SCHEDULE

Definitions

1. Inthisnotice,awordorexpressiontowhichameaninghasbeenassignedintheActhasthatmeaning,andunlessthecontextotherwiseindicates-

“alienspecies”means-

(a) anon-indigenousplant,animalormicroorganism;or

(b) anindigenousplant,animalormicroorganism,translocatedorintendedtobetranslocatedtoaplaceoutsideitsnaturalrangeofnature,

thatdoesnotnormallyinterbreedwithindividualsofanotherkind,includinganysubspeciescultivar,variety,geographicrace,strain,hybridorgeographicallyseparatepopulation;

“AquacultureAct,2002”meanstheAquacultureAct,2002(ActNo.18of2002);

“AtmosphericPollutionPreventionOrdinance,1976”meanstheAtmosphericPollutionPreventionOrdinance,1976(OrdinanceNo.11of1976);

“aquaculture”meansthefarmingandranchingofaquaticanimals;

“canal”meansanopenstructurethatislinedorreinforcedfortheconveyingofaliquidorthatservesasanartificialwatercourse;

“channel”meansanexcavatedhollowbedforrunningwateroranartificialunderwaterdepressiontomakeawaterbodynavigableortoimprovetheflowofwaterinanaturalstream,riverorthesea;

“construction”meansthebuilding,erectionormodificationofafacility,structureorinfrastructurethatisnecessaryfortheundertakingofanactivity,includingthemodification,alteration,upgradingordecommissioningofsuchfacility,structureorinfrastructure;

“dangerousgoods”meansgoodswhichbyreasonoftheirnature,quantityormodeofstowage,arelikelytoendangertheenvironmentorthelivesorthehealthofpersons,andwhicharelistedin-

(a) Part4oftheRoadTrafficandTransportRegulationspublishedinGovernmentNoticeNo.53of30March2001;or

(b) anyotherlawasdangerousgoods;

“generation” in relation to electricity, means the production of electricity by way of natural orartificialprocesses;

“geneticallymodifiedorganisms”meansanorganismthatpossessesanovelcombinationofgeneticmaterialobtainedthroughtheuseofmodernbiotechnology,andincludescombinationsofgeneticallymodifiedorganisms;

“Hazardous Substances Ordinance, 1974” means the Hazardous Substance Ordinance, 1974(OrdinanceNo.14of1974);

“high-watermark”meansthehighestlinereachedbytheseaduringordinarystormsoccurringduringthemoststormyperiodoftheyear,excludingexceptionalorabnormalfloods;

“mariculture”meansthecultureorhusbandryoffishinseawater;

“Minerals(ProspectingandMining)Act,1992”meanstheMinerals(ProspectingandMining)Act,1992(ActNo.33of1992);

“publicroad”meansanyroad,streetorthoroughfareoranyotherplacewhichiscommonlyusedbythepublicoranysectionthereofortowhichthepublicoranysectionthereofhasarightofaccessandincludes-

(a) thevergeofanysuchroad,streetorthoroughfare;

(b) any bridge, culvert, causeway, ferry, ford or drift traversed by any such road, street orthoroughfare;

(c) anyotherworkorobjectformingpartoforconnectedwithorbelongingtosuchroad,streetorthoroughfare;

“sea”meansthewaterandthebedoftheseaandincludesthelandbetweenthehigh-waterandlow-watermarks;

“supply”,inrelationtoelectricity,meansthedeliveryofelectricitytoacustomerasacommodity;

“theAct”meanstheEnvironmentalManagementAct,2007(ActNo.7of2007).

“transmission”, in relation to electricity, means the conveyance of electricity by means of atransmissionsystem,whichconsistswhollyormainlyofhighvoltagenetworksandelectricalplant,fromanenergysourceorsystemtoacustomer;

Identification of competent authority

2. Ifnopersonorauthorityisintermsofanylawchargedwiththeresponsibilityofgrantingauthorisation in respectofanactivity listed in thisnotice, theMinister is thecompetentauthorityinrespectoftheactivity,unlessotherwisedeterminedintermsofsection30(3)oftheAct.

