REGULATIONS

(Made under section 69)

THE ADVOCATES (ADMISSION AND PRACTISING CERTIFICATE)REGULATIONS, 2015

1. These Regulations may be cited as the Advocates(Admission and Practising Certificate) Regulations, 2015.

2. The fee payable for the entry of an admittedperson's name on the Roll under the provisions of subsection(4) of section 8 of the Act shall be-

(a) twenty thousand shillings for East African Citizens;and

(b) US Dollars one hundred or its equivalent inTanzanian shillings for non East African Citizens.

3. The fee payable for a practising certificate issued toan advocate under the provisions of Part VI of the Act shallbe-

(a) fifty thousand shillings for an advocate with lessthan five years practising experience; and

(b) one hundred thousand shillings for an advocatewith five years practising experience and above.

4. The fee payable for 'admission to practise as anadvocate in anyone case stipulated under subsection (2) ofsection 39 of the Act shall be-

(a) five hundred thousand shillings for each case, inthe case of a person so admitted to practise beforethe Court of Appeal or anycourt or tribunal from which an appeal lies to theCourt of Appeal; and

(b) four hundred thousand shillings for any other case.

5. An advocate who fails to obtain a practisingcertificate within six months after the expiration of the lastcertificate issued to him shall, upon being granted leave torenew the certificate out of time, pay the fees for renewal ofthe certificate plus half that the amount as penalty for default:

Provided that the Chief Justice may upon good causebeing shown, waive the penalty.

6.-(1) The form of declaration to be made by anadvocate who is applying for a practising certificate under PartVI of the Act and the form of such practising certificate shallbe as set out in Form I and Form IIin the Schedule to theseRegulations.

(2) The declaration shall be attested by aCommissioner for Oaths to whom the declarant is personallyknown and the Commissioner for Oaths shall date and affixhis stamp, name and signature on the declarant's photographattached thereto.
