1.0 BACKGROUND
The Town and Country Planning Department was created as a small cell of the H.P.
Public Works Department in the year 1964 and the same continued up to 1979. During
the year 1979, an independent Directorate was created but charge of the Director
continued to be held by the Engineer-in-Chief (B&R) or the Chief Engineer of H.P.
Public Works Department, till 1993, when an independent Director was appointed as
Head of the Department.
2.0 INTRODUCTION
Town and Country Planning is engaged in a social transformation development process
to ensure creation of functionally workable, economically viable, socially acceptable,
environmentally sustainable and aesthetically pleasing living environment for humanity
in both, rural and urban habitats, through optimum, just and balanced use of scarce land
resources in view of demographic, socio-economic, techno-legal dynamics, which is
foremost necessity of the day.
Town and Country Planning ensure planned, systematic, sustainable development of
urban and rural habitations and is a prerequisite for all modern development schemes.
Development Plans, Sectoral Plans and Town Planning Schemes go a long way in
catering to civic and other urban services infrastructure, transportation and other
requirements that ensure dynamism and a healthy living environment for humanity.
3.0 AIMS AND OBJECTIVES OF THE DEPARTMENT
Himachal Pradesh, being a hill State, is endowed with rich eco-system and cultural
heritage. Although, there is a low level of urbanization in the State, yet during recent
years urbanization has been exerting high pressure on scarce urban land resources. There
are 59 small and medium census towns in the State, with only Shimla as Class-I city. As
per 2011 census, urban population of the State in these urban areas was 6, 88,552
persons, which is about 10.03% of the total population of the State. Due to various
developmental priorities of the Government activities and opening of new areas, a large
number of new growth centers are coming up very fast. The pressure on land in the State
has increased manifold, leading to haphazard and un-planned construction activities in
Towns, Growth Centers and their surrounding areas. With a view to manage and
regulate this increasing trend in urbanization and to check the un-authorized
construction activities, the Government of Himachal Pradesh had enacted Himachal
Pradesh Town and Country Planning Act, 1977 and made it applicable to all major
Towns of the State, besides the other Planning and Special Areas in the States.
4.0 VISION
To ensure optimum and sustainable spatial development of land.

5.0 OBJECTIVES
1. Constitution of Regions, Planning Areas and Special Areas under Sections 4, 13 and 66
of the Himachal Pradesh Town and Country Planning Act, 1977 respectively.
2. Procurement of Spatial and non-Spatial data bases for planning.
3. Preparation of Existing Land Use Maps and Registers.
4. Research work for the preparation of Regional Plans, Development Plans and Sectoral
Plans.
5. Preparation of Regional Plans, Development Plans, Sector Plans, Town Planning
Schemes, Land Pooling & Re-constitution Schemes.
6. Adoption of modern Geo-information & Communication Technology to enhance the
efficiency of the Department and thereby reducing the services delivery time.
6.0 EXTENSION OF ACT TO PLANNING AREAS
For planned development of various towns and growth centers of the State, the
Himachal Pradesh Town and Country Planning Act, 1977 has been extended to 35
Planning Areas in the State. The names of Planning Areas are as under:-

7.0 SPECIAL AREAS AND SPECIAL AREA DEVELOPMENT AUTHORITIES
Besides 35 Planning Areas, the Government has extended the provisions of the
Himachal Pradesh Town and Country Planning Act, 1977 to 35 areas of the State, by
designating these areas as Special Areas under Section–66 of the Act ibid. The areas
which have growth potential for urbanization and have no agency for development or
for providing basic services have been declared as Special Areas. For regulating
planned and systematic development in these Special Areas, the Special Area
Development Authorities have been constituted under Section-67 of the Act ibid, under
the Chairmanship of the Deputy Commissioners and Sub-Divisional Officers (Civil).
In case of Tribal Areas of the State, Hon’ble M.L.As/Deputy Commissioner/ADC/SDM
are the Chairpersons of the Tribal Special Area Development Authorities. Local
Officers of respective areas and Pradhans of Gram Panchayats are Members of the
Special Area Development Authorities. Baddi-Barotiwala and Nalagarh Development
Authority has been established under the Chairmanship of the Hon’ble Chief Minister.