ENERGY GENERATION, TRANSMISSION AND STORAGE ACTIVITIES

1. Theconstructionoffacilitiesfor-

(a) thegenerationofelectricity; (b) thetransmissionandsupplyofelectricity; (c) refiningofgas,oilandpetroleumproducts;and (d) nuclear reaction, including production, enrichments, processing, reprocessing,

storageordisposalofnuclearfuels,radioactiveproductsandwaste.

3.1 Theconstructionoffacilitiesforanyprocessoractivitieswhichrequiresalicence,rightorotherformofauthorisation,andtherenewalofalicence,rightorotherformofauthorisation,intermsoftheMinerals(ProspectingandMiningAct),1992.

3.2 Otherformsofminingorextractionofanynaturalresourceswhetherregulatedbylawornot.

3.3 Resourceextraction,manipulation,conservationandrelatedactivities.

3.4 Theextractionorprocessingofgasfromnaturalandnon-naturalresources,includinggasfromlandfillsites.

3.5 Theextractionofpeat.

FORESTRY ACTIVITIES

4. The clearance of forest areas, deforestation, aforestation, timber harvesting or any otherrelatedactivitythatrequiresauthorisationintermoftheForestAct,2001(ActNo.12of2001)oranyotherlaw.

Definitions

1. IntheseregulationsawordorexpressiontowhichameaninghasbeenassignedintheActhasthatmeaning,andunlessthecontextindicatesotherwise-

“alternatives”, in relation to a proposed activity, means different means of meeting the generalpurposeandrequirementsoftheactivity,whichmayincludealternativesto-

(a) thepropertyonwhichorlocationwhereitisproposedtoundertaketheactivity;

(b) thetypeofactivitytobeundertaken;

(c) thedesignorlayoutoftheactivity;

(d) thetechnologytobeusedintheactivity;and

(e) theoperationalaspectsoftheactivity;

“application” means an application for an environmental clearance certificate in terms of theseregulations;

“assessmentregister”meansanassessmentregisterreferredtoinregulation27;

“cumulativeeffect”,inrelationtoanactivity,meanstheeffectofanactivitythatinitselfmaynotbesignificantbutmaybecomesignificantwhenaddedtotheexistingandpotentialeffectseventuatingfromsimilarordiverseactivitiesorundertakingsinthearea.,

“environmentalassessmentpractitioner”meansapersondesignatedbyaproponenttomanagetheassessmentprocess;

“managementplan”meansaplanthatdescribeshowactivitiesthatmayhavesignificantenvironmentseffectsontheenvironmentaretobemitigated,controlledandmonitored;

“interestedandaffectedparty”,inrelationtotheassessmentofalistedactivityincludes-

(a) anyperson,groupofpersonsororganisationinterestedinoraffectedbyanactivity;and

(b) anyorganofstatethatmayhavejurisdictionoveranyaspectoftheactivity;

“public consultation process” means a process referred to in regulation 21, in which potentialinterestedandaffectedpartiesaregivenanopportunitytocommenton,orraiseissuesrelevantto,specificmatters;

“scopingreport”meansadocumentpreparedbytheproponenttopresentthecasefortheassessmentofanactivityaspartoftheinitialassessmentprocess;

“termsofreference”meansadocumentwhichformspartofascopingreportandsetsouthowanassessmentmustbecarriedout.,

“theAct”meanstheEnvironmentalManagementAct,2007(ActNo.7of2007).

Application of regulations

2. (1) These regulationsapplytoactivitieslistedinGovernmentNoticeNo.30of6February2012.

(2) Theactivitiesreferredtoinsubregulation(1),areactivitiesthatmaynotbeundertakenwithoutanenvironmentalclearancecertificate.

Duties of proponents

3. Theproponentmust-

(a) designateanenvironmentalassessmentpractitioner(hereinafterreferredtoasEAP”)tomanagetheassessmentprocess;

(b) providetheEAPwithaccesstoinformationatthedisposaloftheproponentregardingtheapplication,whetherornottheinformationisfavourabletotheproponent;and

(c) ensure that the environmental assessment procedures, specified in theAct, theseregulationsandguidelines,fortheproposedactivityarefollowed.

