Re: Freedom of Information Act Request 13-023
This is in response to your Freedom of Information Act (FOIA) request dated February 10, 2013, in which you requested, "a printout of the OIG investigations closed during calendar year 2012." Your request was received in this office on February 14, 2013.
We have extracted from our databases a list of closed investigations responsive to your request, which we are releasing to you with certain information withheld pursuant to Exemptions 3(A), 4, 6, 7(C) and 7(D) under the FOIA. Exemption 6 of the FOIA, 5 U.S.C. §522(b) (6), relates to personal information regarding persons other than yourself. Release of this information would constitute a clearly unwarranted invasion of the personal privacy of the persons mentioned in the records. Information withheld pursuant to Exemption 7(C) ofthe FOIA, 5 U.S.C. §522(b)(7)(C), relates to personal information regarding persons other than yourself that is contained in investigatory files . Release of this information could reasonably be expected to constitute an unwarranted invasion of the personal privacy of the persons mentioned in the records. Redactions marked Exemption 7(C) are also covered by Exemption (6). Exemption 7(D) of the FOIA, 5 U.S.C. §552(b)(7)(D), protects from disclosure information that could reasonably be expected to disclose the identity of a confidential source, including a State, local, or foreign agency or authority of any private institution that furnished information on a confidential basis. Additional information is being withheld pursuant to Exemption 3(A) of the FOIA, 5 U.S .C. § 552(b)(3)(A). This information is specifically exempted from disclosure by a statute that requires that the information be withheld from public disclosure, specifically, the qui tam provisions of 31 U.S.C. §§ 3729 and 3730. Lastly, information withheld under Exemption 4 ofthe FOIA, 5U.S.C. §522(b)(3)(4), protects from public disclosure "trade secrets and commercial or financial information obtained from a person and privileged or confidential," i.e. the type of information "that would customarily not be released to the public by the person from whom it was obtained. " Critical Mass Energy Project v. NRC, 975 F. 2d. 871 , 879 (D.C.Cir. 1992) (en bane).
For your information, Congress excluded three discrete categories of law enforcement and national security records from the requirement of the FOIA. See 5 U.S.C. § 552(c) (2006 & Supp. IV (2010)). This response is limited to those records that are subject to

the requirements of the FOIA. This is a standard notification that is given to all our requesters and should not be taken as an indication that excluded records, or do not exist.