The Special Area Development Authorities have powers to impose taxes, fees and
levies at par to the Municipal Bodies. Functions of the Special Area Development
Authorities, as per Section 70 of the Act ibid are, if required to do so:-
(i) To prepare, the development plans for the special areas;
(ii) To implement the development plans after approval of the State Government;
(iii) For the purpose of implementation of the plan, to acquire, hold, develop,
manage and dispose of land and other property;
(iv) To carry out construction activity and to provide water, electricity, drainage
and other utilities and amenities;
(v) To provide the municipal services as specified in the Himachal Pradesh
Municipal Act, 1994;
(vi) To provide for the municipal management of the special area in the same
manner as is provided in the Himachal Pradesh Municipal Act, 1994;
(vii) To otherwise perform all such functions with regard to the special areas as the
State Govt. may, from time to time direct.

8.0 STATUS OF PLANS
(i) Regional Plans
The Department is in the process of regionalization of the State and different Regions
are proposed to be constituted as per provisions of Section 4 of the Himachal Pradesh
Town and Country Planning Act, 1977. The State Government has constituted 12
Regions on 18.9.2015.
(ii) Interim Development Plans and Development Plans
For ensuring sustainable growth and regulated Spatial Planning, Interim Development
Plans and Development Plans are prepared for the prospective period of 15-20 years.
One Interim Development Plan and 29 Development Plans have been notified by the
Government, so far.

9.0 THE HIMACHAL PRADESH APARTMENT AND PROPERTY REGULATION
ACT, 2005
In view of the changed housing demand scenario, the Government of Himachal Pradesh
enacted the Himachal Pradesh Apartment and Property Regulation Act, 2005 and Rules
there under in the Department of Housing, to regulate development of colonies and
apartments as well as transaction of built properties.

The custodianship of this Act was given to HIMUDA by notifying C.E.O- cum-Secretary
as Competent Authority to exercise and perform all or any of the powers and functions of
the Competent Authority under the Act ibid. However, thereafter it was felt that
assignment of regulatory process under Act ibid to HIMUDA, which itself is a promoter,
is not appropriate. Therefore, in addition to normal duties and responsibilities of the
Director, Town & Country Planning under the H.P. Town & Country Planning Act, 1977,
the statutory duties and responsibilities as envisaged in the Himachal Pradesh Apartment
& Property Regulation Act, 2005 of the Competent Authority have been assigned by
declaring the Director, Town and Country Planning as Competent Authority vide
notification No. HSG-A (3)-I-3/2010 dated 22.11.2010 of the Principal Secretary
(Housing) to the Government of Himachal Pradesh.
In view of above, the Department had assumed this new assignment by taking over
complete record thereof from HIMUDA. The following statutory functions are being
performed by the Department:-
1. Registration & Licensing of Promoters/Estate Agents.
2. To watch the interests of buyers by way of exercising check on sale agreements
between promoters & buyers.
3. To inspect & audit accounts of Promoters/Estate Agents.
4. To ensure provisioning of amenities by the Promoters till transfer of area to
local Bodies.
5. To issue completion and occupation certificates.
6. To ensure proper documentation & enforcement on Registration of Conveyance
by the Promoters.
7. To inspect working of Promoters and Estate Agents for ensuring compliance of
provisions of the Act ibid and rules made there under.
8. To publish annually in the Official Gazette the Report of the activities financed
from the Development Fund and the statement of Accounts.
9. To take cognizance of offences by persons or Promoters or Estate Agents and
initiate penal action.
Thereafter, the H.P. Apartment and Property Regulation Act, 2005 has been repealed
and its provisions incorporated in the H.P. Town & Country Planning Act, 1977 vide
Government Notification dated 21.09.2013 and Rules framed there under notified on
01.12.2014. It is pertinent to mention here that w.e.f. 1 May, 2017 the “Real Estate
(Regulation & Development Act, 2016” (RERA) is in force in the State, wherein there is
no provision of Registration. Therefore, no Registration has been done by this
Department in the year 2017-18. The detail of the Registration as well as licenses issued
under above Acts w.e.f. 01.04.2017 to 31.03.2018 is as under:-