General requirements for EAPs

4. AnEAPdesignatedintermsofregulation3,must-

(a) haveknowledgeofandexperienceinconductingassessments,includingknowledgeof theAct, these regulations and guidelines that have relevance to the proposedactivity;

(b) perform thework relating to the application in anobjectivemanner, even if thisresultsinviewsandfindingsthatarenotfavourabletotheapplicant;

(c) complywiththeAct,theseregulations,guidelinesandotherapplicablelawsand

(d) disclosetotheproponent,competentauthorityandtheEnvironmentalCommissionerallmaterial informationin thepossessionof theEAPthatreasonablyhasormayhavethepotentialofinfluencing-

(i) anydecisiontobetakenwithrespecttotheapplicationintermsoftheActandtheseregulations;or

(ii) theobjectivityofanyreport,planordocumenttobepreparedbytheEAPintermsoftheActandtheseregulations.

Determining if proposed activity is a listed activity

5. (1) Beforesubmittinganapplicationforanenvironmentalclearancecertificatetheproponentmustdeterminethattheactivityforwhichtheapplicationismadeisalistedactivity.

(2) Forthepurposesofsubregulation(1),theproponentmayconsulttheEnvironmentalCommissioner,thecompetentauthorityandguidelines,ifany.

(3) If the proponent has in terms of subregulation (1) determined that the proposedactivityisalistedactivity,theproponentmustapplyforanenvironmentalclearancecertificateinaccordancewithregulation6.

Application for environmental clearance certificate

6. (1) Theapplicationforanenvironmentalclearancecertificatemustbe-

(a) madeonaformwhichcorrespondssubstantiallywithForm1ofAnnexure1totheregulations,andobtainablefromtheMinistryandotherdesignatedoffices;and

(b) submittedtotherelevantcompetentauthority.

(2) If theMinister is in termsofsection30(1)of theAct identifiedas thecompetentauthority in respect of a listed activity the applicationmust be submitted to the EnvironmentalCommissioner.

(3) Ifanyotherorganofstateisintermsofsection30(1)oftheActidentifiedasthecompetentauthorityinrespectofalistedactivitytheapplicationmustbesubmittedtothedesignatedorganofstate.

(4) IftheMinisterhasintermsofsection30(3)oftheActmadeanagreementwithanorganofstateinrespectofapplicationsforenvironmentalclearancecertificates,theapplicationmustbesubmittedtothatorganofstate.

Process after submission of application

7. (1) Aftersubmittingtheapplicationtothecompetentauthoritytheproponentmust-

(a) conductapublicconsultationprocessinaccordancewithregulation21;

(b) openandmaintainaregisterofallinterestedandaffectedpartiesinrespectoftheapplicationinaccordancewithregulation22;

(c) consider all objections and representations received from interested and affectedpartiesfollowingthepublicconsultationprocessconductedintermsofparagraph(a),andsubjecttheproposedapplicationtoscopingbyassessing-

(i) thepotentialeffectsoftheproposedlistedactivityontheenvironment;

(ii) whetherandtowhatextentthepotentialeffectsreferredtoinsubparagraph(i)canbemitigated;and

(iii) whether there are any significant issues and effects that require furtherinvestigation;

(d) prepareascopingreport;and

(e) giveallregisteredinterestedandaffectedpartiesanopportunitytocommentonthescopingreportinaccordancewithregulation23.

(2) Afterthecompletionoftheprocessesreferredtoinsubregulation(1),theproponentmustsubmittotherelevantcompetentauthority-

(a) thescopingreport;

(e) anyresponsesbytheEAPtothoserepresentations,objections,commentsandviews.

Scoping report

8. Ascopingreportmustinclude-

(a) thecurriculumvitaeoftheEAPwhopreparedthereport;

(b) adescriptionoftheproposedactivity;

(c) adescriptionofthesiteonwhichtheactivityistobeundertakenandthelocationoftheactivityonthesite;

(d) adescriptionoftheenvironmentthatmaybeaffectedbytheproposedactivityandthemanner inwhich thegeographical,physical,biological, social,economicandculturalaspectsoftheenvironmentmaybeaffectedbytheproposedlistedactivity;

(e) anidentificationoflawsandguidelinesthathavebeenconsideredinthepreparationofthescopingreport;

(f) detailsofthepublicconsultationprocessconductedintermsofregulation7(1)inconnectionwiththeapplication,including-

