Definition

• The first ten amendments to the US Constitution. It was created to list the rights that certain Framers believed were necessary.

Goals

• Students will create a GO on the Bill of Rights and take a test to show their knowledge of them on Friday.

First Amendment

• Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

What does it mean?• Congress cannot make an “official”

religion.• The government cannot keep you from

practicing your religion. (except in certain cases)

• The government cannot interfere with your freedom of speech or the press to print articles that are against the government.

• Nor stop people from peaceably getting together to protest or bring their complaints to the government.

Second Amendment

• A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

• The government cannot take away the peoples right to own guns to help protect the country or themselves from their own government.

What does it mean?

Third Amendment

• No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law.

• The government cannot force you to keeps troops in your home except in times of “declared” war and when Congress has passed a law that says the government can use your property.

What does it mean?

Fourth Amendment

• The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

• There can be no unlawful search and seizures. The government must have a search warrant to search your house or property and be specific about where and what they are searching for.

• Someone must give reason for a search warrant.

What does it mean?

Fifth Amendment• No person shall be held to answer for a

capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

• You cannot be held for a serious crime without being brought to the Grand Jury and giving proof of you committing a crime. Unless in time of war and you are in the military.

• You cannot be put on trial twice for the same offence.

• You cannot be forced to testify against your self.

• Nor have your life, liberty, or property taken away without due process.

• If the government does take away your property they must pay a fair market price.

What does it mean?

Sixth Amendment

• In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.

• The right to a speedy and fair trail in the area where the crime was committed.

• The right to be told what you are accused of.

• To examine the witnesses against you.• To be able to get your own witnesses

even if you have to force them to show up.

• The right to have a lawyer.

What does it mean?

Seventh Amendment

• In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law.

• The right to have a trial by jury.

• The only way to overturn a trial decision is through the courts.

What does it mean?

Eighth Amendment

• Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.

• No excessive bail. (bail cannot be set beyond your ability to raise the money)

• The fines but forth by the court cannot be beyond reason.

• No cruel or unusual punishment.

What does it mean?

Ninth Amendment

• The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

•The people have other rights than they ones listed in the Constitution and the Bill of Rights.

What does it mean?

Tenth Amendment

• The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

•All powers not granted to the government in the Constitution belong to the states.
