schedule or submit a new one), not disposition authorities
– 36 CFR 1225.24 (media neutrality rules) still apply and provide guidance on when existing schedules for hardcopy or analog records may be applied to electronic versions

Implementation per 36 CFR 1227.12
• Agency may request exceptions to any GRS • Agency may choose to use previously approved
authorities instead of new GRS, but must notify [email protected] within 120 days of GRS Transmittal issuance
• If agency does not have previously approved authority, either use GRS or submit a schedule requesting a deviation.
• If agency does not create or maintain records covered by GRS, no action is required.
• Agencies have 6 months to distribute the new GRS

Flexible Retentions: Purpose
• Provide clarity on when retentions can be longer or shorter
• Reduce need for agencies to request deviations
• Reduce need for NARA approval when bucketing GRS items

Using Flexible Retentions
• Disposition instructions set retention parameters (usually minimum retention)
• Agency options:– use only minimum retention (omit “Longer retention
is authorized for business use” in disposition manual)– set specific retention (or band) within GRS
parametersExample: If GRS says “Destroy when 3 years old; longer
retention is authorized for business use,” agency may specify “Destroy when 5 years old.”
– use disposition instruction exactly as written, leaving specific retentions up to offices or users

Deviation Requests• Deviation from the GRS (outside of retention
parameters) requires agency to submit a schedule
• Schedule must:– identify each GRS item superseded by agency item– provide justification for deviation
• Some GRS items, such as accountable officer records, require additional concurrence from other oversight agencies such as GAO.– Contact [email protected] for information on

Deviation is not required when...
• incorporating GRS items into a bucket without changing their retention
• setting specific retention within parameters established by GRS disposition instruction
• extending retention temporarily (such as for a records freeze or hold)