(i) thestepsthatweretakentonotifypotentiallyinterestedandaffectedpartiesoftheproposedapplication;

(ii) proof thatnoticeboards,advertisementsandnoticesnotifyingpotentiallyinterested and affected parties of the proposed application have beendisplayed,placedorgiven;

(iii) alistofallpersons,organisationsandorgansofstatethatwereregisteredintermsofregulation22asinterestedandaffectedpartiesinrelationtotheapplication;and

(iv) asummaryoftheissuesraisedbyinterestedandaffectedparties,thedateofreceiptofandtheresponseoftheEAPtothoseissues;

(g) adescriptionof theneed anddesirabilityof theproposed listed activity and anyidentified alternatives to the proposed activity that are feasible and reasonable,includingtheadvantagesanddisadvantagesthattheproposedactivityoralternativeshaveontheenvironmentandonthecommunitythatmaybeaffectedbytheactivity;

(h) adescriptionandassessmentofthesignificanceofanysignificanteffects,includingcumulativeeffects,thatmayoccurasaresultoftheundertakingoftheactivityoridentifiedalternativesorasaresultofanyconstruction,erectionordecommissioningassociatedwiththeundertakingoftheproposedlistedactivity;

(aa) informationonanyproposedmanagement,mitigation,protectionorremedialmeasures tobeundertakentoaddress theeffectson theenvironment thathavebeenidentifiedincludingobjectivesinrespectoftherehabilitationoftheenvironmentandclosure;

(bb) asfarasisreasonablypracticable,measurestorehabilitatetheenvironmentaffectedbytheundertakingoftheactivityorspecifiedactivitytoitsnaturalor predetermined state or to a land usewhich conforms to the generallyacceptedprincipleofsustainabledevelopment;and

(cc) adescriptionofthemannerinwhichtheapplicantintendstomodify,remedy,control or stop any action, activity or processwhich causes pollution orenvironmental degradation remedy the cause of pollution or degradationandmigrationofpollutants.

Terms of reference

9. Thetermsofreferenceforanassessmentmustsetouttheapproachthattheproponentintends tofollowinundertakinganassessment inaccordancewith theAct, theseregulationsandguidelinesandmustinclude-

(a) adescriptionofalltaskstobeundertakenaspartoftheassessmentprocess,includinganyspecialisttobeincludedifneeded;

(b) an indication of the stages at which the Environmental Commissioner is to beconsulted;

(c) a description of the proposedmethod of assessing the environmental issues andalternatives;and

(d) thenatureandextentofthepublicconsultationprocessestobeconductedduringtheassessmentprocess.

Competent authority’s responsibilities

10. On receiptofanapplication in termsof regulation6and thedocuments referredtoinregulation7(2),andif theapplicantmeetswiththerequirementsof thecompetentauthoritycontemplatedinsection32(1)oftheAct,thecompetentauthoritymustforwardtotheEnvironmentalCommissionertheapplicationfortheenvironmentalclearancecertificateaswellasthedocumentsreferredtoinregulation7(2).

Consultation between organs of state

11. Ifalistedactivityalsorequiresanassessmentintermsofanyotherlaworpolicyandthatotherlaworpolicyrequiresthatinformationmustbesubmittedorprocessesmustbecarriedoutthataresubstantiallysimilartoinformationorprocessesrequiredintermsoftheseregulations,theMinistermust take steps to enter into awritten agreementwith the authority responsible foradministeringthelaworpolicyinrespectoftheco-ordinationoftherequirementsofthelaw,policyandtheseregulationstoavoidduplicationinthesubmissionofsuchinformationorthecarryingoutofsuchprocesses.

Consideration of scoping report and determining the need for assessment

12. (1) OnreceiptofanapplicationtheEnvironmentalCommissionermust-

(a) withinthreedaysacknowledgereceiptoftheapplication;and

(b) registertheapplicationintheassessmentregister;

(c) within14daysofreceiptofapplicationconsiderthescopingreportand

(i) acceptthescopingreport;or

(ii) rejectthescopingreportifitdoesnotcomplywiththeAct,theseregulationsandguidelines,ifany;and

(d) intermsofsection33(1)oftheActandwithin14daysofreceiptofanapplicationdecideiftheproposedactivityrequiresadetailedassessment.

