The following are applications for extra-provincial and public vehicle operating licenses filed under the Motor Vehicle Transport Act, 1987, and the Public Vehicles Act. Any interested person who has an economic interest in the outcome of these applications may serve and file an objection within 29 days of this publication. The objector shall:

4. pay the appropriate fee.

1. (1) Items 3, 5 and 7 of the Table to subsection 1 (5) of Ontario Regulation 63/09 are amended by striking out “February 24, 2009” wherever it appears in Column 3 and substituting in each case “June 22, 2009”. (2) Section 1 of the Regulation is amended by adding the following subsection: (6) Despite the fact that an illustration of a sign mentioned in subsection (5) may include the date of the illustration as set out in Column 3 of the Table to that subsection, that date is not required to appear on the sign. 2. 2. The pesticide meets the description of Less or Least Hazardous in the Guideline mentioned in subsection 4 (5).

3. The pesticide does not meet the description of a Controlled Sales pesticide set out in the Guideline mentioned in subsection 4 (5).

3. Section 15 of the Regulation is revoked and the following substituted: Exemption, attachment of molluscs to works

15. A person is exempt from the Act and the regulations with respect to the use, handling, storage, display, disposal, sale, offer for sale, transfer or transportation of a pesticide if, (a) the use of the pesticide is authorized under the Ontario Water Resources Act for the purpose of discouraging or

eliminating the attachment of molluscs to works under that Act; or (b) the use of the pesticide is authorized under the Safe Drinking Water Act, 2002 for the purpose of discouraging or

eliminating the attachment of molluscs to works under that Act.

4. (1) Subparagraph 1 ii of subsection 29 (2) of the Regulation is amended by striking out “enter into an agreement with respect to the use” and substituting “approve the use”.

(2) Paragraphs 2, 3 and 4 of subsection 29 (2) of the Regulation are revoked and the following substituted:

2. The Minister must approve in writing the use of the pesticide for the event.

3. The use of the pesticide must stop when the event concludes.

4. The person mentioned in paragraph 1 must comply with any conditions or limitations imposed by the Minister under subsection (3).

(3) Section 29 of the Regulation is amended by adding the following subsections:

(3) In approving the use of a pesticide for an event under this section, the Minister may impose any conditions or limitations that the Minister considers appropriate.

(4) The Minister may approve the use of a pesticide for an event under this section only if he or she is of the opinion that,

(a) the use of the pesticide is necessary for the hosting of the event; and

(b) the use of the pesticide is in the public interest.

5. Subsection 50 (6) of the Regulation is amended by striking out “employed by the exterminator” and substituting “employed by a person mentioned in subsection (1)”.

6. Section 68 of the Regulation is amended by striking out “section 9” in the portion before clause (a) and substituting “subsection 7.1 (1) of the Act and section 9 of this Regulation”.

7. (1) Subsection 98 (2) of the Regulation is amended by adding the following paragraph:

5. A person who is exempt from subsection 5 (1) of the Act under subsection 83 (2) of this Regulation and from subsection 7 (2) of the Act under subsection 83 (3) of this Regulation, if the person presents a letter signed by the Director confirming that the person is exempt.

(2) Item 4 of the Table to section 98 of the Regulation is revoked and the following substituted:

4. Class 4 Licensed vendor of the General class or Limited class Licensed vendor of the General class. Licensed exterminator, if the licence authorizes

the use of the pesticide.

Holder of a permit issued under section 7 of the Act, if the permit authorizes the use of the pesticide.

Manufacturer who presents a written confirmation issued by the Director confirming that the person is a manufacturer.

Farmer who meets the conditions set out in clauses 43 (1) (c) and (d).

A person mentioned in subsection 98 (2).

(3) Item 4 of the Table to section 98 of the Regulation is amended by striking out “or Limited class” in Column 2.

8. (1) Subject to subsection (2), this Regulation comes into force on the day it is filed.

(2) Subsection 7 (3) comes into force on January 1, 2010.

3. L’article 15 du Règlement est abrogé et remplacé par ce qui suit : Exemption : fixation des mollusques aux installations

15. Une personne est exemptée de l’application de la Loi et des règlements en ce qui concerne l’utilisation, la manutention, l’entreposage, l’étalage, l’élimination, la vente, la mise en vente, le transfert ou le transport d’un pesticide si, selon le cas : a) l’utilisation du pesticide est autorisée en vertu de la Loi sur les ressources en eau de l’Ontario afin de décourager ou

d’éliminer la fixation des mollusques aux installations visées par cette loi; b) l’utilisation du pesticide est autorisée en vertu de la Loi de 2002 sur la salubrité de l’eau potable afin de décourager ou

d’éliminer la fixation des mollusques aux installations visées par cette loi. 4. (1) La sous-disposition 1 ii du paragraphe 29 (2) du Règlement est modifiée par substitution de «d’approuver cette utilisation» à «de conclure un accord relatif à cette utilisation». (2) Les dispositions 2, 3 et 4 du paragraphe 29 (2) du Règlement sont abrogées et remplacées par ce qui suit : 2. Le ministre doit approuver par écrit l’utilisation du pesticide pour l’événement. 3. L’utilisation du pesticide doit cesser dès la conclusion de l’événement.

4. La personne mentionnée à la disposition 1 doit respecter les conditions ou restrictions que le ministre impose en vertu du paragraphe (3).