10.0 THE REAL ESTATE (REGULATION AND DEVELOPMENT) ACT, 2016
The Real Estate (Regulation and Development) Act, 2016 came into force partially form
1st, May 2016 and completely from 1
st, May 2017. Town and Country Planning
Department has already made substantial progress in implementation of the Act. The
State Govt. Vide Notification No. TCP-A(3)-1/2016 Dated 4th
February, 2017 has
nominated the Director, Town and Country Planning Department, HP as the ‘Designated
Officer’ as required under the Real Estate (Regulation and Development) Act 2016. The
Designated Officer has been entrusted with the work of preparation of draft RERA Rules,
initiate development of RERA web portal and also to initiate actions for compliance of
various provision of the RERA Act. Himachal Pradesh Real Estate (Regulation and
Development) Rules, 2017 were prepared by the Department under the provisions of the
Real Estate (Regulation and Development) Act, 2016 which were notified on 6th
October,
2017 for carrying out the purpose of the RERA Act. Department has developed a
dedicated Web-portal for providing online registration and complaint facility and 14 Real
Estate Projects and 14 Real Estate Agents till 31st March, 2018.

13.0 POWERS AND DUTIES OF THE OFFICERS AND OFFICIALS:
All the Officers and Officials of this Department perform their duties and exercise
powers in accordance with the delegations made by the Government and Director, from
time to time.
Administrative and Financial discipline in the Department is ensured in accordance with
HPFR, FRSR, CCS (CCA) Rules and CCS (Conduct) Rules.
As regards to specific activities of Town & Country Planning Department, the duties and
powers of the Director have been assigned and delegated to all the field officers of this
Department with a view to expedite the works of general public in a prompt and time
bound manner. The statutory duties of the officers and officials have been prescribed in
the Rules and Regulations, in operation for regulating the activities.
14.0 BUDGET& RECEIPT OF THE DEPARTMENT:
The Department is operating two Major Heads namely 2217 and 4217. The Major Head
2217 is related to revenue expenditure including Salary, Wages, Travel Expenses and
Office Expenses. The Major Head 4217 is related to expenditure on preparation of
Development Plans. Detail of budget provision and expenditure in the said two heads of
account for the last three years is given as under:-

The funds collected in shape of Service Charges/ Development Charges from the
Promoters are being utilized for the following purposes as per Rule-68 (1) & (2) of the
H.P. Town and Country Planning Rules, 1978 (Amended upto 2016) :-
1. For up-gradation and modernization of technology in town planning, housing and
urban affairs;
2. For providing training facilities in urban management, housing and town and
country planning;
3. Organizing and participating in Seminars, Workshops and Conferences on Town
and country planning, housing, urban affairs and urban management within and
outside the country; and
4. Development of affordable housing by the Government through Public Housing
Government Agency as and when required.
An amount of Rs. 1,43,52,721/- only( one crore forty three lac fifty two thousand seven
hundred twenty one) only has been received on account of Service Charges/
Development Funds from the Promoters during the Current Financial Year 2017-18
which is being utilized on the aforesaid activities relating to the Department.

16.0 THE HIMACHAL PRADESH TOWN AND COUNTRY PLANNING
(AMENDMENT) ACT, 2015
Definition of Colony amended.
Time period for preparation of Existing Land Use Map and Register extended
from 3 years to 5 years.
Provision for levy of Infrastructure and Maintenance Charges made.
Period of Registration of Promoter and Estate Agent extended from 3 years to 5
years.
In section-83-A further provision has been made to disconnect the service
connection in case of deviations and un-authorized construction from approved
map.

17.0 Himachal Pradesh Town and Country Planning Rules, 2014.
The State Government has repealed Himachal Pradesh Town and Country Planning
Rules, 1978 on 1.12.2014 by notifying the Himachal Pradesh Town and Country
Planning Rules, 2014. The new Rules have been made more logical, practical and
simplified.
Amendment has again been carried out in the Himachal Pradesh Town and Country
Planning Rules, 2014 on 28.07.2016.
18.0 Regulatory measures adopted by the Department to ensure planned development.
In order to ensure planned development, following steps have been taken:-
(a) The provision of parking on plots abutting vehicular roads has been adhered to, so
that problem of parking on the roads is tackled.
(b) The regulations of Shimla, Manali, Dharamshala and Dalhousie pertaining to
Green, Heritage, Core, Restricted and Other Zones were adhered to, so that their
tourist character is maintained.
(c) The Architects were given licenses under the provisions of H.P. Town and Country
Planning Act, 1977, for ensuring public convenience.
(d) The provision of rain water harvesting tank has been incorporated in the Rules and
is being ensured in each structure at the stage of approval of Plans and completion
of structures.
(e) The provisions of sloping roof and hill architecture were ascertained in the designs
of buildings, so that the same reflect hill development imperatives.
(f) The provisions of Section 16-C regarding proper Sub-Divisions of land were
strictly followed, so that well dimensioned developed plots are made available to
the common man.
(g) In order to restrict development above 45 degree slope in accordance with
regulations, the provision for same has been adhered to in the interest of
preservation of eco-fragile environs and hilly terrain.

