AGREED that under Section 100 (A) of the Local Government Act 1972, the press and public be excluded from the meeting during discussion of the following item of business on the grounds that it involved the likely disclosure of exempt information as defined in Paragraph 1 of Schedule 12A of the Act and that the public interest in maintaining the exemption outweighed the public interest in disclosing the information.
43. APPLICATION FOR A HACKNEY CARRIAGE AND PRIVATE HIRE DRIVER’S LICENCE The Committee considered the report of the Director - Safety in relation to an application for a Hackney Carriage and Private Hire Driver’s Licence. (Summary provided in accordance with Section 100C(2) of the Local Government Act 1972).
44. DELEGATED AUTHORITY – EXEMPT NOTICE OF DECISION
NOTED the decision of the Chairman and Vice-Chairman of the General Purposes Committee following a hearing held on 14th February 2013.

45. TAXI AND PRIVATE HIRE LICENCE TRAINING The Committee considered the report of the Director – Safety in relation to feedback from the above training that had been provided on 8th February 2013. Members who attended the training agreed that it had been useful and it was agreed to send out the paperwork to those Members who had been unable to attend. Members were advised that the laws around the taxi licensing regime could be subject to change within the next 12 to 18 months and it was agreed that training for all Members of the Council be offered at the appropriate time.
AGREED that:
(a) the feedback from the training event be noted; and
(b) future taxi licensing training events be offered to all Members of the Council.
46. DELEGATED DECISION – MINUTE OF DECISION (CHANGE OF POLLING PLACE)
NOTED the decision of the Deputy Chief Executive following consultation with Local Ward Members, County Councillors, Chairman of the General Purposes Committee and the Portfolio Holder for People & Communities.

GENERAL PURPOSES COMMITTEE AGENDA ITEM NO. 4 23RD MAY 2013 UPDATE ON QUARTERLY PERFORMANCE AND ENFORCEMENT MATTERS 1.0 Purpose of Report 1.1 To inform the Committee of the activity and performance of the licensing team for the
period between 1st January 2013 to 31st March 2013, and to provide members with details of current ongoing enforcement issues.
2.0 Background 2.1 A new applicant for a Hackney Carriage/Private Hire Drivers or Private Ambulance Drivers
Licence have undergo various checks these include a Criminal Record Bureau check, DVLA check, two references are required, Group II medical, knowledge and ability tests.
2.2 Also included in the activity report are the applications received in relation to the Gambling
Act 2005. 2.2 This report covers the period from 1st January 2013 to 31st March 2013 and sets out the
range and number of licence applications during this period. It also highlights any activity required as a result of the applications. Appendix One shows the activity for period 1st January 2013 to 31st March 2013.
2.3 The second part of the report updates members on any outstanding enforcement issues.
This information is shown in Appendix Two. 3.0 RECOMMENDATION That the Committee consider the contents of the report and identifies any issues it

35. REVIEW OF STATEMENT OF GAMBLING POLICY – ADDITIONAL CONSULTATION The Committee considered the report of the Director – Safety in relation to the actions taken in response to the Council’s consideration of the Statement of Gambling Policy 2013-16 and the additional consultation exercise carried out in respect of Section 166 of the Gambling Act 2005. It was reported that following further consultation, nine responses were received with the overall majority being that the Council should continue to have a ‘no casino’ policy.
AGREED (by 11 votes for with 1 against) that Council be recommended to confirm the no casino resolution for inclusion in the Statement of Gambling Policy.
36. COUNTY WIDE BEST BAR NONE SCHEME The Committee considered the report of the Director – Safety in relation to the introduction of a County Wide Best Bar None Scheme for a three year trial period. The report provided statistical information as to the cost of alcohol related crime and disorder and cost to the NHS with a significantly high proportion being directly or indirectly attached to licensed premises with poor management standards.

It was report that the national Best Bar None (BBN) scheme was supported by the Home Office with the aim of promoting responsible management and operation of alcohol licensed premises. Members noted that the proposals were to implement a scheme in Nottinghamshire which would be split into three regions: South Nottinghamshire (Rushcliffe, Gedling and Broxtowe); Ashfield & Mansfield; and Bassetlaw and Newark & Sherwood for initial assessment.
AGREED (by 11 votes for with 1 against) that the implementation of the Best Bar None County Scheme be supported.
37. THE GOVERNMENT PROPOSALS IN RESPONSE TO THE CONSULTATION ON DEREGULATION OF SCHEME ONE OF THE LICENSING ACT 2003 – REGULATION ENTERTAINMENT The Committee considered the report of the Director – Safety in relation to the recently published response of the Department of Culture, Media and Sport to consultation responses received to proposals for the deregulation of regulated entertainment and the implications for licensed premises. The report provided the proposed changes which prompted Members to query how premises would be conditioned to prevent noise nuisance. In response, the Business Manager – Environmental Health advised that this would have to be undertaken through other legislation, for example Statutory Noise Nuisance. Members expressed concern as to the deregulation of audience limits for local authorities, hospital, nurseries and schools holding plays, films, indoor sporting events, live and recorded music and performances of dance held on their own premises. It was reported that fire regulations would still apply on audience numbers but that limits had been removed as the organisations in question were deemed responsible. It was noted that further detail was likely to be included in the regulations.
AGREED that the DCMS proposals relating to the deregulation of entertainment in the Licensing Act 2003 be noted.
38. UPDATE ON QUARTERLY PERFORMANCE AND ENFORCEMENT MATTERS
The Committee considered the report of the Director – Safety in relation to the activity and performance of the Licensing Team between 1st October and 31st December 2012.
AGREED that the report be noted.
39. TEMPORARY EVENT NOTICES RECEIVED AND ACKNOWLEDGED BETWEEN 14TH DECEMBER 2012 AND 6TH MARCH 2013 INCLUSIVE
The Committee considered the report of the Director – Safety in relation to the Temporary Event Notices received and acknowledged between 14th December 2012 and 6th March 2013.