(3) L’article 29 du Règlement est modifié par adjonction des paragraphes suivants : (3) Lorsqu’il approuve l’utilisation d’un pesticide pour un événement pour l’application du présent article, le ministre peut imposer les conditions ou restrictions qu’il estime appropriées. (4) Le ministre ne peut approuver l’utilisation d’un pesticide pour un événement pour l’application du présent article que s’il est d’avis : a) d’une part, que son utilisation est nécessaire pour la tenue de l’événement; b) d’autre part, que son utilisation est dans l’intérêt public. 5. Le paragraphe 50 (6) du Règlement est modifié par substitution de «qu’elle emploie» à «que le destructeur emploie». 6. L’article 68 du Règlement est modifié par substitution de «du paragraphe 7.1 (1) de la Loi et de l’article 9 du présent règlement» à «de l’article 9» dans le passage qui précède l’alinéa a). 7. (1) Le paragraphe 98 (2) du Règlement est modifié par adjonction de la disposition suivante : 5. Une personne qui, par application du paragraphe 83 (2) du présent règlement, est exemptée de l’application du

paragraphe 5 (1) de la Loi et qui, par application du paragraphe 83 (3) du présent règlement, est exemptée de l’application du paragraphe 7 (2) de la Loi, si elle présente une lettre signée par le directeur confirmant l’exemption.

(2) Le numéro 4 du tableau de l’article 98 du Règlement est abrogé et remplacé par ce qui suit :

4. Catégorie 4 Vendeur titulaire d’une licence de la catégorie Générale ou Restreinte

Vendeur titulaire d’une licence de la catégorie Générale.

Destructeur titulaire d’une licence, si la licence autorise l’utilisation du pesticide.

Titulaire d’un permis délivré en vertu de l’article 7 de la Loi, si le permis autorise l’utilisation du pesticide.

Fabricant qui présente une confirmation écrite de son statut de fabricant délivrée par le directeur.

Agriculteur qui remplit les conditions énoncées aux alinéas 43 (1) c) et d).

Personne mentionnée au paragraphe 98 (2).

(3) Le numéro 4 du tableau de l’article 98 du Règlement est modifié par suppression de «ou Restreinte» à la colonne 2. 8. (1) Sous réserve du paragraphe (2), le présent règlement entre en vigueur le jour de son dépôt. (2) Le paragraphe 7 (3) entre en vigueur le 1er janvier 2010.

La Gazette de l’Ontario paraît chaque samedi, et les annonces à y insérer doivent parvenir à ses bureaux le jeudi à 15h au plus tard, soit au moins neuf jours avant la parution du numéro dans lequel elles figureront. Pour les semaines incluant le lundi de Pâques, le 11 novembre et les congés statutaires, accordez une journée de surplus. Tarifs publicitaires et soumission de format:

1) Envoyer les annonces dans le format Word.doc par courriel à [email protected]

2) Le tarif publicitaire pour la première insertion envoyée électroniquement est de 75,00$ par espace-colonne jusqu’à un ¼ de page.

3) Pour chaque insertion supplémentaire commandée en même temps que l’insertion initiale, le tarif est 40,00$

4) Les clients peuvent confirmer la publication d’une annonce en visitant le site web de La Gazette de l’Ontario www.ontariogazette.gov.on.ca ou en visionnant une copie imprimée à une bibliothèque locale.

Abonnement:

Le tarif d’abonnement annuel est de 126,50$ + T.P.S. pour 52 ou 53 numéros hebdomadaires débutant le premier samedi du mois de janvier (payable à l’avance) L’inscription d’un nouvel abonnement au courant de l’année sera calculée de façon proportionnelle pour la première année. Un nouvel abonné peut commander des copies d’éditions précédentes de la Gazette au coût d’une copie individuelle si l’inventaire le permet.

Le remboursement pour l’annulation d’abonnement sera calculé de façon proportionnelle à partir de 50% ou moins selon la date. Pour obtenir de l’information sur l’abonnement ou les commandes s.v.p. téléphonez le (416) 326-5306 durant les heures de bureau.

Copies individuelles:

Des copies individuelles de la Gazette peuvent être commandées en direct en ligne au site www.serviceontario.ca/publications ou en téléphonant 1-800-668-9938.

The Ontario Gazette is published every Saturday. Advertisements/notices must be received no later than 3 pm on Thursday, 9 days before publication of the issue in which they should appear. For weeks including Easter Monday, November 11th or a statutory holiday allow an extra day. Advertising rates and submission formats:

1) Please submit all notices in a Word.doc format to: [email protected]

2) For a first insertion electronically submitted the basic rate is $75 up to ¼ page.

3) For subsequent insertions of the same notice ordered at the same time the rate is $40 each.

4) Clients may confirm publication of a notice by visiting The Ontario Gazette web site at: www.ontariogazette.gov.on.ca or by viewing a printed copy at a local library.

Subscriptions:

The annual subscription rate is $126.50 + G.S.T. for 52 or 53 weekly issues beginning the first Saturday in January, payable in advance. In-year new subscriptions will be pro-rated for the first year. A new subscriber may order back issues of the Gazette at the single-copy rate as inventory permits.

Refunds for cancelled subscriptions will be pro-rated from 50% or less depending upon date. For subscription information/orders please call (416) 326-5306 during normal business hours.