(2) Ascopingreportthathasbeenrejectedintermsofsubregulation(1)(c)(ii)maybeamendedandberesubmittedbytheproponent.

(3) On receipt of an amended scoping report in terms of subregulation (2) theEnvironmentalCommissionermustreconsiderthereportintermsubregulation1(c).

(4) IftheEnvironmentalCommissionerdecidesintermsofsection33(l)-

(a) thattheproposedactivityrequiresadetailedassessmenttheapplicationmustproceedinaccordancewithregulations14,15,16,17and18;and

(b) thattheproposedactivitydoesnotrequireadetailedassessmenttheapplicationmustproceedinaccordancewithregulation13.

Procedure where assessment is not required

13. If the Environmental Commissioner decides in terms of section 33(1) that theproposed listedactivitydoesnot requireadetailedassessment, theEnvironmentalCommissionermustwithinsevendaysofmakingthedecision-

(a) inwritingnotifyproponentandthecompetentauthorityofthedecision;and

(b) onpaymentofthefeeprescribedinAnnexure2totheregulations,andsubjecttoconditions,ifany,issuetheenvironmentalclearancecertificate.

Deciding on the scope of assessment

14. IftheEnvironmentalCommissionerintermsofsection33(1)oftheActdecidesthattheproposedactivityrequiresanassessment,theEnvironmentalCommissionermustdeterminethescope,proceduresandmethodsforassessmentintermsofsection35(l)oftheAct,and-

(a) inwritingnotifytheproponenttoprepareanassessmentreportinaccordancewiththescope,procedureandmethodsdetermined;and

(b) inwritingnotifythecompetentauthority.

Assessment report

15. (1) TheproponentmustinstructtheEAPtoprepareanassessmentreportwithin21daysofreceiptofanotificationintermsofregulation14.

(2) An assessment report must contain all information that is necessary for theEnvironmental Commissioner to consider and to make a decision on the application, and mustinclude-

(a) thecurriculumvitaeoftheEAPwhocompiledthereport;

(b) adetaileddescriptionoftheproposedlistedactivity;

(c) adescriptionoftheenvironmentthatmaybeaffectedbytheactivityandthemannerin which the physical, biological, social, economic and cultural aspects of theenvironmentmaybeaffectedbytheproposedactivity;

(d) adescriptionoftheneedanddesirabilityoftheproposedlistedactivityandidentifiedpotential alternatives to the proposed listed activity, including advantages anddisadvantagesthattheproposedactivityoralternativesmayhaveontheenvironmentandthecommunitythatmaybeaffectedbytheactivity;

(e) anindicationofthemethodologyusedindeterminingthesignificanceofpotentialeffects;

(f) adescriptionandcomparativeassessmentofall alternatives identifiedduring theassessmentprocess;

(g) adescriptionofallenvironmentalissuesthatwereidentifiedduringtheassessmentprocess, an assessmentof the significanceof each issue and an indicationof theextenttowhichtheissuecouldbeaddressedbytheadoptionofmitigationmeasures;

(h) anassessmentofeachidentifiedpotentiallysignificanteffect,including-

(aa) cumulativeeffects;

(bb) thenatureoftheeffects;

(cc) theextentanddurationoftheeffects;

(dd) theprobabilityoftheeffectsoccurring;

(ee) thedegreetowhichtheeffectscanbereversed;

(ff) thedegreetowhichtheeffectsmaycauseirreplaceablelossofresources;and

(gg) thedegreetowhichtheeffectscanbemitigated;

(i) adescriptionofanyassumptions,uncertaintiesandgapsinknowledge;

(j) anopinionastowhethertheproposedlistedactivitymustormaynotbeauthorised,andiftheopinionisthatitmustbeauthorised,anyconditionsthatmustbemadeinrespectofthatauthorisation;and

(k) anon-technicalsummaryoftheinformation.

(3) OnthecompletionoftheassessmentreporttheproponentmustsubmitthereporttotheEnvironmentalCommissioner.

