MAY 5-6, 2011 The Georgia Composite Medical Board (GCMB) held its regular meeting on May 5-6, 2011, Peachtree Street, NW, 36th Floor, Atlanta, GA 30303, to consider Medical Board matters. Board members in attendance on Thursday May 5, 2011, were:

Dr. Gross called the meeting to order at 8:00 a.m. AGENDA Dr. Weil moved to approve the agenda of the May 5-6, 2011 GCMB meeting. Ms. Kunes seconded, and it carried unanimously. MINUTES Dr. Cheeks moved to approve the minutes of the April 1, 2011, GCMB meeting. EXECUTIVE DIRECTOR’S REPORT LaSharn Hughes, Executive Director, presented the following to the Board:


MAY 5-6, 2011 1. Lee Baker, M.D an internal medicine physician wants to know if she can refill

pediatric medications when on call or the only physician in the office for the day. The Board advised it is fine to refill pediatric medications but she might want to check with her malpractice carrier..

2. Laural Collins asked who is authorized in Georgia to assess a patient and give them

medication. Is it unlawful for a research study coordinator with no medical license to perform a physical examination, assess a medical condition and dispense medication? This is a violation of Georgia law.

3. David E. Clark Attorney asked why is recruitment for physician review board

members being done now? Board advised this is pursuant to the law. 4. Review of newsletter topics. For information only. 5. Report on “Epidemic: Responding to America’s Prescription Drug Abuse Crisis.” For

information only. 6. Regarding an article entitled “Rx” Big Brother – look at the neckties.” For

information only. 7. Reviewed an article entitled “The Rise of Desktop Medicine.” For information only. 8. Reviewed and article entitled “In Practice: Doctors could learn something about

medical handoff from the Navy.” For information only, 9. Article concerning “Administration wants Tighter Painkiller Rules.” For information

only. 10. Georgia Board of Physician Workforce Fact Sheet on “Georgia’s Trauma

Physicians.” For information only. 11. John E. Wyand asked questions regarding rule 360-3-.02(6) telemedicine. Would the

APRN’s history and physical examination satisfy the requirement of the Rule. The Board advised yes.

12. Andrew Baumann had questions regarding the FDA’s possible requirement for

physician training on Opioid prescribing, appropriate pain management, patient selection and other requirement to help reduce misuse and inappropriate prescribing of Opioid medications. The Board tabled for review at a later date.

Dr. Lee gave the Board a report of a session he attended at the Federation of State Medical Boards concerning continuing education for physicians that prescribe Opioid. The Board members asked questions.


MAY 5-6, 2011 Dr. Summers moved to go into Closed Session. Dr. White seconded the motion and it carried. 13. 10110006 – Require the monitoring physician to have an agreement with contractual

agreement. Refer to AG to open case 14. Ashi Mehrotra sent an email regarding requirements for foreign medical students.

Board referred this question to the Physician Licensing Committee. Dr. Sumner moved to go into Executive Session to conduct Investigative Interviews, Dr. Butler seconded the motion and it carried unanimously. Dr. Gross then declared the meeting would be open session upon completion of the investigative interviews for the purpose of holding committee meetings. 1. On May 5, 2011 the Board interviewed Kylie Hodge and Jerry Ethridge at the Board’s office for vacant seats on the RCP Advisory Committee, and approved seating both of them as members of the Committee.

2. Reviewed an inquiry from WellCare regarding activities involved with setting up

sleep apnea monitors for home care, and opined that activities described did not require licensure as a Respiratory Care professional.

3. Reviewed a question of whether or not licensed practical nurses taking and passing the RRT examination could be licensed as a Respiratory Care Professional in Georgia, and concluded that such individuals would not be eligible for licensure unless they met the educational requirements, as well as all other licensure requirements.
