November 4-5, 2010 The Georgia Composite Medical Board (GCMB) held its regular meeting on November 4-5, Peachtree Street, NW, 36th Floor, Atlanta, GA 30303, to consider Medical Board matters. Board members in attendance on Thursday November 4, 2010, were:

Dr. Gross called the meeting to order at 8:00 a.m. AGENDA Dr. Butler moved to approve the agenda of the November 4-5, 2010, GCMB meeting. Dr. Sumner seconded, and it carried unanimously. MINUTES Dr. Cheeks moved to approve the minutes of the October 7-8, 2010, GCMB meeting. Dr. Summers moved to go into Closed Session. Dr. Retterbush seconded the motion and it carried. Dr. Gross declared Open Session.


November 4-5, 2010 EXECUTIVE DIRECTOR’S REPORT LaSharn Hughes, Executive Director, presented the following to the Board: 1. Reviewed the survey results from the Board members. For information only. 2. Informed the Board that we now have WIFI login information. For information only. 3. Nancy Teele resigned effective 10/29 she is now with Office of Professional

Standards. We are not filling the position. 4. Reviewed a letter from the Department of Audit regarding the Boards Budget. The

Department of Audit will conduct the audit. For information only. 5. Reviewed the Rules Status Report. For information only. 6. Board members presented “Professionalism Questions” and their answers to each

question. 7. Regarding a question concerning medical marijuana. The board members asked

questions. Janet Wray presented an article for the board published by the National Association of the Board of Pharmacy monitoring the issue of medical marijuana and the Iowa Board of Pharmacy. The Board advised we are waiting for funding.

8. Reviewed a letter from Rajesh Patel, M.D. Dr. Patel was present. Tabled for further

information. 9. Regarding a letter from Donna Knight concerning nonlicensed person calling himself

a specialist in allergy treatment. Refer to Investigative Committee. 10. A letter from the Georgia State Board of Hearing Aid Dealers and Dispensers

concerning M.M.G., MD and his programming a digital hearing aid. Refer to Investigative Committee.

11. Regarding a survey question from St. Louis Post-Dispatch. For information only. 12. Jerry S. Chase, MD requested information concerning how long he has to keep

medical records of forms, lab and immunizations. Board advised ten years. 13. James Moss, JD, asked if this is a conflict with our law, regarding the publication of

the “Wilderness Medicine Society” recommendations on the use of Epinephrine in outdoor education and wilderness settings. Send a copy of Laws and Rules.

14. Sam Johnson, MD, North East Georgia Medical Center requested guidance on the

propriety of allowing an out of state student to be allowed to do a rotation in their

hospital with their particular out of state school agreeing to enter into an Educational Affiliation Agreement for that purpose. The Board places the authority on the school.

15. Regarding the Federation of State Medical Boards call for resolutions. For

information only. 16. Regarding a letter forwarded from the Federation of State Medical Boards concerning

some questions about the book, Responsible Opioid Prescribing: A Physician’s Guide. For information only.

17. Kelly Alfred requested comments on “Reporting of Withdrawals of License

Applications to the Federation of State Medical Boards”. Board will not report withdrawal of license applications.

18. Reviewed the final report by Renee Starzyk on Dr. Rangaraj. For information only. 19. Regarding an article “Maryland Court Upholds State Cap on Noneconomic

Damages.” For information only. 20. Regarding an article entitled “Training is Vital for Those Performing Cosmetic Laser

Treatment”. For information only. 21. Regarding an article “Food, Drug, and Device Developments”. For information only. 22. Bob Peterson requested an opinion concerning a UV purifier. Table for more

information. 23. Reviewed the “Newsline” from the Federation of State Medical Boards. For

information only. Dr. Summers moved to go into closed session. Dr. Retterbush seconded the motion and it

carried. Dr. Gross declared Open Session. LAW ENFORCEMENT ACTION REPORT Jeff Lane, Director of Investigations, presented the following for the Board. Dr. White moved to go into Closed Session to discuss investigative/disciplinary matters. Dr. Gross seconded and it carried unanimously. After the Board’s deliberation, Dr. Perry declared Open Session.