Notification of the application and assessment report

16. (1) On receipt of the assessment report in terms of regulation 15, theEnvironmentalCommissionermust-

(a) withinthreedaysacknowledgereceiptofthereport;

(b) ifthereportcomplieswiththeActandtheseregulations,intermsofsection35(6)proceedwiththenotificationoftheapplicationandassessmentreport,inaccordancewithregulation21;

(c) ifthereportdoesnotcomplywiththeActandtheseregulations,requesttheapplicanttomakesuchamendmentstothereportastheEnvironmentalCommissionermayrequireforacceptanceoftheassessmentreport;or

(d) rejectthereportifitdoesnotcomplywiththeActandtheseregulationsinamaterialrespect.

(2) An assessment report that is rejected in terms of subregulation (1)(d) may beamendedandresubmitted.

(3) On receipt of the amended assessment report in terms of subregulation (2) theEnvironmentalCommissionermustreconsiderthereportintermsofsubregulation(1).

Notification of public hearing in terms of section 36(2) of the Act

17. Thenotificationofapublichearingintermsofsection36(2)oftheActmustbedoneinaccordancewithregulation21.

Environmental Commissioner’s decision

18. TheEnvironmentalCommissionermustwithinsevendaysfromthedateofreviewingtheapplicationintermsofsection36oftheAct-

(a) inwritingnotifytheproponentandthecompetentauthorityofthedecisionontheapplication;and

(b) onpaymentofthefeeprescribedinAnnexure2totheregulations,andsubjecttoconditions,ifany,issuetheenvironmentalclearancecertificate.

Amendment of environmental clearance certificate under section 39 of Act

19. (1) The request for an amendmentof the environmental clearance certificateundersection39(1)(a)oftheAct,mustbe-

(a) madeonaformwhichcorrespondssubstantiallywithForm2ofAnnexure1totheregulations,andobtainablefromtheMinistryandotherdesignatedoffices;

(b) accompaniedbythefeeprescribedinAnnexure2totheregulations;and

(c) submittedtotheEnvironmentalCommissioner.

(2) On receipt of an application in terms of subregulation (1), the EnvironmentalCommissionermust-

(a) withinthreedaysacknowledgereceiptoftheapplication;

(b) makeadecisionontheapplicationintermsofsection39oftheAct;and

(c) notifythecompetentauthorityoftheapplication.

(3) IftheEnvironmentalCommissionerintendstoamendanenvironmentalclearancecertificateathisorherinitiativeundersection39(1)(b),theEnvironmentalCommissionermust-

(a) notifytheholderofthecertificateinwritingoftheproposedamendment;and

(b) givetheholderanopportunitytosubmitrepresentationsontheproposedamendment,inwriting.

(4) TheEnvironmentalmustgivethedecisionundersection39oftheActinwritingtotheholderoftheenvironmentalclearancecertificateandthecompetentauthority.

Transfer of environmental clearance certificate under section 41 of Act

20. (1) Anapplicationforthetransferofanenvironmentalclearancecertificateintermsofsection41oftheActmustbe-

(a) madeinwriting;

(b) accompaniedbythefeeprescribedinAnnexure2totheregulations;

(c) accompaniedbytherelevantdocuments;and

(d) submittedtotheEnvironmentalCommissioner.

(2) TheEnvironmentalCommissionermust-

(a) within three days acknowledge receipt of the application for the transfer of anenvironmentalclearancecertificate;and

(b) notifythecompetentauthorityoftheapplicationforthetransferofanenvironmentalclearancecertificate.

(3) TheEnvironmentalCommissionermustgivehisorherdecisionintermsofsection41oftheAct-

(a) onlyafterhavingconsultedthecompetentauthority;and

(b) inwritingtotheholderoftheenvironmentalclearancecertificateandthecompetentauthority.

Public consultation process

21. (1) Thisregulationonlyapplieswherespecificallyrequiredbyaprovisionoftheseregulations.

(2) Thepersonconductingapublicconsultationprocessmustgivenoticetoallpotentialinterestedandaffectedpartiesoftheapplicationwhichissubjectedtopublicconsultationby-

(i) theownersandoccupiersoflandadjacenttothesitewheretheactivityisoristobeundertakenortoanyalternativesite

(ii) thelocalauthoritycouncil,regionalcouncilandtraditionalauthority,asthecasemaybe,inwhichthesiteoralternativesiteissituated;

(iii) anyotherorganofstatehavingjurisdictioninrespectofanyaspectoftheactivity;and

(c) advertisingtheapplicationonceaweekfortwoconsecutiveweeksinatleasttwonewspaperscirculatedwidelyinNamibia.

