grass field in the northern section of the site drains into a small cattail marsh at the top
of the steep slope in the wooded south section of the site. The cattail marsh drains down the
steep slope into a dry creek bed along the southeastern edge of the site. At the time of the
MM&A site visit, there was no flowing or standing water or residual moisture in the creek
bed. This drainage feature is approximately 600 feet long and flows northeast towards
Indian Creek Overlook subdivision.
3.2.5 Disposal Area
Based upon GPS mapping of the perimeter, personal interviews, and examination of maps
and aerial photographs, the site occupies approximately 1.43 acres of the 40.43-acre
property. The site is located in the northwestern portion of the property and is
approximately 150 feet south of Indian Creek Trail.

3.2.6 Disposal Area Conditions
The majority of the site debris is situated along a steep slope leading to a dry creek bed. The
steep slope is heavily eroded with exposed debris in the erosion channels and assorted debris
scattered on the surface. Erosion and gravity have deposited a large amount of debris in the
dry creek bed below. The wooded southern section of the site including the steep slope has
a mixture of coniferous and deciduous trees ranging from 8 inches to 24 inches in diameter.
The northern section of the site in the grass field has small areas of unnatural topography
scattered throughout that suggests the possibility of buried waste. The grass field is a
mixture of tall grass and flowers and includes the fill dirt stockpile located in the upper
northwestern section of the site.
3.2.7 Evidence of Human Activity
There is a small path that leads to the fill dirt stockpile from a gap in the fence to the west of
the site coming from Ken's Produce. No other evidence of human activity was noticed near
the site.
3.2.8 Potential Landfill Gas Migration Pathways
No potential landfill gas migration pathways were noted on-site. The site does not contain
any building foundations or underground utilities that would promote the migration of
landfill gasses.
3.2.9 Physical Barriers
No physical barriers were observed preventing access to the grass field in the northern
section of the site. The southern section of the site is heavily wooded and steeply sloped.
Access to the southern section of the site is not available by vehicle and is difficult to
traverse on foot.
3.2.10 Other Pertinent Information
The site has a cattail marsh that extends into the grass field from the tree line above the

slope containing the majority of the debris. This cattail marsh is in the same location as the
area of debris in the 1971 historic aerial photograph (see Section 4.0). Mr. Walker stated
that the cattail marsh was an area that he had filled in with soil in order to stop the flow of
water into the dry creek bed (Appendix B). There is extensive erosion on the slope
immediately downstream from the cattail marsh.
3.3 VICINITY CONDITIONS
3.3.1 Structures Located within 50 Feet of the Site
No current or historic structures were identified within 50 feet of the site, based on the site
visit and historical resources, which include aerial photography and topographic maps.
3.3.2 Vicinity Water Supply Wells and Intakes
MM&A contacted Phillip Maddox, Maintenance Supervisor with the Town of Garner Public
Works Department, to determine the availability of municipal water connections in the
vicinity of the site (Appendix B). Mr. Maddox stated that the municipal water main ends at
the Arbor Green subdivision on Benson Road, approximately 3,000 feet north of the
intersection of Benson Road and Indian Creek Trail.
The locations of Wells 1, 2, and 3 on the property were confirmed during the site visit by
MM&A. The locations of Wells 4 and 5 associated with the residences on Indian Creek
Trail and with New Life Wesleyan Church on Benson Road were visually identified by
MM&A during the site visit. The remaining wells (Wells 6-11) were not physically
observed, but the properties are developed and are not served by municipal water.
During the site visit, the MM&A field team observed a community well house located inside
the Indian Creek Overlook subdivision approximately 2,300 feet northeast of the site.
MM&A contacted Mrs. Betsy Dean, office manager for the subdivision, and she stated that
there are two community wells servicing the subdivision which have been capped off and
are currently not in use (Appendix B). The subdivision was connected to municipal water
in November 2010 and connected to municipal sewer services in March 2011. There is a

