City of TehachapiGreg GarrettTehachapi City Manager Irsquom very proud of the fact that the ldquoTehachapi modelrdquo continues to be something that is being emulated across Kern County What I am referring to is the way we do business how we manage our assets infrastructure staff and our public and private investments On more than one occasion wersquove had larger neighboring government entities take a page out of our communications book and create programs and positions to emulate how we disseminate information about our City Wersquove sat in presentations where larger communities talk about the need to change their zoning codes to meet the demands of todayrsquos residential customers all the while know-ing these were things the City of Tehachapi has had in place for nearly a decadeOur staff continues to set the bar extremely high in all departments and it isnrsquot rare to receive calls about the way we do business from surrounding communities large and small Our ability to attract talented staff that delivers successful projects initiatives and results on a regular basis separates us from many of our neighbors Just in the last few months wersquove delivered public projects like the Park and Ride Transit Center and helped private investors like Walmart Kern Schools Federal Credit Union and small businesses such as Westlane Brewing Te-hachapi Academy of Dramatic Arts and Luckyrsquos Barbershop find new homes We recently were able come to a responsible agreement with the Tehachapi Police Officerrsquos Association one that addresses the issues of recruitment and retention wersquore hearing about county-wide As part of that agreement we eliminated 10 steps on the officer and senior officer pay scales to bring starting salaries up According to a recent salary survey we now rank 4th among nearby agencies for new officers we believe this will allow us to recruit qualified officers and keep them with the Tehachapi Police Department This agreement also allows for a respon-sible approach to growth within the department as warranted by the growth in our City We need our police department to be the best around as they protect citizens as well as business invest-ments in our cityOur partnership with the Chamber of Commerce and other business-related entities in Tehachapi and the surrounding area help coordinate efforts to attract businesses of all sizes Our model of government partnership and collaboration are a source of pride here in the City of TehachapiI am very proud of the lsquoTehachapi modelrsquo as I hope you are too We look forward to continuing our success together

Can Part-Time Employees Be ExemptJune 20 2019 - CalChamber HRWatchDog
Can I classify an employee who works only part-time as exemptAn employeersquos exempt classification must be evaluated by the employeersquos rate of pay and the duties heshe performs not necessarily by the number of hours workedAn employee who meets the salary test requirements and is primarily engaged in exempt duties may be properly classified as exemptSalary Test RequirementsUnder California Labor Code Section 515 most ldquowhite collarrdquo exempt employees must ldquoearn a monthly salary equivalent to no less than two times the state minimum wage for full-time employmentrdquoFor purposes of the minimum exempt salary level only the code states that full-time employment is 40 hours per week (Note that employers are free to set their own definition of full-time work for other purposes such as entitlement to vacation accrual and holiday pay)Based on the current two-tier California minimum wage for businesses with 25 or fewer employees the annual exempt salary minimum is $45760 ($381333 per month) and for larger employers the minimum is $49920 ($4160 per month)Labor Code Section 515 does not require that an employee work full-time hours in order to be exempt However regardless of the number of hours actually worked the salary minimum stays the same and may not be prorated for work that is less than 40 hours per weekA full-time exempt employee earning $50000 per year who cuts back to 20 hours per week and has hisher salary prorated to $25000 would not meet the minimum salary test and thus could not remain exemptThere are a few exceptions to this minimum salary requirement for outside sales computer professionals and certain doctorsDuties Test RequirementsRegardless of whether an employee works full-time or part-time the employee must be ldquoprimarily engagedrdquo in exempt duties meaning heshe must spend more than 50 percent of hisher time engaged in those dutiesAs an example a licensed architect who wants to work only part-time hours can be classified as exempt as long as heshe primarily engages in architectural work and receives at least the full minimum required salaryOn the other hand an exempt manager cutting back to part-time may not end up ldquoprimarily engagedrdquo in managerial duties in the part-time role because someone else in the company may need to take over more day-to-day management of workers This would mean the manager may no longer meet the managerial duties test and therefore might not remain exempt