(h) To curb hill cutting, provision of cutting only upto 3.50 metre height was adhered
to.
(i) The provisions have been made in the Rules for Barrier Free Environment in public
and semi-public buildings and recreational areas to facilitate persons with
disabilities and the same are being adhered to.
(j) The regulations for Solar Passive buildings have been approved by the Government
for comfortable living, on one hand and to effect energy saving, on the other.
(k) Regulations for Information Technology Park at Waknaghat were prepared and the
same have been approved by the Government.
19.0 HERITAGE CONSERVATION
The areas/buildings in Shimla and Chamba on account of their distinct architectural
design features have been identified and notified as Heritage Zones/Buildings. Heritage
Regulations are in force in respect of Heritage Zone of Shimla Planning Area. The
Heritage Advisory Committee for the Heritage Area of Shimla Planning Area has also
been constituted vide Govt. Notification No. TCP-F(5)-5/2016-11 dated 02.02.2016. The
Archeological Survey of India has amended the Ancient Monuments and Archaeological
Sites and Remains Act, 1958(Amendments and Validation)Act, 2010 vide which
monuments having unique heritage background have been identified and listed for their
conservation and presentation. The Government is determined to ensure that no
construction, including public projects takes place within the prohibited areas around the
monuments of natural importance. In view of said amendment in Central Act, the
Heritage regulations are being re-examined and notified in the Interim Development
Plan of Shimla Planning Area.
20.0 Policy on Urbanization of State.
The policy document, focusing on diffusion of development from urban areas to rural
areas, to create counter magnets, to ensure creation of serviced land/planned urban
infrastructure by a Development Authority, eco-friendly development, projection of
local heritage etc. has been prepared by the Department . It dovetails the mechanism for
optimization of scarce urban land resources, necessity for planned sub-divisions of land
and Land Pooling & Re-constitution of plots having joint ownerships. Suggestion on the
draft Urbanization Policy has been received from Urban Development Department,
HIMUDA, H.P. Pollution control Board, Science and Technology Department.
Suggestions from all the ULBS of the State and all the Executive Engineers of
HIMUDA have been received and examined in the Department. Accordingly the Policy
submitted to the Govt.
21. 0 Single Window System
For convenience of the public in getting their planning permissions cases cleared under
Municipal as well as TCP legislations at one place, the “Single Window System” was
introduced in 13 Municipal areas namely-Shimla, Nahan, Hamirpur, Una, Mandi,
Rampur-Bushahar, Parwanoo, Paonta Sahib, Chamba, Solan, Bilaspur, Nalagarh and
Palampur. The Urban Local Bodies are being assisted by the field officers of this

Department. Besides this, powers have also been delegated to the Deputy
Commissioner(s), Kullu, and Chamba in respect of Manali, and Dalhousie Towns
respectively.
22.0 GRANT-IN-AID TO SPECIAL AREA DEVELOPMENT AUTHORITIES
The Special Area Development Authorities constituted under the provisions of the H.P.
Town & Country Planning Act, 1977 in Tribal Areas of the State are being given Grant-
in-Aid from Tribal Sub-Plan of the State to carry out the following works:-
a) Creation of income generating assets,
b) Creation of assets benefiting community and
c) Providing municipal services/civic functions.
During 2017-18, an amount of Rs.97.00 lacs have been released as Grant-in-Aid to these

27.0 IMPLEMENTATION OF PROVISIONS OF RIGHT TO INFORMATION ACT,
2005.
The updation of publication in terms of Section 4(1) (b) of the Right to Information Act,
2005 has been made by this Department. Special attention has been ensured for
compliance of provisions of the Right to Information Act, 2005 and the status of receipt
and disposal of applications under RTI is as under;-

28.0 IMPLEMENTATION OF TRAINING POLICY OF THE DEPARTMENT
In order to equip the employees of the Department with specific knowledge, skill and
attitude to enable them to play their role effectively, training on different topics like
Disaster Management, RTI Act, 2005, gender budgeting, office procedures & financial
management, GIS and remote sensing, basic computer training on MS Word/ MS Excel/
internet has been imparted to the officers/officials working on various posts in the
Department through HIPA, IIPA New Delhi, NRSC Hyderabad, AGiSAC and IIRS
Dehradun etc.