(3) Anotice,noticeboardoradvertisementreferredtoinsubregulation(2)must-

(a) givedetailsoftheapplicationwhichissubjectedtopublicconsultation;and

(b) state-

(i) thattheapplicationistobesubmittedtotheEnvironmentalCommissionerintermsoftheseregulations;

(ii) thenatureandlocationoftheactivitytowhichtheapplicationrelates;

(iii) wherefurtherinformationontheapplicationoractivitycanheobtained:and

(c) the manner in which and the person to whom representations in respect of theapplicationmaybemade.

(4) Anoticeboardreferredtoinsubregulation(2)mustbeofasizeatleast60cmby42cm.

(5) Ifadeviationfromsubregulation(2)isappropriatethepersonconductingthepublicparticipationprocessmaydeviatefromtherequirementsofthatsubregulationtotheextendandinthemanneragreedbytheEnvironmentalCommissionerafterconsultationwiththecompetentauthority.

(6) Whencomplyingwiththisregulation,thepersonconductingthepublicconsultationprocessmustensurethat-

(a) information containing all relevant facts in respect of the application is madeavailabletopotentialinterestedandaffectedparties;and

(b) consultationbypotentialinterestedandaffectedpartiesisfacilitatedinsuchamannerthat all potential interested and affected parties are provided with a reasonableopportunitytocommentontheapplication.

(7) Thepublicconsultationprocess-

(a) inrespectofanapplicationforanenvironmentalclearancecertificate in termsofregulation6(1);and

mustbecompletedwithin21days.

Register of interested and affected parties

22. (1) An applicant responsible for an application must open and maintain aregisterwhichcontainsthenamesandaddressesof-

(a) allpersonswho,asaconsequenceofthepublicconsultationprocessconductedinrespectofthatapplication,havesubmittedwrittencommentsorattendedmeetingswiththeapplicant;

(b) all persons who, after completion of the public consultation process referred toin paragraph (a), have requested the applicant responsible for the application, inwriting,fortheirnamestobeplacedontheregister;and

(c) allorgansof statewhichhave jurisdiction in respectof theactivity towhich theapplicationrelates.

(2) Anapplicantresponsibleforanapplicationmustgiveaccesstotheregistertoanypersonwhosubmitsarequestforaccesstotheregisterinwriting.

Registered interested and affected parties

23. (1) Aregisteredinterestedoraffectedpartyisentitledtocommentinwriting,onallwrittensubmissionsmadetotheEnvironmentalCommissionerbytheapplicantresponsiblefortheapplication,andtobringtotheattentionoftheEnvironmentalCommissioneranyissueswhichthatparty,believesmaybeofsignificancetotheconsiderationoftheapplication,aslongas-

(a) commentsaresubmittedwithin7daysofnotificationofanapplicationorreceivingaccesstoascopingreportoranassessmentreport;or

(b) theinterestedandaffectedpartydisclosesanydirectbusiness,financial,personalorotherinterestwhichthatpartymayhaveintheapprovalorrefusaloftheapplication.

(2) BeforetheapplicantsubmitsareportcompiledintermsoftheseregulationstotheEnvironmental Commissioner, the applicant must give registered interested and affected partiesaccessto,andanopportunitytocommentinwritingonthereport.

(3) Reportsreferredtoinsubregulation(2)include-

(a) scopingreports;

(b) scopingreportsamendedandresubmitted;

(c) assessmentreports;and

(d) assessmentreportsamendedandresubmitted.

(4) Any written comments received by the applicant from a registered interestedor affected partymust accompany the reportwhen the report is submitted to theEnvironmentalCommissioner.

(5) Aregistered interestedoraffectedpartymaycommentonanyfinal report that issubmittedbyaspecialistreviewerforthepurposesoftheseregulationswherethereportcontainssubstantiveinformationwhichhasnotpreviouslybeenmadeavailabletoaregisteredinterestedoraffectedparty.