master meter for the subdivision located at 2775 Benson Road. According to research on
the NCDENR, Division of Environmental Health, Public Water Supply Section website,
there are no permitted Well Head Protection Areas in the vicinity of the site. However, Well
5 associated with New Life Wesleyan Church is currently identified in the Public Water
Supply Section system as a Transient-Non Community well. The Public Water Supply
Section website states that a Transient-Non Community water system provides water to at
least 25 persons for at least 60 days per year but less than 6 months per year.
3.3.3 Current Land Usage
Current land usage within 1,000 feet of the site is as follows:
North: A grass field located on the property is situated immediately north of the site. Indian
Creek Trail borders the property to the north and is the main egress for the Indian Creek
Overlook subdivision, which begins approximately 500 feet northwest of the site and
extends beyond 1,000 feet to the northeast. Two residences not associated with Indian
Creek Overlook subdivision are located on Indian Creek Trail approximately 350 feet north
of the site. New Life Wesleyan Church is approximately 650 feet north of the site. The
Woodbrook Estates subdivision begins at the corner of Woodbrook Way and Benson Road
approximately 900 feet northwest of the site and extends beyond 1,000 feet.
South: Undeveloped forestland is located immediately south of the site and extends
approximately 500 feet to agricultural fields. A field used for a seasonal corn maze is
approximately 630 feet south of the site and extends beyond 1,000 feet.
East: Undeveloped forestland is located immediately east of the site and extends beyond
1,000 feet. Homes associated with the Indian Creek Overlook subdivision are
approximately 500 feet northeast of the site.
West: Open grass fields are immediately west of the site. The residences of Mr. Ken
Walker and Mrs. Alice Walker are located beyond the fields approximately 320 feet west of

the site. Ken’s Produce is approximately 525 feet southwest of the site. An abandoned
commercial building along Benson Road is located approximately 861 feet southwest of the
site. A farm house opposite of Ken's Produce on Benson Road that appeared to be occupied
during the MM&A site visit is approximately 850 feet west of the site. West of Benson
Road, agricultural fields extend beyond the 1,000-foot perimeter.
3.3.4 Surface Water Features
An unnamed intermittent stream flowing along the eastern boundary of the property flows
into Swift Creek approximately 2,700 feet east of the site (see Section 3.2.4). Swift Creek is
located in the Neuse River Basin and is classified as Class C, Nutrient Sensitive Waters in
Title 15A of the North Carolina Administrative Code, Chapter 2 Subchapter B.
4.0 AERIAL PHOTOGRAPHY REVIEW
MM&A obtained aerial photographs from the Wake County Soil and Water Conservation
District (SWCD) the United States Geological Survey (USGS), and the United States
Department of Agriculture (USDA), Aerial Photography Field Office, National Agricultural
Imagery Program (NAIP) to provide information on the operational history of the dump and
the development history of the vicinity.
The sources and years for the aerial photographs obtained are as follows:

The aerial photographs listed above are included in Appendix E. Following is a summary
of the observations made from the review of the aerial photography:
In the 1954 aerial photograph, the site was densely wooded. North and west of the site there
were numerous agricultural fields with rows visible in the photograph. South of the site