29.0 TCP WEB PORTAL
Overview
To achieve overall growth, ensure high performance and to automate the process of Town
Planning Department, there was a need to help applicants apply for planning permission
in Planning Areas/SADA’s/MC’s through an online portal and allow officials to grant
those applications in a few clicks. By doing this, the department also hoped to make the
process transparent and remove ambiguities in implementation of the provisions of TCP
Act / regulations. Not just this, there was a need to have a robust system of MIS to aid
decision making. Before the advent of HPTCP e-Service application, all processes
within and outside the department in their purview was manual. The first and foremost
step of the portal was to automate these processes. While in the process, it was found that
it is imperative to bring transparency of the applications for the Citizens. This led to a
process reengineering, where each application on submission was issued an auto
generated registration number, which helped tracking of applications. Also another step
towards transparency was introduced wherein, all information was filtered and thrown to
the public domain, through a unique CMS application. Payment gateway integration was
a process reengineering defined over the TCP application that helped make the initiative
sustainable.
This HPTCP e-services application aims at bringing efficiency by providing all the
services for planning and permission on-line which saves the time of citizens and
department. All the information/ application can be tracked on-line and availability of
real time reports results in transparency and accountability. Paperless work as all the
certificates and payment receipts are provided through mail.
Accordingly, customization of all applications, processes, approvals etc. was done
involving all internal and external stakeholders. Divisional office Shimla was selected for
mock trials and pilot roll out. After various mock Trials, the pilot was rolled out in
Shimla District on 01-10-15. The TCP web portal with facility to provide online planning
permission process was officially launched on 13.01.2016 by the then Hon’ble Chief
Minister.
The Town and Country Planning Department portal provides a facility to apply online
applications for permission to plan and construct. The applicants can register and apply
online to get Planning Permission along with a reference number to know its status.
There are two major stakeholders of the application, namely; general users (web portal)
and departmental users (Officer login).
Challenges faced before deployment/implementation
Before the advent of HPTCP e-Service application, all processes within and outside the
department in their purview were manual. The first and foremost step of the portal was to
automate these processes.

can be understood through the facilities being provided to key target groups.
The portal enables the General Public Users to:

2. Apply online for private professional registration, land conversion, building
permission, deviation settlement.
3. View Dashboard for various land related information.
4. Online fee calculator for automated calculation of application fees and other
Charges.

5. Upload and download documents and proposed site maps.
6. Pay online application fee.
7. Reporting unauthorised construction.
The Officers console in the portal allows the TCP Department Users to access these
online applications, validate and take action against/in favour of them. The facilities
available for these users are:

3. Take Action by competence of application.
4. Auto Notification/Alert to applicant, Next action taking authority and third party
consultant.
5. Meeting schedule and upload minutes of meeting by officers.

7. Seek assistance of higher authorities or concerned field officers/experts.
8. Building plan & NOC Approval.
9. Generating Certificate and Money Receipt.

Apart from the above functional innovative aspects of the HPTCP webportal, department
has further added two following incremental and innovative features for providing
seamless services to general public 24 x 7.
1. 'HimTCP' Mobile App of TCP services

As part of the services to be covered under the TCP web portal application, the whole
initiative gained a quantum leap with launch of a dedicated 'HimTCP' Mobile App on 2nd
August, 2016, by Hon'ble TCP Minister TCP, UD & Housing, with a vision to expand
digital empowerment to m-governance. The HimTCP mobile app was developed and
launched simultaneously in Android, Windows and iOS platforms, and has been
downloaded by more than two thousand users from across the state.
The mobile app provides 100% services like tracking status of applications, status of
application like pendency, approval etc. across the gamut of TCP service and field offices
of the state. Mobile application also provides facility to view remarks of dealing
officers/officials of the Department throughout the approval channel. The overall
functionality and 24x7 accessibility of the application is enhanced by the availability of
‘Him TCP’ Mobile application.

