The Georgia Composite Medical Board (GCMB) held its regular meeting on January 11, 2018 at

2 Peachtree St. NW, Atlanta, Georgia, to consider Medical Board matters.

CALL TO ORDER

Dr. DeLoach called the meeting of the Georgia Composite Medical Board to order at 7:30 a.m.

AGENDA AND MINUTES

Dr. Weil submitted a motion, seconded by Dr. Marshall, to approve the agenda of the January

11, 2018 meeting. The motion carried unanimously.

Dr. Mohan submitted a motion, seconded by Dr. Weil, to approve the minutes of the December

7, 2017 meeting. The motion carried unanimously.

Dr. Collins submitted a motion, seconded by Dr. Mohan to approve the minutes of the

December 15, 2017 Teleconference

CHAIR’S REPORT

Dr. DeLoach discussed the following items with the Board:

Recognize staff:

1. Congratulate Edva Smith for her cover and outstanding article in “Fayette Woman

Magazine.”

2. Thank Hector Rodriquez for his 20 years of service to the state of Georgia.

SWEARING IN CEREMONY

Dr. DeLoach swore in a new member of the Investigations team. The Board members

welcomed new investigative agent Cameron Rabbitt.

1. Discussed the High Low Agreement, and how it effects individual physicians.

Nicole Lydon with MAG Mutual Insurance Company was present to address the Board

and answer their questions. Doris Williams-McNeely, Senior Assistant Attorney General

shared her doubts. The Board members asked questions pertaining to what would be

reportable. The Board agreed additional research is needed.

2 Update regarding background checks as part of the application process.

RULES HEARING

Dr. Gross convened the Public Hearing concerning the following proposed Rules amendments:

Rule Chapter 360-35-.2, “Licensure” (Cosmetic Laser Professional)

Dr. Gross asked if anyone was present to address the Board on the posted Rules amendments.

No one was present.

Dr. Marshall made a motion to approve Rule Chapter 360-35-.2, “Licensure” that the Board find

the formulation and adoption of these rules do not impose excessive regulatory cost on any

licensee and any cost to comply with the rule cannot be reduced by a less expensive alternative

that fully accomplishes the objectives of the applicable laws; that the Board finds that it is not

legal or feasible to meet the objectives of the applicable laws to adopt or implement differing

actions for businesses as listed in O.C.G.A. 50-13-4(A) (3)(A),(B),(C), and (D).

Dr. Downey seconded the motion, and it carried unanimously.

Rule 360-38, “Prescribing.” (Drug Monitoring Program)

Dr. Gross asked if anyone was present to address the Board on the posted Rules amendments.

Keri Conley, GHA, presented comments. Based on the comments, Dr. Marshall made a motion

to table the Rule and send back to Rules Committee.

Dr. Downey seconded the motion, and it carried unanimously.

INTERIM EXECUTIVE DIRECTOR’S REPORT

Ms. Hughes, Interim Executive Director presented the report. The Board took the following

actions:

1. Kimberly Johnson requested improvements in the licensing process for active duty

members. Board table for additional information.

2. Paul DePippo, MD had questions regarding renewal. Dr. Gross motioned to assign back

to licensure to see if they can streamline process. Dr. Marshall seconded the motion and

it carried unanimously.

3. Todd Merchen emailed with questions regarding MD vs MBBS. Board tabled and asked

the staff to obtain additional information.

4. Information concerning the Learning Summit – COEP Agenda February 26, 2018. For

information only.

5. Medical Board’s Guidelines for the “Use of Controlled Substances for the Treatment of

Pain: Ten Steps.” Board referred to the Pain Committee for review.

6. Opioid Overdose Surveillance, Department of Public Health, Georgia 2016 (Preliminary

Report) – Discussed Georgia Statewide Strategic Planning Meeting to Address Opioid

Epidemic December 18 – 19, 2017. For information only.

7. Federation of State Medical Boards - Discussion – First Call for Resolutions. For

information only.

8. Federation State Medical Boards Workshop on Physicians Wellness and Burnout. For

information only.

9. Guidelines for the Structure and Function of a State Medical and Osteopathic Board. For

information only.

10. Article “LEGAL: State by State Analysis of Cooperate Practice of Medicine and

Physician Employment.” For information only.

11. Letter from State Pharmacy Associations regarding Compounded and Repackaged

Medications for Office Use. For information only.

12. Guideline for Prescribing Opioids for Chronic Pain. For information only.

13. Report on THC Registry – Draft letter to Dr. Raduka. For information only.

Dr. Downey motioned to go into closed session to discuss investigative matters. Dr. Robinson

seconded the motion and it carried unanimously. Dr. DeLoach recused.

Dr. Marshall, Vice Chair, declared open session.

APPEARANCE BEFORE THE BOARD - Dr. DeLoach recused.

Robert Miles, M.D. requested an appearance before the Board appealing the denial of his

application for licensure. Dr. Miles was accompanied by his attorney Melvin M. Goldstein; Dr.

Marshall asked for explanations regarding the discrepancies in his licensure application. Mr.

Goldstein gave arguments concerning the application discrepancies. Dr. Miles gave explanations

addressing the Boards concerns. The Board members asked questions.

Dr. Gross motioned to go into closed session. Dr. Weil seconded the motion and it carried

unanimously.

Dr. Marshall declared open session. Dr. DeLoach declared the meeting back in session.

Dr. Weil submitted a motion to approve the license for Dr. Miles. Dr. Downey seconded the

motion and it carried unanimously.

Dr. DeLoach declared the meeting in recess for the purpose of holding committee meetings.

Dr. DeLoach reconvened the meeting at 1:30 p.m.

NURSE PROTOCOL COMMITTEE

Dr. Callins presented the Nurse Protocol Committee report as a motion. Dr. seconded the

motion. The Board accepted the report by unanimous vote.


Other Business:

1. Introduced new APRN staff members.

2. Staff request – policy regarding administrative approval.

Approved the Committee recommendation that staff be allow administrative approval

rights once they have been sufficiently trained.

3. Updated proposal for updated checklist.

The staff will add the additional information to the application instead of the checklist.

4. Telemedicine discussion and proposal to add telemedicine to application. Approved request.

Committee will prepare a draft for review at the next meeting.

5. Discussed whether an APRN with pediatric certification can see patients other than

pediatric patients. Board approved Committee recommendation restriction of approval

for protocols with this certification to pediatrics only.

6. Reviewed Updated basic guidelines.

Board will continue to work on these guidelines.
