RESOLUTION NO. 2014-145

RESOLUTION FIXING DATE FOR A PUBLIC HEARING ON THE ANNEXATION OF CERTAIN LAND TO THE CITY OF GRINNELL, AND ACCEPTING FOR FILING APPLICATION FOR VOLUNTARY ANNEXATION OF CERTAIN LAND TO THE CITY OF GRINNELL AND PROVIDING FOR NOTICE OF CITY COUNCIL ACTION

WHEREAS the City Council of the City of Grinnell has received an Application

for Voluntary Annexation to the City from all owners of the following described tract of land, to wit:

Lot Nine, except the North 45 feet thereof, in the Subdivision of the West Half of the Northwest Quarter of Section Fifteen, Township Eighty North, Range Sixteen West of the Fifth P.M. according to the Plat thereof appearing of record in Plat Book C, at page 28, said tract contains 4.17 acres, at the time of survey and is subject to any easements and restrictions of record. WHEREAS the City Council wishes to give proper consideration to such

Application as required by law:

NOW THEREFORE BE IT RESOLVED by the City Council of the City of Grinnell, Iowa that:

Section 1. The City Clerk is hereby directed to send a copy of the Application and this Resolution to the Board of Supervisors of Poweshiek County, the Iowa Attorney General, and all adjacent landowners by certified mail at least fourteen days prior to the date set in this Resolution for action upon the Application together with a notice that the council will consider the Application and take action on the date set.

Section 2. The City Clerk is directed to cause notice to be published in the Grinnell Herald Register, an official county newspaper of Poweshiek County of the Application and the date upon which the Council will consider and act upon the Application at least fourteen business days prior to the date set, such notice to be in substantially the following form:

NOTICE OF INTENT TO HOLD A PUBLIC HEARING AND INTENT TO ACT UPON APPLICATION FOR VOLUNTARY ANNEXATION The City of Grinnell hereby gives notice that at the regular meeting of the City

Council to be held at Council Chambers, City Hall, 927 - 4th Avenue, Grinnell, Iowa on the 20th day of October, 2014 at 7:00 P.M., the City Council will hold a public hearing and consider whether to approve by resolution the annexation in the City of the following described lands, to wit:

September 11, 2014 Grinnell City Council 927 Fourth Avenue Grinnell, IA 50112 Re: Proposed voluntary annexation of a St. Francis Manor property. The Planning and Zoning Commission met on September 9th, 2014 to consider approval of the proposed voluntary annexation of a St. Francis Manor property. Neff explained the property up for annexation. Commissioner Adams moved that the Commission recommend the City Council approve the voluntary annexation of Lot Nine, except the North 45 feet thereof, in the Subdivision of the West Half of the Northwest Quarter of Section Fifteen, Township Eighty North, Range Sixteen West of the Fifth P.M. according to the Plat thereof appearing of record in Plat Book C, at page 28. Aron seconded the motion. The motion passed unanimously.

RESOLUTION NO. 2014-146

RESOLUTION ACCEPTING THE SPAULDING LOFTS, PLAT 1 PLANNED UNIT DEVELOPMENT TO CITY OF GRINNELL, POWESHIEK COUNTY, IOWA WHEREAS, the final plat of the Spaulding Lofts, Plat 1 Planned Unit Development have been submitted to the City Council; and WHEREAS, the Planning & Zoning Commission has made a report to the City Council advising that the final plat for the Spaulding Lofts, Plat 1 Planned Unit Development substantially conforms to the preliminary plans and has provided a certified resolution of approval, and WHEREAS, the City Council of the City of Grinnell, Iowa has determined the final plat is consistent with the City ordinances to promote public health, safety, morals, and general welfare; and WHEREAS, the City Council of the City of Grinnell, Iowa, has considered the final plat for the planned unit development and has found it conforms to the statutes of the State of Iowa, and the ordinances and requirements of the City of Grinnell, Iowa, and falls within the general plan for the City of Grinnell, Iowa, and the extensions thereof.

ALL THAT PART OF BLOCK 16 IN WEST GRINNELL, IOWA LYING NORTH OF THE RIGHT-OF-WAY OF THE HEARTLAND RAIL CORPORATION, CITY OF GRINNELL, POWESHIEK COUNTY, IOWA. DESCRIBED LAND CONTAINS 2.07 ACRES AND IS SUBJECT TO EASEMENTS AND RESTRICTIONS OF RECORD.

WHEREAS the final plat for the planned unit development is hereby approved, and, BE IT FURTHER RESOLVED that the Mayor and City Clerk be directed to certify this Resolution to be affixed to and upon the Plat as endorsement of approval of this Council.