2. TCP Area Check App.
Taking ahead and expanding the initiative of m-governance, Department has also
developed a dedicated app for addressing a common issue often faced by general user in
various Planning/Special Areas throughout the state. This Department through NIC has
developed TCP Area Check App for general public to ascertain whether their Land
/Mohal fall under the TCP Jurisdiction or not with vision to expand digital empowerment

to m-governance. Any person from State can check the status of his village or town
through this app.
Scope of 'Him TCP Area Check' App.
The purpose of 'Him TCP Area Check' app is to increase information quality, improve
overall efficiency and effectiveness in the Departmental processes, along with
convenience in operations for its key stakeholders. In order to achieve its objective there
is a need for the development of mobile application to amplify the affectivity of the
existing web application.
The governance practices involved.
The application covers following Major e-governance practices and Initiatives.
G2C:- It is a Government to customer initiative where in the department made the entire
application and approval process online, it helped bringing in transparency and fairness
to the system. The citizens are allowed to lodge grievances and complaints online which
is then looked after by the concerned department on a faster and more transparent
manner. Citizens have access to 24x7 online tracking of their applications and various
updates are sent regularly through messages and mail alerts.
G2B:- It is also a Government to Business initiative since the launch of the portal, the
TCP department is in a position to collect revenue in the shape of application fees by way
of implementation of TCP Act-1977 in Planning Areas, Special Areas, Municipal
Corporations and Nagar Parishads to the extent of 3 per cent e-charges on all kinds of
fees from the applicants. The portal also has an integrated payment gateway through
HDFC bank, for the stakeholders without any additional charges by the bank. This makes

the entire initiative sustainable. Various stakeholders especially the Registered Private
Professionals like Architects, Civil Engineers, Planners and Structural Engineers etc. are
provided a login to their exclusive dashboard on the Web application.
G2G:- A robust system of MIS has been being formed for generation of various kinds of
real time reports. All superior officers have a dash board to monitor the work of their
subordinate staff. A quick response mechanism for reporting to Superior officers, Vidhan
Sabha, Courts etc. has been established.
Details of coverage of the targeted population.
The HPTCP e-services application covers all the Planning Areas and Special Areas of the
State where HPTCP Act, 1977 has been implemented. Presently the application is fully
operational and live in 35 Planning Areas and 35 Special Areas of the State covering
about 15.57 Lakh population constituting about 23% population of the state across all
twelve districts of the state.
Since the official launch of HPTCP e-services application on 13.01.2016 by the Hon’ble
Chief Minister, the application has been widely used across the state. Till date about
12000 Planning Permission applications have been received through the web portal.
About 1300 Private Professional like Planners, Architects, Engineers, Structural
Engineers and Surveyors etc have been registered through the site with TCP Department.
The TCP portal has experienced about 3.0 Lakh visitors since its launch and is

entire approval process is being monitored online by the Department.

misinformation from Private professional to the citizen regarding submission of their

the citizen can directly check status of his/her case online and thus avoid any scope of

Reduction in foot fall in offices: - As the status of the applied applications can be
tracked online through the Web- portal and Mobile-app from anywhere and at
anytime, the general public does not have to visit the concerned offices for the same.
Automation of offices: - To run this application efficiently the department has
provided the desired infrastructure facilities to the field offices including computer
systems, laptops, LAN and high speed internet connectivity, power backup system
etc. moreover, internal workflow in the department is web based.
Capacity building: - Hands on training was provided to the officers/ officials as well
as private professionals and general public through various workshops throughout the
State.
Ease to use: - The application allows general public to access the Policies, Rules and
Regulations & Achievements of the Department without any login/ user id. Also, the
information about applied applications can be accessed through a single login id. The
id & password in this case is provided to the applicants on their mobile numbers &
email addresses.
Online record generation and review: - This application enables the Department to
generate real time record through Management Information System (MIS) for
information and performance review.
Environment friendly and cost effective approach: - As all the documents are
available online for downloading and printing less paper wastage is there. Cost saving
is also encouraged through this practice in respect of developing number of prints
time and again. Moreover, record keeping is also done online and it can be reviewed
and monitored at anytime just with a click.
Digital Store: - All the data like, drawing and supporting documents being uploaded
is available 24x7 in Digital Store, a centralised Data Centre, thus minimising the
physical filing, paper and printing requirements.
Ease of doing online transactions and depositing the fee: - The calculation of
approval fee is done online by the application at the time of submitting the case for
approval. This practice eliminates the possibility of human error and applicant gets a
clear view of the amount to be paid. This fee can be deposited online through
payment gateway/ e-kosh of Government without any charges by the bank. This
facility provided to general public, encourages online transactions and reduces the
risks associated with cash handling.
Ease of Doing Business: - The application already covers all the business reform
action points mandated by the GoI for Ease of Doing Business Reforms pertaining to
TCP/UD Department. Business reform actions plan envisages providing all services
like Change in Land Use, Approval of Building Plans, single joint site inspection,
third party certification, dedicated conflict resolution mechanism, defining clear
timelines, computerized allocation of inspectors, procedures and checklists etc.
through online system. Also, the reform envisages to make the master plans/zonal

