> The Operator will, at its own cost and risk, design, construct, operate, repair and maintain each Facility so that it can provide the Services to at least the Quality Standards;

> Unless the Council expressly agrees to bear any risk … without limitation the Operator will accept the risk, whether or not this agreement refers to the risk;