LICENSING COMMITTEE AGENDA ITEM NO. 3 23RD MAY 2013 LICENSING ACT TRAINING FOR MEMBERS AND OFFICERS 1.0 Purpose of Report 1.1 To inform Members of Licensing Act training being provided for both Officers and Members
in June 2013. 2.0 Background 2.1 In recent years, Mansfield District Council has held a training course at the Hostess
Restaurant in Mansfield for Officers and Members across the County. The event is facilitated by the Nottinghamshire Authorities Licensing Group.
2.2 In response to the success of the previous sessions and the positive feedback received
following previous years’ event it is intended to hold another event, which is again focussed on Licensing Members and is open to all members of Licensing Committee.
2.3 This year’s training will be delivered by the Gary Grant a well known and renowned Barrister
in the field of licensing. 2.4 The course will be held on 21st June 2013 at the Hostess Restaurant near Mansfield and the
price per delegate is £55.00. The course will commence at 9:30am and finish at 4:00pm. Lunch will be served on the day along with tea, coffee and refreshments.
2.5 These sessions will give members a fuller understanding of the changes to the licensing laws
over the past two years and to allow a strategic approach to be taken with these new powers, make the best use of their potential, consider the correct balance between promotion and restraint and help implement best practice.
The session will also include time for case studies and open discussion. 2.6 It is proposed to make a corporate bid to the members training budget if the Licensing
Committee consider the training appropriate and relevant. 3.0 RECOMMENDATION
Members are asked to consider the opportunity for training and indicate whether they would support and attend the training event.

LICENSING COMMITTEE AGENDA ITEM NO. 4 23RD MAY 2013 REVIEW OF STATEMENT OF LICENSING POLICY 1.0 Purpose of Report 1.1 To seek the Committee’s approval to revise the Council’s Licensing Policy and to begin the
consultation process. 2.0 Background 2.1 The Licensing Act 2003 requires the Council to have in place a Policy relating to the carrying
out of its functions under that Act In respect of carrying out its duties the Council is required to adopt and have in place a Statement of Licensing Policy relating to those duties. The policy sets out the principles which the Council will apply in considering and granting licences under the Act.
2.2 The Act originally required the policy to be reviewed every three years, however, recent
changes have now extended this period to every five years. The current policy was adopted in January 2011 and therefore needs to be reviewed before January 2014.
3.0 Introduction 3.1 The Police Reform and Social Responsibility Act 2011 has introduced a number of changed to
the licensing regime and the draft Statement of licensing Policy has been amended to take account of these changes. The Council is also required by the Licensing Act to formulate its policy with reference to guidance issued by the Home Office under section 182 of the Act. This guidance has been amended and the draft policy again reflects these changes.
3.2 In order to achieve a level of consistency across the County the Nottinghamshire Authorities
have been working together on a joint format for the Statement. Members will appreciate that the Councils across the County are different and therefore it is not always possible to have identical documents, however, wherever possible attempts have been made to apply consistent phraseology.
3.3 A copy of the 2014 draft Statement of Licensing Policy is attached as Appendix one. A large
font has been used to identify where changes are proposed. 3.4 In the main the changes to the document reflect the amendments to the Licensing Act 2003
brought about by the Police Reform and Social Responsibility Act 2011. There has no fundamental changes to any of the policies previously agreed.
3.5 Any comments that the members of the Committee wish to make before the policy is sent
out for consultation can be included in the proposed revision. 3.6 It is proposed to undertake and extensive consultation exercise by directing organisations to
the Council’s website where a copy of the draft Policy will be posted. Printed copies will be available on request. A suggested list of consultees is shown at appendix two. It is proposed that the consultation period will last for a 12 weeks.

3.7 A timetable for the consultation process relating to the review of the Statement of Licensing Policy is shown below. This will allow sufficient time for any responses to be considered prior to seeking formal approval of the policy.

LICENSING COMMITTEE AGENDA ITEM NO. 5 23RD MAY 2013 TEMPORARY EVENT NOTICES RECEIVED AND ACKNOWLEDGED BETWEEN 8TH MARCH AND 13TH MAY 2013 INCLUSIVE 1.0 Purpose of Report 1.1 To inform members of changes to Temporary Event Notices and notices that have been
received and acknowledged between 8 March 2013 and 13 May 2013 inclusive. 2.0 Background 2.1 The Licensing Act 2003 introduced a light touch system for ad hoc, permitted temporary
activities. A Temporary Event Notice (TEN) is given by an individual (a premise user) and authorises the premises user to conduct one or more licensable activities at premises.
2.2 There are two types of TEN;
• A standard TEN, to be given no later than 10 working days before the event to which it relates
• A late TEN, can be given 9 and not later than 5 working days before the event. Late TENs are intended to be used by premise user who is required for reasons outside their control to for example, change the venue at short notice.
2.3 Only the Police and Environmental Health can make representation against the TEN. Once
the Police and Environmental Health receive a TEN, they have three working days to make any objections to it on the grounds of any of the four licensing objectives: prevention of crime and disorder, prevention of public nuisance, public safety and the protection of children from harm. If no objections are received the event will go ahead as planned. If an objection is received for a standard TEN the Council will have to organise a hearing to consider the objection and may impose conditions or decide that the event cannot go ahead. If an objection is received against a late TEN, no hearing is held and the application is refused.