plans/land use plans for all ULBs online for easy information availability to assist
applicants in developing building plans.
Cost Effectiveness and Citizen Centricity/Friendliness:- As mentioned in Point
No. 5 of this report the TCP Web-portal facilitates the general public to adopt a
transparent, efficient, time saving, user friendly, cost effective and environment
friendly system for getting various approvals as mentioned in Point No. 3 of this
report.
Technical Cell:- For functional and technological sustainability of the online
services, Department has already envisaged setting up of its own Technical Cell for
managing minor modifications w.r.t. operational and functional enhancement etc. and
for rendering consistent support and help to the field offices.
Sustainability: - The application is being used in various Government bodies and is
being used successfully throughout the State. The department is charging e-charges
@3% of the prescribed normal fee for various services in order to develop a corpus
for recurring expenditure on maintenance of this application. This application can be
considered as a major step towards ‘Digitalization’ by modifying and modernizing an
age old manual practice. Moreover, after integration of the application with the web
applications of various line departments the plan approval processes will become
even more user friendly. Department has already envisaged setting up of its own
Technical Cell for functional and technological sustainability of the online services.
Potential for replicating the Success of TCP Web portal.
The application is being used in 17 Field Offices of this Department, 34 Authorities and
various Urban Local Bodies covering 70 Planning Areas /Special Areas throughout the
State, due to easy user guidelines and informative website. The application is being
replicated in UD Department/ULBs as well.
Awards and Achievements:- The e-Services Project of Town and Country Planning
Department i.e. HP TCP Web Portal has already received the 'State Innovation
Award' in Government Sector, as instituted by the State Innovation Council, for the
year 2015-16 from Hon'ble Chief Minister on the eve of ‘Himachal Day’ on 15th
April, 2017.
Observation/Recommendation of Evaluation Study / Feedback:- Various
dignitaries of State have appreciated the efforts of the department and have given
their valuable recommendations for this application at various public platforms.
Hon’ble Chief Minister applauded the efforts of department for achieving the
distinction of becoming “First State in Country” for online planning permission and
other services.
Hon’ble Minister for UD, TCP and Housing, Himachal Pradesh has stated that the
“Sustained efforts of the department and other stake holders in developing the user
friendly application have been key indicators of success for the switching over to e-

services overnight. E-services have made improvements in public delivery system
and have simplified the various processes and procedures.”
Worthy Addl. Chief Secretary UD, TCP and Housing, Himachal Pradesh has stated
that this step of the department will be reckoned as the year of “Technological
Transformation” in the Town and Country Planning Department, Himachal Pradesh.
Lessons Learnt:- “ONLINE SERVICES AND DIGITALIZATION IS THE KEY
TO GOOD GOVERNANCE”. Planning permission process of this department are
perhaps most intricate and complicated. The department has done a commendable job
by brining this complex mechanism online. Any good change requires continuous
monitoring and review unless it becomes a culture in the organization. So it is very
important that Department keeps endeavouring for capacity building of all the
stakeholders.