Comments of interested and affected parties to be recorded

24. The applicant responsible for an application must ensure that the comments ofinterestedandaffectedpartiesarerecordedinreportssubmittedtotheEnvironmentalCommissionerintermsoftheseregulations,andcommentsbyinterestedandaffectedpartiesonareportwhichistobesubmittedtotheEnvironmentalCommissionermaybeattachedtothereportwithoutrecordingthosecommentsinthereportitself.

Appeals in terms of section 50 of Act

25. (1) This regulation applies to decisions that are subject to an appeal to theMinisterintermsofsection50oftheAct.

(2) Anappealintermsofsection50oftheActmustbe-

(a) madewithin14daysfromthedateofreceiptofnotificationofadecisioncontemplatedinsection50oftheAct;

(b) madeonaformwhichcorrespondssubstantiallywithForm3ofAnnexure1totheregulations,andobtainablefromtheMinistry;

(c) accompaniedbytheafeeprescribedinAnnexure2;and

(d) submittedtothesecretaryoftheappealpanel,designatedintermsofsubregulation(3).

(3) TheMinistermustdesignateastaffmemberwithintheMinistryasthesecretaryforthepurposeofanappealintermsofsection50oftheAct,whomustperformadministrativefunctionsrelatingtotheappeals.

(4) Thesecretarydesignatedintermsofsubregulation(3),mustacknowledgeanappealwithin14daysfromthedateofitsreceipt.

(5) Iftheappellantisanapplicant,theappellantmustserveoneachpersonregisteredasaninterestedandaffectedpartyinrelationtotheapplicant’sapplication-

(a) acopyoftheappealapplicationreferredtoinsubregulation(2);and

(b) anoticeindicatingwhereandforwhatperiodtheappealsubmissionisavailableforinspectionbytheperson.

(6) Iftheappellantisapersonotherthananapplicant,theappellantmustserveontheapplicant-

(a) acopyoftheappealapplicationreferredtosubregulation(2);and

(b) anoticeindicatingwhereandforwhatperiodtheappealsubmissionisavailableforinspectionbytheapplicant.

(7) TheMinistermay inwriting, on good cause extend the periodwithinwhich anappealmustbesubmitted.

(8) Apersonthatreceivesanoticeintermsofsubregulation(5),oranapplicantwhoreceivesanoticeintermsofsubregulation(6),maysubmittotheMinister,arespondingstatementwithin30daysfromthedatetheappealsubmissionwasmadeavailableforinspectionintermsofthatsection.

(9) Apersonorapplicantwhosubmitsarespondingstatementintermsofsubregulation(8),(hereinafterreferredtoasarespondent”),mustserveacopyofthestatementontheappellant.

(10) If a respondent introduces any new information not dealt with in the appealsubmissionoftheappellant,theappellantisentitledtosubmitanansweringstatementtosuchnewinformationtotheMinisterwithin30daysofreceiptoftherespondingstatement,

(11) Theappellantmustserveacopyoftheansweringstatementontherespondentwhosubmittedthenewinformation.

(12) The Minister may, in writing, on good cause extend the period within whichrespondingstatementsoranappellant’sansweringstatementintermsofmustbesubmitted.

(13) ReceiptbytheMinisterofanappeal,respondingstatementoransweringstatementmustbeacknowledgedwithin10daysofreceiptoftheappeal,respondingstatementoransweringstatement.

(14) Anappellantandeachrespondent isentitled tobenotifiedof theappointmentofanappealpanel in termsofsection50(3)of theAct, if theMinisterappointsanappealpanelforpurposesoftheappeal.

(15) TheMinistermayrequesttheappellantorarespondenttosubmitsuchadditionalinformationinconnectionwiththeappealastheMinistermayrequire.

26. IftheMinisterhasreachedadecisiononappealintermsofsection50,theappellant,eachrespondentandthecompetentauthoritymustbenotifiedinwritingofthedecision.

(a) deliveredpersonallytothatperson;

(b) sentbyregisteredposttothepersonslastknownaddress;

(c) leftwithanadultindividualapparentlyresidingatoroccupyingoremployedattheperson’slastknownaddress;or

(d) inthecaseofabusiness-

(i) deliveredtothepublicofficerofthebusiness;

(ii) leftwithanadultindividualapparentlyresidingatoroccupyingoremployedatitsregisteredaddress;