there was a wooded area for approximately 400 feet leading to more agricultural fields. The
historic farm house is visible on the property, along with some of the associated barns and
sheds. There was scattered development along Benson Road.
In the 1965 aerial photograph, the site and immediate vicinity had changed very little since
the 1954 aerial photograph.
The 1971 aerial photograph shows the northwestern portion of the site had been partially
cleared of trees. An access road had been constructed that begins at Benson Road and
meandered to an area of disturbance at the site. The access road forked at the site to provide
access to a visible pile of debris from the north and west. A darkened area immediately
southeast of the pile of debris appears to have been located in the same place as the majority
of the waste that was observed during the MM&A site visit.
In the 1988 aerial photograph, no visible debris remained on the site, and the access road
was abandoned. The site had been almost fully cleared of trees. There were patches of
irregular color in the area of the pile of debris from the 1971 photograph. Indian Creek Trail
and Woodbrook Way had been constructed, and development was in progress within the
Indian Creek Overlook subdivision and Woodbrook Estates. Jackie's Lane south of the site
had been constructed with homes along its length.
In the 1998 aerial photograph, the site remained cleared of trees. However, the patches of
irregular color from the two previous photographs were missing. Also, a hedgerow had
begun to be constructed on the property approximately 100 feet south of Indian Creek Trail
which blocked the view of the site. The construction of Indian Creek Overlook subdivision
and Ken’s Produce had been completed. The New Life Wesleyan Church property had been
prepared for construction of the church site.
In the 2005 aerial photograph, the woodlands had begun to encroach on to the southeastern
portion of the site. The hedgerow south of Indian Creek Trail had grown in width since the

1998 photograph. The field that is seasonally used for a corn maze had been created south
of the site. The Southern Trace subdivision had been developed to the southeast. The New
Life Wesleyan Church had also been constructed.
In the 2010 photograph, the woodlands on the site had grown to their present extents. The
cattail marsh was visible along the wood line within the site. There was exposed earth in the
northern section of the site that corresponds with the location of the fill dirt stockpile
observed by MM&A during the site visit. The 2010 photograph is generally representative
of the current conditions of the site and vicinity.
5.0 CERTIFICATION
The report certification as specified in the Inactive Hazardous Sites Program, Guidelines for
Addressing Pre-Regulatory Landfills & Dumps, August 2010 is provided in Appendix F.

MM&A personnel visited the Swift Creek Mini-Mart and spoke to the clerk. Though the clerk was not familiar with the location of the Site, she made multiple calls to local long-term residents. None of the residents contacted were familiar with a dump on Highway 50. Additionally two individuals who had lived in the area since 1976 and 1952 entered the store
12/08/2010 11:45 Local resident and member of NewHope Church, south of the Site, approached MM&A personnel on-site. He stated that he had walked most of the property with youth from the church as well as during hunting activities, and he had never seen any signs of an old dump.
Additionally, two individuals who had lived in the area since 1976 and 1952 entered the store and stated they were not familiar with the Site. MM&A Personnel were directed to "Ken" of Kens' Produce and Garden Center, as he has lived in the area for many years, and "if anyone would know about a dump, he would." -JH

06/01/2011 9:00 Spoke with Mr. Walker at Ken's Produce during TO-604-LR1 site investigation. He stated that his father Roy had allowed dumping of yard waste during the time that he was a young boy, late 1960s - early 1970s. He had no knowledge of any municipal dumps in the area. He said that they now stockpile fill dirt for sale in the general area that we were there to investigate and also stores small amounts of yard waste there. The cattail marsh immediately adjacent to the site was indicated as being an area that he tried to fill in with dirt to stop the flow of water down the slope, which was the same slope that MMA found the majority of debris. Mr. Walker also p p j ymentioned that he is not hooked up to municipal water and has 3 wells on his property that they use for drinking and irrigation. -MC

Spoke with Betsy Dean, Office Manager for Indian Creek Overlook Subdivision. Inquired about the community well associated with the subdivision. Mrs. Dean stated that there were two wells servicing the community, and that they are currently capped and not in use. The subdivision was connected to municipal water in November '10 and municipal sewer mid March '11. She stated that there is a master meter located at 2775 Benson sewer mid March 11. She stated that there is a master meter located at 2775 Benson Road. She stated that their is no mailbox or home at this address, only an address for the meter. Mrs. Betty Mosher, Community Manager for the subdivision, told MC that the master meter is located on the east side of Benson Road as you travel uphill towards the subdivision from Garner. The meter is accessed from a driveway with a gate on Benson Road, and she offered MMA access to the master meter if necessary. -MC