31.0 REAL ESTATE REGULATORY AUTHORITY, HIMACHAL PRADESH
INTRODUCTION:
Information communication & digital technologies are the key drivers for empowering
and facilitating the common man at the door step. E-governance is undisputedly a
panacea to induce transparency, accountability & efficiency; besides curbing the
menace of favouritism & corruption. To keep a pace with time, technology and taste,
Department of Town & Country Planning Himachal Pradesh began to imbibe the
Information communication & technologies (ICT) in the month of 10th
April, 2017,
after work on development of RERA web portal for on line services of the Real Estate
Regulatory Authority, Himachal Pradesh was awarded to M/s. Digitech Systems &
Infocom Pvt. Ltd.. HP RERA web portal provide online facility to Registration of Real
Estate Projects, Real Estate Agents and also for filing complaints.
HP REAL ESTATE REGULATORY AUTHORITY
The Real Estate (Regulation and Development) Act, 2016 came into force form 01st,
May 2017. The State Govt. Vide Notification No. TCP-A(3)-1/2016 Dated 4th
February, 2017 has designated the Director, Town and Country Planning Department,
HP as the Designated Officer as required under the Real Estate (Regulation and
Development) Act 2016.
HIMACHAL PRADESH REAL ESTATE (REGULATION AND
DEVELOPMENT) RULES, 2017
Himachal Pradesh Real Estate (Regulation and Development) Rules, 2017 were prepared
by the Department under the provisions of the Real Estate (Regulation and Development)

Act, 2016 (No. 16 of 2016), which were notified on 6th
October, 2017 for carrying out the
purpose of the RERA Act.

DETAILS OF RERA WEBPORTAL
SCOPE:
1. To provide interface for online approval for Real Estate Projects situated within
State.
2. To provide interface for online approval for Real Estate Agents.
3. To provide interface for online registration of complaints.
OBJECTIVE
1. To ease out Applicants from manually applying for Registration of Real Estate
Project, Registration of Real Estate Agent and filed complaint.
2. To grant Online Registration Certificate to Real Estate Projects.
3. To grant Online Registration Certificate to Real Estate Agents.
4. To ensure transparency, accountability and efficiency.
5. To remove ambiguities in implementation of the provisions of RERA Act/Rules and
regulations.
6. To have robust system of MIS
7. To make the project self-sustainable by levying nominal e-charges.
PAYMENT GATEWAY
In order to facilitate the general masses, Promoters and Estate Agents etc. for depositing
the fee in pursuance to the provisions of Real Estate Regulatory Act, the Department has
integrated Payment Gateway in our website through HDFC Bank. The Payment
Gateway has been provided to the stakeholders without any additional charges by the
Bank.
DATA CENTRE
M/s. Digitech Systems & Infocom Pvt. Ltd has hosted HP RERA Web Portal and
Website www.hprera.in through Server which will help the department to restore & save
its data on account of Real Estate Project Registration and Real Estate Agent
Registration cases and fee deposited by various individuals.
E-SERVICE

The project in question is relating to Service Delivery System. HP RERA Web Portal
will transform the department into a regime of transparency, accountability and
efficiency besides facilitating the applicants/common men to apply online and shun the
arduous procedure of sending manual application.
RERA WEBSITE
The Department of Town & Country Planning has adopted its own modernized
departmental website which will not only facilitate the general public to have knowledge
of the policies, amendment of by laws & achievements of the Department but the same
certainly bring transparency in the working of the department as well as to help the
department to bring awareness amongst the masses and to achieve the objective of
planned & regulated development in the State. In nutshell department is a click away
from all the stakeholders.
32.0 Future Programmes.
GIS based Development Plan for Shimla and Kullu under AMRUT.
Under AMRUT Scheme of Govt. of India, Shimla City and Kullu Town have been
included. Under AMRUT Sub-scheme 'Formulation of GIS base Master Plans', TCP
Department has been appointed as the Nodal Agency. The work for preparation of
Development Plans for Kullu and Shimla has been awarded to M/s. Feedback Infra Pvt.
Ltd., Gurgaon (25th
September, 2017) and M/s. MaRS Planning and Engineering Service
Pvt. Ltd. Ahmedabad (4th
January, 2018), respectively. Both the Development Plans are
to be prepared within 15 months. The GIS base maps for both the Planning area shall be

provided by National Remote Sensing Centre (NRSC), Hyderabad, which is the Nodal
Agency for providing base maps for AMRUT Cities.
GIS based Existing Landuse for 3 Planning Areas.
The Town and Country Planning Department, Himachal Pradesh as per the mandate of
the H.P. Town and Country Planning Act, 1977 is required to prepare Existing Land Use
Map and Register for Planning Area and Special Areas. Considering the technological
options available and the ongoing digital expansion with an ultimate goal to provide all
services through TCP Web-portal, the idea of providing online Existing Land Use (ELU)
Maps and Digital Registers to public was conceptualized by this Department. GIS based
ELU and Digital Register(s) for Sundernagar, Jogindernagar and Ghumarwin Planning
Area are being prepared through outsourcing mode by the Department.
